Hard to say if they'll ever put two and two together. If they do, it's probably a material misrepresentation. If they don't, then there's no later questions about whether you lied on an immigration form but there will be that same question again about being denied a visa. Of course, she'll answer correctly this time.

that she will :innocent: it was simple over site on her part, but should I just remain silent or is it better, I point out her mistake before then, to show no intention of lying ???

also if you can on many forms it asks for our service center address . which I think will be California.
But right now I send paper work to TX lock-box do I use TX or Cal address ??? on these form ???

The firstanswer is "NA-VWP"

the second answer should be YES, she WAS denied a visa. This denial will not affect her K-1. Falsifying answers WILL affect her K-1. Since you have not sent it yet, change the answer

But she did already answer No on this form,So the Damage is done :bonk: April 2 before her flight had to fill out new ESTA form and she arrived here April 8 .. the new ESTA was necessary because her passport was due to expire. So i had her file for new passport.. this was just an over site on her part anything i can due to minimize any possible damage or are we :crying:

Hello all and thank you in advance
I'm finalizing our paper work to file a K-1 next week. So I may ask a few  question today just to make sure I Have things 100% correct
My angel arrived back in the USA this week and will return home before her 90 day limit
So ? 1 is
I-129 F
1). line 12 asks is your Fiancee currently is the US easy Yes
But then it ask for
Arrival/ Departure Record (I-94) Number
she is here on the Visa Wavier Program So we have no (I-94) number
Only number I could use is the Application number on top of page or do I just say yes VWP
and leave number blank ???
2).

on the ESTA Application question
F) asks have you ever been Denied a US visa or entry into the U.S. or had a U.S. visa canceled.
to which she answered NO
But in February we applied for a 6 month visa at Embassy and she was told No. :crying: because she had been here to much lately and only planed to return to get married.. which was not true and she will be returning after we file the paper work for our K1. so hopefully we can marry this fall. will this answer cause us problems later or is it a Non issue ???

thank you all this site has been a great help

K-1 Fiance(e) Visa Process & ProceduresFiance address and embassy designation
My fiance is currently a graduate student in Australia but will be finishing in January and moving back to Thailand. I'm filing the application and don't know what address for her I should put on it

Do I put Australian address that she is currently living at? Or the address that she will be living at in January in BKK? Will this cause some problems at consulate if she's listed at an Australian address?

Thanks

No, get engaged and then your fiancee can start the K1 process. You're simply visiting her, they don't need to know anything else, since you're not getting married.

I'm not an expert, but I would discourage you getting married until the process is complete. There's a reason it's a fiance visa. The rest of your question depends on Canadian immigration law, which I have no idea about. I'd ask in that regional forum.

So I would still have to get a K-1 visa even though we don't plan on living there?

That's up to you, but I don't see any reason why you would if you don't want a green card and don't need the visa for entry.

QUOTE (Mandy.Erickson @ Dec 7 2009, 10:01 PM) <{POST_SNAPBACK}>
I am a (pregnant) U.S. citizen and have applied for the I-129F visa to bring in my Irish fiancee for marriage. We know that our visa will not be granted until AFTER the birth of our child. However, he wants to come here for the birth... and stay for about a week or two after then go home. I was told by my local immigration office that he will not be allowed entry into the United Stated if a fiancee visa is in processing. There has to be some kind of loophole in the case of a birth. I don't see how the U.S. could deny him the right to be present at his son's birth. The U.S. embassy in Ireland is no help to him because they don't return phone calls. I'm wondering if there is any way he is guarunteed entry into the U.S. and if there is, what is the process. I am stressing out so much about this!! Thank you!!!

I think your local immigration office is wrong, i'm not sure why he couldn't come on tourist visa while it's processing. He''s not "guaranteed" entry, but i'm pretty sure he would be allowed entry.

The lady was really helpful and talked to several different people. Apparently since the address is outside the US she can't do anything on the computer, and it's a hard copy fix that has to be done with a letter to CSC.

When it gets approved an forwarded, will I get a number or something so I can contact VSC and ensure that the address is correct?

Thanks for all your help, I'll try to call them first thing in the morning. It says on the USCIS website to make sure and call them if changes on I-129s may reflect a change in embassy or port of entry (although i don't know why this would change since she's Thai and I stated Bangkok embassy), and if there's a way to change her address online I certainly can't find it, since she's still abroad.

You're right, it doesn't make any sense that you can't change that address. There has to be plenty of people that have this same problem.

I called them and they said I have to send a letter requesting the change. I'll try and get this out today, hopefully it's in time.

I know this question may be rather obvious, and i've looked through the old threads and found some different answers.

My situation: Fiancee is in Australia finishing graduate degree, is a thai national, K1 application has Fiancee's address abroad listed as Australian address. She graduates in January and will move back to Thailand. The application lists US embassy in Bangkok as embassy designation.

Should I bother contacting USCIS to change the address once NOA2 is issued? Should I send an email or note to embassy once it gets forwarded? Or does it really matter since she's already printed Packet 3 from embassy website and begun assembling it and it lists a new contact information on that form.

Thank you for your time.

Your timeline lists the NOA1 as 22 September, so your NOA2 may be imminent.
I would contact the USCIS first if your case has not yet gone to the NVC.
The Consulate wouldn't even consider your question without a case in hand.
I'm assuming she will expect to have her interview in BKK, so the sooner
you square things away regarding the address the better.
Even though BKK is the designated consulate, in a bureaucratic situation many things
could go wrong if they have the wrong contact address.

I hope that was helpful.

Thanks, just attempt to call? Is there a certain line that would be preferred to reach them?

Unless you can stop the petition from getting to USCIS in the first place, you're better off waiting for them to tell you to send a new check if they require it. You have to remember that something like 60,000 people apply for a fiance visa each year, not to mention the numerous other visas. The chances of your new check getting to the right place are pretty slim.

Sorry rose.gif Hope it goes quickly for you!

Yeah, that's what I'm worried about. sad.gif I can't believe I did that! I looked at everything 5 times, but completely forgot to make sure the check was correct. I knew I was missing something

Would they send a RFE (i know a check is not evidence) or something like that...or would they just send back my whole package??

They'll send the whole thing back, they won't issue NOA1 without cashing the check. Someone earlier put the wrong amount or forgot to sign it and they mailed it back.

K-1 Fiance(e) Visa Process & ProceduresI-129F & G-325A Residence Question
QUOTE (axexa @ Dec 15 2009, 10:01 AM) <{POST_SNAPBACK}>
My gf is Ukrainian. Her permanent residence is with her parents in Ukraine. However, she has been working as an au paire in the Netherlands since August. It will last one year. She goes home in August.

My question is about "residence" in the forms. They ask (G-325A) for city and country of residence. Do I put the Ukraine address here. Is it the permanent address? Obviously, she will interview in Ukraine and probably be there by the time the application gets to that point.

Also it asks for residence last 5 years. Do I include the work address as her most recent "residence?" Or is it only the permanent address in Ukraine I need.

Then it says last address outside of US for more than one year. This asks for ADDRESS not RESIDENCE. But she has not been there MORE THAN ONE YEAR. And it is not her permanent address.

I will include Netherlands under employment last 5 years.

I-129 asks for her address. I want to put permanent address in Ukraine. I want no confusion about her residence. And I want any communication to her sent to her home in Ukraine not employers in the Netherlands. Do I have to put the Netherlands where she physically is now?

Thank you for your help.

I had this same problem. I'd put the netherlands address, otherwise if you were looking at all the forms it wouldn't make sense. It should be clear to the adjucator that she's from Ukraine. I ended up just sending them a letter to change for address on the I-129F to her current one when she moved back to Thailand.

Hello, unfortunately a few weeks after filing our paperwork for the K1 Visa I had to move house. We have just received the receipt of filing and been allocated a case number. I found information on the immigration website about changing your address if you're an alien living in the US but not for if you're an alien living outside of the US.

I'm sure this has probably been answered before but I didn't find anything in the seach that really seemed to apply.

Does anyone know what the process is to change the alien's address outside the US at this stage?

Thanks

Yes, I just did this last week. You must send a letter to them stating the change of address. I put the WAC#, both peititioner and beneficiary's names and birthdate, the old address, the new address, and signed and dated it. It seems like they got it and updated my case as it was touched a few days after I sent it. PM if you have anymore questions. You can't do it in the online or with AR-11 since the address is abroad, they have to change the hard copy of I-129F

K-1 Fiance(e) Visa Process & ProceduresQuestions about submitting the ORIGINAL copy of my fiancee's letter of intent and biography
QUOTE (Karen_and_Jay @ Dec 18 2009, 10:23 PM) <{POST_SNAPBACK}>
QUOTE
I don't think you have anything to worry about with the letter of intent. It's the content of the letter that counts, and not who it is addressed to. USCIS just asks for a statement of intent from each party. They don't specify what format to use for the statement.

The G-325A I submitted for my fiancee contained a combination of text entered on the computer, a bunch of stuff I wrote by hand, and my fiancee's signature. Her signature was the only thing she personally wrote on the form. It was accepted without any problems.

The guides are telling you not to submit photocopies of forms that require a signature by either you or your fiancee. The director of the VSC has told Gary that a photocopy of the G-325A is acceptable, but people have gotten RFE's for sending photocopies of this form so it's probably better to be safe. How the form is actually filled out, whether by computer, or hand written by a complete stranger, is irrelevant, as long as the signature is authentic.

Wow, thanks for the quick and thoughtful answer. I saw so much conflicting points of view here that it is hard to know for sure! I did see what the director of the VSC said, which is funny since he sounds quicker to accept a document than many of his subordinates.

I only have one signed copy of the G-325A from my fiancee. Do you think I should only send that? My only other option would be to make 3 photocopies of her signed copy, which they could easy do if they so desire.

OMG, all this fuss over minutiae! Minor details get amplified when it takes 2-4 weeks to receive mail from a SO!

I would send it. I think the 4 copies is part of the old form (2007?) There's nothing on the new version that says you should do it. I did just to be safe, but I don't think it has been a problem lately. Someone else please reply if it has been.

I understand that the reason for the K-1 Visa is to bring your foreign fiance TO the US to marry you here. However, is it possible to have the marriage there (Portugal) first, and then just sign the paperwork here? I know its against the law to be married twice, but is it still if its the same person in 2 different countries? We decided to start the K-1 Visa process so we could get a head start rather than waiting the extra time until we were married, then filing for a K-3 visa. Anyone have any thoughts on the options we may have? We would like to have a ceremony in Portugal, then come to the US to file the paperwork within the 90 day limit. Anyone with help or advice would be a savior!!

Thanks!

Tim & Katia

Depends on if the ceremony is a legal one or not, i'd ask the regional thread.
