Waivers (I-601 and I-212) and Administrative Processes (221g)mandatory administrative processing?
OMG my husband's middle name is also Mohammed. Tuesday makes 13 weeks since our interview... 91 days tomorrow.
If all this is based on PART of a person's name... it is soooo unfair!

I have emailed the embassy, called DOS, and had my congressman and senator inquire. Still nothing. The embassy told the senator's office 5 months or less. But they also told us 3 months average in an email earlier this month.
Of course, DOS tells me the embassy controls AP, and the embassy says the exact opposite... it's all up to DOS.
This is the most frustrating thing I have ever been through!

HI everyone,

New to this forum, desperate times call for desperate measures!!

I am a UK citizen, born and brought up in the UK and married to a US citizen.

I think I trump everyone here by saying that I have been in AP for 7 months!! Yes thats right, 7 months!

My lawyer says that it is due to me having "Mohammad" in my name (i dont even use my middle name).

The funny thing is that I am actully in the US visiting for Thanksgiving and heading back home soon after!

I have contacted the Congressman, call the DoS on a daily basis and was wondering if anyone else has done anything else different?

Any help is appreciated
Thanks!

Were you able to get a visitor visa while on AP? I wondered about trying that for my husband to come see me for Christmas.

Congratulations....! so happy for you

Do you have US embassy contact #? Did they call you or email when they issue visa? It's 10th week for us...still nothing..! Thinking to visit embassy..! so upset!

79 days here and nothing.
We can't get a person at the Jordan embassy and they won't reply to my emails. I have been calling DOS once a week.

There is so much about AP that makes me crazy. But this one really gets me... NO ONE knows what's going on!
If I email the embassy, they say it's in the hands of DOS.
If I call DOS, they say the embassy controls it.

Does anyone in the immigration department know where our case is or who is working on it? :bonk:

I never head of contacting the govorner. I contacted my congresen and she is nice and is trying to help but the embasy is not responding. She say "they may say is under AP" and I said that's what there telling me she said if it is ap there's nothing anyone can do cuz it may be the name or something and they can do as many checks as they want and she's seen people who tool serveal years I was like omg that does not make me feel any better and she said she is just trying to be honest. So idk is any of your guys husband names Islamic name?

Mohsin's middle name is Mohammed. That could keep us in AP forever! :bonk:
But I actually know a guy whose name was the same as a suspected terrorist (his wife googled it) and he had less than 2 months AP last year. God only knows what they do with these things!
I want to go visit again, but I don't know when to plan. Right now we think if it's still in AP in Feb I will go back if I get a tax refund.

Hello everyone,

I just wanted to see if I could get some advice here. My fiance and I have been in AR for 78 days now. I know this is not too long, comparativly. Im just wondering is there anyone other then our congressmen that we can get involved at this point to hurry things along. My congressmen has been really good about emailing them, and asking for a status, but she says there is not much more that she can do. Is there anyone else that can help us?

Thanks for any advice

Danni

My husband's interview was just a week after yours in Jordan. I was there and the interview was awful... separated us and interviewed us and all and we are in AP now too.
I can't get any help! My senator's office emailed the embassy and they told him 5 months or less.
I know it's not much help for you, but just know you aren't alone!

Awhhh cool ! I guess that's about 100 miles west of me,I'm in Mitchell. Famous Corn Palace !! lol Well ... Sorry to say it's not only Pakistan that it's hard to get though, it's most of the mena countries. Did you find out anything from DOS ? Only thing they'll ever tell me, is case still pending AP?

I haven't visited SD yet, but my sister lived in Mitchell when they first moved there and she still goes there a lot. Small world LOL!

I didn't call DOS. But yesterday we finally got into the system to check for updates. IDK maybe Ramadan slowed things down here or something. The last person I know of who got AP here was a friend of mine I met here on VJ. Theirs only lasted 50 some days. Praying ours goes that quick!

Good luck !

I am sorry you are going thru this. From what I have read, Pakistan must be really hard to get thru.

I really hope the AP is fast. We sat at USCIS for 5 months while most went thru in 3 months. The only RFE we got was because I did not send the original marriage contract to NVC.
Then after the CO interviewed us, we faced separate interviews from DOS and homeland security. It was terrible! The 2nd CO took all Moh's brothers and sisters names and told us it was going back to Washington DC for AP. He said most AP was taking 4-6 weeks but I don't know if I put much faith in that. He told us our papers were perfect and no one ever asked to see any of the 30 pounds of evidence of our relationship I brought with me. They never even asked for extra pictures and I had a scrapbook prepared just for this!

Add us to the list... mandatory administrative processing at our interview yesterday.
We were told it was being sent to Washington DC. I think this means background checks... am I right?
The CO said our paperwork was perfect... which I guess is a good thing!
And I am trying to be strong, but it will be very hard to fly hime without my husband in a couple weeks.
I feel emotionally and mentally drained.

Age difference goes the other way... I am the female USC.
I am 14 years older than my now-husband.
When we attempted a K1 in Jordan in Sept 09, the CO actually told him I was told for him... even asked him what he paid me to bring him to the US. Sent everything back to DOS for further review. (I made the mistake of not being at the interview).
On Oct 6, 2009, we married in Jordan and are now attempting a CR1. Pray for us!

I have posted in several forums and no answer.
So I will ask here...
Anyone know about how many interviews are held each month?

NVC told my congressman's rep they had 166 cases waiting for Jordan.
Would these all be CR1s or all types?

Feeling lost and confused!

K-3 Spouse Visa Process & Proceduresfiling for I130
After having our I129 returned to uscis at the interview, I am now preparing to fly to Jordan to marry my fiance and I have lots of questions.

1.Do I need to cancel the I129 or let it expire (Sept 22)?

2. Can he apply for a visitor visa to come here while we wait once we are married? I know its hard with the K1. But what about with this?

3. I am also undecided on the CR1 or K3. Do I file the I130 regardless of which visa we actually choose?

4. We can decide CR1 or K3 after uscis approves the I130?

I feel so lost. This is the last thing we expected... especially on the grounds of lack of proof of a relationship. And thats amazing to me when he had copies of over 6000 text messages from me from the last year, phone calls every day (and I don't mean 2 minute calls), chats, emails, everything.
After looking at our pics, the CO decided I was too old for him and NEVER looked at any proof of our relationship.
So we want to marry as we had planned... only now in Jordan not the US. And I need good advice.
Thank you VJ friends.

I have decided to abandon my K1 and fly to Jordan to marry my fiance at the end of the month. Marriage was our plan any way. It doesn't matter where. We don't want a big wedding and will marry ASAP (within 2-3 days of my arrival). I plan to stay 6-8 weeks, but I don't want to lose all that time in the processing of the I130.
However the mail system from Jordan has been very unreliable and some things he has sent to me have been lost... making me afraid of mailing the papers from there.
Is it possible to DHL or FedEx the I130 since it goes to a PO box?
Thanks again for all the help!

No, they do not deliver to P.O. Boxes. there is a actual physical address to send the I-130 to Chicago USCIS Its on the instruction sheet of the I-130 for overnight deliveries

Any U.S. resident petitioner submitting a completed I-130 by courier/express delivery, should use the following address:
USCIS Lockbox
Attn: SAI-130
131 South Dearborn – 3rd Floor
Chicago, IL 60603-5517

This is all you need!!!!!!!! Best wishes and congrats on the future marriage!!

Thank you so much!
I don't want to lose another day!

Ally Hon, don't worry. I don't think they are refering to you. They are talking about just in general how there is fraud and how sometimes one person will use another person to get what he/she wants, and pretend to love them.
You and Moh love each other, and that is what counts. Now please get off of VJ before you drive yourself insane and go enjoy your husband. rose.gif biggrin.gif

Wish he wasn't at work... that's when this thing gets me!! LOL
And sorry to be so defensive. It's just after that interview, I feel like all I have done is try to PROVE everything!
And the saddest thing is... we really don't have a clear answer as to why we were denied! headbonk.gif

I totally understand and would feel the same way if I were in your shoes! And I can only imagine how frustrating that is. Personally I have a theory after seeing your story, and researching others...I THINK that it is very difficult for the male beneficiary to be approved in Jordan for the fiancé visa if the fiancée is not present at the interview. Just my own theory and maybe I am wrong. But after knowing you and Moh and seeing your denial one month ahead of my own habibi’s interview, I knew that I HAD to be at that interview with him no matter what.

It may sound a little crazy... but at least we still got married WHEN we wanted to, even if it wasn't WHERE we planned. I try to look at the good things in this. It's what I have to do!

I hope this is not a suggestion that my husband does not love me. I have been married and been in relationships before, so I know what it feels like to be played. Let me assure everyone here that he does love me. Just read what my friend posted who flew here with me. She has seen us together.
It may be easy to lie to someone online, but living together proves things. I am in a country where I do not even speak the language. I am completely dependent on him for everything, and he has been wonderful. Not to mention the fact that I live with a chronic illness known as lupus and he has been willing to accept anything that may come up that, also. I am not going into detail, but it is not always easy. He is more of a man than any I have known before, and he is NOT here just for a free pass to the US!
And the way we went about our marriage, and not telling his family now, was partly for our own personal reasons... We wanted this time all to ourselves, and his family will know before I leave. But for now, we just want to enjoy being alone.

This whole process has been so emotionally draining that I really don't see how a couple who DOES NOT love each other can go thru it. It's an emotional roller coaster, and without his love and support, there are days that I would not have made it thru.
Staying here with him is wonderful, but I have children and work in the US, so that is where we really want to be.
I know the road ahead of us is long and hard and having to feel like we need to constantly prove our relationship is really getting old. But we keep saving every phone record, email, card, etc, because we know it is the only way. And honestly from some of the things I have seen on here, I think we spend more time together than most couples when we are living apart. It all just seems like a bad dream sometimes. But then I see this wonderful man I married and I know we will keep pushing on!

Maybe I have not given enough information here. I am living in Jordan now with my husband. It is true that his family does not know about our marriage. Part of that was OUR CHOICE. We wanted this 6 weeks alone... as a sort of honeymoon period. We did not want to visit family every day and that sort of thing. We were not sure how his family would react, so rather than make things harder, we just kept this private. Not to mention the fact that we are newlyweds and need this time to get to know each other.
It's not that his family knows nothing about me and our relationship. They see him online and on the phone with me when he visits their homes... so I am not someone he has been hiding for over a year. And his mother was there when he went for the medical exam for the first interview!
I met his family my first trip. We had no privacy. And honestly... I don't know why we didn't take any pictures with them that trip. At that point I had not researched all this visa processing and did not realize how important some stupid photos would be. And I really did not know if I would stay in Jordan or if he would try to move to the US. It wasn't a great trip, but some things went very well, especially with the sister of his I stayed with.
I see now that we made some mistakes. There is no way to undo what has been done. We are working very hard to get thru this I130 and K3 now. I sent all the paperwork back to the states yesterday. We are planning to visit his family before I leave. But now we just need our time alone. I wish someone could understand that. And please understand too that this is NOT fraud. We are very happy together. We have been for more than a year now and our love for each other has only gotten stronger as we have been living together.

I called uscis about filing the I130 after the fiance petition. All they requested was a letter stating that I was withdrawing the fiance visa petition. I sent this to them. I have included a copy of it with the new I130 petition and we hope to send it all back to the US today via DHL... if the English translation of the marriage certificate is ready!

As for pics with his family, we are still hoping that happens before I leave. But honestly if they try to turn us down because we have none, I think I will argue all day with them. This relationship is about the 2 of us, not his family or mine... and really that should be all that matters.

The times for the interviews are under embassy info.
Yes American citizens are allowed at the interview. Someone I met here and just flew to Jordan with attended her fiance's interview today. They received AP for a background check. Seems Jordan is hard on K1s.
Good luck and I pray you do not get the woman who interviewed my fiance. She was very opinionated and unfair.
And by the way, I am with Mohsin now in Jordan for 6 weeks and we married 2 days ago! You will need to send a copy of all the major requirements with the I129F. If you check the instruction for filing I-129F there a section that tell you what to send if you are using it as a K3 application. I am sure you know that you do not require to make another payment your fee will be waived. For me, i sent the major documents but left out the additional evidence that I had mailed with my I-130 - like pictures, e-mails, travel docs, bank accounts, e.t.c. I hope this helps.

Plus, i felt the need to file K3 also just to get him here without any further delay, but with the look of the processing time right now K3 may not be the best option. I just hope for both approval at the same time or my I-130 that way I can get the best deal. Goodluck buddy, you will back when everything is ready - "maybe together"

We definitely are going K3. Time is most important to us right now after being turned down at our K1 interview earlier this month. We don't care about having to wait for a work permit and all that later. Just want to be together ASAP and K3 seems faster, especially in Jordan.

Right now, it says it takes 41 days for him to get a K3 interview in Jordan, and 199 days for a CR1. Thats a HUGE difference! K3 is the route for us!

I am flying to Jordan next week to marry and will send all my papers back to the uscis while I am stying there for a couple of months. So I need to be sure I take everything with me.
I was just going over the K3 checklist. My mom will check my mail and fax my NOA1 to me if I get it so can file the I129 right away if the I130 is received while I am away.

My question is... Do I need to resubmit the proof of our relationship with the I129? It is not on the checklist. But I do not want to leave anything out.

US Embassy and Consulate DiscussionCan I count this as income?
I am hoping to receive my approval soon and I am looking over the I134. I know that I will need a joint sponsor (I just started working in November 2008) and I have a joint sponsor. But I need to know if my income from SS disability can be counted as part of my income. It is the only income that I have had for the last 12 years and I continue to receive it, and will get it for the next couple of years. My joint sponsor is a retired teacher, so the income is more than enough there, but I would like for my income to be as good as it possibly can be.

OP, did you specifically ask about when petitioning for K visa with the I-134? The I-864 which you will need at AOS has provisions for co/joint sponsors. Typically I-134 is a single person.

Yes. I said specifically K1 visa and I134. I asked "Can I have 2 joint/co sponsors for a K1 visa?"
The response was "You may use more than one sponsor."
I also explained that I had divorced late in 2008 and had then returned to work in November, so I now had the needed income, but my history did not look good because my only previous years income was from SS disability.

Just to be safe on all this, I went ahead and contacted my embassy. They will allow more than one joint/co sponsor. So I may just go that route if I need to. This may also help others out there wondering about more than one joint/co sponsor. Contact your embassy to be sure about it. You never know until you ask! good.gif

US Embassy and Consulate DiscussionUsing Joint Sponsor
How do I calculate household size when using a friend as a joint sponsor? Does the income from all sources combine to form as one lump sum and then one household size or how do i do this with the I134? My sponsor has a wife and 2 kids and then there is myself and my fiance. Of course we don't live together. But do I add all the income for myself and the sponsor (his wife does not work) and count it as a household of 6? I hope I am making this clear. I think we are going to be very close to the guidelines and I want to be sure, as I don't want to list his assets if I don't HAVE to.
I just went back to work in November after I got divorced, so my fiance and I will be ok now, but my history looks bad. And my friend really wants to help, but I am trying to keep him from revealing too much information, only the tax transcripts if possible.
Thanks for any advice!

Additional processing has nothing to do with your evidence darling. (there is a 221g that you can receive for further evidence of a relationship **the evidence you have will prevent that**)

It has to do with background checks for name matches.... You just have to wait on them to clear your SO's identity

It can happen after an interview or at any stage of the process.

This stuff just really confuses me.
I thought his name was clear when it left uscis with an approval. I guess with all this even a college education does no good! headbonk.gif

background check is done throughout the process until you have the VISA in your hands..

YES you 100% right but You always have to think positive good.gif

Thinking positive. Praying a lot.
And really praying no one else shares his name... especially if they have a bad record! smile.gif

AP could still be possible after you passed the interview...

We are thinking positive. We have lots of evidence... stacks of phone bills and online conversations, emails, etc... of our continued relationship.
And after months of agonizing about the sponsor, all that worked out, too. Not only do I have 2 jobs now that puts us above the guidelines for this year, but I also have a joint sponsor who is well above the guidelines... just in case.
So we are praying there is no AP.
I never realized it could happen at this point.

US Embassy and Consulate Discussionupcoming interview
My fiance's interview date has finally been set for Sept 1 in Amman, Jordan. I thought the waiting was about to be over, then someone suggested something to me.
Could the embassy still put us in AP after the interview because we are processing a K1 visa?
I am new at all this and had no idea this could happen.
Please advise me!
