K-1 Fiance(e) Visa Process & ProceduresBeneficiary Change of Address
QUOTE (babblesgirl @ Feb 11 2008, 08:49 PM) <{POST_SNAPBACK}>
Only the petitioner can register a change of address vis USCIS whilst the petition is awaiting approval. The beneficiary must wait until the file reaches NVC before being able to do this.

OK, so all I have to do is register the change of address online with USCIS shortly after she moves? Then she waits until the file reaches NVC before making any other changes?

My fiancee (beneficiary) is soon moving to a new address (same city). Does anyone know if its necessary and how I would go about changing her address for the I-129F Petition? Can it be done at the USCIS site or must it be done another way?

Thanks!

K-1 Fiance(e) Visa Process & ProceduresK1 London Interview
I believe my husband paid courier by card as well. It took about 2 weeks to receive visa and passport returned. Remember do not open brown envelope. This must be given to officers at POE. My husband also enter POE in Chicago with no problems. He said he spent about 10 mins with officer and was picking his bags up the same time as others on his flight. Again, every entry is different. No need to be nervous at interview or POE. You will do just fine... :)

K-1 Fiance(e) Visa Process & ProceduresProof of engagment
I totally just lost my reply ...

Here's so having a second go.

thanks for both your advice so quickly! I think we fall into the former - we never had any kind of engagement party and my ring isn't that much of a rock to be seen in normal everyday pictures lol

My guy was saying when he was filing the original paperwork there was a time constraint - that the photographs had to be dated from before the date the petition was filed. Are their similar restrictions on any of the images/emails/chats whatever else I send in?

K-1 Fiance(e) Visa Process & ProceduresProof of engagment
i haven't been on here a while but now i'm back - and with a question. So everything got approved on the American side and i'm working my way through the forms la la but I have a question regarding the evidence you need for "proof of engagement". How actually have people proved they are engaged rather then merely in a relationship? Or is it all the same photographs, copies of travelling, emails etc

all hints and advice would be much appreciated!

K-1 Fiance(e) Visa Process & ProceduresInterview Information
This is what I never understand - they tell you not to make any formal dates or plans to travel till you hear the yes or no regarding the visa, so then they want a wedding date. So your advised i take it in the cover sheet to suggest a month your hoping to get married in?

K-1 Fiance(e) Visa Process & ProceduresUS Passport style photos
I got mine done from a professional photography shop - this was in York. Cost me about £15 for six pictures and they emailed my guy a digital copy too. I think it's far easier if you can find someone to do it and know what the standards are then trying to do it yourself!

K-1 Fiance(e) Visa Process & Proceduresk-1 and the i-134
Do you need the i-134 (affidavit of support) for the k-1 visa? The US embassy claims you don't but people on this forum have done it and produced it anyway for the interview.

I'm getting so flipping confused!

K-1 Fiance(e) Visa Process & ProceduresK1 or CR1?
So confused you all. My FI and I would like to get married now...but we would also like to have a small ceremony here (U.S.) with my mom, sister and brother present. But I don't know which would be faster because that is the MOST important thing. Having him be here by the end of 2012 God Willing and if possible? He's in Ghana and I know that he comes from a country with higher "fraud" rates and etc. So what would you VJ's recommend for us? Wait to get married here (U.S.) and do a K1 Visa or get married now like we want to and do CR1 visa? I'm trying to look at time frames.
Thanks In Advance for your time!

K-1 Fiance(e) Visa Process & Proceduresletter of intent & the declaration of the relationship

:help: what about the declaration of the relationship and how the two of you met in a two year span. are there any samples of this? :help:

It does not have to be in a letter format, it is simply a attached sheet to answer question 18 of the I-129F.
Tell your story. Put "I-129F Supplement: Question 18, explanation of meeting in person" and the date at the top of the sheet. Sign it at the bottom.

K-1 Fiance(e) Visa Process & ProceduresLawyer vs. Self file K1
The paperwork for the I129F is very extensive, but it can most definitely be done without the assistance of a lawyer. I don't know your financial situation but with all the fees involved if u can save on a lawyer that would be my suggestion. My best friend happens to be an attorney and I did not need her assistance at all. Download a guide and take it portion by portion and u will be just fine. Develop a checklist and refer to this site for any questions you may have. Good Luck!

We are newbies to filing a K1. I have read alot of posts and different websites. By far this has been the best website for information and we are really getting excited to submit the K1 documents. The question I have is how many people are using a lawyer to submit the documents and how many are going at it by themselves? Also I am curious to know the sucess rate for each. My gal is in the Philippines if that helps out which I have heard is a little tougher.

Thanks all for your help.

K-1 Fiance(e) Visa Process & ProceduresWhat are some good examples of proof of engagement?
I never read where you had to prove engagement, but only to prove ongoing relationship. To prove ongoing relationship, I provided proof of my trip going to visit recently. We do however have our receipt from the ring and we did a save the date "tentative.". I hope this helps.

K-1 Fiance(e) Visa Process & ProceduresThoughts on the 90 day ceremony deadline
Unfortunatley, this total process has taken that luxury and excitement of a wedding away from us. With the stress of this process I just would not be able to handle the stress of a big wedding without ending up in the hospital. My fiancee and I have been deprived of each other for so long, that we plan to go to city hall get married and have an intimate dinner with family and friends later on that evening and get on with our lives already. So no planning when he gets here (LORD willing) we will file for a license get married and enjoy each other. Its frustrating, but its the way it is for us anyway!

K-1 Fiance(e) Visa Process & ProceduresHelp! Getting Married Just before leaving on K1 visa
Are you serious? The whole point of the K-1 visa is to get married in the US. If you wanted to get married in your country you should have gotten married and applied for the K-3. I don't mean to sound mean or short but I can't believe all that is involved in the getting the visa and now that you have it, its still is not good enough. They only suggestion I have is to have a mock ceremony in which you will not really be married or come her get married and go back and have a mock ceremony. Good Luck! (shaking my head)

K-1 Fiance(e) Visa Process & ProceduresWe did not take photos
Most of the pics that I submitted of my fiance and myself were taken by me. I didn't want to bother anyone but knew I wanted to be able to look at the photos when I returned to the States. I have to agree with RichieRich if I were reviewing you case I would find it hard to believe you met the girl you want to make your wife and didn't want atleast one photo atleast to treasure when you returned home. That would make me very suspicious. Sorry!

K-1 Fiance(e) Visa Process & ProceduresKI and Divorce
Okay, I am confused. Had to follow the convo to see what the confusion was. It does not say that she filed for the k1 visa, it says she wants to know if she could potentially be denied a visa, because of the overlap of her fiancee getting the divorce decree and the amount of time from time he obtains it till she files for visa.

Even if she is asking for info for herself or someone else, what is the harm in that, people do it all the time.

K-1 Fiance(e) Visa Process & ProceduresVisitor visa holder and US citizen plan to get married at church in US. Please help...
There's a lot of mis-information being posted here.

Entering the US on a VWP with the intent to marry is perfectly legal AS LONG AS you return to your country within 90 days. If you return to your country as a legal spouse (having filed a marriage certificate), your USC spouse must file a K-3 for you to return.

If your ceremony was not legalized with a marriage certificate, your USC can file a K1 for you to re-enter as a fiancee.

If your entry into the US on a VWP was with the intent to remain in the US, THAT is fraud. It's the intent to remain, not the intent to marry, that is the issue.

K-1 Fiance(e) Visa Process & ProceduresHit a major snag... it may be over
Ask your Fiance if he has any family here or if his family knows someone in the US that might sponsor him. Don't give up yet. It took us 3 months but we found a sponsor by going to my husband's family. They knew someone in New York who agreed to act as a sponsor.

K-1 Fiance(e) Visa Process & ProceduresK1...pros and cons ?
I went the K1 route & if I had to do it all over again, I'd still go that way, in my opinion.
From the time we filed, to the day of our interview that was approved, it took a little over 6 months.
Yes, the downside is that I won't be able to work for a while & can't visit Canada for a while either. It was a choice I was willing to take, but it was the better one for us.

K-1 Fiance(e) Visa Process & ProceduresDenied at the border
It won't affect your petition, but you may be asked(I think it was a question in one of the forms), don't lie.
CDAgirlMIFemaleCanada2010-01-19 10:39:00
K-1 Fiance(e) Visa Process & ProceduresI-129f pending can we visit eachother?
Being denied at the border for not enough ties will not cause a K1 denial.

There's a question on one of the forms you fill out when petitioning a fiance visa that asks "have you ever been denied entry to the U.S." Just answer it truthfully. It will not cause a refusal from that alone.

K-1 Fiance(e) Visa Process & ProceduresRequired vaccinations?

Sigh, that's what I was afraid of, I hate extra blood work - it's not a needles thing, it's veins thing. I hate them.

Well, look at it this way (if it makes it better, haha)....
I'd rather have the titre test to see, then to get a vaccine injected into my body (unless absolutley needed).
If I were you (& I did do this myself), go get the titres done. And then if they say you need the vaccine, get it/them.

K-1 Fiance(e) Visa Process & ProceduresPlanning the wedding before you get a yes?
I bought my dress, & the bridesmaids got theirs as soon as I picked which ones I liked.
Everything else (church, reception, flowers, photographer)..I had places in mind & talked to them, explaining my situation. Since it was a February wedding, wedding places weren't too busy.
So when we got a "yes" I called all the places I wanted to do business with & booked it.
I couldn't take the chance booking anything without the final approval.

CDAgirlMIFemaleCanada2010-04-22 20:13:00
K-1 Fiance(e) Visa Process & ProceduresAm I allowed to enter America from Canada while waiting on my I-129F NOA2?
Simply, yes you can visit while waiting for your K1 approval. MANY people on here visit while its pending. Personally, I visited during the waiting time twice a week(lived in a border town).
Just bring proof of ties to Canada (rental agreement, bank statements, letter fom employer...) to prove you will return to Canada.
Bring your NOA1 to show you indeed HAVE filed & are doing it the legal way.
I never had an issue.

If that still doesn't work, you can fill out the forms by hand (I tried printing mine too but some of the info was too long for the text boxes so I just gave up and filled in the form by hand - we didn't have any problems with our I-129F / K-1 packet)
