I'm a Sawasdee thread poster from years back. What happened to this thread? am I really the first poster in 2012? I thought I would bring it to the top.
Well, we have good news, Jum is officially a U.S. citizen. From first meeting in 2004, through the fun adventures of wading through the immigration process, we have come to the finish line. I wanted to thank Visa Journey for all of the great information and support from all the members. It is a long journey for everyone. Speaking from one who has seen it through to the end, I can provide one word of advice on the whole process: "PATIENCE"

Hi. I still follow this thread. My wife obtained her K-1 and is now living with me in the US. We are in the process of applying for AOD now. She just got her SSN the other day and we plan to go down to the county government office this week to obtain our marriage license. So far, things have been going smoothly.

Yes, if you can get an original or certified copy of her birth certificate you will be better off. Here in the US they won't take a house book for any proof of birth. You should be able to get one through the Amphur's office where she was born without a problem.

On another note, I took Teaw to get her learners permit so she can learn to drive. She took a long time studying the materials which, of course, don't come in Thai and they give test in almost any language but.....what else?? Thai!!! Cause they said they don't have the money to translate it. Bull hockey!!!! That's down right discrimination!!! They guy asks, English, Chinese, Vietnamese.....and I cut him off and said she's Thai but you guys won't spend the money to do it. So she did it in English...25 questions and I thought she'd NEVER finish!!! LOL!! She did take her time but passed so now I will be looking at driving schools to teach her how to drive.

Aaron, if you are checking the forum, how's things in Chiang Mai???


Nice to hear she passed. I've been wondering how hard the drivers license process will be for my fiance when she gets here to Nebraska. We want her to get driving as soon as she can, but getting the SS card and making the marriage arrangements are still first priority. If I may ask, what was your overall experience after arrival like?

Hi everyone, Good news, my girlfriend passed the interview yesterday and will pick up her visa on Friday. As soon as she gets it in hand, I'm going to book her a flight to Boston.

One question, I can't find the post but someone mentioned that once she's here and we're married, what she used for a birth certificate for the embassy isn't good enough here when we go to the next step. I believe they accepted a house registration (tambien baan) and her ID as sufficient at the embassy. So she should go to get an official, translated and notorized birth certificate before she gets here? She's from the province of Chanthaburi.

Congratulations! I don't have an answer to your question, but I just wanted to note that - coincidentally - my fiance also passed her interview (this last Tuesday) and will pick up her visa on Friday as well. Unfortunately, it likely won't be until around November when she can actually come to the US however. Anyway, keep us posted on your progress!

Unfortunately for us it took the full 6 months, actually almost close to 7.

Got the interview e mail today.
August 22nd. 12 weeks after applying for the interview date.
well.... we waited so long, we'll wait 8 more weeks


Congrats. We just submitted our packet 3 materials today to the Embassy. Hope our wait isn't that long.

When you sent in your materials for packet 3 to the embassy, did you receive any sort of notification that they had received it?

My fiance recently received packet 3 from the US embassy in Bangkok. Just to confirm, is she supposed to use DS-156K (which says it has expired already), or DS-160? Thanks in advance.

The sooner your fiancée and you gather the required documents, the sooner her interview. You can read Packet 3 on the embassy's website fora complete list of documents she will need to gather and/or fill out.

On average visa in hand takes about 2-4 months from now depending on how quickly you send in the paperwork as well as how busy the embassy is.


Thanks. I found that list of documents on their website and have been reviewing it carefully. I will be sending my own I-134 and financial documents to her very shortly so she can prep too. I hope this process gets done sooner rather than later!

My fiance has been to the US before on a tourist visa to visit me and my parents, and she really enjoyed it. Still, the transition will be a big challenge. Having spent a few years living in Thailand myself, I know how hard it can be to adjust to a completely new environment. At times fun, but at times definitely challenging.

In general it is extremely difficult for a "normal" Thai citizen to obtain a B2 tourist visa to enter the US. In most cases you are reading here the Thai national has never left Thailand and met the US citizen petitioner in Thailand.


Well I am asking for my specific case and she has a tourist visa valid for 10 years. We did a lot of preparation, but it wasn't too bad to get a tourist visa. I think the Thai just have to take the process very seriously, have ALL their stuff in order, and show good proof that they will be returning home (a.k.a. full time job with a big company).

So...
After reading about these medical / police report / etc questions...
Was this stuff already completed for the USA tourist visa? Can she reuse those same reports?

if you decide to get married in thailand the spousal visa is the cr-1/ir-1. which could take 9-12 months or so the difference is your wife would receive her permanent resident card on arrival. the k-1 is not likely to be completed in 5-6months more like 6-9 but check against timelines for thailand and you get more information.


After doing some reading, it seems like the CR-1/IR-1 route is better.
--cheaper. less flights back and forth. Process itself is cheaper.
--quicker for her to get a job, since the residency is immediate. No sitting at home for 4 months.
--Would allow us to get married in Thailand first. I think her family would like that.

The only downside I see is longer time to wait to live together.
K-1. Apply for K-1 immediately, wait 7 months, move to USA, can't work, wait a few months, residency. (7months + 4months)
CR-1. Plan wedding, fly to Thailand, get married. Apply for CR-1. Wait 9 months, move to USA, residency. (2months + 9months)

What do you guys think? If I'm planning (well, hoping) to be married in Thailand and the USA, is it wise to go the K-1 route or CR-1/IR-1?

as for getting married if you get married in thailand, and plan to get married here, you must be careful. married is married. if you register your marriage at the local amphur you will not need to get married in the u.s. if you decide to do the k-1 and just have the ceremony but not register at the amphur you will be fine. check with some of the other members but i think you need to be careful of the photos (secondary evidence)not indicating marriage at the k-1 interview.

Hello. I'm a new member here and I have a question.

This whole K-1 process takes like 5-6 months. During that time I'm thinking to get married to her in Thailand. After she is approved for her visa to the US, then we would get married in the US. There are no children or other family.

Does this mean I should be filing for a K-3 or a K-1?

She can visit on the VWP, but must leave before her time expires...(she will have to do her interview in Ireland)

The decision is up to you on how fast you want to apply...a K-1 you can apply now. The CR-1 you will have to make another trip to get married and then apply. The CR-1 visa is the best one out there...she will get a greencard and SSN...she can work right away. The K-1 she will have to adjust status (another $1010) and wait to be able to work.


No plans for her to work after we get married so that's not an issue, but after all the travel the cost works out about the same. so which ever way, I can do the paper work and gets her here to stay the quickest is the way I guess we should go. but for my own reasons,i wanted to get married there.

I have looked at the IR-1/CR-1 visa.but would she be able to travel over on the VW during the wait the separate time is what worries me

Separation from family may be longer than if filing for a K-3 Visa (or K-1 visa for a non-married fiance).

Hello all
Very happy to have found this site and reading about what others are experiencing. I expect to spend a lot of time on these Boards in the coming months.I've learn a great Deal already and want to thank everyone for sharing there story's.
I found my soul mate last July while attending my Nephews wedding in France. She is an Irish citizen and I was born and raised in the USA. I'm also first generation Irish, which also makes me entitled to Irish citizenship.
We need to start making a decision on how and when to get married, But time and money as with most things in life is a big concern. I need to decide which route to take soon the K1 or K3. hire a lawyer or can I do this myself ??? she has traveled over several times on 90 day wavier and I have gone over to Ireland. but we recently applied for a six month visa. which was denied at the Embassy. they told her she only planed to travel over and get married. No we are trying to make plans to get married In Ireland or the US. But now we only wish to expedite things so we can be together
I have booked a fight for her soon planing to use the 90 day waiver. But I'm very Nervous that they will not allow her to travel over on the 90 wavier because of the denied 6 month visa. she has been home since mid Jan and will return in early April. any thoughts or advice is greatly appreciated.

My Fiancee was vaccinated when she was a child early 60s , but has no records or proof and has been told there is noway to get the records. she has visible marks on her arm from the Vaccination, will she have to get all the vaccinations again or is there another way to prove she has had the vaccinations ??? The date stamped of the final divorce is what you use. If it is Feb 14 then use that date.


We don't have the final decree yet and now he's arguing/filing about the way the judge worded he's order. But it was said to be final, with no further appeal possible on that date. the only thing I'm worried about is if the date doesn't. match up later, because of the constant delays.. we don't want to have to wait to file I-129-F any longer. we may have the correct date before our target date April 17 to file. But the divorce is final. just the actual date for paper work may change.

Hello all
and thank you in advance, finding this web-site has given me the courage to try and run the Visa gauntlet without legal help.. that and the fact, I can't really afford a lawyer.. Our Target date for filing form I-129F is April 17. My better half arrives here for a visit soon VWP and we just wish to make sure, what she must bring for the initial filing.

Her divorce was final February 14 Valentines day sweet ;-) and this was in the high court cant go any higher But he still is trying to drag it on. Now the Judges wording is being appealed,because it cost him more $$$ this has gone on for years over 10.. so we don't have the final date of the divorce yet. but the judge told her in court this was it Over and done..

1).can we just use Feb 14 and correct it later if it changes it surely will be over before we get threw this long process


2). I only need to file a copy of my Birth cert or passport ? I plan to send both But copy's good ??? plus More

3). Does she need to bring any originals for initial filing or Just bring all originals to interview

She can travel on the VWP as long as she likes, if she is denied, she can never use the VWP again. Typically, although it is a case by case basis, the CBP like to see more time OUT of the US than in Good luck


We've used the VWP several times since we met and always obeyed the letter of the law. but they sure make it hard to do it legally.

1. as long as they admit her, there is no fraud. However, you cannot step out of the US and then restart with 90 days on the VWP. They will either deny her entry or limit her stay in the US She can leave the country however, there is not guarentee that she'll be readmitted or for how long Good luck

the 90 day VWP is for total time in the USA correct ?? and your allowed two a year 180 days.. if she then goes home for a month will they allow her to come again or is it a case by case at the POE. how long must she return home ???

the better half will soon be here under the VWP for 88 days and we plan to file our K1 I-129-F the week she gets here.
I was thinking of using my Vacation time to take a bike ride around the great lakes with her. which would take us into Canada for a week or more. will this be a problem or can I use it to my advantage in anyway ??
1). if shes out of the USA can we restart her 90 days so we can be together longer or would they consider this fraud.
2). do I need to stop and make sure they stamp her passport. when going out and back in ??
3). anything I'm over looking ? not worth taking the chance leaving the country??

Since then has not had so much as a parking ticket, and for the last 20 years he has been a Christian Minister.Now i have to decide whether or not i should wait to see if he is possibly granted a waiver so he can attend his son's wedding, meaning i have to obviously add an unknown amount of months onto how long i have to wait to see my fiancee again. Or if i should just go ahead with the wedding, knowing my dad will not be able to be there with me.I have been apart from my fiancee for a long time now (and you guys here are the only people who know how agonising it feels), and im feeling really angry that he didnt look into this back 8 months ago



Not easy choice but, your Fiancee comes first. that's who you will spend the rest of your life with your dads an adult. he will understand or should. move forward just my opinion

Despite what they say, they base it off of what they used to do, with Texas just initially processing them now so it's less work on them at VSC or CSC. Before they changed the policy last June/July, depending on where you lived, you sent your packet directly to either CSC or VSC.

Yes she can fill it in.

If you make more than the required guideline amount it will not make any difference. If you do not attach bank statements or a bank letter to support it, it will not make any difference. They do not care about "penmanship" they care about documentation.

Personally, I have $347,000,000 in the bank. What? You don't believe me? :P

After all, you're mailing it to that address, not the address in California or Vermont.
