hi all.. i just want to know if someone here experienced on getting a parent's consent from biological father. Just dont know what documents needed. I called dswd, they told me that only to married couple they are issuing a travel clearance for the child who's travelling with either of the parent. It just happened that the father acknowledged and signed the birth certificate of our daugther. We are not married.
My story is this. The biological father was petitioned by his mom 2 or 3 years ago and i think he's automatic green card holder as his status when he gets there, im not just sure if he's US Citizen now. I heard legitimate and illegitimate child has the same rights when the biological father wishes to petition his child. I am thinking and based on what i have read with some cases here, embassy is only concerned on the eligibility of the child to become a US Citizen. Since my fiance is a US Citizen and he will petition me and my daughter. On that case my child has two chances to become a US Citizen, one is through the biological father and the other is through my fiance. I think Embassy just wanted to make sure that only either of the two can file the petition. Cant have 2 petitions. My question is, what kind of Waiver do i need to tell the attorney that she will make? Is it like or saying there that the biological father is allowing and giving the rights to my fiance to petition our daughter and will never file under his name? Just to prove the embassy that the biological father will never file.

I really wanted to be ready incase embassy will asked me for the proof. Any help on this matter will be much appreciated. Tyvm.

In anyones experience or opinion, will i need a co-sponsor if my income is only slightly over the 125% poverty level?

The guidelines for 2008 say $22,000 for a family of 3, to which i will be making an estimated $23,500-$24,000 this year.

Does anyone know if they follow the guidelines closely and possibly take into consideration that my past few years were much higher but due to a recent job change it has been lowered?

Finally, i'm done with my tension for now. I had my interview at USEM Manila yesterday May 12, 2008. Arrived before 6:30am and my first fell in line at security to enter the embassy, where they posted IR1/Cr1/K1/K3 Non-immigrants visa applicants. It wasn't long line there compared with the other two lines (for other applicants). There were different lines also for "seafarers", that's probably the some people said who had had previous interview at USEM where they said we should arrive so early. But there's nothing to worry about that. Those long lines were different from us.(who has scheduled interview at the consul).
At this security check, he asked for my appointment letter that embassy sent me, i told him i didn't receive any packet from USEM, what i have was e-mail appointment letter that they sent us right after I scheduled my interview, i told him briefly this is what i showed also in St. Lukes and the guard noticed that there's St.Lukes marked on my appointment letter, he just uttered "hindi co yata alam yun ah, ok cge patingin nalang I.d mo", i showed him only my postal i.d, and he let me in.

(Hey guys, don't bother anymore to bring your cellphones or any gadgets, because there is really no way you can store it in USEM, though there are this outside people who will charge you P200 for you to give them your cellphones and you will be given by number for you to claim it later. Well , this people are not working at USEM. It's up to you guys, either you entrust your phone to these outside people and pay P200 for them to keep your phone while your still inside the Embassy or just leave your phone in your house, for me i didn't bring my phone, i just left at the hotel.)

At second security, the guard asked again my appointment and i showed him and he instructed me to window 3, it's where I put all my things to their x-ray machine for security check. After this, the guard instructed me to embassy pavillion. (geez! this was a wrong instruction he gave me, been in pavillion, fell in line for almost 40 mins and when i was almost finished at the line, when the staff checked my ds156 and ds157 he said, ma'am You should be at the immigrants section. There were few of us also in K3 and K1 there who got wrong instructions from the guard from the window 3. So, the staff told us to to go to immigrants section. When we got there, there were many people already, wow, just because of that wrong instruction.Those some applicants who were scheduled for 8:30am were ahead of us already. But it's okay. It's past already.


Ok here's the steps i have done yesterday inside the Immigrants Section. (don't worry guys we won't be going to different floors here, its only in this Immigrant Section big room that everything will happen from the 1.checking of ds forms, 2.finger scanning, 3.pre-screening,4. consul interview, and 5.delbros- payment of visa delivery, unlike in St. Lukes different floors to get all things done so we won't be needing back and forth from time to time at USEM.)

1. GIVING NUMBER. Fell in line to window _ , they asked 2 sets of ds 156, 2 sets ds 157, and appointment letter.(Since I am K3, i didn't have the DS156k, for K1 you will be asked for this). After the woman check mine, she gave me number, this number was important so don't lose it. I then took sit again at waiting area.
2.FINGER SCANNING. From the window where I gave my DS forms and appointment letter, its here where we will hear if our names will be called already for Finger scanning. When i heard my name i went to window _ for Finger scanning.(if your palms perspiring just make sure you dry it before you put it in the finger scanning machine, don't worry also, there's staff here that will assist you and hold your fingers for the scanning.) After finger scanning, i then took a sit again at waiting area.
3. PRE-SCREENING. My number flashed at the board and the window where i will go. I then proceed to window _ for pre-screening of my docs. Here, the guy only asked to give him first: NSO Birth Certificate, NSO Marriage Certificate and NBI.
After he checked what i gave him, he then second asked me again to give him the following; Affidavit of Support (134) W2s, and Tax Transcripts. ( i gave him 2005,2006,2007 W2s and 2005,2006,2007 tax transcripts, Affidavit of Support and Employment letters.) After he checked it, he gave back the employment letters to me.
* with pre-screening here i was asked, (my pre-screener was a handsome gay and he seemed nice)
-who is your petitioner
-when is his birthday
-what's his work
-how i met my husband
-when i first met my husband in person
-how long he stayed in Philippines
-what date exactly he got here in Philippines
-when did we get married
-how long my husband stayed in Philippines
-were you married before
-were your husband married before
-do you have kids
-does your husband has kids

The third he asked me to give him were pictures. I gave him pictures, of me and my husband with my family and with his family. The pre-screener then asked "Is your husband a muslim?", i answered "No, he is not, he is american.", by flipping the pics, He also commented , "he is still young and handsome like you, you two are meant for each other." I said "thank you sir", and then he asked me , "have you experience to travel abroad or international flights", i answered "No, not yet Sir."and then he gave me some advises about nothing to worry about , it's important that i get a good sit at plane so i will be comfortable with the flight. I said "thank you sir for that tips". Once again he looked at our pics, and then i asked him, "do you need anything or any proofs Sir?" and he said , "No, this is enough already" , "Ok, you can go back to your seat and wait again for your number to be called. Thank you", I answered "ok sir, Thank you po."


At the waiting area, i sighed and i felt something a bit upset because they never looked at my evidences, i brought so much of our proofs and evidences that weighs almost 7 kilos, geez! until now i have back pain for carrying this.


4.CONSUL INTERVIEW.
I couldn't say i have had a friendly consul, unlike others had. What i had was a tall American woman with i think in her 30's with very short hair. I greeted her "Good Afternoon", she didn't greeted me back though, she just said "have a seat." She asked me the same questions what my pre-screener asked me. Plus she asked me some additional questions. She even told me "i think you need to be grilled", then she smiled. She also gave some comments, "So you were 23 or 24 when you met your husband". i answered her, "i am 23 when i met my husband." She asked me, "what did you like most about him?", I answered, "He is so thoughtful, no matter how busy he was he always finds time to give time to me even when he was still in Afghanistan. " She then uttered, "oh he is a Military" , i said "Yes Ma'am".
Then once more he flipped our pictures, and she said "i think everything is all fine."

Then she explained brief about the document verification. She asked me if i paid for it, i said yes i did. And she said, The USEM requires document verification so to make sure there are no fake marriages or no fake identities to all applicants. She then said "Ok, i think everything is okay now. You will need to wait for your name to be called once again for one last time." And i said "thank you Ma'am", and she said "thank you"

I then took a sit again at waiting area. After few minutes my name has been called, i went to window_ and the girl gave me back the appointment letter plus the instruction to pay the Delbros visa delivery.

5. DELBROS Visa delivery payment.
They gave me form to fill up for visa delivery and i paid P400 for delivery fee, i put my address in Bataan is why P400, if only Manila area it's only P250. (I saw some someone from Cebu she paid more than P500.)

Finished before 12pm. And was so tired and exhausted because of too much pressure the past few days. The first days of my mens period came the morning of my interview, because of the nervousness i felt i think. haha.

At 5pm i met Relyn at MOA and check the possible place for Eyeball meeting. Will be posting about the infos at the eyeball thread.

Woke up at 4am, Cloe fetched us with his dad and arrived USEM at around 6am. Went on line for appointment letter/ID check, scanning of things and went right away to sit on the blue chairs.

Waited to get instructed to line up again for DS-forms checking, pictures attached and no blanks left unanswered. Stub will be given as your cue number.

Was called for finger scanning at window 16.

Watched out for our number to be flashed for pre-screening. Was getting nervous until assigned to window 24, she was nice that you won't feel nervous at all as she asks you.

*We greeted each other 'good morning'!
*Was asked the following questions:
How we met? when?
When was his first visit?
Any other visits?
What's age? my age?
What's his job?
What course I finished in college?
If I still see the girls' father?
She asked the girls their names and age.

Asked from me our birth certificates (wasn't expecting since my fiance' submitted them with I-129F) good I have them, NBI clearance, CENOMAR, affidavit of support, ITR, money remittances, pictures and emails. She complimented me on the emails for using good quality papers,LOL. That's all she asked from me, I was wanting to give her more to lighten the weight of my bag. laughing.gif Too bad she did not even a single printed chat from one of our talks for 2 years, NO!

Went back for a seat and waited for our number be cued for the final interview. Assigned at RM27, waited for 15mins I guess for an interviewee to finish ahead of us, was seeing RM28 has interviewed about 3 already and we haven't started yet which goes to show our CO might give us a hard time.

As we enter, we greeted her with my daughter saying 'good morning po' laughing.gif She likewise greeted us. The CO is in her 30's, pretty and simply brushed up her hair.
*Raised our right hand for the oath.
*So you are......? yes ma'am.
*Asked the girls' names and ages
*How did you met Michael?
*When did your first talked?
*When was his first visit?
*What's his job? What does he do? I explained in detail.

She kept browsing our album as she asked me questions.

*Ahh, so you are a nurse? You'll have good opportunity there!..thank you ma'am!
*I see your family are all there..how were they able to get there?... t'was through F4 visa ma'am..what's that? My grandparents petitioned us but unfortunately as the visa quota was available, I was more then 21 yrs old then.....ooohh, u were too old to go.. headbonk.gif
*I also see that u were once denied for a visa, why is that? Ma'am I was supposed to attend my aunt's wedding as a bridesmaid but got denied......oohh that was bad. no0pb.gif
*Alexa's registration is late, why is that?...I answered...then she asked me her baptismal certificate...she asked me again...so Portia is late registered?..I said no ma'am, that's Alexa...oh yes, sorry. I think she was just trying to test me how familiar I am with the facts.
*Does the girls have same father? yes ma'am! wink.gif
*Do you still see the girls' father? yes ma'am on unexpected circumstances since he lives on the same city....ok, I understand that. yes.gif
*Can you show me some pictures of you and the girls? I handed her 10 pics each for Portia and Alexa (infancy - pre-adulthood). tongue.gif , hospital pics right after they were born,baptismal, bdays......the CO really looked at them in detail and glances at each of the girls...she again tried to confuse me, is this Alexa? no ma'am, that's Portia.

CO: I think everything's ok, I don't see any problem. All you have to do is go to window 34(cnt remember it right) so your visa could be printed...I replied kindly...our big thanks to you ma'am...the girls dueted, thank you po, goodbye po! laughing.gif She smiled and said welcome.

At Window 34, I was given PINK SLIP only!

What a relief! Our talks was just like very casual though I kept waiting for her to look at us but she didn't. It was me who kept trying to make an eye contact. I think as long as you know every detail, there won't be a problem, that's how I see it. Just be smart, show a little confidence and be professional in answering. Being over prepared with documents is an advantage than be sorry later.

And one thing more.. what if the biodad will send me the consent and of course it will be notarized from the US then the CO will found out that the biodad is a legal permanent resident in US.. will it affect the situation? should i consider getting another possible document from the biodad asked by the CO? Or since he isnt USC yet, will the letter of consent be enough? are they just want to have a proof that the biodad allowed our daughter to immigrate. Oh,we had an agency from Nevada whom we thought will help us all the way(but they did not).They suggest us to get my kids father's consent letter which i refused,Why would i?he certainly abonded my kids.Not fair huh?you raised your kid and now the good future of your daughter is being sacrificed because of someones irresponsibility.he's current residency is i dont think a threat..Goodluck

Finally i get to talked to the biodad and he is willing to cooperate and will send the letter of consent as soon as possible.. and it is confirmed that the petition of his mom for him gets approved and now he's living there as Legal Permanent Resident as status for 2 1/2 years now. And now.. i hope when i get to submit the consent i hope CO wont ask anything again when she gets to find out that the biodad is in the US too, that's the only thing im afraid of. I am thinking the other side of it.. what if i'll just file an abandonment? I really don't know what's the right thing to do. But i've talked to a lawyer and she advised me that it's better to send the consent since i get to find the biodad and willing to cooperate and forget the crazy thinking about his status in the US. Nothing else we can do but to tell the truth and if CO asked for something then so be it need to comply with it and go through the process and wait. Well i guess that's it.. I just hope the consent will be enough. And i trust the Lord, I know He's beside me always. smile.gif

Thanks so much all. I definitely was getting really scared after seeing people say that we can't do it this way. We had no intent of circumventing any process at all. We just decided to take the word of our lawyer. I hope it's not an issue and things go ok for us. I can't imagine being without her now after we've been together for these last 3 months. We had to go through so much to get to this point even. I know many of you do it and I don't know how. I commend you all for that one, that's for sure. I guess when it's love, it's love and you'll do just about anything for it! :thumbs:

Just so you know, we had to go to secondary each and EVERY time she came into the US. She had an issue with a small amount of marijuana at the border before we started dating and she was flagged for it. Of course she got lucky because they didn't make her inadmissible or do a ban, but it still made things very difficult at times. The 3-4 hour drive from Toronto to Michigan turned into a much longer trip because of this. There were times when we were sitting in secondary for 2-3 hours waiting to get admitted. After almost 2 years and probably 50+ times in secondary I felt like it was my second home! Like I said though, for love, it's worth it. :)

Hi all, new to this forum and new to the whole immigration process. If you need some background, check out my thread that I started in the AOS forum, it has all the relevant information. I'll give some cliffs notes just to refresh. For reference I'm a US citizen, and she is a Canadian citizen.

My fiancee is currently visiting me in the US. We've been dating for 2 years now, going back and forth the whole time pretty much every 2 weeks to a month at the most. Obviously we talked about marriage at some point, but nothing was decided. We then found out that one of her childhood friends was an immigration lawyer and we met with him for a consult. He suggested that she not go back to Canada this time, stay here, and that we get married, then file all the paperwork. We talked it over and then her mom said if we wanted, she would pay for the wedding and give us whatever was left over (her father passed, inheritance) for us to keep for immigration funds, living expenses, etc. Therefore we decided to follow the lawyers advice and we are getting married on the 26th of this month (November).

I have a few questions....

She came into the US the first week of September (this year) to visit again. They admitted her as a visitor, no I-94 form. How long do we have to get the AOS paperwork filed? Also what date do they consider this paperwork officially filed, when they get it, or when it was sent?

I know you can't enter this country with the intent of getting married and living here, which is a concern that I have. If they feel that she did this, they can obviously deny us right? Is there any way to prove that this isn't the case? Has anyone done this successfully?

We do have records of all the times we've come and gone because we got pulled into secondary every single time she was with me, due to prior incident which has long been resolved at the border. According to our lawyer this incident (small amount of marijuana) shouldn't and hasn't excluded her from visiting or immigrating to the US.

I'm just looking for other people who have done this. I see most people get the K visa first, and then do everything I am doing now. I'm really hoping the lawyer didn't royally screw this up for us. I'm trying to do everything as transparent and honest as possible to avoid any problems.

I'm a US citizen and my fiancee is Canadian. She dearly misses Canada too. We are going through the process of getting married (the 26th of this month) and then filing all her paperwork after. She plans on staying here during the process and she has been here over 2 months already. So you all know we are looking at some serious time that she's "stuck" here, lol.

She got pretty inebriated on Halloween weekend and she was crying "I want to go back to Canada!" Talk about breaking my heart. She misses her family and friends there. I understand because I would miss them too. We've been through a lot together in the last 2 years, but nothing compared to some of you. I know we can do it though! :thumbs:

She really misses Canada, especially when she reads about all her friends and family doing things for Canada on Facebook.

Hi there, this is what I sent them:

- Form DS-156 (in duplicate)

- Form DS-156K

- a copy of the data pages of my passport

- Checklist


Do not forget to send form DS-156K but do not sign it. You sign it in front of the consular officer. You don't send the evidence of relationship nor the evidence of support. These documents you take with you on the day of the interview. And make sure that you send DS-156 in duplicate with a photo attached to each copy. I had my interview in Frankfurt last week and all went well. I should receive the visa by mail this week. I'm trying to wait patiently :).

Did you say you filed taxes as married filing separately? I think you can still produce your transcripts showing that. What matters is that you didn't file as "not married".

 

Good point! We did file married separately. The first year I came here I filed taxes but it was extremely complicated cause half of the year I had worked in Germany. I had to file for an extension. For 2012 I didn't file since I had no income. I only had to send in a form to the IRS that I own a mutual fund in Germany. I'm clear with the IRS cause they wrote me a letter in May saying they would research my case and two weeks ago they send me a letter basically telling me that everything is OK. BIG relief on that side! Maybe I should include these letters.

Thanks for your answer Dave. You just reminded me that my husband has indeed signature authority over my account. Have to contact the bank. I also have to look into the emergency contact. Another thing we were thinking about is having a living will and last will. In my opinion that's pretty strong. I mean if I trust my husband with my life in case I am sick that's strong prove. Who would do that for a fake spouse. You could have an accident tomorrow and be a vegetable.

Thanks for your reply. Well, we have one joint bank account. No joint credit cards since my husband is not allowed to have one. We have an utility bill, I'm on his health insurance (can prove that with some dentist's bills), I'm the beneficiary of his retirement plan, no joint car lease (very complicated, it had to be approved by the court), we took one trip to my home country together and 2 short trips, a few joint memberships.

It's time for me to file for the Removals of Conditions. We are still a happily married couple and our marriage is totally real. K1 and AOS were no problems at all. We have known each other for nearly 28 years and started dating 5 years ago. No RFEs or any other problems.

Well, nevertheless I have some worries now. First of all, my husband bought a house long before we got married and, of course, it's not paid off yet. Due to the burst of the real estate bubble the value of the house dropped CONSIDERABLY, it's totally upside down. This is the reason why we did not put my name on the title. We will try to shortsell the house next year. So that's the one thing. The other thing is that we did not file our taxes jointly. My husband has been on a Chapter 13 bancruptcy since 2009. He's got one more year to go. It seemed to me that it was better to file separately in order to protect my own savings. Whenever I tried to get advice from a lawyer or accountant the could not give me a definite answer. I have not had a job since I came here.

Now I'm worried that these two facts will not look good and could possibly result in denial. We do have a joint bank account. I have another bank account only in my name. Of course, I kick in with my money when the going gets rough. I mostly got cash from the ATM but I also wrote out a few checks and gave them to my husband. Unfortunately I don't have copies. However, we have account statements showing the money deducted from my account and added to our joint account a few days later. I also paid for some stuff in the house with my money, like a new stove etc.. Do you think this counts as financial mingling? Does anybody here have experience with not filing taxes jointly. 

Another question I have is how did you do your supporting letters of friends. Did you have regular letters or sworn in affidavits? I have a huge problem with asking favors of people. And I hate bothering anybody with having to go to a notary. Is it good enough just to write a letter and have it properly signed? Has anybody experience with that?

 

Is there anybody here who had a similar situation?

Yes, we need to send the original affidavits and there is no need to get those notarized.

 

Thanks for confirming! I just don't understand what they mean by "Affidavits sworn to or affirmed by at least two people...".
