Hi I know its not easy to wait about the processing times. Done with that situation also. So we waited also after my annulment decree. We took K1 visa way back 2008 and we cancel it before the denial. So we just wait till my finality of annulment and after a month we filed the I129F on 2011 and we got approved.

Hello MensahLuv,
My Fiance and I have been talking, emailing, dating for almost 3 years. Been to Ghana once and going again. I was married before to a man that I met here in the U.S. he was from Ghana. He was already here. He had overstayed his Visa when I married him and I filed for him. He is now a U.S. citizen. This was a real marriage. At least based on my part. We have been divorced since 2008. I later found out he had children in Ghana that I never knew about and he filed for them and the mother of the children his now wife after he was a citizen. He denies this but that is neither here nor there. I am just concerned that it will look suspicious (hope not) and I don't even know if that part will be brought up. My mother would have to be a co-sponsor with me.
So based on that what do you think? I am still thinking spousal visa? But I don't understand how the adjustments works when they are spousal or fiance visas?

K1 Visa may be the fastest route to go. That is the fiance visa. It took us 8 months to get interview. Submitted June 2010 and was approved Jan 2011, Receive Visa Febrary and he moved to US in March 2011. Was approved on the first try. My case was 1 of the easier ones. Some people wait about 1 year with the K1. Whether you have to have a second interview is determine on individual basis so I really cant help you there. After fiance arrives in the states you 2 will have 90 days to get married then you will file for Adjustment of status so he can get permanent residence (greencard), which initially will be a 2 year conditional greencare. Then you can later apply for a 10 year greencard. The CR1 can take 2 years or more. With the CR1 you have to be married so that may not be the route if you want your family in the US to be a part of your wedding.

8 months from start to finish? That is a pretty good time line. Do you think if I file in January/February he would be here before the year ends in 2012?

So, I want to marry my FI he is in Ghana. Our story may be a situation may be a little complicated. I was once married for 6.5 years previously to a man from Ghana. I meet him while he was here in Ghana he had over stayed his visa. We married (never had children) and he is now a citizen. We are divorced. I then found out that he had other children in Ghana by a woman that is now his wife and he has since brought them over here. As luck would have it I have met a man from Ghana through a friend and we want to get married.
I would like to find out from other people's experiences what is the best option for us in this situation? We want to get married ASAP but some of what I am reading it says that a CR1 (Spousal visa) takes a very long time. I would like to get married with my mom and family present here in the U.S. but I don't know how long a FI visa takes?
We do want to get married in the next year 2012. What would be best for us and our needs? And knowing about my past situation and that it may cause suspicion or delays?

I would suggest not letting the amount of time it could take be the determining factor. People seem to shy away from the CR1 because they're told it takes longer. In reality it may not be that much longer than the K1. According to the comparison guide, the K1 averages 7.5 months while the CR1 averages 9 months. Our CR1 process took 7 months. The time it takes depends on the case. There are some K1s that took longer than my CR1.

My choice to go with the CR1 was less about how long it would take and more about what privileges my husband would have upon his arrival. For me, an extra month's wait wasn't too bad if it meant he could travel/work/drive immediately. Think about what's more important to you and more beneficial to your situation.

You're so right! I'm been so fixated on how long it will take and possibly planning for a wedding. I hadn't thought much about the other benefits and things that would be important and needed once he arrives.

The K3 has been slowly eliminated from most consular’s, because the K3 takes the same amount of time as the CR1 now.

K3-ia multiple entry visa for up to 2 years without a Green Card. No work privileges.

CR1- Green Card, with all LPR privileges.

Forget the K3, it is not easily available from most consulars. With the CR1(spouse visa) the AOS is done before the visa is issued, which gives you a green card availability upon entery into the US.

I read that the K3 was created to get your spouse here faster. Can you tell me the major differences?

You realize that the wedding would need to take place before you file for the CR1 visa, after it is approved 9 to 12 months later then you would be looking at a reception in Jamaica. So,what are you going to do about your K1 application that is already in the pipeline?

I haven't started any process yet. I still have to decide before I go to Ghana in about a month.

She stated in an earlier post that she has yet to start the process and she's trying to figure out which will be best for her.

Definitely consider getting married in Ghana and apply for spousal visa if you have a desire to travel without waiting. I got married in Dominican Republic. My husband first entered the US on November 2 and we flew to Jamaica 2 days later.

I am considering that. Would both a k3 and CR1 Let him travel as soon as he arrives in the U.S.?

Family can have their vacation then.

I'm thinking of getting married in Ghana and when he finally arrives have a reception/party/vacation in Jamaica. That is an option as well. Even though I really wanted to get married in Jamaica. I can compromise.

I don't know if you had your heart set on Jamaica in the Caribbean particularly, but another option is to get married at a courthouse in the US and then have you wedding ceremony, reception and vacation somewhere else. Because of Visa situations my wife and I did not get legally married at our wedding celebration.

If you went the K-1 route you wouldn't be able to go to Jamaica because your fiancee/spouse won't be allowed to leave the US. But Puerto Rico, Guam, U.S. Virgin Islands and Hawaii are all part of the US if that's the atmosphere you are going for.

The Virgin Islands. That never crossed my mind. That is a very good idea! So, because the V.I. are apart of the U.S. We can get married there and have no problems with coming back and etc. That's a great idea!

Why, the US have lovely beaches aswell.

You're right there are many lovely beaches in the U.S. I just wanted a vacation type destination for me and my family away from the U.S. I will not be getting married on the beach as I am Catholic and it has to be in a church. But I wanted a fun reception and vacation.

I want to get married in Jamaica. My fiance is from Ghana. You don't need a visa to go to Jamaica just a passport. A have a couple of questions. 1) Would the marriage be legal here in the U.S. as far as the U.S. immigration is concerned or do we have to get married in the U.S. for the fiance visa?
2) Can you fiance travel from the U.S. then to Jamaica to get married or will he have travel restrictions because of the fiance visa?

I arranged the internship myself through a sponsor and I am receiving credits for it from my university. Since it is not government sponsored and I don't think the 2 year rule should apply - or?

thank you for your reply. It is all a little bit confusing to me since I am actually only in the Netherlands due to my studies, however I had to deregister from Germany and I am only registered as a resident of the Netherlands legally. I was also wondering if I return back in February whether I should not register myself back in Germany and degister from the Netherlands since as soon as I finish university, I won't have anthything more to do there.

Did you say you just sent in the I-129 sth file and they project you to be done in May/June? Does this mean, you will be able to travel to USA in May/June?

I am hoping to be able to send all my documents in by December 3rd..we'll see!

And concerning the university issue in the USA, I am really not sure how it might work. But thanks for the advice, I'll ask the university.

Hi,

I am a German citizen, residing in the Netherlands due to my studies and live very close to Belgium. Right now I am doing an internship in Michigan and engaged to an American citizen. After I return in February, I hope to be able to come during Summer time and for us to be able to get married.

We are in the process of gathering all the documents/files for the visa process and I was wondering which U.S. Embassy I should go to.

I think I should be able to go to Frankfurt (Germany) since I am a German citizen, but as well to Amsterdam since I officially reside there.
However, to obtain my current J1 visa, I actually went to Brussels (Belgium) to receive my visa since they waiting time is much shorter. I had could make an appointment within 3 days and had my visa the next day after my interview.

I know that in Frankfurt the waiting days are longer, and Amsterdam is similar.

Yet, I am not sure if there is some advantge or some kind of rule that allows/forbids me to only apply for the visa in Amsterdam or Frankfurt and not Belgium. I had chosen Brussels before it was getting very close to the starting point of my internship and I don't want to be late by going to Frankfurt/Amsterdam.

Is there anyone who is from Europe and knows if there is any rule on which U.S. embassy to choose, since once we file the K1 visa that embassy would be responsible for all the processing. Is there an advantge to go to the country that have the nationality from, in my case Germany?

Side questions: Assuming I would be able to be in USA by next July and everything went smoothly with the fiance visa. Can I start going to university while I am waiting for my AOS?

Right now, I am doing an internship here and won't leave the states until mid February. I was wondering if we could already file the fiance visa,

Yes, you have about 3 more months of waiting and researching. Our NOA2 did not come until right at the 6 month mark. Of course, I missed one question on the I-129F and it cost us an extra 60 days :blink: If you don't have a RFE, then you should be receiving your NOA2 in about 3 more months :thumbs:

In the meantime, you can start collecting your evidence for the interview. IE: phone logs, emails, chats, photos, etc. Research those "DS" forms that will need to be filled out and given to the embassy. You and your fiancee decide which place he/she will need to go in order to complete the medical exam. Don't forget about your affadavit of support, the I-134. You need to work on it and get your employer to write on letter head regarding your employment status, including salary, and recent check stubs. Also, you need a transcript of your tax return (or returns depending on the embassy requirements).

So you see, you have lots to do and that will keep your mind occupied and before you know it, your NOA2 will be in your hands :yes: Good luck to you as you travel down your journey's pathways :D

I sent a lot of the things Like chat logs and pictures. waiting for the Irs to send tax transcipts that will be slow because of all the procrastinators and there taxes. she already has most of the forms that we know about for the embassy.

Hello,

I've recently got engaged and went through the whole process of filling for a fiance visa but im very confused. I want to plan my wedding and know when exactly will i take off from school so it doesnt help not know how long the wait will be. But from what im reading its suppose to be less than a year but does that vary? Like does it depend on where the fiancé is from? Mine is from Yemen so will that have a big effect on how fast the process will go? Someone please help me!

The process length can vary a lot. I think its fairly common to do a civil ceremony after this paperwork is all said and done and have a 'wedding' after.. for my fiance and I we have been waiting nearly 8 months and still haven't received an NOA2 or any RFE's so I think planning a wedding for a year after we had gotten engaged would have been quite risky. We are planning our 'wedding' for about about a year and a few months from now (two years after we were engaged), to ensure we will be able to make it and are just planning on getting married at the courthouse when he arrives to save the hassle of trying to time it right. I'm not sure about the country affecting timing.. but I hope that somewhat helps you with your planning! =]
