I am so worried about filing for Citizenship and i want to do it while my I-751 is pending. But i am getting ready to send my N-400 in November 11,2013 but am little worried since i got trips outside of US and one of them i stayed outside for about 207 days but i am still living to my US citizen, happily married and have a Daughter together. I am planing too get an other trip in August and i will be outside of US for 4 month's and 23 days and my total days outside of US would be 422 days outside of US. I don't know if i should hire a Lawyer or if i would have enough evidence to provide to USCIS as proof that i still tight my continuous resident in US. The reason why i spent those days outside of US is that i enroll to medical school in Dominican Republic and me and my wife still paying for my schooling and i don"t know if USCIS will understand that. I have a pending I-751 . I need lots of advice from you guy's !!

Just received my packet I-751 back from USCIS California, because i submitted it with insufficient funds and they asked me to resubmit the form with correct amount fees, so i will just print an other form I-751 out then change the date and have my wife and me sign it then send it tomorrow to Department of Homeland security

I will send it early tomorrow morning and i hope that it will get there on monday morning ( January 21, 2013 ).
I am so mad for that mistake and i will resubmit it with exactly the same evidence then everything will be all right . Thanks everyone for viewing my post and i hope that you will make more than double look on your packet every time you will send something to any of the USCIS facilities..

From what I've read there's no way to predict when you'll get it back. I'd estimate in 2-3 weeks. They usually look over the main application (the I-751 form) not long after the receipt of the packet. So they'll notice the check amount is wrong and bump it back, it should happen right away.

At this point you have no other choice but to wait. Patiently. Nothing else you can do at the moment.

Thank you very much Captain, for your help. They received my packet , January 14, 2013. So Captain, do you know when i can expected to received the packet back since i have sent insufficient funds to USCIS ?
Do you think i can receive it this month? some people told me that it can takes me more than 15 weeks to receive the packet back. Please, if you have any idea about that, i will be very happy to hear it.

Ok, thanks i got it. I just wondered that i have a problem with my I-751, USCIS in California received my packet since January 14 at 10 AM and just ten minutes ago i was looking to see if the cashier's cheek is cash and the lady at the bank told me no. I took a look on a copy of check the i realized that my wife sent $490 to USCIS perhaps $590. So i am in a big trouble, i don't know what to do, if i should call USCIS or if i should wait to hear from USCIS till they make a decision.

please, i need some advice about what to do. the problem is that my wife sent $ 490 to USCIS for the form I-751

Your post makes me think you misunderstood your lawyer. If your I-751 is still pending when your N-400 window OPENS, which is November 2013, you can still file N-400. You don't need to wait for your I-751 to be approved/finished.

Your 6 months out of the US has disrupted your continuous residence and that means there is more paperwork that you need to file to prove you didn't break your continuous residence so they process your N-400. If they don't approve your reasons you won't be able to be approved (and will need to re-file later).

Qn - you have a lawyer so why are you asking here? Don't you trust them?




Well, i trust the lawyer's but i don't have one that's why i am asking for help on visa journey. Well, i don't think 6 months outside of US will disrupt my continuous residence, wile my wife and my baby girl still live here in US and i am with them every time comeback to US and now i am here till my windows open in November 2013. Hopefully i will meet the continuous resident like the lawyer said

Thank you guy's for your answers ! Yes, i do had a reentry permit but i wasn't stay staying outside of US for a year in any of the 3 trips i made outside of US. First trip, i stayed only for 97 days and the second trip i stayed only for 4 days outside of US.
Only one of them, i stayed for 6 months and 25 days is my third trip outside of US. But i don't think the reentry permit could help me qualify to fill for citizenship, i am planning to stay inside US till November 11, 2013 to see if am qualify to fill for N-400 .

I did talk to a Lawyer and she told me if my I-751 is pending and i could submit the N-400 and now i would like to know if i should wait for the earliest date to fill for N-4000? my earliest date would be November 11, 2013.
I want to make it clear for you guy's, before i made my firs trips outside of US, i came in US February 9, 2011 and i spent 325 days in US and now i would like to know if these days are disrupt by my 3 trips outside of US or for the days i have been staying out of US ?

I will appreciate all your every answer while i am working on my timeline !!

I am so frustrated because spent too many days outside of US. i am currently enroll to Med school in Dominican Republic and and i married a US citizen at birth. i got my conditional green card in February 09, 2011.

I have travelled outside US, 3 times since i got my conditional residence.

January 15, 2012 i traveled to Dominican Republic for 97 days


May 23, 2012 i traveled to Dominican Republic for 4 days


May 30, 2012 i traveled to Dominican Republic for 207 days

and now i am in US and i just submitted the form I-751 to remove the condition on my status and now i would like to know when i will have to fill the N-400 if i wont have any problem with USCIS because i spent too many days outside US ?
An i am thinking to submit the form N-400 for naturalization while the form I-751 is pending, i need some advices about what to do. Me and my wife are still living together and we have a baby girl and she is 14 months old.
I will appreciate all of your every comments guy's .

Question about being out of the US. Probably 4 times a year we travel to see my family in Canada. These trips last no longer then 4 days. When they look at how long you've been in the US do they look at the continuous amount of months spent in the US or do they look for total time in the US. On one hand I think we're fine on the other I'm not sure especially if it's 'continuous' months spent.



You are good with your case, when your early date come to submit N-400, just submit it and you will be a USC >> good luck

Well, i believe i could make it happen since i could get a letter from the Medical school i enroll overseas and the hospital i was doing rotation for the six months i spent outside of USA. In November 2013 i will have 20 months of living inside of USA, i will do all my best to bring proof with me for my interview and i will submit copies of them with my N-400 too, and i hope the IO will be nice. I file my taxes with my wife, we have cars on our name, we pay rent together and we both spending money for my medical school overseas and i believe the IO will consider my case.

you broke your continuous residence because you left the states more than 6 months, I don't think you can file as before, except if you can proof to the io that you had to stay out for all that long for because of aa health condition or you have school overseas



Well, the reason i broke it is hat i i am enrolling to Medical School overseas ( Dominican Republic ) and i am planning to get a later from my school to send with my N-400. So, i don't know if it is a good idea but i will do it.
I believe i will have enough proof and evidence to send to USCIS and bring to my interview to show the IO the reason i stayed that long outside of USA.

Hey, guy's i just wanted to start a new thread base on 3 years marriage to a US citizen . On this thread we will talk about N-400 only, so i will have to submit my N-400 in November 2013 and i want all the filers N-400 for November 2013, to join me on this forum to discuss every single thing, so i want us to be succeed with the N-400.
I already made 3 trips outside of US and in September i will do my fourth trip outside of US but on of trip lasted 6 month's and 23 days, so i am so afraid of that but i will do all my best to provide USCIS with many evidence i can to get my N-400 approve .

I am worried about the 208 days spent outside but like i said i will try all my best to provide USCIS with enough evidence, since i am still married and have a Daughter with my wife and still live together and we file our taxes together and i think i will have a chance. I planning for an other trip in September and i will spend 114 days outside of USA.
I was thinking about hiring an immigration lawyer but since you don't have any criminal history it is not important , it is wasting money if any of you hire a lawyer and you don't have any criminal history. So i am sill waiting for all of your advices and i think we could make impossible things happening at USCIS.

Sill stuck in Initial review, no email, no text but i just received a yellow letter on mail and they ask me to provide evidence indicating i did not abandon my residence , terminate my employment in the united states or abandon my U.S abode. School records outside of U.S, credit card and loan statements, proof of income or mean of support, rent/ mortgage statements and utility bills, car registration and insurance and a letter of explanation.

Too many evidences to provide , so i don't know what to do guy's any advise would be appreciated!!

Way too slow guy's i really can't wait to receive a yellow letter or place in line for interview. My priority date is july 2, 2014 but looks like my field office , salt lake city Utah is over loaded or maybe the phoenix lockbox but i have talked to a Tier officer 2 a d she told me that she recommend that i should receive a preliminary interview letter by mail sometimes this week , so i am impatient now !!!

I made a walk in in July 15 but the office were too busy and the Security have them change my appointment from July 25 to July 21, so i went yesterday and i got my FP  taken less than 10 mms, and i already downloaded the 99 US citizen test question to my iPhone and i am half way ready for my interview test !!

Second Stage

I went to school outside of U.S and one of my trip i stayed outside about 6 months and i made 5 trips.
Yes, i file jointly taxes and i already submitted official transcripts with my application, anyway i will start working in the evidences today and see what i can do, hopefully they won't deny my case ..

Sill stuck in Initial review, no email, no text but i just received a yellow letter on mail and they ask me to provide evidence indicating i did not abandon my residence , terminate my employment in the united states or abandon my U.S abode. School records outside of U.S, credit card and loan statements, proof of income or mean of support, rent/ mortgage statements and utility bills, car registration and insurance and a letter of explanation.

Too many evidences to provide , so i don't know what to do guy's any advise would be appreciated!!
