K-1 Fiance(e) Visa Process & ProceduresHi Everyone! New to this whole procedure and a bit nervous
So, after getting all my stuff finished, I'm just waiting for the papers from the guy. Anyways, I was trying to get example forms for him to look at when his packet comes after this is all finished. Wanted to see if anyone whose done it before, are they the forms underneath the Example forms for K-1 starting at the support form I have to fill out(I-134) and going down from there? and then of course including the ongoing relationship and anything else they might ask for? Just curious cause I was trying to get it altogether and save it so I could send it to him when he needed it. thanks!

Yikes, just realized that those forms expired, well some did in 2009 and here in 2010. Do the forms drastically change? or where can I get updated examples for them?

K-1 Fiance(e) Visa Process & ProceduresHi Everyone! New to this whole procedure and a bit nervous

Hi Kristen.

Not wanting to be a wet blanket here.

What I'd like to see you and Dan talk about is where IN THE LONG RUN it would be best for the two of you to live your lives.

US/UK couples are lucky because it's relatively easy to get a marriage visa for either country (compared to others).

I read your comment above about Dan wanting to live here in the US because it's "cheaper". :innocent: Now as I said I don't want to be a wet blanket, but I've been traveling back and forth across the pond for many years. Been married to a Brit for ages also. I can tell you for a fact that most people living in Great Britain feel the way Dan does and I've never quite figured out why. Housing is cheaper in the US, yes that's true. But we build 'em cheap over here out of lumber with asphalt roofs. A brick and morter house with a tile roof in the UK lasts forever. As far as everyday necessities go like groceries and clothing, things are the same. Petrol is cheaper here, but we use more of it and drive further to get everywhere, so it comes out in the wash. New cars are a bit more expensive over there, but used cars are far cheaper than a used car here. Not to mention the fact you can effectively live WITHOUT a car over there. Health care. How much does THAT cost in the US compared to the UK?

Talk about these things. They'll matter as your life goes on. Talk about where the cultural activities are you both love. Talk about where your children will get a better education. Talk about HOW you want to live.

Life on either side of the pond can be good.

Hi! I really appreciated your response and you're right, we do need to talk about this even more. You're not being a wet blanket at all, I like to hear what other people have to say, especially those who have been through the process. Yeah, he thinks that here we can get more for our money, like a house being the most important thing and then including other necessities that we'd need. I love it here, I admit that, but I love it there too. I can see what you mean though, the only thing thats really messing with my choice, is jobs. I know that the job market is hard here (michigan) and that's what worries me, because I want to get a different job after I get my bachelors degree, and I'm unsure of how Daniel looking for a job is going to go. Very true about the better education as well, it's a lot to think about for the future. However I'm not sure exactly how the education system there is, but I loved where I went to school here, plus we could move to a place with better education. I appreciate everything you've made me think about :) Anything else would be greatly appreciated!

K-1 Fiance(e) Visa Process & ProceduresHi Everyone! New to this whole procedure and a bit nervous

Well it may be tough, and it may be tough for a while. If waiting on all this is the right move, then you do that. But I'm in your shoes; I'm struggling and only just getting to the point that I qualify financially to sponsor Mr. Owl for the adjustment of status--the green card part that will allow him to work and help out. It's totally rough, but poor people make it work too.

You are very welcome and I'm pleased that it's helping. You get a grateful rush after you succeed and you end up wanting to help other people going through it.

Yeah I figured it would be tough though to be honest. I know that just doing what I do now is not going to be able to support us in the long run, and that he definitely would need to have a job, hopefully soon if possible when he does get here. *sigh* I just feel bad because now he's got a promotion at work and it's just really hard. Just a huge decision, that's for sure. I'd be worried about having to get a job over there as well though, cause I know it took a really long time for him to get the job he has now ! I have a feeling he and I have a lot of talking to do!!!!

I can't even imagine the rush! I was so excited that he and I started discussing this :) It's definitely helping :)

K-1 Fiance(e) Visa Process & ProceduresHi Everyone! New to this whole procedure and a bit nervous

Okay. So go ahead and start gathering your documents. Call the IRS and order tax transcripts from the last 3 years or however many years are available for the past three.

Yes, you'll send him the completed sponsorship packets to take to his interview. It's there they'll be appraised. They are pretty much the crucial portion that will decide your visa at London consulate.

And so you'll need a joint sponsor. I understand hating to ask, believe me. The great thing is that the I-134 is a nonbinding document, that doesn't put your parents or whomever you ask at any risk. It only concerns the potential of beneficiaries receiving government benefits, and it expires after 90 days of entry--90 days during which the beneficiary is not eligible for benefits anyway.

That is the short explanation of why the document you'll ask your parents to sign is not a big deal. But you must ask them.

Thank you very much :) I really appreciate all of your help during this process, I'm just getting nervous now. I've been reading threads about jobs and living here I know how hard it is to find a job. Even my job is part-time, and while trying ot finish school I'm unsure of being able to find a job once I'm done with it. And with him, he's really great with computers, but he has his heart set on coming here because its cheaper than over there, which I agree with completely. I wish the job market were better, then I'd feel more secure about this, I don't want to be stuck living at home for a really long time!

K-1 Fiance(e) Visa Process & ProceduresHi Everyone! New to this whole procedure and a bit nervous

If you don't make that, you get a joint sponsor. You have a couple months to work that out, but there's nothing stopping you from getting the ball rolling. If you're going to be living in your parents' basement, one of them will probably help you out, yeah?

You will still be the primary sponsor. You'll get all your stuff together. Then your joint sponsor will do the same, separately. They must qualify for their household size plus your fiance, so the income threshold may be a little higher.

Each sponsorship packet will include tax returns for the last 3 years, w-2s for those years, a few recent pay stubs from work, and a letter from your employer saying when you started, what your pay is, and that you are an employee indeed. Must be on company letterhead. You can also get a bank statement showing your assets and when you opened the account. You ask you bank to prepare this. You don't need allllll this, but as much of it as you can get is good. Check out the I-134 instructions.

Wow, I'm not sure if they would or not. Bit disappointed about that, but ah well. I should be getting a payraise within the next month but I still don't think that'd give me loads more, plus its a part-time job cause I'm still in school. Wish they gave us a break for that! Almost done with my bachelors and hope to get a different job soon which hopefully pays better! I'd like to get things sorted as soon as I possibly can, but it looks like I could probably get my tax returns, w-2's and my pay stubs I can start printing them out now. Are these items that I have to send to him for his interview? I remember reading about it before when I was randomly checking out the things to send him but can't remember if this was one it. Getting a letter is easy enough though for me and the pharmacist could do that in a day tbh. What about stocks and stuff, they would need that info, I'm pretty sure I just read that on the link someone gave me earlier. Oh wait, just read what you wrote about assets!! sorry lol. My sister also works at the bank so I'm sure she can get me the info about when I opened my account. thanks for replying though :)

If your household will consist of just you and him, it's about 18,500.

a year? well we were going to be where I am which is in my parents basement, but i don't pay rent or anything, then work on getting our own place where we see fit.

yikes, and what do we do if we don't earn that much? I work 30 hours a week but i don't get that much :(

Um the Instructions Page of the I-129 F that comes with the form states that any courier services that are not USPS and/or Express are sent to that adress instead of the Lockbox...
So you send it Standart it goes to the Lockbox, otherwise Express/Overnight or Fedexed it goes to the Lewisville Adress

found it, thanks!!!!

K-1 Fiance(e) Visa Process & ProceduresHi Everyone! New to this whole procedure and a bit nervous

1. Write your check to United States Department of Homeland Security--don't abbreviate it.
2. Make sure your cover letter has a table of contents listing all the documents in your packet, in the order in which they are arranged.
3. Uhhuh.
4. I would stay away from staples except where you're fixing plastic bags to plain paper. USCIS is going to take the whole thing apart and reorganize it according to their own needs, and when they do that they're going to use a two-hole punch file folder. If you staple, it might rip some pages when they dismantle it. You can help them by two-hole punching the top of each page, then collating related documents with an Acco clip or a paper clip.
5.-7. Uhhuh.
8. Don't staple it to the G-325. Staple the plastic bag to a separate sheet of white paper. You can clip that page together with the G-325 if you like.
9. Right
10. No notarization needed. Back and front copies of the BC.

You still don't need your chats and emails. At all.

Use return receipt when you send by USPS. You can choose overnight if you want; that's fast. The address you have is the correct one--if you're sending by USPS. So send by USPS.

so, can I staple the same forms to each other, like the I-129 which is 3 pages, I can staple those 3 pages together? I'll paperclip the page with the photo connected to the g325 then. thank you so much!!!! So excited! :D appreciate it !!

Augh and I keep forgetting that I don't need those message yet! I shall save them for the things that he needs! lol and just make sure all my pictures and boarding pass copies and passport stuff is in order :) Sorry about that, I remember someone mentioning that before!

No, I was the same way. It all seems pretty obvious from the far side of the process but I know what a wilderness it is when you're in it for the first time. Nap time! Refresh! You don't have to do it all at once, and you probably can't do it all at once well. Even when you've got it all complete, let it marinate for a couple days and then look over it for errors before you think about sending. Fresh eyes.

You were right! I took a break, and found out I aged my father by 30 years and forgot to respond to a question on one of the forms! lol yikes! But I've e-mailed him the 3 things I need from him and will hopefully get those asap :) He's a sweetie, said he'd get on it today, since we spoke last night about it :) Anyways to clarify I made a list of everything I needed, and I just have to get some fb messages, and I have chat logs from blackberry and msn as well to go with our proof of relations, would that be good along with pictures? I have quite a few from the different times we've seen each other in the past year (3 times altogether, including a semester I sent in london at uni) Here is my list and please correct me if I'm wrong on anything :)

1. Check: $455 (who do we make the check out too)?
2. Cover Letter
3. I-129F Form
4. Question 18-supplement ( I stapled this to the back of my I-129F form, is that okay? I figured since it was a part of that it would be okay)
5. Intent to Marry, both of them
6. Proof of having met (Pictures, boarding passes, and copies of passport stamps)
7. G-325A Form - Mine
8. Passport sized photo (do I staple this to the back of my G-325A form? I know I have to put it in a plastic bag with my full name on the back, but it is alright to staple the plastic bag to the form?
9. G-325 A Form -Dan's along with passport sized photo, I'll just wait to see what someone says about that what I asked above
10. Copy of Birth Certificate (does this have to be notarized? I think I already asked this and they said no so)
And we don't need anything else, no previous marriages, or children, or name changes or convictions so :)

Thanks everyone!!!!
And I can mail this to this address?:

USCIS
P.O. Box 660151
Dallas, TX 75266

Is this the best address to send it to or is there another faster way? And I have to send it by USPS? What's the fastest way to get it there? thank you!!!!

I think you're reaching critical brain fog for the day, hee. The more you look at the forms, with all the anxiety around doing it perfectly, the more confusing it seems.

You are the petitioner. For your letter, use your name and address. Your fiance is the beneficiary. On his version, he'll use his name and address. On your letter, you'll say you [I, Kristin] wanna and will marry [that guy you're going to marry's name]. He'll switch those for his form. Because he's not you. He's him.

haha, I think you're right because he just told me the same thing cause I'm messaging him constantly about different bits i want to like triple check with him even though i already know it! lol, sorry I just am really anxious haha. Thanks for all your help!!!!

Where in Michigan? My fiance is in Ann Arbor (and I'm there visiting right now).

Welcome to VJ...congrats on starting your visa journey!

I see a DETROIT TIGERS jersey!!!!!!!!!!! lol I'm about a half hour from Ann Arbor :)

K-1 Fiance(e) Visa Process & ProceduresHi Everyone! New to this whole procedure and a bit nervous

Your fiance must sign one and send it over. Add your signed letter and put them both in the initial petition packet. Use the template on this site for both--they'll look exactly the same except for the original signatures.

Do it again before the interview so the new batch of letters is renewed and current for that stage. Yes.

The addresses thing is getting a tiny bit vague because they've just changed it so that ALL petitions go to Dallas before being sorted out to the regional service centers. Go to the USCIS website to find your regional center address if you want to use that on letters. It won't ruin anything to put Dallas on there, though.

The USCIS Dallas Lockbox

For U.S. Postal Service:

USCIS
P.O. Box 660151
Dallas, TX 75266

Alright, I don't want to mess this up tbh with you, but with that fiance letter of intent I want to make sure our names are in the right spot.
When it says "Applicant/beneficiary's name"
And when it says : "petitionary's or beneficiary's name"

Am I putting on mine, my name in the first part and his name in the second? and then I sign it
And when he signs his will his name be in the first part and mind in the second part? Thanks, sorry I'm just getting confused on this part!

And is my address going to be on both of them at the top?

when we are doing our fiance letters of intent it says we both have to fill it out. So I am doing these two and putting it with my I-129 form, however it also says "when submitting for interview" does that mean we have to do it again for that? Where does the petitioner live ? depending on that you are sorted to a Service Center, but first you will have to send it to the Lockbox.
But your letters you adress to your Service Center ! Please let us know where the petitioner live, also you shud fill out more of your profile info, that will help us quick to help you

I don't think it will hurt if you put the internship in that box, and I don't think it will hurt if you don't. I don't think internships are considered occupations. You'd write "intern" under the occupation portion if you want to include it.

There are a few instances, when filling out the forms, where there are not incredibly clear-cut answers to every unique situation and life history. The forms are general and somewhat broad so that they cover everyone's basic story.

You will not be penalized for interpreting questions to the best of your ability and filling in your information with the intention to be clear and honest. In this instance, a good faith interpretation could include the internship, and a similarly good faith interpretation could leave it out.

In my opinion.

Thank you!!!! How do you know what Service Center to put on for the address on the cover letter? And it is $455 for the I-129F correct? With the Birth Certificate, do I have to send the original? Or can I make a copy of it and have it notarized?

I can't seem to open any PDFs today, so I can't see the G-325, but doesn't it just ask for your work history? I would personally ignore internships. Someone else can clarify.

Ignore the A#. That field is a little confusing. You don't have an A#; don't put anything there.

Thanks for the A#, and it says "Last occupation abroad if not shown above."
And well I didn't get paid for the internship, it was just a 4 month thing. any other advice?

You don't need to list addresses you just "stayed at" for a while. List official addresses.

And on the emails/chats thing...you're really making more work for yourself for no reason. That stuff is for the embassy/interview stage. I'll stop saying this now if you insist on including them. Posted Image

well I figured I saved more than my partner did, so I was tryign to get that stuff ready since I was going through photos and that too. but I have the photos set for my petition form :) I am just checking on stuff for him as well to help him out and try to make it a little bit easier. should I do entire conversations then? and what about personal stuff, there are some conversations i wouldn't deem appropriate for other eyes? that sounds really bad but .... and we were friends first, then dated, but have kept close since we've dated and we're basically back together now of course since we're doing this. should i just do from when we dated onwards??? or start at the beginning of our friendship (9years ago)

Once the AOS process is complete, your husband would be issued his green card. You would be able to go visit his family.

When you apply for AOS, you will also want to apply for Advanced Parole (AP)[form I-765], that would allow your husband to travel outsdie the USA borders while the AOS process is in-progress.

that is really useful information, I really appreciate it! Thank you !

That figure also calculates the fee for Adjustment of Status (AOS). The current AOS fee is $1010. You will do the AOS process after your fiance arrives in the US and you are married.

WOW, that is expensive. After that is all done, I'm curious as to how difficult it would be for us to go visit his family on holiday in England?

K-1 Fiance(e) Visa Process & ProceduresHi Everyone! New to this whole procedure and a bit nervous

Yeah, go ahead and get his stamp from visiting you as well, if it's easy enough. You should be very solid. Describe on your supplemental sheet the three visits with dates that correspond to the three pieces of documentation that back them up--be factual instead of telling a romantic story. "We met like this, then visited on this date, and this one, and this one." Not really necessary to list more than one meeting but can't hurt and doesn't overwhelm them with data.

Send maybe 8 photos. They don't really need more than 3 or 4. You can position them in a document, maybe 4 to a page, with names and dates beneath each, and print it out on regular paper. I did printing on photo paper, cut them out, put them in plastic bags and stapled them to blank sheets of paper, but that may have been overkill. I've heard seasoned veterans describe the simple layout-print out method as perfectly acceptable. Just remember to label each pic.

I would put your passport photos (not the stamp evidence, but the photos you need to include) in plastic bags stapled or clipped to a sheet of paper with names written on back of the photos.

Not needed...

With our photos from England, New York and England again, I'm putting where they were taken, should I put the actual addresses? I have ourselves clearly staed in the picture, and the dates and if it was at a restaurant or where it was taken. Is that alright?
kristinanddan09FemaleEngland2010-09-26 14:58:00
K-1 Fiance(e) Visa Process & ProceduresHi Everyone! New to this whole procedure and a bit nervous

Names dates and places writen on back of the photos putem in a plastic bag just so they dont fall all over in the mailer. Paper clip or staple it to a page in the petition.

We included 25 photos, stamps from both passports, itinerarys and ticket stubs from flights. Emails, msn chats, copys of snail mail cards and envelopes, print outs from phone records which we highlighted to show the phone numbers ( even tho it said my city and province beside it. )

I'll have to go through my photos, and I'll ask if he can get the stamp from this time to the United States when he visited. And then I can show my flight info for that flight where we met up. I'll get my stamps as well documented. Now I save our conversations, but am i supposed to print out all the pages or if I can find the dates, print out multiple pages? I'm not sure the best way of going along with that. Thanks for all the examples :)

K-1 Fiance(e) Visa Process & ProceduresSending original documents to my finace for interview
I cannot say what happens at the interview, as ours has not occurred yet, but the Moscow Embassy website says that the affidavit support must be notarized, so I have done so on mine. Someone at your bank can probably do it for nothing so why not do it.

QUOTE (Arbind.Ariadne @ Dec 28 2009, 11:03 AM) <{POST_SNAPBACK}>
The I-134 doesn't need to be notarized. As far as I remember, my then fiance (now husband) also sent copies of his checking and savings account, real estate property value, tax info from the last two years, payslips, letter of employment, etc. The copies I mean are scanned and printed copies from the original. He sent all those to me a month before my interview because in the Philippines, we don't mail anything to the Embassy. We just take with us all required documents during the interview. I don't know with your fiancee's Consulate though.

I also brought with me the original boarding passes, plane tickets, hotel receipts, and more but the Embassy thought it was sufficient to have chat logs, e-mails, 10 pages of photos, copy of the book he sent me, and greeting cards as proof of ongoing relationship and proof of having met within two years. As for proof of your naturalization, don't send the original. It may or may not be required but if you'd send it, just make a copy. Remember that your passport and naturalization document are very valuable to you. Don't risk losing them.

Hakuna matata.

I hope things go faster and easier for you and your fiancee.

God bless us all.

K-1 Fiance(e) Visa Process & ProceduresResidency Rules For Child On K-2
Gary,
Does your son in Moscow have a social security number (SSN)? Is an SSN necessary for you to decare him on your income tax? Must he wait for his green card to file for an SSN? Did you adopt your son, and is adoption necessary to claim him as a dependent.
Thanks much for your always valuable assitance.

The child must be a permanent resident of the US to get a green card. This means he uses your address and does not leave the USA for more than one year (continuously) without an AP. He CAn go to school out of the country but should plan on returning every summer (at least) to maintain his residency. He also needs to be listed on your tax reurn as a dependent OR file his own income tax return. He should obtain sme form of US ID showing his permanent residence in addition to the green card (not required but it helps)

He qualifies to apply for a green card as the minor child of his K-1 mother. He must maintain his green card on his own after it is issued and meet all qualifications as any other green card holder.

Our oldest son is a student in Moscow also and returns each summer, he can work here during the summer if he chooses and has a Vermont drivers license. we have the same plan. Once he finishes his education, he can decide where he wishes to live and where he wishes to be a citizen for that matter.

K-1 Fiance(e) Visa Process & ProceduresResidency Rules For Child On K-2
Thanks for the useful info. To follow up, I have 3 other questions:
1) If we get my fiancee's son a green card, but he abandons it (stays away too long, for example, or decides that he definitely doesn't want to live in the USA), will that hurt his chances for getting a multi-entry tourist visa to be able to visit his mom and I from time to time?
2) I read that once his mom gets her permanent green card (presumably in 2 years), that she can petition for other family members to immigrate to the USA. Is that true? I assumed that she needed to be a citizen to do this. I am curious if this is another possibility, although I understand that the petition can easily be denied.
3) Does anyone know if it is difficult to get a visa for a son or daughter to visit their mother in the USA who has a conditional green card?

K-1 Fiance(e) Visa Process & ProceduresResidency Rules For Child On K-2
My fiance has her interview in February in Moscow. We are including her son to follow within 1 year on a K-2, as we think the option of living in the USA could be valuable to him in the future given the poor Ukrainian economy as well as allowing him to visit us whenever he wants if he should decide to stay in Russia or Ukraine after his 4 years at the University in Russia. Her son is not sure he wants to get a U.S. green card (AOS) as he and my fiancee believe that it will require him to make a certain number of visits to the US each year and spend a certain amount of time each year in the USA. Can anyone tell me what are the residency requirements for a child coming on a K-2 to maintain his conditional green card. I didn't realize there were any residency requirements, but I thought his green card (AOS) was simply a function of his mother getting a K-1 followed by a green card.

#5 - just one copy of G-325A. Four copies was an old form

I don't believe you are correct about needing only 1 copy G-325A unless this change is extremely recent. I'd send 4 copies or use the form USCIS sends out which is a 4 sheet carbon form. I would also attach 4 copies of each additional sheet so each copy is complete.

Regarding the starting date of your job, it doesn't have to be precise to 5 years ago. If you started more than 5 years ago, then you can put the actual starting date.
Regarding addresses, I wrote small and put the whole address in. Always better to be complete rather than risk a delay.

K-1 Fiance(e) Visa Process & ProceduresK-2 Interview In Moscow
My Russian wife arrived here on a K-1 with her 17 year old son to follow. For him to get his K-2 visa, I presume he will need an interview in Moscow. Do I simply need to email the Moscow embassy to arrange this interview? Will his case number be the same as his mother's?
Thanks!!

K-1 Fiance(e) Visa Process & ProceduresIn love-Tourist visa or Fiance visa?
As someone else posted, the fact that she has been here 3 times, and left timely, gives her a reasonable shot at a tourist visa. If you don't like meeting her somewhere else, give the tourist visa a shot.
A previous poster suggested meeting in Europe. Although it is easier to get a visa to travel to non-soviet Europe, than to the USA, a Russian can still have problems getting a visa to a non-soviet European country. Countries where she can go to without a visa include Egypt, Turkey, Thailand, Chernogoria (formerly Montenegro), Cyprus, Dominican Republic and Ukraine. All have beautiful beaches, and if she is like all the Russian women that I know, she loves the sea. Oh, I forgot. She can also go to Cuba without a visa :-)

K-1 Fiance(e) Visa Process & ProceduresIn love-Tourist visa or Fiance visa?
I think you do not understand all that is involved in getting a K-1. A 6 month wait, interview and fees for this, gathering police certificates and fees for these, translations of all her documents and fees for those, filing the petition and fees for this, a medical exam and fees for that, and if your girlfriend does not live in Moscow, travel expenses for the medical exam and interview, as well as possible travel to gather police certificates. Additionally, you will spend a lot of time researching and gathering information for the many documents that you must file. It is not a cheap or easy process. I would never want to go through this unless you are ready to be married. Even then, maybe it is not worth it :-) The money and time would be better spent meeting her somewhere else.

I thought the K-1 gives you the option to marry or decide against it, without consequence. It's definitely a possibility that we could end up marrying after 3 months, because like i said, we are definitely in love. It's also a possibility that we'll need a little more time to decide to marry. Having her stay with me for 90 days and then determine our next course of action seems like a reasonable thing to do.
