Yes, he's on all their birth certificates and he has custody of them due their mother abandoning all of them. And thanks for the reassurance on not to worry. I'm trying not to, honestly!! LOL But I'm sure it's something simple. My husbands went thru fine, with no requests for evidence at all. So he told me not to worry, that if he went thru fine, there shouldn't be a problem with the children. I'll keep you posted if you'd like. I appreciate it!!

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion about DS-230 and interview
We are getting towards the end of our journey (yipee!!) and I'm putting together the pieces we need to mail off the DS-230 packet. I've been reading up to make sure I don't miss anything, and am a little confused on a couple of points. I thought maybe someone might be able to help me out here.

One question is do I need to send a copy of MY birth certificate (I'm the US citizen, my husband is from England) along with it? Will they require a copy of MY previous marriage certificate and divorce? And does my husband need to send a copy of something stating he has legal custody of his 4 children that he's bringing with him to the US?

The other questions about the interview are how much will he have to pay at the interview in London? And does he need to bring his children to the interview as well? Or will they require just him to come (alone)?

My husband lives in England and I live in the US. We have sent in the last of his paperwork and it was received January 6, 2011. We had read that his interview can't be booked until he has his medical, so I asked the NVC and they say he can't book his medical until he has his interview date. So we are confused. He called and booked his medical in London already for Feb 7, 2011 and they gave him a list of things to bring but said nothing about bringing a letter with an interview date. So now we're confused and not sure whether to keep the medical or cancel it and wait. It seems like you always get contradicting information on this journey, it's a wonder anyone makes it thru without developing high blood pressure LOL

Can anyone who's done this recently shed some light on this?? We'd greatly appreciate it! Thanks a lot :thumbs:

My fiance visits backs and forth, the only time that it was a problem and I received a call from the airport upon his arrival was when he was between jobs... after that no problem at all. I am concern though after we file for the K-1 Visa...
A friend of the family told me that it is risky for him to visit while the papers are getting processed but Im not sure what she means by that! He has an stable job in the UK and always has the return ticket with him... I cant wait for him to be home for good!!! Every day is harder!! Im very happy I found this site!

I am in the process of sending my forms as well. I had a friend of the family that is a paralegal go over them and she did say to use None for things such as middle name which I have none... Also for previous husband, none and nothing in the rest of the boxes. I think if you put None and in the next ones n/a is fine but if you leave them blank shouldnt make much difference since you already stated you have no previous husband.

Im sorry to hear this! Unfortunately I am just getting started on the process, I am mailing my I-129F at lunch time so I have no idea how long it will take! Is there anhy way that you could make an appointment with the embasy since they wont discuss it over the phone? That way you may get more info!
You can also check in the immigration timeliness and see how long it took for others there!

So I was all excited this morning when I checked the status of my package and said that it arrived to Texas! I checked it right after lunch sure that nothing change since it was sent to a PO Box and it was not going to be out for delivery when this message came up "We attempted to deliver your item at 10:12 am on August 19, 2011 in DALLAS, TX 75222 and a notice was left because an authorized recipient was not available"

What does that mean?? I would understand if it was sent to an actual person but it was for the USCIS and PO Box!!!

I had to choose between the two options too! It is a hard choise because I had a friend that got married to her Mexican fiance while she visited and she claims she got her green card in 4 months but I am pretty sure it was not that easy... I was told by another friend that she cant leave the country until everything is done!
I talked to a friend of the family who works for a law firm in the immigration side... I dont know how much they charge but I can tell you that I just sent the I-129F form for the K-1 visa and it is not very difficult! yes it is nervewrecking and stressful but anyone can do it! just pay extra attention and double check the all the papers! This website is great full of examples and support!
I chose to do it the right way because my fiance while Italian lives in the UK and has a 7 year old and god forbid anything happens to her and he not being able to be there.. the relationship as it is is not the best as it is thanks to the mom.

Seems like I keep having little obstacles in my way... I checked my bank account today and just realized that I dont have enough to cover for the $340 check that I cut last week for the I-129F... Im making a deposit at lunch time but I am still freaking out! What if the check bounces? OMG that would be awful and it would delay the process!
Does anyone know how long it usually takes for the USCIS to deposit the check? I sent my app on tuesday and was received on friday afternoon... I really dont know how the process goes from there.. so my question is... do I need to be worried? Ill make it to the bank in about 4 hrs!!!

I just want to hear back from them soon! the wait is killing me! I have all those different scenarios in my head!

Fingers crossed! USCIA Please give me about 5 hrs!!

I think all I-129F go to Dallas if they are sent by USPS and a different addres if courier service. The service center I believe it goes by zip code and you can look it up in the USCIS website.

Im afraid I cant help much on that subject because I havent made it that far. What I can say is that the paralegal that helped me get my I-129F filled out right told me that India is a country with high fraud when it comes to coming into the US and so they are extremely careful and as soon as something doesnt match it gets rejected... with that said you submitted all the info and seems like everything is legitimate and so I dont think you should worry!

I had the same problem when I was about to send mine... the expiration date and no new version. I asked a friend of the family that works at a law firm and she said that it was okay since the site said Previous Editiobs Accepted. As far as the typo goes I guess it depends on how serious the typo is... I double and triple checked my forms but itts always a possibility that I missed something! Hopefully nothing too important that will delay the petition.

I sent mine last week and am now waiting to hear back!

Yesterday I received the first notice stating that they received my I-129F and that it was going to get processed! I know its only the start but I am sooo excited! According to VJ says that I can expect the NOA2 between dec. 19 and jan. 3! I want to hear back already! At first I had no idea the process was so long and it had to go so many different places! Thank you to all of you that share info and helped me to keep calm (and carry on!)

I was wondering if I should start fillinf the papers for the next steps or just wait until I hear back from them in december or whenever it is! Im really not familiar with the next steps!

Two centimeters is not very much, I suggest you just cut 1 cm from each side that is less valuable. I dont think walgreens or cvs are able to do that and if they shrink it you will loose the resolution... old school trim I believe is the best option here!

The process can be super confusing at the beginning so I recommend reading and re-reading! I dont remember needing the birth certificate at the time I applied for the I-129F, I think in the example forms you can use a different document to show proof of citizenship such as passport. VJ does a great job with the examples of forms so yuo should nbe able to find it there. As far as the pictures go yes you will need the real pictures not copies of passport. And 3rd, since he has working visas for the US are you sure you need to file for a fiance visa? ypu may be able to marry him and do an adjustment of status but dont quote me! do some research.

Im really sorry to hear that the fathe ris not cooperating... I havent had to deal with this issue yet but I know it will come eventually. My fiance has a 8 year old girl and his ex wife just doesnt cooperate and is the worst person that I had to deal with in my life... We know that she wont let her come with us not even for vacations! Its very sad to see that parents do that to their own childs... they are limiting their future and chances to be better...

I think that in your case you will have to get lawyers involved if he is not willing to sign the documents required.

Hello VJ friends and thank you for reading my post!

I got laid off from work last Monday in an attempt to save the company, their cash flow is really weak at the moment and my work is very well done by the AP lady and so I am now collecting unemployment and studying for the CPA exam full time. I was wondering how or if at all this will impact the process of the visa. I do plan on getting a job back but right now Im living with my parents so I will focus on getting the exams out the license and a career change... from Staff Accountant to CPA which is really what I always wanted. So my questions is this, I received the NOA1 last week of August and so it was estimated that I would hear back (hopefully, fingers crossed!) in december for NOA2. Is it then that I have to show proof of support? Im a bit concern because I dont want to have to get another job in a hurry but I dont want to delay the process anymore!

I know that this topic has been covered more than once, but I have a small related question. I know that when we assemble the I-129F package we should punch two holes in each document and use ACCO-type fasteners. Also I see that we should not use binders or folders and if you use tabs place them at the bottom of the pages. What I was wondering was which documents do you fasten together. Do we make one big pile that is fastened together or a "Petitioner" pile and a "Beneficiary" pile? I know this seems like a little thing, but I just don't want to ruffle anyone's feathers, if you know what mean?

It's just on the J1 visa, and not even all J1 visas. He receives government funding to go to university, and that's what they base the 2-year rule on. If you check the box that says you receive governemnt funding, they automatically give you the 2-year rule. Don't ask me why. If we had known this at the time he was applying for his student visa, maybe he wouldn't have been so honest... but it's all done now.

Hi everyone, I'm new to this website. My fiance is from England & I'm from Michigan. He has just finished a year studying abroad in San Fransisco on the J1 visa. He has a 2-year rule on his visa, meaning he can't come back and live in the US until summer 2011. We were planning on applying for a waiver & getting a no-objection statement from the UK government, so he wouldn't have to worry about the 2-year rule. He is back in England finishing his last year of university, so he only needs to be there for 1 year anyways. We were planning on applying for the K1 visa after he gets his 2-year rule waived, so we can get married in 2010 after he graduates.

The problem is... we have just tried to start this process, and it appears that the 2-year rule is geared towards people who are not going back to their home country at all & want to stay here and become permanent residents. With the K1, you don't get permanent resident status until after you get married & after the 90 days has passed, right? I am worried if we get the 2-year rule waived, he won't be able to get a K1 right away because he would be doing things backwards.

It's all very overwhelming and I am just wondering if anyone has any advice. We want to get married as soon as possible. We've been long distance for 2 years already, and the thought of waiting another 2 years before we can get married is just awful! Especially since he's back in England now, so we'll only see each other every 5 or 6 months, instead of every 3 months when he was in SF.

Any help is appreciated!

BAYVIEW PARK HOTEL: We arrived into Manila in the afternoon the day before and checked into the Bayview Park Hotel for 1 night. It is located across the street from the US Embassy. We were on the 10th floor with a direct view of the Embassy Street Entrance for K1 applicants. Reservation was made over the internet on the Hotel's direct web site. Rate was $75/night for double. Web site provided efficient real time processing. Used US issued Visa card with no problem Immediate confirmation: both on-screen and emailed. One issue was that the Web "Advertisement" stated breakfast buffet was included, but the confirmation made no mention of it. On check in, was told confirmed reservation did not include breakfast. No big deal to us - but a little shady...

The hotel is a 15 story hotel. 200 rooms or so. 3 classes: DELUXE and two levels of "suites". By filipino standards, it was not bad. By US standards, it was like an old tired "Best Western". OK - just run down. frayed carpets, cracks on the walls, missing grout in the bathroom, chipped furniture. Mattress was good. Base room rate was $59 - but with all the taxes - total was $75. billed in pesos, conversion rate ok at 41.5/dollar. They are pretty strict about late checkouts after 1pm. There is an escalating late check out fee that goes up each hour until, by 6pm, its the price of another full night. The good news is that most likely you will be back from the embassy by 12 or 12:30pm and will be able to check out before 1pm.

Our interview time was at 7:30pm. We arrived at 7:15am. No lines at all at guarded street entrance nor the security checkpoint going inside the embassy building. We were in the "blue seats" within 5 minutes of walking up to the outside gate.

Step 1: All 7:30am appointments were seated together. Starting about 7:40am, the group was directed to the first station to get a ticket number and submit DS forms and appointment letter. There were maybe 70 people in the 7:30am group. The 70 people were sent in order of arrival. It took about 45 minutes for all 70 to get through and get there numbers. From a few inquiries, it seemed that the first of the 7:30am appointment group arrived before 4am and the last arrived approximately 7:45am. We arrived about 7:15. For my money, I wouldn't trade the 45 minute "advance" that the first folks in the group got for the 3.5 - 4 hour wait that it cost them. I was glad we came over to to the embassy just a few minutes before our appointment time.

Step 2. About 9am we were called for fingerprint scanning. Nice filipinos working at that station. TinTin had to redo her scans about 7 times, but finally they came out clear enough. There was some hypothesis being discussed that the problem was hand lotion she had used. Don't know for sure, but after wiping her hands off a few times, got a scan that was "good enough" to be accepted.

Step 3. About 10:45am was called to window for prescreening. Filipino woman was "efficient". She wasnt overtly friendly - nor overtly mean. Asked a few questions - Who was I? When did I arrive in the Philippines? How many visits did I make? How did TinTin meet me? Any prior foreign travel for TinTin? Collected NBI, BC, Affadavit of support, 2007 ITR, 1099s, Letter of Self Employment, Bank Account Statements. Did NOT ask for CENOMAR. Looked briefly at photo album. Not interested in any other proofs of relationships (letters, chat logs, plane ticket boarding passes, etc) She really acted like she was just interested in collecting information for the American Consul - she didn't seem interested in the information, just transcribing some things onto a worksheet and collecting documents. She didn't care if she got the info from TinTin or Me - she just wanted forms and info. Total time less than 5 minutes.

Step 4. About 11:15 was called to room for American Consul interview. TinTin and I walked in together, and said Good Morning. This guy was a total piece of work. Young, arrogant, disinterested. Didn't bother to reply with even a hello. Immediatey "dismissed" me with "Step outside, I'll let you know if I need you". That curt..no nice to meet you, could you step out for a while, I would like to speak with tintin in private..thank you....nothing. without even making eye contact: "Step outside, I'll let you know if I need you." Needless to say, I was pissed! So, I stepped outside after making a point to get his eye contact and say "Good Morning" again.. grrrr..... TinTin was inside only about 5 minutes. Simple questions. Any previous marriages her, me. Any children her, me. What do I do for a living. Very Simple questions, TinTin said he never even made eye contact with her - just kept his eyes on his computer and asked the questions. "After 5 mnutes, he said, Ok you are approved. Step outside." TinTin then said that we had a letter for him. He looked up - suprised - and said "a letter??" It was a written request to pick up the visa at the embassy rather than wait on Delbros. He checked with one of his colleagues and then came back and said OK. Now please wait outside. Just an all around pissy attitude - not someone who should be working with human beings! (I know, I know, we ARE happy that the day went smoothly, no tough questions, no issues, approved visa, approved for embassy visa pickup - but as an American, I was certainly embarrassed to have this guy be the "poster boy" for TinTin's first dealing with an American. And it was pretty damn insulting to be dismissed without even a "Hello, would you mind waiting outside for a few minutes" by some beaurocratic peon.)

Step 5: Releasing Window at 11:50am. Almost everyone that was in front of us (5 different people) was being told they were on A.R. pending a variety of documents that they needed and were missing. The list was quite amazing - many basic things like no Last Year's ITR, no W-2, No DS-157. No Medical exam yet (!), wrong size pictures, etc. And all 5 got the word that they will be contacted in 4-6 weeks after Document Verification was completed. Most seemed not to know anything about what Document Verification was.

A NOTE ON DOCUMENT VERIFICATION: We paid for Document Verification exactly 4 weeks before our embassy interview. We texted Delbros per their procedure and received back the confirmation texts from them the same day we paid. Even so, I called the embassy 3 weeks in advance of our interview to confirm that our document verification had been completed and make sure that all was fine. Suprise suprise - I found that the embassy had no information that we had paid the delbros fee yet and therefore the Doc Verification process had not been started. I called delbros that day, had them call the embassy that day and also sent a fax with payment receipts and delbros confirmation text messages to the embassy that same day. I then called back every day for the next 4 days until the embassy confirmed that we had been submitted to NSO for the doc verification to commence. Our name/paperwork was submitted to NSO on Monday 24 March. We confirmed during the interview today that that document verification had, in fact, been completed prior to our interview. (so that means it was completed in no more than 9 business days) There are a lot of threads on VJ on the document verification process. My recommmendation while they are still working out the kinks in this new process is that you pester the heck out of both delbros and the embassy well before your interview date to ensure that they get it done before your interview. They did have a copy of TinTin's Cenomar in her file, which they did NOT get from us - so my assumption is that it came from the document verification process.

Well, next stop is a last trip back to Samar to say goodbye to the family there, then CFO, then to the airport heading to the West Coast of the US.

I had the same worries like you when we were starting the process. I am also a single mom with two kids and we just finished our K1/K2 interview last week.

If you are not married and has never been married to the biological father then you have automatic sole custody of the child and therefore you won't need any waiver or any letter of consent from the biological father, even if your EX signed and acknowledged his paternity on your child's BC.

Some single mom who went to interview with their kids was never asked anything about the biological father, in my case I was asked:
1. When did the biological father left?
2. When was the last time the biological father has seen his kids?
3. So you were never married to their father?
4. Are your kids in contact with their father?

My case is that, I was separated with the biological father of my kids when our youngest was just 6months. My daughter is now 10(would be 11 by nov.) while my son is 8years old (would be 9 by sept). So basically, it has been over 8years already. He has signed and aknowledged his paternity over my kids on their BC but we were never married. Their father never extended financial support since he left.

Are you still in contact with the biological father? Does he give financial support? I don't know your answer to these questions but it will be best if you will not mention anything about the biological father to the prescreener or consul. Do not complicate things by mentioning about him being able to petition his child etc... Just wait till they ask you anything about your ex and make your answer very very brief. You don't want to give the impression that you are still very much attached to the ex right...

You are on K1, your child who is on K2 is your derivative. the embassy will not be concern on the eligibility of your child to become a US citizen, rather they will be concern on:
1.Your bonafide/authentic/real/genuine relationship with your petitioner

2.Your eligibility to marry your petitioner (his eligibility to marry you is the concern and has been checked by USCIS during initial petition application)

3.Your petitioner's financial capacity to support you when you and your daughter gets to the US.

hi all.. i just want to know if someone here experienced on getting a parent's consent from biological father. Just dont know what documents needed. I called dswd, they told me that only to married couple they are issuing a travel clearance for the child who's travelling with either of the parent. It just happened that the father acknowledged and signed the birth certificate of our daugther. We are not married.
My story is this. The biological father was petitioned by his mom 2 or 3 years ago and i think he's automatic green card holder as his status when he gets there, im not just sure if he's US Citizen now. I heard legitimate and illegitimate child has the same rights when the biological father wishes to petition his child. I am thinking and based on what i have read with some cases here, embassy is only concerned on the eligibility of the child to become a US Citizen. Since my fiance is a US Citizen and he will petition me and my daughter. On that case my child has two chances to become a US Citizen, one is through the biological father and the other is through my fiance. I think Embassy just wanted to make sure that only either of the two can file the petition. Cant have 2 petitions. My question is, what kind of Waiver do i need to tell the attorney that she will make? Is it like or saying there that the biological father is allowing and giving the rights to my fiance to petition our daughter and will never file under his name? Just to prove the embassy that the biological father will never file.

I really wanted to be ready incase embassy will asked me for the proof. Any help on this matter will be much appreciated. Tyvm.
