If you still have a job, and making the income level you need, a letter from the employer will meet the criteria of the I-134. Are you still working?

Some embassies require the most recent tax year return (2009) - so that shouldn't be an issue.

The criteria are:

  • The vaccine must be age-appropriate* for the immigrant applicant
  • The vaccine must protect against a disease that has the potential to cause an outbreak.
  • The vaccine must protect against a disease that has been eliminated or is in the process of being eliminated in the United States.
*ACIP recommends vaccines for a certain age range in the general U.S. public. These ACIP recommendations will be used to decide which vaccines are age-appropriate for the general immigrant population.

These criteria will be applied to the ACIP-recommended vaccines that are not specifically named in immigration law.

If an ACIP-recommended vaccine for the general U.S. population meets these criteria, overseas immigrant applicants will have to receive the vaccine during their immigrant medical exam. Again, the only exception is if an immigrant applicant can show proof of having already received a given vaccine or if the vaccine is not medically advised.

Immigrant applicants who are already in the United States and are changing their visa status to become permanent residents also will be required to receive the same vaccines unless they can show proof that they already received a given vaccine or if the vaccine is not medically advised.

Applicants will need to get only one dose of each vaccine during their medical exam. However, applicants are encouraged to get other doses of a vaccine to finish each series.



What vaccines are required for U.S. immigration?

At this time,* vaccines for these diseases are currently required for U.S. immigration:

  • Mumps
  • Measles
  • Rubella
  • Polio
  • Tetanus and diphtheria
  • Pertussis
  • Haemophilus influenzae type B (Hib)
  • Hepatitis A

  • Rotavirus
  • Meningococcal disease

*On December 14, 2009, the human papillomavirus (HPV) and zoster vaccines were removed from the list of required vaccines for immigrant applicants. All other vaccinations on this list remain.

Any future vaccines recommended by ACIP for the general U.S. public will be subject to the new vaccination criteria. If the recommended vaccines fit the new criteria, they will be added to the list of required vaccines for immigrant applicants.

I have never seen a requirement for something like that. (they could care less what your faith is)

They only care that you met the person within 2 years of filing, make enough income, relationship is legit, and you answer all the questions on the forms required.

Misrepresentation is a "cardinal sin" to the USG.

However, you said it wasn't true - can she prove it? and if so, why didn't she prove it then?

I suspect you may face a harder go at this than normal.

Why? There is nothing asking for that in the I-129F forms.

You would most likely encounter this when filling out the forms for the embassy interview, and will be given the chance to discuss things there.

Hello All.
I am a new user of this website. I found this website really helpfull. I need some information about applying K1 visa.

Well, I am Pakistani National seeking asylum in Ireland. My fiance is US citizen. We met in Ireland during one of her Visit to Ireland. We got Engaged last month when She came back again to Ireland.

When I applied for asylum, I submitted my Original Passport to Irish Refugee council. So right now I dont have Original Passport with me. All I have photocopies of my passport.

Now we both are thinking to apply for K1 visa next month. My question is that Am I eligible to apply for visa and how we will do it. I can get my passport back once I get my visa for US?

So is there any who can give me more quide line.

Yes - you are eligible for a K-1 - as long as both of you meet the requirements.

You may wish to wait to see what happens in Ireland prior to attempting the K-1 - you need to be "settled" somewhere (for interviews, etc...) - you will need your original passport at some point.

I have seen where they required the person to go back to the home country for the interview (however, your case is complicated by the asylum request).

I am not sure of the requirements for Ireland for asylum - asking back for your passport may stop the case for asylum. (and that may make you go back to your home country)

If it's after getting the visa, and arrival in the US - no issues.

I have seen some issues with age (mostly with older women, younger men) in MENA countries - depends on which country and the culture in most cases.

I wouldn't recommend breaking your probation from leaving the country just to get married, you could be causing a bigger issue down the line.

That won't work - in my review of cases for hardship on the USCIS, they would need a lot more - they rarely grant them.

It is possible - but I would seek out other means before going through that.

Case in point, ok - he can't get a US visa - but can he travel to Canada or Mexico - where you can visit/meet by a simple border crossing?

You have a legal issue preventing you from leaving the US - "you can wait till that is over and then visit" would likely be a question from them.

You can always try - worst thing is that they will refuse the application and you will have to either fight it or come up with something else (added cost)

In Nigeria - does what you did (the engagement, traditional clothes) = "marriage, just without the license"? (or something similar).

I don't know how a marriage would "speed things up". (K-1 vs K-3/CR-1)

The real question is how soon will she want to come to the US?

If it's more than two years, I would recommend getting married there, when your ready to bring her over, you would file for the IR-1 (10 yr card). (of course, being seperated for 2 years, being married, might be to much to ask)

If it's less than two years, then you either can go with the K-1 or the CR-1 - your choice - they have different costs/waits, but you have to compare (there is a link above that does that for you) - I would go for the K-1.

(in fact, I did the K-1 for my Fiancee)

1. Yes - it should be signed - however, if there is guidance from USCIS that says they do not need it (signature) for the initial petition - your beneficiary will sign it at the interview (or prior with submission at that level/stage).

2. Make an extra sheet of paper with the form name, your name, question # and answer - do this with any form you "overwrite" the box.

3. Anything not in english (official) needs to be translated. Copies, unless specifically asked for originals, are fine.

4. Put in the address where your sending the petition to.

I wouldn't say it like that.

Your status is controlled by the I-94 - which for a K-1 entry, will have 90 days. After that, you are out of status if you haven't applied for the AOS.

Being out of status means ICE can pick you up and deport you, regardless of your marriage or previous visa. (worst case) - I have read cases where this has happened, to the point where the couple were sitting in ICE custody for a while. (In Texas)

If you go over 180 days, you can suffer a ban if you leave the US with an AP (yes, even if the AP is given to you, the ban would kick in on your return to the US)

So it is implied that you will AOS during that period.

Play it safe and protect your status - AOS prior to going out of status.

Seems to be the big one- a few requests that want to skip that part are also denied.

You will find it's very difficult to do this during the initial process.

Your best bet is to contact the embassy where it's going to and let them know the change of address of your beneficiary. Unless you can catch it at USCIS, NVC will be no help to you.

Umit had to do this - but Ankara used emails to notify us (and we downloaded all the forms from their site) - so it was not a big thing.

She did take an updated G-325 with her during the interview.

The embassy would not work with us till they actually got the package from NVC.

NVC said to contact the embassy... catch 22 :)

The marriage in Tunis would be recognized by the US - However - my reading of the above says that the US doesn't recognize the marriage - because she wasn't divorced properly prior to marrying you? Is this what you mean?

You can always try to get a B2 visa - but I wouldn't hold out much hope, seeing that you are trying to immigrate here with the failed K-3 attempt.
