From my understanding of the law, deportation or removal from the US is based entirely on immigration status, not martial status.

Being married does not change the immigration status, only the AOS (by virtue of being married to an USC, in this case) would.

If you get an IJ having a bad day if they find you out of status, your going to have a bad day.

we have a letter from our friend, he wrote a letter for us, like how we met. and he signed his name on letter, is it ok that he just scan the letter with his signature and email us and we print it out? or have to get his original signature?

Original signatures are usually the norm.

However, you do not need a letter from a friend describing how you met, you or your boyfriend will need to do that (read the I-129F instructions).

It's a territory - not a state - so entry by a non-USC would require a visa.

Since your K-1 was used all ready (initial entry to the US and it's a one entry visa), she would not be allowed to enter (no visa)

Then, on the return to the US, you are required to show a passport - and the non-USC would need a visa to re-enter the US. (which was all ready used)

Hi, I have just submitted my I-129F petition, and am now thinking/planning about I-134/financial support. I read here that basically the magic number is 125% of the poverty line. But all the places I have read, this number, $18,212, is said to expire after 3/31. So, now it's April already, has anyone heard any new number that's published? Or when will they publish the new guideline? Will it be like last year, the poverty line unchanged?



It still isn't updated. If they are processing you, they will use the poverty level that was in effect when you submitted the I-134/864. (so in essence, until they change it, you will use the preceding year 2009)

You can check the USCIS site (forms) for the latest and greatest. (still currently 2009 version)

None of those documents need to be notarized. You only need original signatures for the documents that require them.

You can make copies of the "official" documents you send (like birth certificate/passport)

This is incorrect.

If you have a valid visa (visitors/VWP) you can enter the US for visiting, even if you have a K-1 in process.

You will have to show strong ties back home (which is the norm anyway) - and plenty of people do this everyday.

My own wife visited me during our K-1 process, and even told CBP she was in process, and she was given 6 months to visit.

well the one thing I did notice after the packet was sent was that I forgot to sign my permission to marry and she signed both of them, I asked the lawyer and she said it shouldnt be a big deal, and maybe it is, I hope its something that simple, but who knows. Hello, I recently recieved an email stating that my case is now at the request for evidence status, I filed with a lawyer back in december, and included many pics, chat history, western union receipts, emails, plane tickets, bank statements, intent to marry, birth certs, you name it we made sure we had it in there, I havent recieved the letter yet but should in the next couple of days and am wondering, what it may say? and how long does this delay the process? They told me that once i send the packet back with the info they need I will get my spot back in line and then I have read on here it goes to the NVC and that process is about 2-4 weeks, then off to manila which is about 90 days til interview. I would like to be there for the interview but its very hard to pinpoint when that will be until she gets the call, so realistically how much longer would you guess that she would be here if all goes well? I was thinking like September?

Without the actual RFE - hard to say.

Did you get the first NOA at least?

Did you file within two years of your last meeting with the benificiary?

Did you make a copy of everything you sent in? Was everything signed (as appropriate)?

Can't say on how long this will delay you - they can take up to 60 days to go over your RFE evidence.

Instructions state: If either person is using a name other than shown on the relevant documents, you must give USCIS copies of the legal documents that made the change, such as a marriage certificate, or court order...

So, my financee's divorce decrees from two previous marriages show her married names on the divorce decree, which are both different from her maiden name being used on our I-129F. Does this mean we also need to submit the marriage certificates that show her maiden name going into those marriages?

Anyone out there have any problem if NOT including the prior marriage certificates for the woman who previously changed her name?

Your timeline may not be as exact as you laid out.

Since you plan on moving to Colombia - I would suggest you move there, get married, then when it's time to leave, you can file for an DCF or CR-1 (DCF would be my first choice).

If you wish to travel to the US with your wife and family, they will need a visitors visa - not to easy to get in Colombia I've seen.

If you wish to go ahead with the K-1, get the greencard, then move back to Colombia, you will have the issue of being outside the country for more than the allowed time for GC holders. (you can request to leave up to 2 years prior to going though).

The K-1 route will probably take longer than your timeline - but the cost and wait along with just leaving to go back to Colombia seems like a waste of time/money to me, I would pursue the DCF - then come to the US as GC holders (you will, of course, try to get visitors visas - however, since she will be married to an USC, you may find it tougher than normal)

Once everything is completed he will file a K-1. How long do you think is the US citizenship process and can he immediately file K-1 once he's a citizen? i know so many ask this before but how long is the processing is of K-1 especially for a filipina?



Can't speak on how long his USC will take, however, once he is an USC - then the K-1 processing will take the normal time frame (usually in 6-7 months) - as long as it's a straight forward case.

I just mailed my k1 petition (I-129F) to CSC yesterday. Was going through the copy of the paperwork for my records that I noticed I missed putting the Name of the employer on my G325A. I put down the address only. Now I am getting little worried.

Anybody knows what kind of problem this will cause?

From what I understand so far, if they send me an RFE, it could add months to the processing. Is that true? If that's the case I rather have the application returned to me so I can refile. That will cause a delay of only a week or so.

Also, anybody knows what's a more realisting average time from file to visa issue is for a fiance coming from India? Not the time listed on USCIS. I want to know from peoples personal experiance.



That should not be an issue at this stage.

You may wish to get a new one ready - and send it to your beneficiary, then they can give them the updated one at the interview. (we did that because of address change).

Yes - RFE's can add more time to the process, depending on how fast they get your RFE back and how fast they work on it. (They give themselves 60 days to do so).

proof of his living in the US during the last 2 year period prior to the submission (if he was here for school, he should be able to show evidence of that);

That is what they will require for "proof of meeting" in the 2yr stipulation.

Pictures, correspondence, not so much at this stage (more important for the interview). (photos/letters can be faked)


You only have to prove one meeting in the 2yr period, not multiple ones. So if you visited him, and have the stamps in the passport, that would satisfy this.

Good he has the waiver for the J-1 - some petitioners forget that one.

Be very careful on stating you have six months to enter with the K-1 visa, all though this is the normal length, it can be different for different reasons, for example, if your medical is only valid for 3 months, for some reason, the embassy can make the visa only good for that period of time.

So a more correct answer is that each individual should check the expiration date of their own visa and plan accordingly.

The lawyer in this case may be offering the advice to get married asap (within 60 days) to avoid any unpleasantness.

That would not be acceptable as "proof of meeting". You would need to show passport stamps, airline boarding/tickets/hotel receipts, etc... to prove that you were actually there, in person, in the other country (or if the beneficiary came to the US), within the 2yr requirement, prior to sending in the petition.

If you attempt to get this evidence after the petition is sent, say by visiting, your petition would be denied, and you would have to start over, again.

A letter, even notarized, would not be sufficient. If they allowed that, anyone could write a letter - regardless if it's true or not.

Photo's showing you together are not required for filing the I-129F. They are usually looked at the interview, as supporting evidence of the relationship. You will not get an RFE for lack of photographs, however, you will get an RFE for not showing proof of meeting within the 2yr of filing the petition.

One example where it was granted (not to meet in person) and one where it wasn't.

As you can see, they do not get "personal" when they go over the petitions, they just bounce them against the rules in place, if it passes, they send it down the chain, (to NVC) and then on the embassy.

If you don't make the rules, they have no choice but to deny, you will have a chance to appeal - but from most of the appeals I have read through, they usually stick to the "technical" reading of the rules and go from there.

Like I said in that post, unless you exhaust all ways to meet in person in the 2 year period prior to submitting the petition, they will deny it, unless you have very strong reasoning to change their mind.

Some questions that would come to mind:

1. Why can't the beneficiary meet you in the US?
2. Why can't you meet in Mexico or Canada or any other country?

I filed my I-129F form on April 14, 2010 US Postal Service-overnight. The application was received the next day on April 15, 2010. The check was cashed on April 19th and I receive an NOA1 on April 21, 2010. Now I'm just waiting for instructions from the USCIS office regarding what needs to happen next, as they did not provide any on the first NOA1 notice.

They usually do not - once they approve it - you will get the NOA 2.

I've been reading the various Forums on VisaJourney.com to get an idea of the types of K-1 Visa cases that are pending approval, and I have yet to read one case that is like another. It seems as if each case has its own special circumstances, which makes it difficult for me to make an educated guess about how my case will be processed.
Just go with the standard timing as posted on the USCIS site.

Having said that, here are my questions. My fiancé (Morocco) and I (US Citizen) have not yet physically meet in person. We met on the Internet. So I made a passionate request to the USCIS office to have the requirement to physically meet within two years of filing the I-129F form waived due to financial hardship. I provided what I thought was pretty good evidence to support my claim of financial hardship, but I'm very anxious as to whether or not the adjudicator will feel that my claim of financial hardship is acceptable.
Your petition will most likely be disapproved. Financial issues are not considered good enough for meeting in person. Looking through all the denials on the USCIS site, I only saw a few that were approved without the meeting requirement met, and they were "life or death" situations. If you can't pay to meet the person, then you probably not going to be able to meet the financial support needed later. Also - what is preventing your benificiary from meeting you? That will be stated in the denial.

The other thing is I feel as if my fiancé and I have an advantage in this process, because my fiancé already has a valid alien number and ss number. It turns out that my fiancé was in the US for six years attending a college in MA. He completed his studies and received his degrees and returned to Morocco well before his Visa expired. I'm hoping that the fact that he had already lived in the US and doesn't need to apply for an alien number or ss number will make the process easier for the adjudicator to approve because he already has a history of being in the US.
This is a good thing, since this means he went through the visa process, but I do not believe this will help you in this case. The lack of meeting will cause you issues. USCIS has no choice, the rules for the K-1 are clear, and you do not meet them.


Please share your opinions regarding my thoughts on this process. I'd really appreciate whatever information you have to share regardless of whether it's in our favor or not because "knowledge is power."

As you all know this journey has been full of surprises for us. We were placed in AP end of February and now the processing has come to an end. Now my fiance is requested to submit any old or new passports on the document he recieved from the consulate. My fiance has only one passport and does not have another old passport. So, the consulate just told him to submit that passport with a letter stating that is his only passport. Do you know why we got this request? Should we be worried in regards to any more delays? They are probably looking for any travel, as documented on passports.

Some people "wash" their travel history by getting a new passport prior to getting a visa.

Seems to be a standard request from some embassies.

I wouldn't be worried as long as you were honest in the whole process.

What do you think they will say if you don't put your address on the 325, and they look up your F-1, see you were in the US, and didn't mention that?
