Unfortunately we've received a checklist that the numbers on the I-864 of the joint sponsor do not match the transcripts. Well, what we did was put down her numbers on her form and her husband's numbers on the I-864A being they file jointly. Did they expect her numbers to match the total on the transcripts where it has their numbers combined? If so then guess we'll have to resend it. We just didn't think that way, but I'll call them later today to verify.

Oh one more question before I send this off probably on Friday...under residence abroad last 5 years...do I include the 11 months I spent with my wife(then only gf) in the states? This was under a tourist visa so not sure if by residence they mean anywhere I have lived whether as a resident or not, or only as a resident.

Ok so a possible co sponsor is a friend of my wife's who is much older than her and retired. She does get retirement income, so would that count?

Also, any tips on how to assemble everything in the I-130?(NOT the AOS)
What should be stapled, what should NEVER be stapled, I know it's just a little iffy so any recommendations would be welcome

Hi guys, this is my first message here but I've been reading for a while and find this forum very helpful. My wife is an American citizen, we got married in Nov 2009, and she's been temporarily living in Israel with me since July 2009. We now want to go ahead and file the I-130 so that we can return to the states together. I anticipate no trouble in the first stage being we've been living together overseas for over 3 years so obviously it was not done with any wrong intentions and we have alot of proof for that(pictures, chats and emails, the fact we've lived together in Israel for 3 years, affidavits and more). However, my concern is about the affidavit of support. Being my wife has been staying in Israel with me for the last 3 years, what would satisfy the requirements that she could support me in the states? Would a letter from her brother in law that he will hire her in his business suffice?

Any help would be appreciated

Thanks Ryan...it's just sort of confusing...in some places it says the other household member MUST fill in the form as well, and then in some it says he must unless the joint sponsor can prove her income is sufficient - which it definitely is.

Hi folks...first a quick update...

We sent our I-130 Sept 14th...being we had to send it to family in the states for them to add the money order etc, it should only be received at the chicago lockbox today. So, hopefully I'll have a NOA1 update soon.

Also, while preparing for the next stage already, I have stumbled upon a couple of questions where the AOS is concerned. We are going through a joint sponsor and the joint sponsor makes enough money to support on her own. However, she does file jointly with her husband. So, being in the tax returns both of their names and income would be stated, should we state it on the form as well, or can we just have her info on the form being his is not needed anyway.

One more question - Being she is my wife's daughter, a birth certificate will be sent. However, there are two issues with that: 1. Her last name is different now being she is married(does that mean she will also need to send us a copy of her marriage cert.?) 2. on her birth certificate, her mom's(aka my wife's) name only has her last name and first initial. Would a first initial be enough? I don't know, it's a weird certificate I guess...does anyone else in the states know about those?

Ok, I just found something else out. For Israeli citizens it's from any police station. For Palestinian residents it is from the DCO(Civil Liaison Office) in the applicant's residence. So wherever exactly he lives, does he have a DCO office there?

I wouldn't do it before it's really necessary. You don't want to be late, but yeah I'd worry about them losing things. Easiest is just to call and ask...if you want I can call for you.

As for the copy Jules, I didn't know that but I'm not done checking things out for me either. But from what I've read so far, I am not worried about doing it in a few months. Last time when I went to get it(granted that was a few years ago for a tourist visa, and not with them having to send it to the consulate) I got it on the spot.

Figured I should add just to be on the safe side that being you are not an Israeli citizen, the process could be different for you...so what I've checked might not be relevant. I suggest you(or him) just call the police station that is nearest to him and ask.

Where did you hear about 6 weeks? I've looked into things too, being I'm going to need it...and it seems like it's fine to do it between NVC and the interview. Not one of those things that should take months and months like say India. Israel is a small country and you should be able to obtain it that same day, plus I think it's optional to send it to the embassy, you could probably also have them give you a copy.

Well then I would probably apply once I start sending in the forms to the NVC(which is what I'm actually gonna do myself, too)...that gives you time till approval and then interview scheduling, not too early, not too late.

I, myself, being in Israel am taking into account the possibility of being put on AP cause you just never know.

Well I figured he would be able to apply but did he ask them how long it takes? If they are the ones issuing it they should know if it's 1 day or 2 months. AP is very tricky no one really knows who gets put in it and why, where exactly in the west bank is he? Ramallah, Jericho, Nablus, anywhere else? If he has nothing on his records I wouldn't worry too much about being approved but AP could still happen.

Muslimqueen, is your sister in law able to get to the consulate again for that? IE permits etc. maybe she'll be able to inquire about it there being there is no phone number, and it shouldn't be a far drive.

One more thing though...when sending the IV package, do I just include in it what's written in all the cover letter samples? IE
Bar-coded Cover Sheet.
2 Passport-sized photographs.
Completed and signed form DS-230, part I.
Completed and unsigned form DS-230, Part II.
Photocopy of the Biographic data page of the beneficiary's passport.
Certified Birth Certificate of the beneficiary.
Certified Marriage Certificate of the beneficiary and the petitioner.
Original police certificates of the beneficiary
Original military certificate of the beneficiary

I read in some places that you also need to send all originals of what you've sent before to USCIS. If so then in what package? And does that include just, say, the petitioner's birth certificate or divorce papers, or does it also include all the bona fide evidence?

And one very last little thing...Where it says in the AOS not to count anyone twice, does that mean that if my wife puts me first as the sponsored immigrant(21a), she(well actually me being she gets to just sign it) needs to put down 0 at 21c? Cause that's weird, but that's what makes the most sense. It's like I'm married but I'm not married lol

Yes the petitioner(my wife) will file I-864. The joint sponsor from what I was told files I-864 as well. I just got off the phone with NVC, they said that the husband of the joint sponsor would need to fill and sign form I-864A(as a household member), but we would only need the one set of transcripts from the joint sponsor, being it has all the information cause they file jointly. Also, for the current individual annual income line we use 2012 income. Just need to verify that they gave me all the correct information as far as everyone else here knows...anyone?

We are using a joint sponsor, who files joint with her husband. We are using both of their incomes. Does that make the husband a household member? If so(and if not), which forms need to be filled by each of them? Do they both need the transcripts ordered? Also, do they both need the proof of citizenship or just the joint sponsor herself?

Hello,

I am filling out my i-864 for my husband. I have lived abroad with my husband for the last 6.5 years, and my salary will not continue when we move to the US. (I have a joint sponsor.) I just recently lost my job on 12/25/2012. I am listing myself as unemployed. Should I should still list my annual income as what I earned in 2011? (2011 is the most recent tax return)

Also, I have ordered my transcripts a month ago and they have not arrived, but I will be sending the AOS package soon. The mail is not very reliable in my country where I now live. Is it okay that I just send copies of my returns?

I never had any problems with the mail here, from USCIS I got NOA1 hardcopy after 7 days and NOA2 after 10 days. Mail is usually pretty reliable but what we are doing with the transcripts anyway just in case is have it sent first to the joint sponsor in the US and then they are sending it to us here. I just don't trust big government agencies to get things right, I trust the mail though.

Going off the September 2012 filers on here though, it seems to be that they're going to NBC and then getting sent to a local office for processing now. Do you have an 'MSC' code?

I'm also wondering if they could also all of a sudden request more documents that they "forgot" to before.

 

For instance, at interview day I brought with me the 2012 transcripts of our sponsor, being up to the NVC stage only 2011 was available, so made sure to have that with me. However, the consular officer did not even ask for it, and I forgot to even mention it.

 

Now I'm wondering if once they are done reviewing this, they'll be like oh btw we also need 2012 transcripts and then I have to wait again. It's slightly ridiculous.

Ok so had my interview on May 6th. Officer said everything in my case looks pretty good, they just need a document from the ministry of interior with my exits and returns into the country, being in my passport I did not have a stamp of coming back into Israel after I was in the states in 2008, and he wants to verify it is the same as what I stated on my DS-230(08/08). The reason I did not have a stamp is cause I used the hand print thing instead...

 

Anyhow, less than 2 hours later I already got the document and handed it to the reception desk.

 

it's been over 3 weeks, in which I try to stay in contact with the consulate through email which is the only way, and I was told at first that they received the documents but they are pending review, and yesterday finally they said that it is under officer's review.

 

How long could this review take? Does anyone have experience with it? It's one little document, you'd think it wouldn't sit on the desk for weeks but you never know I guess...Also, is it the same officer as the one who conducts the interview?

 

And lastly, is it possible for them to give a 221g for a document and not put me in AP(I know it is considered a form of AP but I mean THE AP), and after I submit the document put me in AP or should I not worry about that? Cause that would be a waste of time, if they wanna do that why not do it to start with while they wait for my document as well. So I'm just worried about wasting more time if after they finish reviewing it they decide they need to check more stuff.
