K-1 Fiance(e) Visa Case Filing and Progress Reports

Another update: My fiance had has interview on Friday and it was quick and easy. He left his passport and was told to expect all paperwork in a "few days". I've since cancelled my flight to France in June--the company did not refund my $1500 ticket! (That was Northwest Airlines, by the way) I told them that I was extremely displeased with that decision and that I was a good customer (4 international flights in one year!) and that I would be forced to use a different airline company when booking future flights. I had hoped for at least a sort of travel voucher that I could use.

Another question. Can anyone tell me about how long the process will take when he arrives at the airport? Is it a lengthy process? We are trying to decide if he should just come as far as Chicago instead of trying to make a connecting flight to come closer to my area. Often there is only 2 hours between arrival flight and next connecting flight. I worry that may not be enough time.

Another question: Can I send him a cell phone through the mail so that he has something he can use to call me from the airport? I know I can directly ask the post office today, but thought perhaps someone already knows this answer.

Congratulations on the visa!

WRT the flight.... based on my experience, a travel agent will hold the ticket for up to one year, then charge a nominal fee (~$150) to use the remainder of the value of the voucher towards another flight. (Doesn't have to be to the same destination.) If you purchased the ticket directly from an airline, they will normally refund the money less an administration fee.... depending upon the airline. Check your particular airline web site for terms and conditions.

Loved the video. Some of those shots were taken by a very gifted person with an artistic eye. Lucky them.

Just a quick post to let people know that after much heartache, my fiance has been told that his k-1 visa is approved. His quick interview today went well at the Paris embassy. He handed over his passport and was told to expect it by mail in a "few days". He plans to look for flights the first or second week of June! He's coming back.

VISA GRANTED APPT. FRIDAY

After being told that my fiance needed to file a 601 and 212 with Rome, after all the time, money, loss of sleep we found out that it was unnecessary. But at least that's good news because>>>>>

HIS VISA IS BEING GRANTED! His appointment is this Friday at the embassy in Paris. HE's coming back!!

NOTE FROM PARIS THIS MORNING:
We have received the response memo from USCIS Rome and we will issue the visa according to their instructions.

Please be informed that Mr. Eymond-Griffin’s I-601 and I-212 waivers were returned to the American Consulate in Paris together with an Interoffice Memorandum explaining the results of our review (USCIS records does not indicate that Mr. Eymond-Griffin accrued any periods of unlawful

presence during his visits to the United States, which would render him inadmissible. An I-601 waiver is not required.

The I-212 waiver is not required too since he was not removed nor deported from the United States).

Got NOA2 Approval through snail mail today!

Another February approval yes!. I just checked my mailbox and we are approved, now I can quit smoking and calm my nerves. Can't wait to tell my baby the awesome news. Here we come NVC! To those that haven't been approved yet, keep your head and lets pray and continue to support one another, hopefully yours would come soon. Its also weird that the USCIS site is not accurate because on the site, it still has my case pending and I haven't received any emails yet, I do have a account set to alert me of any changes. The phone system isn't accurate as well because it still says it pending also. For those that have not received an approval make sure your addresses is correct with the service centers, also make an appointment with your local immigration office to speak with a immigration officer so that you can get more details regarding your petition. If you need any witness or any sort, I'll be proud to testify ono your behalf regarding USCIS errorneous website!

Congrats! I hear you about the smoking thing. When this whole process started, I started smoking again after not smoking for 20+ years! Crazy, I know but it is nerves. You know our visa was approved, but I never received a NOA2 by mail. What do I do? Ours was a unique situation because a waiver had been judged to be unnecessary and therefore we were approved, but I did not ever get a NOA2.

Thanks for the replies! That makes me feel a little better about her maintaining her original family name on her Thai passport.

It is indeed a situation where its not easy at all for her to change her surname on her passport (there will be implications for her property that she owns in Thailand and other things). At some point, we will likely have to consult a Thai attorney to learn more about the process of getting her name changed on that document.

Removing Conditions on Residency General Discussion

Different surnames on evidence for ROC?

Hello. We are applying for Removal of Conditions in the next month. My wife (the applicant) changed her surname to mine after our marriage here in the US. However, she still uses her foreign passport in her old surname, and thus all of our air tickets have been purchased using her old surname. I?m just wondering, will this be problematic for our ROC compilation of evidence of bona fide marriage if we submit copies of our air tickets when we have different surnames on them? I will note, on other US-issued documentation, she uses my current name. So basically, some of her documentation will have her old surname (passport and air tickets), and the rest will have her using my surname.

Other evidence we are planning to submit:

*Apartment lease with both of us identified

*Federal taxes for 2012, 2013

*Retirement beneficiary form designating my wife as beneficiary

*Life insurance beneficiary form designating my wife as beneficiary

*Marriage certificate

*Copies of our drivers licenses (showing same residence)

*Itemized health insurance statement showing all of our health insurance claims and payments for the past 2 years

*Current car insurance statement showing we are jointly covered (however, the car title is only in my name)

* Voided copies of checks from a bank with both our names

*W-2 forms for both of us (showing same residence)

*Experian credit report showing she is a joint user on one of our cards

Any thoughts on whether our evidence is sufficient either? Thank you in advance!

Traveling to UK after US Citizenship

Red pen ok , but my custom form had red marks on it from the POE in Dublin. Because they did secondary screening on us in Dublin, but our luggage was already on plane. So when we arrived at JFK they noticed the marks on that form and pulled us in again. Only this time, went threw our luggage. I don't smoke but Betty does and we had a few to many cartons of Majors. Paid the penalty and they sent us on our way. After repacking ;-(

You saying not to fill it out with a red pen? US customs on a return trip was going to confiscate my overpriced notebook, because the battery was dead. Good thing I had the charger cord in my bag, but had to run all over to find an outlet to plug it into. It booted into Windows, so was okay, if it didn't, goodbye notebook.

We never had problems entering a foreign country, was always coming back. Feel they really target good looking women coming back alone with a visa or a green card. Never targeted my wife when I was traveling with her, if they did, not sure what I would have done. Couldn't go with her on her last trip, but that was my first question, were you stripped searched when I picked her up at the airport? She said no, maybe its because she finally had a US passport.

God, I hate the airlines, last trip was a total of 5.5 hours of flight time with another waiting ten hours in long lines.

Well that little piece of paper caused me a big pain in the A## once . In Dublin had a red mark On it from secondary screening. Because I opened my big mouth and said we plan to get married. But after we convinced them we plan to do it legally. They let's us go on our way
But when we arrived at JFK the officer you think is not looking at that paper noticed a little red mark on it and pulled us aside for secondary screening. Talk about a major pain. But they finally lets us go on after searching everything we had and paying a fine for not declaring everything

Is that that custom declaration piece of paper the flight attendants hand out right before you land? Wondered about those, hand that out without any pens to fill them out. Already had my pen kept at boarding inspection because it can be a WMD. But my wife manages to find one from somebody, normally another woman that has a small one hidden in her purse.

Have to stand in a long line where a person collects them, watched those people, just collect those many pieces of paper. Never verify if that is really your name on that slip, just collect them, and once they have a handful, drop them into a trashcan. Does anybody really read these?

Really don't know why we have to fill these slips out, thoroughly inspected anyway, go through every inch of our luggage and darn near stripped naked. With a hundred buck bill as the lowest denomination, need a pack of a hundred of those to hide, that is not easy. Who has ten thousand in cash anyway? Tickets cost more than that.

Did bring home my wifes' Technics SLD33 LP turntable, but took it all apart first and packed that in with our luggage. That is a classic in the HiFI world. But had a hell of a time explaining that when coming back. Wife and stepdaughter were stripped searched when they first came here, only because they came from Colombia. What a mess they made out of her luggage, was worthless and all cut up. But they also had to fill out that customs form, if that makes any sense.

I was mad at him for the rest of the night! He said he "doesn't like authority" to which I said "you were in the navy for 6 years, shouldn't you be better at dealing with authority than anyone else?" I think sailors tend to be a little more unruly than other than members of the military. He knows better now, though.

It's like... Even if they are power tripping (as opposed to just doing their job) nothing is gained from arguing with them or lying! And so far, in my experience they're usually just doing their job.

Pre-Interview Case File Review

My husband received a yellow notice, "THIS IS NOT AN INTERVIEW NOTICE", requesting documents that are recommended to bring to the interview.

I believe the first request is a mistake by USCIS. On my husbands application he selected "NO", but USCIS requested the following:

"You have indicated you are applying for a disability exception to the English and civics testing requirements. Please bring an original Form N-648, Medical Certification for Disability Exceptions, to the interview...."

Is this something he can address at the interivew? Since he did select NO in the application, this doesn't apply to him and is a mistake on USCIS's part.

Also, need some help and clarification for the following request:

"You have indicated that you are applying for naturalization on the basis of a marriage to a U.S. citizen. Please bring an original Internal Revenue Service (IRS) Form 4506 listing tax information for the past three years (what does this mean?) or copies of the income tax forms you filed for the past three years...."

We have a copy of our 2013 tax returns with W2s, but not for 2012 or 2011. We do have Tax Transcripts from the IRS for 2011, 2012 and 2013. The IRS Tax Transcripts are official documentation of the filed tax returns. Would this be sufficient to take to the interview?

I am trying to avoid calling USCIS as it depends on who you talk to and you get different information or nothing that helps.
