all have to send taxes, the same as the sponsor. USC and LPR are supposed to pay taxes. immigration requires that you send taxes to see if you have made above the 125% over the poverty guidelines

 

why?

the i134 is non binding, it only lasts until she come, but when you file the AOS, you will need to file the affidavit of support i864. you probably also need a joint sponsor. if your dad doesn't want a binding contract, then you will have to find another person as joint sponsor

 

once she becomes a LPR, she will need to sign up for insurance, if you have insurance then she can be under yours, or she will have to sign up for a private one under Obamacare

are you asking about item 8 on the i134 form? that is about his family, not your fiancé. they want to know household size, so there goes spouse and children. relationships, if it's your mom, relationship is spouse, if you are his dependent or you have siblings that are dependents, then relationship is father.

your fiance will appear on both of them

 

as you are the main sponsor since you are the petitioner he will appear on your i134 since you're filing the fiance visa, but if you made enough this year, then you won't need a joint sponsor

 

your dad has to have enough to cover his own household plus the beneficiary which would be your fiance spouses and dependent children are counted as part of the household

 

the petitioner and co-sponsor can only combine income if they live in the same household. that's the difference between a co sponsor and a joint sponsor. I know that's possible for the adjustment of status when petitioner files the i864 and the household member files the i864A, but now we are talking about filing two i134

 

the same will happen after you marry and have to file adjustment of status. but it looks like you make over the poverty guidelines

you mom cannot be a joint sponsor because she only has tps. to finacially sponsor someone they have to be a USC or LPR

 

your dad can but his income would have to be 125% over to poverty guidelines to cover himself, his family and your fiance.

 

he would put his individual income, and a letter from SS stating what his monthly income is from disability. if it's not enough then you'll have to find someone else to be your joint sponsor. your mom's income doesn't count.

there is a difference between the joint sponsor and household member. the joint sponsor as said can be any usc or lpr that resides in the US, but the household member has to be a spouse of direct family member of the petitioner that lives in the same house, such as a parent or sibling to combine income

 

or if the joint sponsor is married and needs to combine income with spouse, but that is for adjustment of status

only people who are dependent and on your taxes count towards household, the other people who live in the home don't. do you have children that depend on you? they would count. if it's only you and your fiancé, then the household is 2.

 

the affidavit is based on annual income filed on your taxes? how much did you make last year? Did your employer send you your W2's on what you made the year before last and what did you declare on 2012's taxes?

then she lied? because she alone doesn't make 22K right, only 11? then why lie? she doesn't qualify on retirement alone anyway she wasn't honest then, that's a problem

 

she's married and she will be your wife's joint sponsor, so she alone as you, has to make over 24K for 3 people, she has to be able to cover herself, her husband and your wife. she can show proof by asking social security for a letter stating how much she receives for retirement

 

she needed to prove that she alone makes over 24K, which clearly she doesn't

 

and not even if she filed the i864 and your dad filed the i864A as her co sponsor, they don't qualify because between the 2 they have to make over 24k

 

 

what she should have done is provide proof of and declare the 11k plus her assets. and proof of letter from social security stating how much she receives monthly

 

you can try to rectify but I don't know if they'll accept it

I did not send copies all pages of my two passports (Ecuadorian and American) neither the demographics pages. I think that was my big mistake. I only sent Russian visas and passport stamps from my Ecuadorian passport. I stayed at her apartment most of the time and 3 times at her parent's house. We have train tickets to her town where her parents live which I already sent to them but not translated, The tickets are written in Russian, Do you think that I should sent the train tickets again with the translation to proof that we met together during that event? If I include the affidavit from her parents and friend, Does the affidavit have to be notarized?

As Harpa said, I would translate everything that needs to be translated just in case.... Also, make sure you send copies of all pages of the passport and make sure you make a note which entry stamps were used for the trip you met within the last two years... make sure everything is in order and it makes sense to them... photos are secondary evidence that can be sent with it.... good luck and keep us posted... again, be happy that they looked at your application... I am still waiting :-(

Did you send copies of all pages of both of your passports including the demographics page??? I would send that in again together with the pictures and the tickets you mentioned.... also, please be sure that these trips took place within those dates specified in the letter.... did you stay at her house?? perhaps a statement from her parents that you guys met in person and that you stayed there with them if that´s the case... they probably lost it or couldn´t find this evidence you sent just put together a packet with all of this information again and send it to them.... I am sure other VJers have suggestions as well... good luck!!! you are lucky... it has not even been two months and they already looked at your petition.... usually after you respond (you should do so as soon as possible), they approve the petition within 2-3 weeks...

That's only needed at the Embassy stage as part of the documents that you add when you file for the visa itself (remember that the I-129F is a petition for you to be able to request the K1 visa). Getting them done too early in the process is also not advisable as they might expire in the meantime.

She can come and spend days her on her tourist visa.... no problem.... as long as she leaves the country before her I94 expires, which should be fine because she will be here for like 2 months or less... hopefully the fiance application is approved but the average time for an approval is 5 months (even though they are moving faster these days)... even after that there´s a process with the National Visa Center and scheduling her interview so you are probably looking at an interview in late January or February if everything goes faster than the average time..... I have seen a lot of people who applied in July getting approved.... good luck and keep us posted....

Your income is more than enough for the income requirement and therefore you do not need to use assets. You can leave that whole section of the I-134 blank. Anything you list there needs proof of ownership and value to go along with it. Showing the assets when you meet the income requirement won't really help you any, so I would simply provide the income proof and keep it simple.

Hi guys,

 

I have a few questions, I am filling out the I134 for my fiancé.... my income is more than 125% so it is enough to justify the I134 but there is a section for "savings banks in the US", "stocks and bonds" and "life insurance".... Does the savings banks refer to the amount in the checking account or just a saving account? I have part of my retirement where I work that are basically invested I guess in stocks and bonds (sorry not too familiar with that), do I have to include that as well even though I met the guidelines with the income?  The same thing with life insurance, do I have to include that as well?  I would appreciate some input... thank you ...
