K-1 Fiance(e) Visa Process & ProceduresTime from being assigned to an adjucator to NOA2
QUOTE (kokosunny @ Apr 7 2008, 07:16 PM) <{POST_SNAPBACK}>
NOA1 sent date November 10. I called on March 13 and was told our file was with an adjudicator since March 11 and action is usually within 10 days. I called about April 1 and the agent didn't go beyond his basic computer screen. I called again on April 7 and after hanging up on an agent who was adamant about RFE and who I was actually tempted to ask if she was a voice prompt answering machine, I reached a nice man and was told the file was in the file room and hadn't been to an adjudicator yet. He said he would walk over and get the file out. This stimulated a touch - the first in almost 4 months. Other phone calls did not stimulate a touch. Do you only get a touch when the A file moves? Now what?????????

I will not wait so long in the future. If there is no action after the average 135 days, call often to make sure you get some action. The file has probably been misplaced.

Ok how the heck do you get through to a real person? All I keep getting is options for automated responses!!! I figure wouldn't hurt to call now hahaha....

K-1 Fiance(e) Visa Process & ProceduresTime from being assigned to an adjucator to NOA2
QUOTE (Eli the Barrowboy @ Apr 7 2008, 11:24 AM) <{POST_SNAPBACK}>
Hi there,

We were assigned an officer on February 20th. We got a NOA2 on March 17th. The person who has yours may be full-time, part-time or have 50 other applications that aren't registered with Visa Journey.

I think it's almost harder once you know it's on someone's desk but once you get the NOA2 - which won't be long now - you'll feel a lot more relaxed.

Personally, I don't believe the "RFE trick" works to do anything other than reassure you that your petition isn't lost and I have yet to be convincd otherwise. But that's just me.

R

Ok but how do you "know" you were assigned to an officer? Will it state this or just when you receive NOA1 you can assume you were assigned to someone? And what is this "trick" whether it works or not I may give it a whirl once some other Jan people start getting approvals haha!

QUOTE (azezohome @ Apr 7 2008, 01:43 AM) <{POST_SNAPBACK}>
Hi, in our case it was assigned on January 22, 2008 and got approved on February 06, 2008 but i think it really depends on the person reviewing your file. If the person is fast you might get it in a week or so. And since your case has been assigned more than ten days ago i think you might here something this week. Goodluck and god bless.

Do you mind me asking what the "RFE trick" means.....I thought we don't really want to get RFE's? Also how do you know when you are assigned to a particular adjuicater? I thought once you get NOA1 that means you have been assigned etc...
Thanks!

K-1 Fiance(e) Visa Process & ProceduresK1 visa process taking longer than expected
Sorry to say you are still inside the "normal window" of USCIS processing times. Have you filled out a timeline on here? If so that will show you an estimated "adjuicated date" and that is giving you when your window time will be up...it is only after that date you can call and find out exactly what is going on....I mean you can call now of course but they are just going to tell you basically the same thing (that you are in still the normal processing times window).

I have a Sept 27th wedding planned and dunno if I am even going to actually get that date at this point! Good luck!!!!

K-1 Fiance(e) Visa Process & ProceduresAll this talk about being denied at POE...
My fiance' was denied in Detroit after flying from London! He was entering on a 6 month visa though since my divorce was not final yet so we could not apply for K1 yet....well they didn't trust him to return back to England so they didn't let him in! He lost all his money just got a flight to Detroit and back to London basically for 600 quid!!!! UGHHHH Now he is terrified he will get denied at POE on the K1 but told him that would be really slim (hopefully!) since now they know we have for sure done correct procedure for us to get married etc....

In the timeline on here where it says RFE reply is this where I put the date that WE replied to the RFE or the date we hear back once they received it and have resumed processing? K-1 Fiance(e) Visa Process & ProceduresCan I / Should I put more than one consulate?
My fiancee is a Filipina, living in Japan. Her daughter, who we also want to bring, lives in the Philippines. I am currently completing the I-129F forms, and I have 2 questions about which embassy.
1) Being from the Philippines, but living in Japan, can she go to a consulate or embassy in Japan (Osaka is closest)?
2) Her daughter can not come to Japan for the interview, so for her daughter would I somehow need to mark that she would require interview (if required) in Manilla?

I believe it will be faster for my fiancee in Japan, but if she / we need to go to Manilla, that is possible also. I do have the form marked that she resides in Japan and her daughters address as in the Philippines, but I dont know if that is enough. Suggestions?

Hi All,

You guys are getting me nervous with your comments about the Affidavit of Support. I plan on having it notarized tomorrow. Quick question - on the affidavit of support, question 11 - do I check intend or do not intend specific contributions to support the person named in item 3?? Or N/A Fiance Visa.

Thanks!

This question has been asked 1000000000000000000000000000 times, if you search for it you'll find some other threads with answers as well. smile.gif

I asked on anther site just a couple weeks ago and the answer I got was "I-129f petitions).

Line 11 - you might put something along the lines of "fiancee/child will
cohabitate with petitioner as normal family members after U.S. arrival and
marriage, fiancee/child will be provided with driver training and/or
necessary transportation, bank account funded with a balance of $xxx.xx
dollars to provide daily funds for any personal needs either indefinitely or
after USCIS-approved employment results in substantial ability to
financially assist in the support of family finance"

The main reason for line 11 is if the affidavit is submitted by someone
other than you but you should still describe what your support will involve
and the above is a guideline you might go by."

Hope that helps.

If you are sending by Priority or First Class with delivery confirmation, it can definitely be sent to a PO Box - I speak as a seasoned eBay seller who sends everything that way and has never had anything returned by the USPS. I have never sent anything by USPS Express Mail, but I don't think there would be any problem with that as well. Delivery Confirmation does not mean that someone has to sign for it, only that the mail carrier scans the barcode on the label before delivering the package.

Yes, the USPS (The US Postal Service) delivers to PO Boxes. I suggest Priority Mail with delivery confirmation.

FED EX WILL deliver to a box you just have to sign a "waiver' on the way-bill to allow them to leave it at the box

K-1 Fiance(e) Visa Process & ProceduresDoes USCIS have heart about the process? quicker process technique.
QUOTE (j_hunt_12 @ Jan 13 2008, 12:10 PM) <{POST_SNAPBACK}>
I know the processing times are very random most of the time BUT.....

Looking over the forum on visajourney it seems like those who send in a LOT of materials and have a more "normal story" have better processing times. I saw one couple that had a 2 month time period before the interview, but they entered a lot of materials including engagment party pictures. Does anyone else see a correlation between number of pic and materials and process times? It seems like maybe if the couples' story is fairly normal, they were together a fair amount of time, and they sent in a lot of pictures and materials they do better off. Does this seem true to anyone else? It seems like those who do worse don't sent much information.

I know everyone at USCIS is heartless but maybe not completely; I can see where the heart might come in to play if they see a really "cute" couple that made a very good effort to send a lot a materials, including personal stuff etc..

Thanks...

at the risk of sounding slightly arrogant, we appear to be one of those 'warm fuzzy' "real couples' and we are still trapped in the Chicago lock box collecting dust... www.myspace.com/williamandekaterina judge for yourself.

I just checked http://www.uscis.gov...0004718190aRCRD

crying.gif And it is really a bad new that average processing times for certain application types may grow longer. In particular, naturalization applications filed after June 1, 2007 may take approximately 16-18 months to process.

helpsmilie.gif Now I want to ask how long an I-129F will really take? USCIS received my paperwork of I-129F and some other files and noticed it in September 2007.

That comment ont the website says "naturalization" will be delayed. Naturalization pertains to green cards and citizenship not I-130's and I129f's

So you were last touched on the 7th of Feb.
That means that someone scanned your file. They did something to it, looked at it, moved it, filed it somewhere, etc.

Every time that date changes, you have been "touched"
Based on your time line, your approval could be coming soon!!! smile.gif

I have a question along these lines. If you call does it create a touch? i called on the 7th also to get my wife's case number after only receiving my step son's NOA, and now it shows an "update" on the 7th.

Yes, I've seen many people call and they were touched, because simply, the adjudicator got the information for you that you requested smile.gif

QUOTE (babblesgirl @ Feb 10 2008, 02:16 PM) <{POST_SNAPBACK}>
We sent our petition on July 27th and did not receive an NOA1 until September 27th. However, USCIS did acknowledge that we sent the application in earlier.

There are two dates on the NOA1; 'notice date' which acknowledges when USCIS processed the receipt and 'received date' which acknowledges actual receipt of your petition into their mailroom.

USCIS state they adjudicate petitions in order of 'received date' (although you should allow for some deviation on this - they cannot process them perfectly in order) so if yours says January and not November then you need to have some harsh words with your lawyer. I doubt you will be able to change the date to November though.

Luckily, you are with VSC and so your application will probably get adjudicated within 3 months of the NOA1 received date. CSC are currently processing around the six month mark.

Hang in there. We're all used to waiting sad.gif It's not ideal but definitely worth it in the long run. Good luck!

Happened to our K-3 also. received in mail room November 12, Received NOA February 7 dated the 4th. and they claim it was received December 23. Who knows? at that point was just THANKFUL to get the notice!!
but still feel a little robbed of time.

In 2005 I traveled to the US I am a UK citizen, I stayed in New York with family for three months and then moved to Florida.I extended my visa and was staying with family again. My fiance and I met in March 2006 and were in sepreble from then on.I lived with my cousin but stayed with my fiance more often then not.He even put me on the lease to the apartment as it was a gated community to be honest we rarely spent a night apart ,but I kept my place with my cousin and always extended my visas from his address. I have always had my own income as I rented my house in London. In march 2008 my latest extention was denied and stupidly I left returning to England, truly unaware that I had just deported my self. When I tried to return to the states in April I was denied entry based on that I was not eligible for the VWP.I then returned to London and made an appointment with the US embassy, the earliest appointment was July 9th where they refused my application due to not being in my own country long enough but did not excude me from re-applying.We are now about to send in the K1 visa as all we want to be is together we have phone records, pictures, lease from the apartment, records of my extentions. I suppose what I am asking do we tick the right boxes,I am so nervous that we will never be together again. Please give some advise

Hi, Being denied for a tourist visa does not prohibit you from receiving a 'k" visa. we were denied a tourist visa May 2007 and we have our interview July 17th. we had to mark the box "yes" that said have you ever been denied a visa previously. Also it was explained to me by my attorney that the people that deal with tourist visas are much different than the consular officers that handle "k" visas. they are more educated and have not been told necessarily that "everyone intends to illegally emigrate"

my point is they are 2 different creatures, tourist visa versus K visa. stop stressing you will go bald or Grey!!! trust me on the grey part.

you need to get a message archive decoder to print the conversations, the print function will only print 1 page, with the decoder it will print it all...I have days with over 20 pages of chat and that is not including when we just talk VOIP. I haven't figured how to print the VOIP record but with over 1000 pages of chat I'm not too worried.

K-1 Fiance(e) Visa Process & ProceduresAirport Fees?
When I came back I am glad I kept an extra 1000 pesos. I did have to pay I think 750 pesos before checking in on an international flight. I think what the ticket people are referring to is that all taxes and fees are paid for the *ticket* airport fees are above and beyond! Best thing to make sure is have your SO call the airport to find out the actual fees so she isnt stuck in cyberspace, that would not be a good day for anyone.

Good luck and congratulations!

I bought the one-way ticket for her online and she needs to get the e-tickets from the airport when she goes there. So, she has to pay an extra P1,620.00 at the airport? I just don't understand why.

From my understanding, the K-1 process considers extreme circumstances regarding having met. And in my opinion, your circumstance is not extreme. Your explanation here seems very legit.

Just to clarify, have you two gotten to know each other through communication (phone calls and chats)? Because you said you haven't met but have gotten to know each other.

Anyway, welcome to VJ... I'm sure you will be able to find some great words of advice around here. Good luck! good.gif
