Yes, we need to send the original affidavits and there is no need to get those notarized.

 

Thanks for confirming! I just don't understand what they mean by "Affidavits sworn to or affirmed by at least two people...".

Thanks for replying, Severina!  Did you send originals of affidavits or photocopies only?

 

The instructions of I-751 say that you should send original affidavits (you find that under Evidence of Relationship, 5.). So I sent the affidavits with the original signature (I did make copies before sending smile.png ). However, I did not have them notarized. Some people here say that you should notarize and others say you don't have to. So we will see what will happen. I only sent the package last Friday so I can't say anything yet. Good luck to you!

I also sent a letter explaining our situation. We do not have much financial comingling and I explained why step by step. I think this is a better thing to do than to not send evidence in and later get an RFE. Since I mailed my package yesterday I don't know what's going to happen. Hopefully we will get approved right away. The letter was signed only by me (the permanent resident). Since the USCIS addressed only me in the reminder letter for ROC I thought it is OK if I signed it. The form I-751, of course, was signed by both of us and I also stated in the letter that we file jointly. The affidavits were dated August and September. I think it makes sense that they should be dated close to the filing date.

Well, in September I filed for ROC and had my biometrics. A few weeks later I received the devastating news that my mom was diagnosed with Alzheimer's disease. This changes everything, I have to be with my family. My husband and I agreed that I will go back to Germany in March next year. I will not return, instead my husband will come to live with me in Germany. We are aware that it might take a while until he will be able to come since I have to find a job, apartment etc. and he has to organize a lot of stuff here. So I have a few concerns at the moment. As the processing time for the ROC can take up to a year I will probably not have my new Green Card before I leave. I read on the Internet that there's a proper process to abandon your Green Card with form I-407. Sounds like a clean process. But what do you do when you don't have your new Green Card yet? I assume I have to withdraw the petition. Does anybody know how you do that? Do you send a letter to your service center? Also I wonder if you will get a confirmation. It might be important to have that with regard to the IRS. Apart from that I wonder if I will be able to enter the US under the VWP again. I'm very scared that there might be some emergency here and I would have to apply for a tourist visa which will take I don't know how long. Has anybody here experienced a similar situation? Any help will be highly appreciated.

blink.gif WHAT???? I never ever asked to break the law. There are ways for him to come into the US LEGALLY and apply for his immigration from this side. This is all I'm asking for, not how to circumvent the law. Which is why I said "we want to be legal". And there are legal ways, we are just looking for the BEST legal way. Which is why I asked here for others who have come to the US and filed from this side how they did it. I apologize if you took it any other way than that, as it was absolutely NOT intended to be seeking advice for UN legal ways. That is not how we are. Thank you for your time.

I called USCIS and they won't tell me the receipt number, said to call back in 30 days if we don't get a receipt. So I guess we wait. Yes, he can visit you even when the case pending. I had visited my husband 4 times under this visa process, I used the Visa Waiver, and sometimes I stayed 3 months sometimes 2 weeks.

Take with you some good documents to show them, if they asking you. I had always bring with me a letter from my chief, that I work and have vacation, land to the house and apartment, housing contracts, bank statements and return tickets and and,,

But, if they don’t trust on you, they can send you back with the next flight. It’s not illegal to use the tourist visa when you case still pending.

I became a citizen on March and got my passport expedited a week before going outside the US. I believe you dont need to send the documents, you can fill the app online and then go to the post office or a special center if you need it expedited (additional charge for that). The green card will be destroyed when you get the Naturalization certificate and you need to present the original, they will keep it and then send it back to you so make sure you have copies! Im not sure how minors work since here at the age of 16 you have certain priviledgies...

K-3 was developed at a time when CR-1 was taking much longer that today, NVC has greatly streamlined the CR-1 process to the point where K-3 becomes irrelevant.

As mentioned, you're fine to marry here, without any paperwork (well, immigration paperwork, marriage licences, etc, that's all up to you and your state), so long as he's going to leave.

I would advise, however, that when he arrives in the US and they ask why, he says "to visit fiance" or family or whatever, and not volunteer "here for my wedding." That wouldn't be lying to them - it would just be not shooting himself in the foot. If he's leaving anyway, no need to create headaches and a possible refusal. You'll most likely be fine.


Okay, we had thought about doing that but wasn't sure if it would be "illegal" or anything. I told him about your advice, and he asked me to pose the question the other way. What about me going to the UK to get married? I wouldn't be able to move there right off as I have to tie up lose ends here in the US first. But can we do the same thing? Just me going to visit and us quietly getting married there? Or would that violate a law or something? Anyone know? Thanks to you all for your invaluable advice as this is so new to the both of us!!

Okay, I'm American (born & raised in Mid-Michigan), my fiancee is a British citizen. What would we have to do to get married here, but him not moving here? He wants me to move there to England eventually, but it will take a while to do that yet. Do we still need to get him a visa and such to just get married here? Hello everyone, I'm new to this process. I'm an American citizen, born and raised in Michigan. My husband is a UK citizen, born and raised in England. We were married last August over in England. Up till now, we had planned on me moving there to the UK, but now things have come up and he's going to move here to the US. So now we've put the brakes on and are reversing directions here. I find that researching what we need to do for him to come here is far more complex and complicated.

Okay, so I spoke with a woman at the USCIS this morning. She said we need to start with an I-130 along with a G325A, then file a I-129F with his children added to it, then follow it with a K-3 (and K-4 for the children). Okay, so what confuses me is I can't find a form for a K-3 or K-4. Can someone point me in the right direction? Also she said the K-3 would have to be filed in the country we got married in? Which would be England? Am I incorrect?

Also, I was told we need a sponsor who makes a lot of money and can prove they can support him and his children and stay above 125% of the poverty line?? Is this correct? This disheartens me as everyone I know is broke like me.

His main concern is it having financial reprocussions on his family, which I can understand, even tho he knows we'd never stick him with anything. Now, my question is this...my husband said somewhere (and he can't remember where) he seen a clause or rider contract that he can sign releasing the sponsor of any financial responsibilities. My ex said he was interested in seeing this form or website, but the poblem is that my husband can't find it again. I've been searching as well with no luck.

Does anyone on here know where to point us for this form? A website link, form name or anything like that? We'd be ever so grateful! Thanks so much.

My 2 cents is continue to pursue the CR-1. In the end, it is the best visa since you do not have to adjust status and hubby can work as soon as he is admitted to the US. Plus, waiting times are not that different anymore. But indeed, he should not come to the US with the intent of adjusting status.

Its important to keep in mind that terminology matters very much, and misunderstanding of the terminology can cause problems. Also, the USCIS 1-800 Customer Service line is famous for giving out misinformation, so take the information you receive from there with the proverbial grain of salt.

A visitor's visa is just that....a visa allowing the beneficiary to come and visit the US. Using that visa for any other purpose, constitutes fraud. So, for example, using a tourist visa to come here and work would constitute fraud....just as it would if a man married to a US citizen were to use his tourist/visitors visa to come here and subsequently declare a desire to emigrate by filing the set of petitions you mentioned.
You would do best to read and re-read the Guides here on VJ as they offer a wealth of information....and do just what you've done, ask questions if you're unclear about anything. smile.gif

Exactly, thank you. The USCIS said he could come on a visitors visa, then the embassy in London told him he'd have to return regardless. so we were confused. but we never intended to overstay, and the USCIS said he would have to adjust his status once he arrived on the visitor's visa. we ARE doing this the legal way, it's our family and life here, no way we're wanting to do anything even remotely illegal. which is why i'm asking questions here.
