I called NVC today to ask about this. They said our daughter needs to be at the interview also, so now I need to try to get her a visa for Japan. But in the mean time, since this will be a rush and there are other complications that require this to be expedited, can you help me out with P3 and P4? what is this? What is required of them? I have the birth Cert (no father named, so shouldnt be a question of custody), what else do we need for the children?

Thanks, that helps a little. My Fiancee lives in Japan, her daughter in the Philippines currently. She has been working in Japan to support her daughter. Anyway, my fiancee's interview will be in Tokyo, but her daughter doesnt have a visa for Japan, so any suggestions on how to get her daughter an interview in Manilla?

One more thing, since the approval is derivative of the parent, does that mean Visa photos and G-325A is required or not?

the point is, the US government considers EVERYONE that will come is coming for the purpose of being an immigrant. Therefore, a nonimmigrant visa (visitor) is difficult to get, especially for a single girl from a poor country. They must convince a consular officer they will leave the country - good reason is not convincing, you must show a job, significant assets, a business, etc something that would force her to leave. If they have just met on-line and she is coming to marry him, probably she has NO way of proving this.

First, I think your in the wrong forum, this is for K3 and you are asking about K1 process.

Second, it seems you may already know the answer. K1 requires you to have met in person in the last 2 years. It is a requirement, and you must provide evidence when you submit or it will be rejected. If you do submit and plan on meeting before approval, you will get a RFE (Request For Evidence), which delays the process and would likely be rejected because at the time of submission you had not met. Which means you would need to re-file.

But probably the best advice I could give you is: Go meet her in person before you decide to get married.

She just needed to show the letter that came from Embassy, then they agree. I takes about a week or so to get, maybe 3 if your not in the country. I think you can get from Japan embassy. I have read on some sites that include packet 3 as part of the process and some that just mention packet 4...Sorry if some these questions are elementry, but this is my first time for both of us... also i was reading the guides section of VJ and it says I will need to dend in 4 copies of each of the G-325 form...is this correct.

Yes, 4 copies of G-325 for each of you. When you open the form, it is already 4 pages. when you fill it in, it fills in all four pages for you. you only need to print once as all 4 pages will print, but one page is for USCIS, maybe one for NVC, one for embassy, something like that.
Packet 3 or not is dependent on the embassy. each one is diffent, but mostly the process is the same, just the steps they take to get there are different.
Embassy we are using is in Japan, so it is different than Manila.

I dont know if you would really call it packet 3 or not, but I got a packet from USEM in Tokyo with forms and request for some original documents. We just used the coverletter that came with that packet and it was enough for Japan Police.

Hello-
First- Welcome to VJ. You will find a wealth of information and support here.

Second- One of the 1st things you will learn is to take one step at a time. Your first goal is to do some reading.
At the top of the website there is a link called "GUIDES". Click on this and you will find information for k-1 visas.
There are also "timeline" links up there too.

Third- Be prepared- there is a lot to get together to submit. It took me a couple of months to get it all together- and that was WITH help of a lawyer!

Fourth- Be patient and remember step #2.

I know it can work. My friend did this. She did not meet her fiance' in person until he came over here after they went through this whole process. He has his interview last December, and was here a few days later.

Many reasons keep people from meeting each other. It states in the documents what you can do if meeting is not feasible, so please look! I know this because at one point I questioned all of this myself. It all depends on the situation. Really.

Besides the religious reasons, there may be financial concerns as well. I believe my friend was a combination of both of these. Seriously, some people cannot afford a $3000 airfare ticket plus travel expenses. I was very fortunate that I was able to piece together enough money to visit my fiance', but that is not to say the trip was not wraught with worry-about the religious piece. (another story; another time!)

My advice- Read ALL the documents. There are options for you.

You're not the only one who has seen the EFT section of the instructions, PirateStar. New or not, it's definitely there. I was just about to pull it and copy it here when you did.

I think your idea of starting with the bank, to see who authorized the EFT, is the most expedient way to go. Certainly easier than trying to deal with USCIS. And if the bank says "the dept. of homeland security authorized the EFT" than you have proof that they SOMEWHERE have your app.

Thanks much for taking the time to write me a detailed answer. I certainly understand the system better now. I hope I am not overburdening you, but your reply brought up 2 or 3 more questions. I understand that you will be busy today dealing with immigration, so don't feel rushed to answer. I suppose that I should write you again in July to see how things went after your son's arrival to make sure that there were no snafus that you didn't expect. I will be seeing my fiance again later in July, so that may be the time to have her sign documents and start the K-1 process, so we will need then to make the final decision on whether to apply for her K-1 with the son as "to follow", or whether to bring him with her at the start.
Anyway, here are my questions:
1) What will be in your oldest son's passport that will allow him to enter the USA, and how did he get this in his passport?
2) What is infopass?
3) Do I have any control over when the AOS interview will be? In other words, if the son comes with mom, but then leaves on Advanced Parole to attend the university at the end of August, can I plan for the AOS interview to be during his New Years break from college or might he need to return in the middle of a semester simply to go to the interview because we have no control over the scheduling of the AOS interview?

Thanks so much for responding. Our situations are extremely similar, as my fiance is Ukrainian but lives in Russia (St. Petersburg), so her son may also be going to the university in Russia. I want to be sure that I understand everything correctly, as what you wrote sounds too good to be true. If I understand you correctly, we have 2 choices:

1) He comes with the mother, but since the AOS takes too long, he can get advanced parole in order to return for the start of the university. My question here is whether her son must return to the USA when the mother has her interview for the AOS? If no, can it hurt his mother's chances for AOS if the son spent so little time in the USA and plans to go to the university in Russia/Ukraine. If the son arrived with mother, will he automatically get AOS if the mother gets it, regardless of whether he is currently in the USA?

2) He can come within 12 months of the K-1. This is 12 months from issuance of the K-1 or 12 months from her US entry? If I understand you correctly, your oldest son has never been in the USA, but simply needs to come here for 2-3 weeks to get his AOS because his mother already has it? He needs no interview and it doesn't matter that he just arrived and will be leaving soon?

Additional questions:
1) How long is the conditional green card good for, and will the son have difficulty getting a permanent green card if the has not been living in the USA?
2) Can my fiance choose where she is interviewed (Kiev or St. Petersburg)?
3) What is the age limit for a K-2, and does the age restriction apply at the time the K-2 is filed for, or is it an issue if he reaches the age limit between the time of filing and the time of approval?

Regarding posting my timeline, I have not done anything yet as the timing of when I get the K-1 may be important given the son's situation. I want to understand everything first and then I can decide when is the best time to receive the K-1 and apply accordingly. But certainly I will post my timeline when it begins.

The plan is for him to go to college in Ukraine, but certainly my fiance would like him to be able to come to the USA to visit, and possibly keep the option open for him to live here. What are the requirements for him being physically in the USA in order to get a conditional green card and green card?
Additional questions:
1) Must the child arrive with the mother when she comes on the K-1, and if not, when must he arrive?

For forms you need the I-129F and G-325a for BOTH petitioner and benneficiary. You need more than just the forms though in your submission packet.


proof of marriage termination is required (divorce, anullment, death certificate). All documents submitted to the USCIS that are NOT in English needs to be accompanied by an ENGLISH translation.

Kiev will deal with the financial stuff come interview time.

Sorry for such basic questions, but I am new to this website and I will soon be meeting with my fiance for a week and I would like to start the fiance visa process. I want to make sure I bring all the necessary forms for her to sign to start the process while we are together. I understand that there is an I-129F form. Is this the only thing that I would need her to sign? Is form G-325 (Biographical Date) also filed with the I-129F? Is a signature necessary on this form? Are there any other forms she must sign to apply for the fiance visa? I understand that I must include her photo with my application? What are the requirements for the type of photo and number of copies? Lastly, will I be filing all of my documentation regarding proof of a relationship (photos, airline tickets, etc . . .) with the I-129F?

Hi. I am just starting out. My fiance is a widow, and from the guidelines I see that she must supply with me with a copy of the death certificate of her husband for the K-1 application. Must this copy, or copies of any documents, be notarized? I also had the 4-sheet form with carbon copys for my G-325a. I'm assuming you requested it from USCIS? That's completely acceptable. The four separate signatures are for people who printed it from online.

Yes, I received my forms in the mail from USCIS. Your answer seems the most logical to me as the USCIS website says my version is the most current and why would they put 3 carbons in the form if carbon copies of the signature were not allowed. However, the statement of others that an original signature is required on each copy has me a little nervous. Thanks for all the responses.

1) I see in the guide that they request 4 signed copies of the G-325A. I have a 4 sheet form with carbon paper, so 3 of the copies only have a carbon copy of my fiance's signature. Is that adequate?

2) I was born in the USA. Question number 10 is confusing on the I-129F. It seems to be asking for my birth certifcate number, date and place of birth, and later on for a certificate number for somebody not born in the USA. But in looking at the sample on this website, I see that they say that I should "complete only for naturalization certificate" this first box where it appears I should put in my birth certificate information. Does this mean that I should put N/A in this box? I also don't understand this box marked "parents".

I was reading the consulate website where my fiancee will go for her interview, and they talk about a slew of vaccinations that may be necessary. Will they do these at the exam, or must she get these before the exam. The list seems too long to reasonably do them all prior, but they don't mention doing vaccinations at the exam.

Upon reading the Kiev Consulate website, they discuss the need for vaccinations and have a long list of vaccinations that may be required. Will they do the necessary ones at her medical exam prior to the interview? They don't list vaccinations as something that is done at the medical exam. What if she shows up with no medical records for vaccinations? I can't believe that she would need to have all these vaccinations prior to the interview as the list is quite lengthy and I am sure that some are unnecessary. For those who have been through the interview, what was required regarding vaccinations?

1. No. The appointmetn will be made with the call center. Kiev consulate will send and you MIGHT receive a letter called "packet 4". You do not need it. If it never arrives...no problem

2. K-1 fiancee is non-immigrant. Kiev uses DS-156 and DS-156K for fiancee visas. They use DS-157 for males over age 16 ONLY, not for anyone else. They do not use DS-230. Various consulates use various forms, but Kiev uses only those TWO for a female K-1 applicant.

Even though the K-1 is non-immigrant, Kiev handles them through the immigrant visa section, which is good news for you and you will see why. The immigrant section has 6 or so applicants everyday vs. the 300 or so for non-immigrant section.

So I can just ignore where it says on the Kiev website that I need an appointment letter? It is interesting that my fiancee is considered a non-immigrant though she is seeking become an immigrant. It says, on the Kiev website, that non-immigrant visas are for tourists, students and for work so your answer clears up the apparent conflicting information.

My fiance has a February 5th Moscow interview. From reading the Moscow Embassy website, your fiance needs to go the DHL office in Moscow (8 Marta Street) before her interview and pay for her visa delivery and get the "airway bill" from DHL to take to her interview. The website indicates they will send the visa anywhere in Russia, so your fiance will not need to stay in Moscow or have the visa sent to the sister's residence. In fact, they don't want you returning to the embassy to receive your visa. All visas are delivered through DHL.

Regarding vaccinations, it is my understanding that your fiance does not need any vaccinations for the interview or medical exam. Vaccinations are only required when you apply for your fiance's green card once in the USA.

Well, we can all agree that this is tragic when it happens. And we can only speculate here, and in truth we have no idea what was in the head of his fiancee. When they met, she didn't even have a grandson, and very likely her daughter was not even married, so there may not have even been a son-in-law and baby that needed supporting. Her circumstances changed. But it was certainly generous of the poster to air his unhappy story so that others can learn. An overseas relationship is certain a minefield with potential pitfalls, and I am a big advocate for discussing these issues early in a relationship. In my case, our relationship was about 11 months old when I filed the I0129f, but we discussed the possibility of her coming to the USA at about the 5 month mark. I didn't want to continue this relationship and become further attached to my fiancee if there was going to be some impediment that would ultimately doom our relationship. So I was very clear that this discussion we had did not mean that we were necessarily going to get married, but it was simply about being clear that that neither of us expected something that would be a dealbreaker and that doomed our relationship from the potential of a successful result. She was very understanding that this relationship required a lot of travel and expense and time for me, and that it is only normal that I would want to be sure that there was at least the possibility of a happy ending. It may not be an easy thing to bring up earlier in the relationship, but I think it is mandatory.

I don't think that we, who are unfamiliar with their relationship, can say that it was a scam. Waiting 3 years to pull off a scam does not seem reasonable to me. A scammer would have given up long ago and looked for another man. We don't know how well they knew each other and how much time they spent together and whether she was receiving financial support from him prior to this. And we don't know if his ex-fiancee is currently the sole supporter of these people, which would make her request not so unreasonable and not at all unexpected. Certainly this should have been discussed before filing the I-129f. My fiancee is a widow and has a son about to enter the university and a daughter currently in the university. We discussed this and have a complete understanding of what support I will provide. In fact, and this may not be very romantic, but I had us each make a list of what we expect from each other and what questions we had for each other regarding our living situation, and my questions included whether she planned or wanted to work in the USA, financial support for her children, whether her son would want to get a green card, how often she wanted to travel back to Russia after we marry, and how much time she expected to spend in Russia each year, etc . . . .. . It was very useful and we are clear on everything.
