K-1 Fiance(e) Visa Process & ProceduresK-1 forms and other question
Okay. Thanks, Inky. I have another question. I've been married and divorced before. Will I need to send copies of the divorce papers with my packet?

K-1 Fiance(e) Visa Process & ProceduresK-1 forms and other question
So far, my I-129F package is coming together. DHL arrived today with the forms my fiancee needed to sign. Reading through the forums and guides brings a couple of other questions, though. I read somewhere that when using the passport as proof of citizenship it needs to have a validity of 5 years. My passport was issued in Dec of 2006. Does this mean that I have to have at least 5 years from the time of filing before I need to renew my passport or does it mean that I need to have my passport for 5 years?

I've also read somewhere on here that the USCIS wants to see original forms. I'm not sure if this is old information now since these forms are available for download and printing from the web. Will I be risking an RFE if I just send in single-sided forms? It's better to know in advance. :)

K-1 Fiance(e) Visa Process & ProceduresI think I'm pregnant...
I, too, am sorry for your loss. It would seem that our "children" would've been about the same age since my fiancée is completing her 7th week. And, like mentioned above, we don't plan on mentioning anything about the pregnancy until it comes time for her medical exam and interview; which, I'm planning on being present for. At least you know that you can conceive and can try again once you're in the States. I wish you well and hope your visa journey is quick and uneventful.

I just found out that my fiancée is about 3 weeks pregnant with our first child. I've been following this thread and am about to file our own I-129F. What would I put in the section for children; currently expecting our first child?

K-1 Fiance(e) Visa Process & ProceduresWhile waiting for NOA2

BC= birth certificate
CENOMAR is a Certificate of No Marriage but I think it's only required in the Philippines? I don't know what NBI is...
If it takes a little while to get, you'll want to look into getting a police check done for all the places you lived since you were 16.

Where are you filing from? Some countries have slight variations on what needs to be submitted before or during the interview. Your profile doesn't give much information about which consulate will be processing your paperwork, but the your regional forum might be the best place to go since folks who have gone through your consulate can give you the clearest answers.

He's right. Your profile is very incomplete. I know the moderators of this site would also ask you to create your VisaJourney Timeline since it aids others in trying to determine how long their visa applications might take.

NBI is the police clearance. However, I don't know what the letters stand for.

K-1 Fiance(e) Visa Process & ProceduresWhile waiting for NOA2

When did you file? For long how now? Yes you can now start gathering some documents needed like your BC, cenomar, nbi. Take note that the last two mentioned should be recent prior to your interview.

Yes, they should be recent. In fact, the CENOMAR is only good for 6 months. I'm not sure how long the NBI is good for, but I would imagine that it's the same amount of time as the CENOMAR. Your fiancee will also need to make sure that his/her passport is valid and has enough time left on it before it expires.

Yes, there is something that you can start doing now. Gather everything that you'll need for the interview. The steps are listed on the K-1 (I'm presuming that's what you're filing for) guide. Click here and scroll down to just under where it says to create a VJ Timeline.

K-1 Fiance(e) Visa Process & ProceduresK-1 and Honeymoon!
I'm a truck driver and have been all over the country. I might be able to offer some suggestions if you can tell me some of the things she likes to do. Does she like to go hiking? If so, visit some of the national parks. I hear Yellowstone National Park in Northwest Wyoming is beautiful. Plus, it's only a few hours from Jackson Hole, WY; which is a gorgeous town in its own right. Take her to see some of the things that make this country unique. A trip to Mount Rushmore in the Black Hills of South Dakota would be an idea. I live in Illinois and grew up in the Chicago area. So, there are several places that I could recommend in that area. Congrats on getting her here. Best wishes.

K-1 Fiance(e) Visa Process & ProceduresFAQ Question
I was reading the K1 FAQ's. In regards to where it says, "The fiance(e) also needs a passport, valid for at least 6 months from the time the visa is issued" does this mean that my fiancee's passport needs at least 6 months from the issue date or needs to have 6 months or more before the expiration?

The is your Receipt Number that you can use to track via Case Status. https://egov.uscis.g...d/CaseStatus.do

Okay. Went there, did that. Signed up for further notifications on case status. Will this tell me when my case has been "touched" or is that after I get my case number on the official NOA1? If not, where do I go to track the cases progress? Is it the same link as above? Thanks.

K-1 Fiance(e) Visa Process & ProceduresStill no NOA?

For you, your Receipt Date would be either 04/08/2011 or 04/07/2011. You will get your NOA1 in about a week. You need to get her ready all her paperworks. Getting CENOMAR, NSO Birth Certificate takes whole day and sometimes she will have to come the following day if there lots of people trying to obtain NSO documents. Inform you fiancee to bring a male relative when she goes to NSO or while trying to get her documents. There are lots of thieves around NSO pretending to be customers. The sooner she gets her documents ready, she will be able to get it corrected if there are mistakes on the documents. Also, it will cost lots of money to obtain those documents. I would suggest to send money via Western Union and have her take a picture when she gets her money at Western Union branch in the Philippines. Let her keep the documents from Western Union. Don't forget to send her card via USPS (Do not include cash on the card because it will end up missing including the card).

I sent her a Valentine's Day card, which she still has. I send her money via Western Union quite often for her OB check-ups (we're expecting our first child in October). I had heard that the NBI and CENOMAR were only good for 6 months. That's the reason I was thinking about waiting for a month or two before sending her for these. Any idea how much (an amount in Pesos is fine) I'll have to send? Keep in mind that her Philippine passport is currently expired and needs to be renewed.

K-1 Fiance(e) Visa Process & ProceduresStill no NOA?

Yes. On the far right side there are another series.

20001434 009
V371335 04082011

Other than that, nothing else that would seem significant. If need be, I could figure out a way to PM you with a picture of the check.

At what point should we start getting ready for her interview? I filed only last week. I know that there will be some things that we can do now, but from what I've been reading, the vast majority of things can wait for about another month or two; her CENOMAR, NBI and renewing her passport, for example.

Check the back of the cashed check and you will see like WACXXXXXXXXXX and that is your receipt number.

Go to your online bank and you should be able to see the front and back of your cashed check.

The back of my check doesn't have the WACxxxxxxxx on the back. The bank they use in Lewisville is the same as mine, Chase Bank. What I do see is this:
JP Morgan Chase
Lewisville, TX. 75067
Site ZZZZ
>124001545<#754464xxx (I left the last 3 numbers private for security concerns)

Would the numbers after the # sign be my receipt number?

For us, it's too soon to be expecting our NOA1 since our filing date was only last week.

thanks but what about the I-864 do my parents still have to fill them out? and by the way when they fill out their own I-134 do I combine their income or separate? thanks

Since you're inquiring about your parents filling out forms, I take it that you're unable to meet the 125% income requirement on your own and need a co-sponsor. The I-864 won't become necessary until after the beneficiary (your fiancee') enters the U.S. and marries you. The I-864 is only for the Adjustment of Status. At that point, any co-sponsors that were listed in the K-1 process will need to fill out their own I-864. Such is the case with the I-134. You should not include any financial statements on any form other than your own. Your parents, presuming they are acting as your co-sponsor, should fill out and provide supporting documentation for their own I-134.

hello my name is avelino a US citizen
I currently graduated from the philippines I live with my parents im planning to file a petition for my fiance she is in the Phlippines right now I am confuse wit I-134 affidavit of support. can I still file a fiance visa petition for her even if I didn't work for 4 years? I have no tax return to show to the USCIS because I was out of United States for school. I do have work right now but under an agency its a temporary job but they cut some taxes from me. Can I use my parents to help file an affidavit of support or be a co sponsor for my fiance? can I include them? What are the steps should i do? what are the forms do I have to fill out or my parents? thanks for you help

If you can't meet the 125% income requirement, then you will need a co-sponsor that can meet the requirement. Any co-sponsor would need to fill out their own I-134 and provide proof to support their claims. It doesn't matter what your past income is. They are only worried about your current income. For two people living in the household, you would need to earn a minimum of $18,212 per year. Add an additional $4,675 per person to your minimum income for each additional person living with you.

Petitioners sponsors to America are, as far as I know, are never allowed at the interview. My guess is that they don't want any comments from us. And no, the embassy doors are not always open to Americans except in emergencies. There are just too many Americans everywhere in the world.

It depends upon what type of visa and what embassy the beneficiary is interviewed at. My fiancee and I were both present for her K-1 interview in Manila.

K-1 Fiance(e) Visa Process & ProceduresLetter Certifying Pregnancy & intent to marry
If there are concerns about divorce this early in the relationship (even hypothetical), then perhaps the relationship should be discussed between the two of you and evaluated on its own merits for success. After all, what's the point of filing a petition and spending all the money involved if there's any doubt of his true intentions?

K-1 Fiance(e) Visa Process & ProceduresLetter Certifying Pregnancy & intent to marry

Thanks, dukeandduchess. It's responses like Baron555's that throw me off... It IS because of the pregnancy, so what? Why is it any less "real?" Especially in the eyes of bureaucrats...(I should know, i am one!)

Ray-J, CONGRATS! That's so great that you got to be there and spend time with them right away! Thanks for letting us know how it worked out, i also saw the comment about having to accept the pregnancy and wasn't sure how relevant is it. Much success to you and your new family :)

Even though the relationship may be due to your pregnancy (congrats, by the way), the only thing the embassy is concerned with is if the relationship is a valid and genuine one. They're more concerned with if the beneficiary is just getting married to come to the US, only to divorce as soon as they get their green card. In this sense, the pregnancy will have no bearing on the outcome of the petition. However, if you're able to be there for his interview and the embassy will allow it (Manila is one of the few that do), be by his side. It shows the interviewer there is a valid relationship and almost guarantees an approval (depending upon country). With that said, Barron is right. It has nothing to do with the petition. I never mentioned it in ours.

K-1 Fiance(e) Visa Process & ProceduresLetter Certifying Pregnancy & intent to marry
Okay fellow VJ'ers... it's been a while since I started this thread and a lot has happened since then. Amy gave birth to our beautiful daughter, Serena Marie (last name withheld), on Sept 25. She was born 3 weeks early but still considered full term at 37 weeks. I arrived in the Philippines on Oct. 10 and stayed for a month. Amy's embassy interview was on Oct. 18. They didn't even ask to see any copies of what we had sent into USCIS. So, an additional letter was unnecessary for Manila (other embassies may have different requirements). What I ended up doing was simply listing Serena as our daughter in the appropriate places on the DS forms the embassy has you fill out. The interview asked if we had her CRBA taken care of yet and was satisfied when we told her we were in the process of doing so. After that, all the interviewer was concerned about was my income level and that it was over the 125% minimum.

K-1 Fiance(e) Visa Process & ProceduresLetter Certifying Pregnancy & intent to marry

work for what? The issue of pregnacy is completely and totally irrelevent to the I-129f petition. You need to BOTH sign letters of intent to marry. The sample letter here on VJ works perfectly well.

USCIS could not possibly care less if your fiancee is pregnant and who the father of the child is. It need not be mentioned.

You may need this letter for the interview...if the child is not already born by then, but not for the petition.

Gary,
Thanks. I guess I'm just thinking too far ahead at this point. Am I correct in thinking that this letter wouldn't even be necessary if I'm there for her interview?

I would edit it to this:

I certify my intent to enter willfully into this marriage with the beneficiary within 90 days of her entrance into the United States.

The pregnancy is of no concern to USCIS....it will be to the consulate but you can mention all that in your updated letter of intent that you will send for that.

I have letters of intent (using the examples from here for this) from both my fiancee and myself (signed and dated). I believe I'm good in this area. Thanks. However, this does bring to mind the question of if the updated letter of intent is still needed for the interview if I'm in attendance. Either way, I'll draft one and include the pregnancy mention at that time so they'll have it for their files.

There is no need for the pregnancy statement what-so-ever. Kind of sounds like your only intent to marry her is because shes pregnant! You talk more about the pregnancy than intent to marry.

I would remove the pregnancy statement and just leave it as an intent to marry.

Inky,

I found out about the pregnancy AFTER I proposed. So, no. The marriage is not because of the pregnancy. However, the purpose of the letter would be to inform the USCIS & Embassy that there's a bundle of joy on the way, I'm aware of it and intend to proceed. I have other letters of intent to marry included in the package. I believe this is from the USEM's website in their FAQ section... See this post for the basis of the reason for the letter:

FAQ

Q. What if my Fiance is pregnant and this is not disclosed on the approved petition?

A. Visa processing can continue in this case if the consular officer obtains a statement indicating awareness of the pregnancy and the desire to proceed with the marriage.

K-1 Fiance(e) Visa Process & ProceduresLetter Certifying Pregnancy & intent to marry
I'm following the advice of everyone here and drafting a letter to include with our K-1 package. Here's what I have so far:

To whom it may concern:

This letter is to certify that I?m aware of and the father to the pregnancy of the beneficiary, Amy Antonio, to this petition for her K-1 status visa. The date of conception was approximately January 10th, 2011 during my stay in Manila. A check of the passport pages supplied with this application package will prove that this date is within the date ranges of my stay. I also certify my intent to enter willfully into this marriage with the beneficiary within 90 days of her entrance into the United States.

Would this work? Should I change or add anything? The only thing I can think to include with it would be a copy of the ultrasound picture I have and the chat transcript for the date that she confirmed we are pregnant. Thanks in advance.

We didnt an RFE for that, but we did get some delay...so, just make sure you will not do the same mistake we did! =P

God bless you on your journey!

Thanks. I sent it out this morning via USPS Priority Mail with Signature Confirmation. Even though I was sure that I had the correct version of the I-129F since I had only recently downloaded it from here, I had to double check. So, now I'm crossing my fingers and hoping that I have all my I's dotted and t's crossed; which is much better than having your t's dotted and your I's crossed. We're hopeful that both my fiancée and new baby (expected to make his/her world debut on 10/14) will be able to come back with me when I return home at the end of October. I think you're fine as far as the package
Remember to put the e-notification form in front of everything (or maybe just above the check, since it's the first thing they'll check...lol).

We put together the whole proof package with punch holes cause it was a big amount of paper and we were afraid they'd lose something, or mess them up. However the forms and the documents stays in front of everything, putting them together just with a normal paperclip. Hope this helps.
Good luck on your journey :star:

Thanks. My proof package doesn't sound like it is as big as yours was. However, what is there is convincing enough to show that we've met the requirement. I took a clue from the guides for the passport picture requirement for the G-135's and put all proof (pics together (labeled on the back with who's in the pic, dates & places they were taken, etc.), and a copy of my boarding pass from my stop-over in Korea to Manila) in its own zip-loc bag stapled to a sheet of paper marked "Proof of Meeting".

How did you go about copying pages of your passport? Color, black and white, what? All pages? Only front page? Just curious.

Some people have had issue sending only a copy of their passport and were later requested to submit a copy of their birth certificate (if I remember correctly) - so if you have one, definitely send it.

Since I don't currently have a copy of my birth certificate, I copied all pages - including the front and back covers - on a standard black & white photocopier at the office. There were a lot of blank passport pages because I've only used it once (so far). However, the one page that really counts (the one with the entrance and exit stamps) is legible.

Exactly. The factor for USCIS is determining whether or not you have met within the last 2 years. The case for proving ongoing relationship is made at the time of interview.

ATM receipts may or may not be helpful - any kind of evidence like this is considered in the bigger picture compared to other evidence - but at least those receipts show you were in the country at said time, so they probably don't hurt. Bank statements showing those withdrawals would probably be more substantial since they show your name on it and not just an account number.

Yes, I agree. In addition, bank statements would also provide proof of income. But since I'm not at this stage yet, I don't need to worry about it. Besides, I can get an income verification statement from my employer for this. Now, can we PLEASE get back on track here? Is there anything missing from the contents of my packet that I haven't thought about? :D

Finally! I think I have everything I need. Here's the list of items I have on my I-129F Cover Letter:

Contents include:
- Payment in the amount of $340.00.
- I-129F
- G-325A and passport style photo (Petitioner)
- G-325A and passport style photo (Beneficiary)
- G-352A Supplement: Attachment 1, Additional residential and work history (Petitioner)
- G-325A Supplement: Attachment 2, Parental address information (Beneficiary)
- Copies of US Passport Pages (Petitioner)
- Letter certifying intent to marry (Petitioner and Beneficiary)
- Proof of having met in person in the past two years
- Proof of ongoing relationship (chat transcripts, pics of her and I together in addition to extended family)
- Proof of divorce from previous marriages (Petitioner)
- Form G-1145, E-Notification of Application/Petition Acceptance

In regards to question 18 in my I-129F, this is what I have:
"We met on a social networking website known as Tagged.com in late 2009. From there, our friendship grew to the point were it was decided that I would fly over to meet her. I arrived in Manila the evening of 1/7/11 where she and the family met me at the airport. After spending 6 days with Amy and her family, I reluctantly returned home."

So, does it look like I'm good to go? I will be sending to the Dallas Lockbox via Priority Mail. Also, how important is it to punch 2 holes in the top of the pages and use appropriate separators (currently, packet is in the order stated above but unseparated)? Thanks in advance.

P.S. Yes, I will update my timeline as soon as I send the packet. :)

What did you use as proof for residence in the US for 5 years or more for your daughter's CRBA? I have a few things but Im not sure it is enough information for the DOS.

I obtained and submitted copies of my high school transcripts, both official and unofficial since I didn't know which they would need.

Also, On the DOS website it says "The father (unless deceased) has agreed in writing to provide financial support for the person until the person reaches the age of 18 years" For the CRBA. How does one go about making this agreement. The Consulate website in Russia doesnt have a form for this nor does the DOS. Do the just want a written notarized statement or what exactly?

The DS-5507 is the form you will need for this. Even though you're going through the Consulate in Moscow, I'd check out Manila's website (http://manila.usemba...th-abroad7.html) and use their check list. Some items won't apply to Moscow, such as the NSO copy of the birth certificate (for that, follow the requirements for Russia), but all the forms you should need are available from there.
