K-1 Fiance(e) Visa Process & ProceduresCan someone explain this please?

Check out this link for some comprehensive info about 'touches'.
http://www.visajourn...p?showtopic=300

A touch means that your case has been handled in some way, if only to be moved from one corner of an adjudicator's desk to another.

Your estimate of adjudication is a calculated date which is an *** estimate *** based on exisiting timelines averages. It's the date when you can expect an yes/no about your visa approval.

Jen

Yes/No on your PETITION approval - not your visa. The petition simply allows you the privilege of interviewing for a visa at your consulate.

(I know that was a typo JenT!)

Oh, of course... thanks for catching that Kit!!

neither of us meets the financial criteria required for sponsorship; neither of us qualify for either US or UK sponsorship.

She has already indicated that sponsorship to the U.K. is also not possible.

I saw that comment but wasn't sure whether that was what she was referring to. If that's true, then improving their income situation is the only option, I'm afraid.

K-1 Fiance(e) Visa Process & ProceduresWhat if we can't meet financial requirements?
The financial restrictions exist for valid reasons... if you cannot improve your income level and do not have a co-sponsor, you will not qualify. Your only other option would be to move to the UK.

I agree. Don't see any reason why you couldn't file now, based on what you have listed. If anything, it'll help the time pass quicker since you'll be together and NOT checking the post box every day....

BUT, if you get an RFE, you'll want to be able to address that ASAP. Your online status will not tell you what the RFE is for, specifically... only that they are asking for additional information. Doubtful that you'd receive an RFE in a month's time, but who knows....

Welcome to VJ and best wishes on your journey!

If you do not feel confident about your ability to understand and correctly organize the paperwork or you believe your case is more complicated than normal, you should certainly start by having a consultation with a qualified immigration attorney.

K-1 Fiance(e) Visa Process & ProceduresLost in the Maze, please give me ideas.
A medical reason for not traveling is not considered 'extreme hardship' as far as I know, which is what you would have to prove to circumvent the "must have met in person" rule.

You'll have to find a way to meet her in person before you can file, unless you can prove extreme hardship. I don't know of any cases here at VJ where an extreme hardship claim was successful.

I asked her to marry me and we started the K1 process. So far, we are at the point of her going to get a visitors visa and being denied because she has a fiancee in America.

What's her original country? Where is she engaged to this other guy? Is she going to end things off with him?

Why does she have two men!!

so confused.

Oh for crying out loud. Re-read the original post.

She doesn't have an A# yet, so don't worry about it. You don't need a copy of her bc, or the letter she has written. You need proof that you have met in person which it sounds like you will have.

Here's a copy of the (edited) cover letter I sent with my packet which you can use to help yourself gather the info you need:

You were lucky you had a friendly counselor officer. In most countries that would not fly. Counselor officers in the higher immigration fraud countries look for things like that to deny visas. So don't try that in China, or the Philippines.

If your fiancee was approved and has visa they you have nothing to worry about.

Agree... perfect example of how officer's opinions differ, even in the sme Consulate. It sounds as though you have nothing to worry about. Congratulations!!

QUOTE (moxcamel @ Nov 5 2007, 08:09 AM) <{POST_SNAPBACK}>
I'm not sure where the impression that engagement rings are necessary keeps arising. There is no formal requirement for it, and in fact many cultures (such as FSU countries) usually don't even have engagement rings, although this is changing in the bigger cities as western cultures gain more influence. While a CO might express curiosity or interest, it would (IMO) be an abuse of authority to read anything into the lack of a ring. And since anyone can just throw a rock on their finger, I highly doubt it strengthens the impression of an ongoing relationship either.

A little off topic.

As a beautiful woman working as a waitress, my wife was getting hit on quite a bit because she didn't wear her rings to work. She didn't want them getting dirty or lost. It became such a bother for her, I suggested we buy a cheap ring for her to wear to work. Even the smallest cubic zirkonium looks like about a full carat, so now her customers think she's married to a real moneybags. The Chinese don't really wear rings either.

The ring is quite attractive. I think we paid about $6 for it.

What a great idea!

She doesn't need to prove that she's not going to marry you. She has to prove strong ties to Canada such that they do not believe her to be an immigration risk. There have been so many posts, ad nauseum, about this subject. Do some searching....

If your friend is arranging for your fiancee' to come to the USA and does not know what to do then I would advise to find someone else to make these arrangements

K-1 Fiance(e) Visa Process & ProceduresCanadian wants to stay in America - urgent
QUOTE (cartoboy123 @ Nov 26 2007, 07:29 AM) <{POST_SNAPBACK}>
If you're a Canadian citizen you don't need a visa to enter the USA, nor remain for the 6 months. Just use your Canadian passport. Remember, you're going to be asked questions as to who you're going to be visiting etc. and you'll want to have ties to Canada (in writing) to prove you intend to return. You might have trouble with that if you're giving up your residency, and maybe won't have a lease agreement? If you're going down for six months, maybe you're not working right now? You're going to need some type of documentation, if you're asked, to prove that you intend to return.

Another concern, perhaps depending on the province, is your health coverage for yourself. Are you covered for the full 6 months? You might want to look at additional health coverage for your stay.

Like everyone else has said here, don't stay past your six months. I see that you've mentioned you'll go back to New Brunswick to await the rest of the journey. You'll be going through the Montreal Consulate at that point. You won't be able to return to the USA until you have your Visa by then as you'll have been in the US too long by then to return until it's finished.

Best of luck on your journey!

Sorry Mods, but I'm with Becc on this one. I advocate diplomacy as much as the next person (well, ok, there are not many 'next people' on VJ) but there are a couple of members who continually jump on their holier than thou soapboxes with misinformation and accusations.... I don't see them being reprimanded and it's getting really, really old.

We are, for the most part, a blunt bunch here on VJ....

Becca ~ I can't say it any better than what LaL did, so I'l just say "what she said" in answer to your question to me. wink.gif

JenT ~ As I've said a million times, mods don't police the board. We respond to PMs telling us where the problem is and then we act. If you think people are getting away with things then report to us the post where the problem is and we can act. Don't assume we have seen it.

The problem here is that if everyone jumps in and fights fire with fire then we find it harder to actually take action. There is no one person responsible any more and we just tend to lock the thread in question. If you want us to act against the continual misrepresentation of information by certain members, and/or any attitude you may see that is out of line, by NOT responding yourself it makes it easier for us to reprimand where it really is needed.

So Mags, when one clicks on the "report this member" its not brought to your attention? We need to actively send you a PM? I just want clarification.

Yup, you don't even have to type anything, just C&P the link to the post and we'll have a look. I always send a response PM too, so you'll know I received it.

I thought the "Report this Post" only got sent to Ewok.

K-1 Fiance(e) Visa Process & Proceduresphone call and touched

I called USCIS and then checked the status on-line and it shows the case has been touched. Does it mean someone worked on my case or because of the phone call to USCIS? Any ideas? Thanks!

Did you call and talk to someone only at at the USCIS number? Or did you use the RFE trick to contact the CSC directly? If you called only the USCIS that should not result in a touch. But if you contacted the CSC by route of the RFE options then that will normally result in a phone call based touch. Otherwise if you only called and talked to just a USCIS agent then it is most likely a legitimate touch.
