If you enter with intention of not leaving, you are committing fraud. Do you think we would all just be waiting for the process, apart, if it were legal to fraudulantly use a tourist visa for a purpose other than a round trip?

D&N, your little crusade is becoming increasingly annoying.

Do us all a favor and shut the hell up.

It shows she is a trustworthy person , she could've stayed there and live a lie just for the visa and that's is ,but she came home that's great I hope too they see that at the interview.

For the record, one event like this does not indicate trustworthiness... she would have had to have cared for a quadriplegic for at least 2 years until she was able to remove conditions, remove herself from the situation and divorce. That's a lot to have deal with, even IF she did have the green card as her objective. The OP has indicated that he has reason to trust her beyond this situation which is what is most important. No one here can make judgments on her character.

K-1 Fiance(e) Visa Process & ProceduresK-1 and returned home
Wow.... what a story.

The usual cases on VJ have been that the petitioner has petitioned for more than one visa and many of them have been approved.

You can expect that it will be a question she'll have to answer satisfactorily at her interview, so the most you can do at this point is be prepared for it. How well it goes will depend on her answer and the mood of that particular examiner that day. Ignore the judgmental comments in this thread and hope for the best.

K-1 Fiance(e) Visa Process & Proceduresquestion about my situation, please help
QUOTE (Michaela_Hassan @ Nov 27 2007, 02:26 PM) <{POST_SNAPBACK}>
For your fiance not to be granted a visitors visa is pretty normal. He's an unemployed turkish male. I think the K1 is a good option for you. But you have to intend to marry him here within 90-days or he has to go back to Turkey. His income won't matter much to the consulate on the K-1, he doesn't have to prove ties to Turkey anymore, because he's intending to marry you within 90 days and remain in the US and you and your father have agreed to sponsor him.
What you will have to prove at the interview is the validity of your relationship. If he gets denied this time, it will be a long process, he can't just get another interview at will. The petition will be returned to the US and eventually expire, or it will be reviewed by the service center...depending where you file. So make sure, that you have everything in order when you do file for your K1. If I were you I would make some sort of wedding plans once he arrives, just so you can answer any questions they might have about your upcomming wedding, the plans don't have to be set in stone, really that's impossible anyway waiting for a visa and not knowing when it will be granted, but plan on marrying in the US and make sure that's what you both want. If you want to marry in Turkey, I would suggest your parents fly out to meet him there, then marry and file for K3/CR1.

Michaela

Nope. You'll have to apply for Advance Parole if you want to travel out of the country before the green card arrives.

Revised to say: You can travel, but your husband will not be admitted to the US without a green card or advance parole document.

Was wondering the same thing....

Because there had already been one RFE and the adjudicator doesn't have to send another one if the first was answered unsatsifactorily.

I'm sure this has been addressed at some point in VJ history, but I can't find it.

My fiancee and I have run into some issues we need to resolve before the wedding. We filed the I-129F back at the end of August, and having seen how slowly things were going, I figured we'd have all the time in the world to try and work things out. Now that a few July approvals are trickling in, I'm starting to wonder; I think it's best to wait until next summer to marry, assuming we can find a good way to work these problems out. I realize that would likely be the case anyway, but I don't want to be making these decisions at the last minute with all paperwork already in place. I know that cancelling an I-129F and then trying to file for a waiver and re-file sounds like a major headache.

I realize there are other steps involved after VSC approves the I-129F, but we would really rather just put the whole thing on hold for a few months. Is there any way to do this? Or are we stuck deciding between "cancel and possibly refile" and "full speed ahead"?

If we do cancel and re-file, does that hurt our chances of approval? Is the waiver petition generally successful in such cases? Nothing about our file is otherwise problematic AFAIK, but this throws a real monkey wrench into things. Ugh! sad.gif

Thanks in advance...

The foreign fiance has six months to use the visa, after issue and then 90 days to marry the petitioner once they enter the US. That will get you to summer. You can also simply delay sending back the P3 documents to delay the interview. Even then, you can simply request a later interview. No reason is needed.

I would recommend these delaying tactics instead of a potential refile and waiver process. Also, never indicate to USCIS or the Consulate that you're having second thoughts. That will hurt your evidence of a bona fide ongoing relationship and actual intent to marry.

good.gif That's what I'd suggest too....

K-1 Fiance(e) Visa Process & ProceduresAge difference a problem?

I agree with gugu. Wait until she's 18. Then, marry and apply for K3. You'll go back to the States and get established with a job and domicile. She'll wait in Thailand. The wait for K3 may be comparable to K1.

It's not a question of age difference. It's a question of you being engaged to a child. Even if you wait until she'll 18, you'll still raise eyebrows and may have a hard time gathering proof of a legitimate relationship. Have you asked this question of others going through Thailand?

She IS a child.

To apply for a K1 fiance visa, you will have had to prove that you have met in person within the last 2 years.

A K3 visa is for a spouse, so obviously, you are going to have to meet to be married.

You'll have to find a way to meet, or else keep your online relationship the way it is.

Definitely consider the timing of your expected employment before you even apply for an EAD. We did, and it was a waste of money since David received his green card long before he got a job....
OP is entering the country on a K-1 so should file for EAD with AOS not before filing AOS, filing for EAD with or after filing for AOS costs nothing when based on the pending I-485.

K-1 EAD by itself is a waste of $340, That type of EAD is a 90 day EAD that expires 90 days after entry on the K-1, and can take up to 90 days to get.

That's right... I'd forgotten that the rules changed/fees increased after we filed.... sorry to have mislead....

In order to file for the K1 visa your fiancé would need to be a US citizen - which you say he is not; he is only a green card holder.

Ooh, that completely bypassed me then. Do you know what my options are, as he only has a green card?

Thanks

There are none. You can only be petitioned for by the USC you are intending to marry. Sorry. You'll have to wait for him to receive his citizenship if you want to live in the US.

May I just ask you all: NOW WHAT? What can I expect to happen and when? Will my fiancee receive notification? When? How many things will I receive by mail before her interview? If someone can give me a timeline of what happens now, it would put both our minds at more ease. Thanks for everyone's great advice and support!

I've read all the recent posts and I saw something about the NSC not doing the hunny-bunnies anymore. Is that true? And should I still send my petition to Nebraska or would it go directly to California. Or do you know????

If Nebraska is where the instructions say you should mail your form to, then so do. They will forward your petition to California, or Vermont, but more likely California. Nebraska is no longer directly processing K1s.

My name is Steph and I am a 29 year old divorced mom of one crazy 5 year old. I have a Psych degree and work as a Habilitation Trainer for special needs adults.

I met my man through our tattoist while I lived in England for 3 years. Fell in love got engaged end of story wink.gif Well not really but here we wait for the good ole visa journey!

He attempted to come here in Dec and since he had gotten the 6 month visa and had goodbye cards from co-workers he made it all the way to Detroit only to be detained and sent back to the UK! They thought we were going to get married on his 6 month visa sooooo here we are still apart........SIGH.

As you can see by my siggy we applied for the I129F in January and he already sits waiting in the UK with his police record just waiting to make his biometrics appt! I check USCIS daily to see the dang "Approved" come up.............

Forgot to say I am the US citizen he is UK citizen and we are planning for hopefully fingers crossed a Sept 27th, 2008 wedding!

it means everything and nothing

Touches mean nothing. Some people get touches soon after receiving NOA1 (I did), some do not. Some people get a touch right before approval, some do not. (I did not.) Some people get a touch mid-way through the process, others never get a single touch and then an RFE shows up in the mail. For all practical purposes, touches are random bits of useless information. Don't put any faith into them, and certainly don't worry over them when they either come or don't come. The only time you can ever say that a touch meant something is after the fact, and by then it's useless information.

So my case has been pending for about 2.5 months and I am getting a little anxious that there has been apparently no action on it whatsoever. I was just wondering, do they alway record "touches" everytime the look at it and have that change of status available on the USCIS website, or is it possible that one day I check and it is just approved with no "Touches" recorded.

We got our NAO1 on January 16, I am planning on going down to Brazil to visit my fiance over the 4th of July and I would love it if she could come back up with me, but I am starting to think that is not going to happen. Oh if I could have only filed in Vermont!!!! crying.gif

NOA1 sent date November 10. I called on March 13 and was told our file was with an adjudicator since March 11 and action is usually within 10 days. I called about April 1 and the agent didn't go beyond his basic computer screen. I called again on April 7 and after hanging up on an agent who was adamant about RFE and who I was actually tempted to ask if she was a voice prompt answering machine, I reached a nice man and was told the file was in the file room and hadn't been to an adjudicator yet. He said he would walk over and get the file out. This stimulated a touch - the first in almost 4 months. Other phone calls did not stimulate a touch. Do you only get a touch when the A file moves? Now what?????????

I will not wait so long in the future. If there is no action after the average 135 days, call often to make sure you get some action. The file has probably been misplaced.

Ok how the heck do you get through to a real person? All I keep getting is options for automated responses!!! I figure wouldn't hurt to call now hahaha....
