K-1 Fiance(e) Visa Process & ProceduresG-325a form question
If that still doesn't work, you can fill out the forms by hand (I tried printing mine too but some of the info was too long for the text boxes so I just gave up and filled in the form by hand - we didn't have any problems with our I-129F / K-1 packet)

K-1 Fiance(e) Visa Process & ProceduresMade a small mistake, will this be a problem?

When my fiancee was filing for my visa, she mistakingly filled in my firstname against middlename as against the way they are written in my International Passport-
She wrote: LASTNAME-MIDDLENAME-FIRSTNAME.
Instead of: LASTNAME-FIRSTNAME-MIDDLENAME as in my passport and in my school credentials

Our case is already at the embassy here in Nigeria and my interview is on the 30th of March...

I have already started my medicals and the names are in the correct order here (medical document) as in my passport.

-What can we do to arrest this situation?

-How can we go about it?

Please anybody with info should pass it over...thanks for your helps so far!

My fiance (now husband) made a slightly similar mistake when he filed our I-129F petition. In this case, he wrote part of my first name as my middle name and omitted my actual middle name (in the Philippines, you can have more than one name as a first name - there are some people with five or more "first names"). I do remember filling out the G-325A correctly though. Anyway, all I did was fill out the visa forms (DS forms) for the embassy with my correct name and never had any problems. Now that we've filed our Adjustment of Status (I-485), I made sure to follow my country's naming conventions because I would have to amend my passport and would like all legal documentation to reflect the same exact name.

K-1 Fiance(e) Visa Process & ProceduresAnnulment and Letter of Finality
Have him send you the letter via Air21/FedEx because it's trackable online - PhilPost is very unreliable so whenever I needed to send my hubby something through the mail, I opted to pay extra by using FedEx rather than risking it getting lost by PhilPost.

K-1 Fiance(e) Visa Process & ProceduresI-129f forms questions

This may be a little long-winded but we were starting to fill out I-129f form and the G-325a forms and just had some clarification questions and questions about the proper format for some of these answers.

For the I-129f:

Part B, question 9 - we've come to understand A# refers to alien registration number or something similar. It also is asked for on the G-325a form. I don't have one of these?
Yes, the A# is your Alien Registration number - if you've previously been issued a visa, you probably have one. If not, you should put NONE.

You can download the G-325A form here:
http://www.uscis.gov...form/g-325a.pdf

Part A, question 10 - for a birth certificate, is there a specific format to fill this out? We have it written in the box as, "number, August xx, 19xx, City, KY" (though obviously with the information filled in :P) Is that the proper way to fill it out or are they looking for mm/dd/yyyy for the date or for the full state name instead of the abbreviation or does it not matter and I'm just overthinking it?

Actually, that goes for any date they ask for where the form doesn't specify mm/dd/yyyy format.
Follow the mm/dd/yyyy format. I believe in some of the forms we used dd month yyyy (e.g. 01 January 2010) in the signature parts. It's probably better to follow just one format though - to keep things uniform.

Also, for any question that doesn't apply to us, do I type N/A or none or just leave those fields blank?
Do NOT leave anything blank. Type NONE or N/A depending on the question.

Part B, question 18 - how much detail are they looking for here? We have it filled out as "We met online in early 2009. Began talking on the phone in September 2009. Met in for the first time in late October 2009 and were together in December 2009 and January 2010." which I feel is a little short but what sort of answers have you guys given in terms of detail?
That's pretty much how we filled out ours - on a separate sheet and we ended the statement saying how our relationship has grown and we want to spend the rest of our lives together.

And for the G-325a:

For any questions asking for the City and Country, do I also add in the province or state or just City Name, Country Name? For example, for my date of birth I have it typed as Brantford, Canada. Would I leave it like that or change it to Brantford, ON, Canada or Brantford, Ontario, Canada?
You can probably just leave it as city and country.

Similarly, for people familiar with writing American addresses, is it formally supposed to be written as US, United States or USA? We believe it's USA but just wanted to double check.
You can use United States or USA. :)

The same question as above for the I-129f form, is there a specific way to write dates if it doesn't specify mm/dd/yyyy?
Stick with the same format you've started using - for example, if you've been using mm/dd/yyyy, don't use dd/mm/yyyy

Under fields that say "if none, so state" do I need to type "none" into every field or just the first one for each section?
Do NOT leave anything blank. Type None or N/A depending on the question.

"Applicant's last address outside of the United States of more than 1 year:" - this doesn't apply for Andy but for myself I'm a little unsure what to put here because my current address in Canada, I have lived at for less than a year but by the time this is processed it may hit the one-year mark. So should I write my current address in anticipation of that or write my address before that?
Write the address that you've actually lived in for more than a year at the date of filing - there's a part for the "present address" so that shouldn't be a problem.

For the employment section, I'm having trouble fitting the full name as well as the address into that box. I know I could just print it out and handwrite the answers, but even then I feel like it's a small area to fit all of that information and it would be squeezed anyway. How have some of you guys filled out this part? Also, Andy works from home so should we just give the main office address for his company? Do they need a street address or just city/state?
you should probably use a separate page for this and just attach it to the form because it asks for full name and address of employer.

We've been having the same problem on the field for the date and place of previous marriage/termination of marriage. They're tiny fields. :(
We just filled in this form by hand because too many fields were too small.

"This form is submitted in connection with an application for:" would we check off "Status as Permanent Resident" or "Other" and write K1 Visa Application (or if not that, what should we write there? I-129f package?)
write "I-129F PETITION"

Anyway, if you took the time to read and help us out, thank you so so much. I realize a lot of these are little things and may not actually matter but we just wanted to be sure - I've heard sometimes you need to be very, very specific with these forms and neither of us has done this before. :)
I felt exactly the same way when we filed our I-129F so ask away! With these things, you can never be too careful ;)

Edited to add: Also, for previous address/employment sections, under the month column, does it matter if we write, for example, Aug or 08?
I think we wrote the words here - "JANUARY FEBRUARY MARCH APRIL MAY... etc."

K-1 Fiance(e) Visa Process & ProceduresK-1/I-129F Military question

Okay I?m just really confused as to what I put on this form.

Part A on the top part of the form asks for my address

Question 14 asks where she will be staying after arriving in the Us

And on part C question 1 it asks me if I?m in the US military and if so list my overseas address and when I will be returning to the states.

Anyone know a definite answer to this? There is hardly any information for military members :(

For Part A, my husband used his mom's address in the U.S. (but this matched his info on the G-325A that he filled out because he lived with his mom right before he got deployed)
For the address where I would be staying, he used his mom's address in the U.S. too.
For Part C, he listed his overseas military address (Vilseck, Germany).
* this is only because he didn't have his orders yet and technically he was still part of his old unit that was stationed in Germany.

When he got back to the U.S. and bought our house, our I-129F had already been approved. I believe he did change his address eventually but we were already at the embassy stage then (when he called to schedule my interview appointment).

K-1 Fiance(e) Visa Process & ProceduresShould we get a lawyer?
I have helped a few couples file their I-129F petition and guided them through the K-1 process (in the Philippines only as different embassies may have different procedures) because they didn't want to hire a lawyer and have to pay exorbitant fees. My husband and I are currently in the AOS stage so we are by no means experts on the whole immigration process and never will be because the rules/guidelines continually change. The best that all VJers here can do is help you by answering questions and offering advice. Deciding on whether to hire a lawyer is a matter of preference. There are no guarantees that having a lawyer will speed up the process or get you an approval. There have been cases when lawyers neglected something / filled out forms incorrectly which resulted in delays (RFEs) or even denials. That just means that even if you have a lawyer, you should still go over the documents yourself and not leave it all up to the lawyer.

If you're confident that you can complete the forms and won't miss anything (follow the guides, use the example forms as reference, etc.), you can go ahead and file without a lawyer. Between my husband and I, I'm the meticulous one. I checked our documents at least 10 times but my husband is the type who hates to read paperwork unless he absolutely has to (only because he already deals with so much at work and always has a lot on his mind, I do my part by keeping track of everything else). When we filed our I-129F petition, I sent him a checklist, instructions with the important parts highlighted as well as sample forms with headings in red (because I knew that's as far as he would read before he lost track - there were a lot of things that needed to be done and at that time, he was also in the process of looking for our first house AND transitioning into his new job).

If your case is very complex, it would be a good idea to hire an immigration lawyer but if it's relatively simple AND again, you're confident that you can cover everything (filling out forms, gathering supporting documents, etc.), look through the guides and sample forms here on VJ, ask other members who have filed... If you have any questions, don't be afraid to ask. There are no stupid questions and there will always be someone who'd be happy to help!

K-1 Fiance(e) Visa Process & ProceduresDoes I-134 for fiancee visa need to be notarized?

Hello guys,

I was a bit confused.. I saw from other requirements that the i-134 need to be notarized but on other post, the new i-134 doesn't need to be notarized.. What did you guys do?

Thanks!
Melanie

Hi! We had our I-134 notarized but we filed last year (February 2009).
I just checked the USCIS website: http://www.uscis.gov...00045f3d6a1RCRD

It says:

You must sign Form I-134 in your full name. (Note: Signing Form I-135 is under penalty of perjury under U.S. law). For this reason, it is not necessary to sign Form I-134 before a notary, nor to have your signature notarize after you sign it.

My husband's 2008 income tax return also showed only $7K as adjusted gross income but when you look at his W-2 his actual annual income for 2008 was almost $40K - it was listed in Box 12 with Code Q (which means it's non-taxable combat pay). He just wrote his actual income on the I-134.

He gave me a copy of a "Verification of Employment" from his station commander which showed his rank, pay grade and monthly base pay to bring to my K-1 interview. I didn't have any problems ^_^

K-1 Fiance(e) Visa Process & ProceduresPassport stamp date is wrong!

Just getting our petition package together (the fiance's totally useless at paperwork! lol) and wondered what you did with this in the end coz I have the same situation.

I've put both my passport stamp with the incorrect date and the itinerary, boarding pass and luggage tag showing the correct date. The passport stamp is printed onto a page with a list of all the evidence for that trip and I highlighted the fact that the date of entry is incorrect but that the other evidence shows the correct date.

My problem with not including the stamp is that 2 other accurate POE stamps are on the same page, so I'm including them already in my other evidence.

We didn't actually take any photos of us together during that trip (nuts, considering we were together 6 weeks! lol) but we did travel to NH and back for a week, and I have our itinerary and matching boarding passes for that trip. I haven't included them because I thought it might confuse matters, but I'm curious of what I should include now that I've got this discrepancy with the POE date and my other evidence.

So my options are:

1) Just submit my POE stamp, minus the itinerary, boarding passes and luggage tags
2) Just submit my POE stamp, minus the UK-US return itinerary, boarding passes and tags but include the NH trip evidence showing both our names.
3) Submit all my POE stamp and UK-US evidence, but highlight the inaccuracy.

Many thanks!

Option #2 sounds good - just so you won't have to worry about the inaccuracy. The POE stamps are more valuable when you think about it (as Starlight95 said) because it shows that you were actually examined by an IO and entered the country... Just include the boarding passes, itinerary and luggage tags that match the 2 other POE stamps.

I can relate with the photos issue - my husband and I only took about 2 or 3 pictures during our whole vacation together (almost a month). We spent most of our time together just talking, watching TV/movies... We didn't think to take pictures. LOL.

K-1 Fiance(e) Visa Process & ProceduresG-325a form

My fiance lives in Russia and her signature is required in the G-325A form. Can she just scan or fax me the form or does the USIC require the original signature?

USCIS requires forms with original signatures so the best way to go is to have her download the form, fill it up herself, sign it and then mail it to you ^__^

Also, don't forget the Letter of Intent to marry requires original signatures too!

K-1 Fiance(e) Visa Process & ProceduresK1 INTERVIEW DATE :-)
I think the main reason they deny a K-1 visa is if you can't provide proof of a bona fide relationship with your fiance (sponsor).

K-1 Fiance(e) Visa Process & Proceduresvisa will be denied?

thank you guys......

about our genuine relationship...we have lots of phone calls receipt coz my fiance do call me everyday since we met till now...we do have lots of emails, letters, picture online and pics together...

thank you so much for your reply now i feel better! so really scared that my fiance will not be on my interview but because of your advise now i don't have to worry...

God Bless......... :D

The pictures of the two of you together are probably the most important. When they asked for proof of genuine relationship during the interview, the pre-screener didn't even ask for the phone/video call/chat logs that I had, just took the pictures - but I think every pre-screener / CO is different so just bring as much proof of your relationship as you can.

Don't be scared about going to the interview alone! There were a lot of K-1s on the day I had my interview and there were only 2 that had their fiances with them :)

K-1 Fiance(e) Visa Process & ProceduresUnexpected Worries About K-1Visa Rejection

While you have met the requirements of having met in person at least once in the past two years, it is very IMPORTANT you keep emails, chat logs, phone records to show you have maintained the relationship with your fiancee. This is what is most important to the CO at the Embassy. If you do have an opportunity to visit each other again, take a lot of pictures in different places, maybe with some relatives also in the photos.

Good Luck.

In 47 days??? How did you do that? Do you know somebody high up in a political office? Is your fiancee/husband on active duty in the military ?

Audy_Rob is right! Be sure to keep everything that will prove that you have a bona fide relationship.

I know! We were really surprised! We expected to wait a couple of months at least. My husband was and still is active duty in the Army so that might have something to do with it but we didn't do anything to expedite it. @_@ I think they really were just working pretty fast that month? There was another couple who filed AFTER us and their I-129F was approved in 30 days (fiance wasn't in the military)!
F & JFemalePhilippines2010-02-24 15:05:00
K-1 Fiance(e) Visa Process & ProceduresUnexpected Worries About K-1Visa Rejection

The waiting is hard; it gives you months and months to worry about what might go wrong in the process. But reading on VJ forums will arm you with some idea of what to expect in the next stages, and how other people have solved problems that, hopefully, won't happen to you anyway :P
I've had a photocopy of the I-129F we sent off in Nov. sitting in a drawer, and it's hard sometimes not to pull it out and agonize over every "N/A", wondering if it should've been a "none". But try to keep busy, and think of hobbies or things you've always wanted to try but haven't before. Soon(ish), you'll be getting ready to move on over to the US (or welcome your partner, if you're the USC) and all this will be behind you. I keep telling myself "we only have to do this once!"
Best of luck!

In my case, my then-fiance (now husband) didn't show me a photocopy of the final I-129F that he mailed until after the petition was already approved (we filled it out together during the last time we were together in the Philippines but there were some blocks that we left blank because we wanted to make sure all the info was correct before filing). LOL. All he told me was that everything was good and I shouldn't worry. It did help keep me from worrying too much. I just did my best to keep busy and spent as much time as I could with my family... I'm glad I did because I really do miss them terribly. My husband and I can't wait to visit!

Hi! The I-129F instructions states that you should have met within 2 years of filing the petition:

You may file this petition if: You and your fiancé(e) intend to marry within 90 days of your fiancé(e) entering the United States, and are both free to marry, and have met in person within two years before your filing of this petition

You can check the instructions here - http://www.uscis.gov...i-129finstr.pdf

My fiance (now husband) and I only met twice before we filed our I-129F petition too. Before filing, we first met in June 2008 then the last time we were together was December 2008 to the first few days of January 2009. We filed in February 2009. Our petition was approved without any RFEs in 47 days from our NOA date. :)

I'm confusd too. I've never heard of the petitioner receiveing an "appointment letter" from the USEM in Manila. What does this letter say? You will have to continue calling the embassy and they will tell you when you can schedule your interview.

My fiance (now husband) also received a letter - it was the exact same letter that I received from the U.S. Embassy in Manila but I believe his must have come from the NVC. It was addressed to me but with the U.S. address instead of my Philippine address - that was the only difference.

For our I-129F K-1 petition, I believe my then-fiance (now husband) sent it via USPS Priority Mail to the California Service Center - it got there in 3 days. :)
For our AOS packet, we sent it via USPS Express Mail with Return Receipt (mail, not electronic) to the Chicago Lockbox - it got there in 2 days but we didn't receive the Return Receipt until after a month after - the NOAs came a LOT faster. LOL. Delivery Confirmation is still the best choice so you can track it online. XD

In my humble opinion, you need to do what feels comfortable for you. You know your situation the best. You know yourself. To each his or her own.
If you DO hire a lawyer, shop around. You want someone you can trust.

K-1 Fiance(e) Visa Process & ProceduresHi Everyone! New to this whole procedure and a bit nervous

You can't find it because there really are no hard and fast rules for the I-134. All the instructions say is the sponsor must have adequate finances.

So some if not most consulates go by the rules for the I-864, which you will file later on for his adjustment of status. For an income shortfall at that time, the rules are specific that cash assets must be three times what the sponsor lacks (for a family based adjustment).

so what about this time around just filing for what i have to send in for the first packet for the K1 petition? should I get a sponsor if I'm short, or can I add in my stock account?

Yes it counts. But you need to have saved about three times the amount of money you are lacking.

Can I ask what you did and what others did for the back of the photos?

I know to put the name, date, and location.

However if there are other people in the photos, such as family members, is it necessary to identify who they are?

I'll be honest, I did do that, I'm not sure about other people though. Just so they know who they were, if they were friends, or family members of each other.

I'm curious what everyone would recommend, a check or a money order? Also, I have all the originals saved and also a copy of each one on my laptop as well. And I'm sending copies of everything correct? Also, do the two hold punches at the top of the page go in the middle? or can I just paperclip all the corresponding parts together? I'd have to go out and by those clips cause I haven't hand any but I of course have loads of paperclips. Can I just put all the information into one enveloped or should I put another one inside of it?

Oh and you'll also send him your sponsorship packets of course. When you get into that phase of things, additional questions about packet 3 and consulate experience and the medical and all that, migrate over to the UK regional forum for the best info. You can also read and have Daniel read the embassy reviews for London--tab is at the top right of this page. That will help him get familiar with what to expect.

Thank you very much! Yeah, I figured I could start getting examples for him, and yup I read those embassy things, well nto all of them but I was mentioning it to him but i'll have to send him the site i'm sure. :)

Hi Kristin,

Sorry, I don't have much advice to offer in the way of the forms, but just wanted to say hi and that that I'm so happy I found this thread because I'm pretty much in the same position- American girl in her 20s trying to marry her English boyfriend! The forms are all confusing, but just keep asking questions- this is an amazing website with amazing people here to help. Good luck with everything!

lol we are most definitely in the same boat then!!!!! if you ever want to message me feel free too! I feel like I've gotten a lot of the things done for now haha. And of course missing him loads :( I love this site :D

So, after getting all my stuff finished, I'm just waiting for the papers from the guy. Anyways, I was trying to get example forms for him to look at when his packet comes after this is all finished. Wanted to see if anyone whose done it before, are they the forms underneath the Example forms for K-1 starting at the support form I have to fill out(I-134) and going down from there? and then of course including the ongoing relationship and anything else they might ask for? Just curious cause I was trying to get it altogether and save it so I could send it to him when he needed it. thanks!

Yikes, just realized that those forms expired, well some did in 2009 and here in 2010. Do the forms drastically change? or where can I get updated examples for them?
