You do not need police clearance unless there was a previous charge. The visa fee was $240, and we paid Dr. Buteau $300. That was in December, but save just a little more just in case things changes so quickly. Good luck on your journey

Your cousin might want to brush up on immigration current events. A K-3 is almost never given, usually it is closed at NVC and the CR-1 is processed. If you decide to marry you are looking at 12 months wait after you file the paperwork and possibly AP all over again. Getting married won't solve anything and will add at least 12 months to the process.

Your lawyer is correct in that there is no appeal for a denial.  The writ of mandamus however, is not an appeal.  It is a court order compelling the USCIS to reach a decision on your case.  It is one way for you to force their hand to either approve or deny your fiance's K-1.  Contrary to what you may think, the USCIS will not simply deny it to comply with the mandamus, so it may be a way to escalate your visa request, if it should sit in AP for a long time.  Talk to him [lawyer] about it and find out what he thinks...

As a suggestion, ask him about him filing a writ of mandamus, instead of the I-130, and force their hand?  Looking from the outside it would seem the next logic legal step.

 

None of the reasons for AP - be it suspicion of legitimacy of the relationship, or life details of the beneficiary, etc - will be dismissed or lessened if you get married.  Your marital status will not affect AP and if you get married and file for I-130 you will be looking at a processing time of 12 months if all goes without any delays, and chances are, in the end, your husband will still be placed in AP once again.

 

I do not presume to know of your circumstance, nor do I presume to know your case better than your lawyer, so please take my comments as unqualified opinions and suggestions only.

 

Thank you for your suggestions I will inform my lawyer although I think we cannot appeal a k1 if denied. There are no red flags in our case only two that i could think of is he age difference i am 12 years older and I was seperated at the time we started our relationship but divorce was final 8 months later. We have been together for almost 2 years we have over $3000 of phone records I have gone to see him 10 times I have all my flights countless pictures with him and his family. He has a clean record physical came back perfect. I just dont see it. I have replayed the interview over and over again to see where we went wrong and we answered the same questions separately. Sometimes I think maybe I shouldnt have gone to the interview maybe they wouldnt have drilled us so much.

Agree with all the above. If you marry you start all over. Around one year for the spousal visa process then right back into AP.

spoke to my attorney he says if within 1 month of AP I dont hear from them we contact them to get an answer if denied the AP is cleared and he recommends to file for the I130. The only reason I think i would be denied is because Cuba is a high risk country for fraud and they might have thought that we were a fraud couple. lets see I will sit tight and wait a couple of more weeks but I wont sit and twiddle my thumbs and wait long cause I already know how this is you have to insist. :protest:

We were put in AP two weeks ago. Really we had all evidence in order. They didnt request anymore evidence. They gave him back his passport. The consular was not very nice. I hear that this AP could take months I have even seen one that is still in AP after a year. does anyone know if I can get married on my next trip to cuba in june even though I am stll in AP and then file a I130. We dont want to waste any more precious time. We have been together already 1 year and 9 months and the though of having to wait another 8 months to a year kills us.

You have to send original certied divorce paper and if his is in spanish it needs to be translated as well as an original birth certificate translated also. I to had the problem about being married at the time of meeting my fiance here is my time line
First trip to cuba July 2010
Met fiance on march 2011 he is a family friend
Got together October 12 we were both seperated at the time
July 6 2012 he proposed
July 26 2013 i got my divorce finalized.

And yes they will question you on that they did to me when i went for my interview maybe that is why we were put in AP. Although on my written statment i explained everything. Just make sure you write dates for when you got together and when you were seperated. They will ask you at the interview

If you have travelled using the VWP and ticked 'no' to the moral turpitude question on your application you will likely be grilled some at interview. I was and my minor run In with the law was 30+ years ago as a juvenile. It didn't result in a refusal but you might want to be prepared for it

I'm sorry to hear that again our interview was a year ago this date. I was there they interviewed me first than him. He has two kids. I was told why i did file for them. I said we will before the year is over. I also have two kids my self. She said since i am here why dont we get married. I was leaving the next day.it has been every difficult for me i did a lot of crying and asking my self What went wrong. But i trust God and he will make a way. I got a letter last week that our case is close and i can file again. So we are getting marry this year and i will file for him has my spouse. Just be strongh....

Sorry to hear that.  You can apply for the I-130 once you marry him, and if you will be applying for the children as well; however you must apply one I-130 per person which is $420 for each I-130 application you submit.  The turn around time is about 7-9 months, so at least you have another chance.   1. When did we start dating?
  2. When are the children coming?
  3. Why was my last visit to Haiti in 2012?

In 2012 I lost my job but still managed to go to Haiti twice that year.  In 2013 due to financial hardship and the issues we were having with his passport I decided not to go in order to cut back on expenses.  He has 3 children and we filed for them as well.  He was asked question #2 twice.  I found that to be kind of odd, why would the immigration officer ask him the same question twice?  My fiancé?s response to the question was because I am the one handling everything he and I agreed due to financial reasons that the children would follow later. This is exactly what we discussed.

 

I contacted the Embassy and spoke to a gentleman who asked me over the phone when did my fiancé and I meet?  I answered the question and was asked the question again.  I also found that to be kind of strange.  Was I being interviewed over the phone?  He then went on to say that there wasn't enough proof.  And once a decision is made it is final and cannot be over turned not even by a lawyer.   He mentioned something about the children and then said to me I should have applied for my fiancé only and if we were married then I would have been called in for an interview.  I was actually waiting on standby just in case I was called in to come in for an interview.   I explained to the gentleman, on the application whether or not the applicant or the petitioner has children is one of the many questions that is asked on the forms.  It was answered truthfully and it was also indicated that the children would not travel with their father, however at a later date.  For some reason I really feel like the fact that the children were on the application was the reason for the denial.  The youngest was born in 2008 and we became in couple in 2011, based on my conversation with the gentleman who answered the phone he said without really implying that I should have only applied for Jean Eddy.  I love his children as my own, we?re a family and I felt that adding them to the application was required and the best thing to do.  They are still very young children and they would have certainly had a brighter future here.

 

The gentleman was very helpful I don?t know if anyone else has experienced this when calling the Embassy, but they are not that friendliest and they have no patience.  He advised that I come to Haiti and marry my fiancé then apply for the I-130, can someone please advise me on the process and the turnaround time after I apply? I have some comfort in knowing that we do have another chance still I was expecting him to be here in another 2-3 days.  I will be traveling to Haiti next month.  Since the K-1 was denied will I receive anything regarding the decision that was made by mail or email?

I have learn in certain circumstance a fiance can be a qualifying relative under this statue.

 

A US citizen fiancé(e) may also be a qualifying relative for purposes of the waiver according to 9 FAM 41.81 N9.3(a) and 8 CFR 212.7(a)(1)(i).

I was advised by a lawyer before even starting this process to get married before filing since we knew there'd be a waiver.  She stated that it's already hard enough to prove hardship to a qualifying relative, let alone getting (at the time, the consulate) to even process a waiver for someone to whom I wasn't even related.  That was a strong enough argument for me.  And since we knew we'd be getting married anyway at some point, that's the plan we proceeded with.

 

But you will be surprise how many people are not aware they are inadmissible especially if it occurred as a child and it was out of their control, but looking back it was an experience and we are still going strong.  I just thank God that we will be able to file a waiver, because there are so many people out there that are not even qualify for a waiver (married or not) and it will never be available for them.

That is what I wanted to make the poster aware of, because it was a learning experience for my husband and I.  There are certain waivers that can be file for fiance visa; however then there are those that only qualifies if the parties involved are married (which we fell into that category and it seems the poster fell into the same category). I also got my senator involved who also called the embassy on our behalf and was advised that the waiver will become available once the petitioner and the beneficiary marries.

I realise this is my first post, but I have been an avid reader for a few months. I had my K1 visa interview this morning and it was denied. My fiancée and I are distraught at this, but we are being strong.

The reasons for the denial were several convictions in the space of 6 months, ten years ago, with no convictions prior or since then.
Apparently they were considered as CMTs, sadly. But not drug-related.

The CO did say that there was no waiver available to us in this instance, but should we get married and apply for a CR-1 then the waiver option would then become available.
So, for us it looks like another year of waiting and more and more paperwork.

I can also confirm that, yes, you are now allowed to bring cellphones into the embassy in London.

Does anyone have any options that we may not have considered? As long as we can be together quicker!

If you're submitting any passport stamps as proof of having met in the last 2 years you'll want to add a copy of the bio page as well. On it's own I don't think it's necessary, she'll need her birth certificate for the interview.

She does not have a birth certificate.  Will her passport suffice?

I filed my I129f form just recently. I included my fiancé child name on the form (because the form ask for her children's name)but my fiancé has no intentions of bringing her child to the US as yet( as she does not have full custody). Does this in anyway affect the process if she submitted the child's name? And /or by including her child's name, does that mean my fiancé is automatically filing for her daughter?
