Okay, I am about to go and get my passport picture done and then taking everything to the airport. Here is what I have.

Can I staple the I-129F form as its 3 pages long? not sure if i should keep it seperate or not. I am also going to go for next day for delivery at the post office and sending it to the

lovely thanks for the tip on the pics, i have like 3 per page as they printed out quite large but not too worried about it. i have where its at and what day its at and who is in the picture as well. i just have to print some out from his last trip here and my trip there that i just returned from. if i make a copy of all my passport pages, does that have to be in colour? do i have to highlight anything???

yeah the last trip sort did it, he came here in feb and i just arrived home from a visit a couple days ago. great i'll probably do next day just because i'd feel more comfortable with it. want to do this as soon as we can. do i have to make a color copy of my passport? i am sending that as I can't get to my birth certificate right now. or would that be okay in black and white? i have found my bank statements from when i was there during one visit and found a hotel bill from when he came here to ny and we met up there for a visit as well. i also have quite a few pics. so we don't have to show evidence of an ongoing relationship right now? i dont wanna get into trouble for it is all. thanks !

Yeah I remember we spoke. I'm glad everything is obviously going well and you have decided to start the 'journey'!

We sent ours USPS and it got there, although I don't think we paid for next day. You can choose to have it signed for if you like and also you can track it on the internet. We also sent a check, which is fine.

If the USC is living in Michigan then you should be CSC.

ah, see I was going to put proof of ongoing relationship as well in there, i have pictures of us together, and i think he did take money out once while he was here, will have to ask if he can go back to feb and get that from his bank. and he may have some from NYC and I can get something from that time period as well like the hotel bill that i had to pay for with my card. maybe it'll be easier to show passport stamps as well. . . i'll make copies of my passport pages then to show I was there and get his for the time he was in NYC and here in Feb in my state. I guess i was just trying to get the info for an ongoing relationship as well since they said it could be added to this. with my check, do i just put that in front behind the cover letter? or does it have to be in front of the cover letter? and am i allowed to staple like the I-129F form since its 3 pages long? or should I leave them separate? also, when sending it, should i put it in some kind of envelope? inside of the mailing one? I thought i saw somewhere to use the USPS, theres a way of asking to have a signature so you can track it and know when it arrives isn't there? or is that UPS? I know i read it somewhere but can't seem to find it now

The requirement is having met in person in the last two years. It's not how many times you call each other. Work on things that show you in his town/country or him in yours. He had some credit card bills showing purchases in my town and vice versa for me. That was dated evidence of being in the same town where the other lived. Yes use passport stamps, boarding passes, receipts (credit card or ATM...anything showing meeting. The Skype isn't important if you've got the other. Photocopies of everything is fine.

thank you, i searched my email but they must've gotten deleted. however i have all mine lol, he doesn't have his! so unfortunately he's not in right now but i'm hoping when he gets home he will have them in his email

on the skype front, I tried searching and found something but its not really working for me so i'm getting extremely irritated with that front. esp as we have lots and lots of phone calls between us since we started using it. also, i'm wondering how to do my blackberry messages. we've had them for a couple years now an dhave been using the messenger on there to keep in touch. however i dont want to print out every single message cause its easily over 100 pages long at least.

Do make copies of your boarding passes - those are great!

Assuming you booked your flights online, do you happen to have the itineraries stashed away in your old email somewhere? I was surprised what a search in Gmail brought up for me :-)

Pictures are secondary - so it's good that you have boarding passes and all that. No, the photos do not need to be on photo paper - but do remember to make note of who's in the photo, date and approx where you are.

Can't help on the Skype front, but I know this question's been asked before, so I'm sure someone will pop along wiht an answer. All the best!

so I'm looking at this as I'm wanting to send this out tomorrow after getting my passport photo, and I have my boarding passes going into London, will those be alright if i make copies of them? do i have to show my return ticket as well? and well I'm not sure if you can find your itinerary for your past trips because he cannot find his boarding pass for his last visit here in february. bit bummed about that and I'm wondering if it's going to cause a problem or not? i have emailed to see if they can send me them in an email and i can just print them out but haven't heard anything from the airline yet. I also have a lot of pictures, and I want to keep my originals as i only have one so i can make copies, but do they have to be on photo paper??? also, we have a lot of skype phone calls - does anyone know how to print out a log of the phone calls between us??? i dont want to print out all of it cause its got to be a whole lot of paper that I'm sure they don't want to go through. thank you !!!!

another quick question - when is he allowed to travel back home? his sister is supposed to be getting married and I know he would like to go home for that. After he is approved for the K1 can he travel back and forth? or do we have to wait a certain amount of time for that as well??? The wedding is next July.

A number of years ago, through a loophole created by the way the requirements for employment were phrased, K-1's arriving at certain POEs (Kennedy Airport, for example) could be issued an EAD that would be stapled in their passports and would be valid for 90 days - the period of their authorized stay. That loophole was closed a number of years ago so now it is clearly evidenced that entering on a K-1 visa does not authorize one to get an Employment Authorization on entering the US. They are, however, allowed to apply for one. This is probably what you have read or heard about.

Every EAD that is issued is based upon the current legal status of the individual. An EAD issued for a K-1 would be valid for the same length of time of the authorized entry by the K-1 - that is, 90 days. The only problem is that it takes at least 2 to 3 months for an EAD to be processed so in many cases, the K-1 entry status would have expired even before the EAD was even issued. As it costs several hundred dollars even to apply, it just isn't worth it.

So, the better plan is to enter on the K-1, get married and then apply for the EAD at the same time as the AOS. This EAD is not based on the K-1 status but on the AOS applicant status and will be valid for 1 year or until the AOS is approved. If the AOS takes more than one year to approve, the EAD can be renewed. The cost of the EAD application is included in with the fee for the AOS.

Sent off application, just trying to get next step in order

okay, so it has been sent off, and yes i know it will take some time to get approved. however, once they do approve it I want to verify the documents needed so daniel knows what to fill out once he receives packet 3 (which I believe is the next step after approval here in the U.S.)

He will need to have documents :

DS - 230
DS - 156 (and he needs both the DS-156 and DS- 156F??) (we are applying for the fiance visa)
It is just him, as he has no children so we won't need to fill out the DS-157 correct?
DS- 2001

Then I understand he needs to then get his medical done and get an interview date, in which he has to bring what I sent off in the first packet, and then proof of the wedding ceremony possibly and our relationship? just to be on the safe side we can send off a log of our skype calls, bbm messages, and some emails. although ive heard london doesn't really worry about those things? Question about that as well, I'd like to have a small wedding so we can save up for a larger one down the road where everyone can come. Do we have to get married in my home state? Or are we able to have a small ceremony elsewhere? I wasn't sure, just knew that he wouldn't be able to leave the country. thanks everyone! you guys are awesome

I know I'm a little bit ahead of myself, but I think that I can fill out what I can, and get answers when I can so I know when the time comes.

Under question 7 in type of business, I'm a pharmacy technician, is this what I would put there? I wasn't sure if it should be Pharmacy or Pharmacy technician.

And when it asks you for an annual income, is this going to be on my tax forms? And do we put on there what we have in a checking account? I also do have stocks, do I have to list every single one I have? I have a guy that does ours for us. I get a statement every few months, but i'm not sure if that is what I'm going to need or not.

And if his interview is in 2012, does that mean the poverty guidelines are going to change? Would the amount that is currently $18,387 have to equal my annual income? I read that if you don't have enough you can use money you have in things like stocks, and make sure you have the difference between what you earn and the amount of the poverty level enough for 5 years?

What is cash surrendered?

I know the police certificate is good for a year, so I dont see why you can't get it now. I also am working with England and we're just waiting now for our NOA2, and even though I know it's giong to be awhile I want to get as much of packet 3 done as possible.

A few logistial questions

I am still waiting on my NOA2 but I like to plan ahead. I have been getting a lot of good info from this site but I it also gave me some ideas that I wanted to run past the community.

1. Proof of ongoing relationship - I am in the really lucky position of being able to travel to see my fiance quite a bit. Since we have filed, I have seen her twice and we have two more trips planned. My question is with all the talk of Skype and phone records, can I send my fiance in to the interview armed with a copy of my passport stamps and photos of us on all our adventures? Would it be better to have both phone records and travel records? My thought is that if we are meeting on a regular basis, that should trump almost any other form of evidence.

Your photos together, passport stamps, and e-tickets should be plenty - especially since you have met several times which is more than is required. We had no phone records and it didn't matter.

2. Assuming we get approved (*crosses fingers*) after the interview, how long does it take to get the package and the actual visa from the consulate?

your wife's passport, with visa inside, will come to her via DHL in 5 or 6 days after her interview

3. Does going to the interview make any difference (bad or good)? I know I cannot be with her when she is being interviewed but I would like to be there for support and to celebrate our hopefully good news. In conjunction with my second question, I also would like to get her packed up and come back over with her as soon as we can. After we get the visa, is there any reason we can't jump on a plane and come home?

Going to the interview makes no difference, and she can get on the plane with you as soon as she has her visa.

4. What's the process for getting through immigration at the POE? I know she has to give the CBP officer her packet and they open it, but I wanted to know how long it would take. I would love to be with her assuming that we fly to the US together so I am also curious if that is an issue or not. Waiting for two hours at the airport when she came over on a tourist visa when she was being grilled was not fun and if I can't travel back with her, I would like to be prepared.

I didn't fly with my wife, but I did not wait long at the airport for her to come out. She had no problems and little delay at POE.

Taxes owed to the government

My fiance currently owes the Canadian government a few thousand dollars in back taxes due to an error from his tax preparer. He has been making steady payments to them of 280.00 a month which was agreed upon by the tax department and him. My question is will he have a problem once we start the immigration process if he still has a balance owed to them? Could this be a reason for his visa to get denied?

Beneficiary Change of Address

So, just to update this post based on my experience...

I called NVC to ask about changing the beneficiary's address. They were very nice and told me that I can change the address while it is at the NVC but they MUST have the case in hand. She said they generally have it for about a week and then it is sent to the Embassy. If the address doesn't get changed while at the NVC, it is possible to contact the embassy and have them change it.

I tried calling after 2 weeks of receiving the NOA2 and they have not received the case yet. So, perhaps the best bet to change an address is about 2-4 weeks (plus a week-long buffer that they will have it) of receiving the NOA2.
