We got our NOA2 on February 8. The USCIS web site says:

On February 14, 2006, this approved or re-affirmed case was shipped to the Department of State for visa processing. If you have any additional questions, please contact the Department of State.


That was two weeks ago. The NVC says that they haven't received it, and that it could take up to 90 days for them to receive it, but please feel free to call back and inquire NEXT month. I called back to inquire the next minute, got a different operator, and was told the same thing.

Is anyone else having delays getting their K-1 petition to go through (or even get to) NVC?

Your petition should arrive this week call them again by Thursday if you spoke with them today. Same thing happen to me and I wish I could have choke the guy over the telephone. :yes:

Recognize that I-134 along with its supporting documentation is not 'the' one item you need as evidence that your fiancee meets the public charge provisions of the law. It is but one of a number of pieces of evidence that may be asked for.

If you are working, a consulate is highly likely to want to see evidence related to your employment.

For the affidavit form I-134 there are given 4 different items you can submit as proof of ability to support your fiancé(e), but it says you can submit one or all of them. My question is, if I just submit my bank information with a decent amount of money present and a deed for an apartment in my name, that fulfills 2 of the items, is that enough? I have a job, and an income (which I will show) but I have no pay stubs, is this a problem?

There is a 9 digit number following an "A" that is typed above the beneficiary's name in the NOA2 that wasn't present in the NOA1. Is this "A" number the same as "Alien case number" that is required on various forms (such as in AOS forms)? I have a second NVC case number I retrieved by calling the NVC customer service number. Is this NVC case number, which starts with an "SEO", the "Alien case number?" Or is this NVC case number strictly used by the NVC and US consulate abroad?

Well, I don't know about certified mail, but I do know that the service centers only check their mail about once a day, and I think it's early in the AM. They let all the notices gather for the day and then pick them up the next morning. So, just wait and see if it gets picked up tommorow, it should be, I got the same message and it was.

A TSC employee will pick it up about 6:30am tomorrow morning. :thumbs:

Hi All,

I am very happy and also nervous. Johanna got to Bogotá yesterday, this morning she did the lab work and everything went fine. At 2:00pm she has the doctor’s appointment. Tomorrow morning the bank to pay the visa fee and then in the afternoon back to doctor’s to pick-up the paperwork. :thumbs:

Then Friday, March 3, the interview. I will keep you posted and write all the details to help other VJ members. I will post a detail thread with all the information that Johanna will give me in “The Foreign Embassy and Consulate General Discussion” section. :yes:

Tabs at the bottom (they ask that you do not put them on the sides) to indicate where each section started, Cover pages for each section, and then bound it all together with an ACCO fastener at the top. The ACCO fastener is the best out of my opinion, it is much neater and makes it much easier for them to file (I don't think they like staples and clips can fall off, but obviously it won't impede approval! Better to keep your officer happy though ;)).

It is still a little confusing to me too, but as I know, when they send you the package 3 the only thing you need to do in a hurry is to send the DS-230 forms back with the copy of your passport and 2 passport pictures! Then, they'll send you the package 4 with more instructions and you have to join all the documents necessary for the interview day!
Anyway, it's reccomended for us to START getting all the documents (including those ones necessary for the affidavity of support) and the medical exams ready right after you know the papers are with NVC (a little after you receive the 2nd NOA), so you have time to get the documents little by little and don't take the risk of having any of them missing!

How did you mail your I-129F petition? Who did you use? Because you can track it with some couriers.

If you mailed it by regular mail, it takes a while. If you mailed it express then you should have gotten something by now. Call or e-mail them if you express mailed it.

For an immigrant visa or adjustment of status the I-864 is rather definitive - income of 125% of the poverty level, assets that can be converted to cash within 1 year can be used to make up a shortfall of income in the ratio of $5 worth of assets to $1 of income.

For a non-immigrant visa the requirement of meeting the public charge provisions of the law is rather more subjective. To quote 9 FAM 40.41 Notes, N4, "These factors, and any other factors thought relevant by a consular officer in a specific case, make up the "totality of the circumstances" that the officer must consider when making a public charge determination." It's not so simple as earning 100% of the poverty level.

Hey Guys, once again I am hung up on the whole poverty line thing.
I understand that for the K-1 that you need to be 100% above the line.
I understand that for AOS you need to be about 125% above the line...
But...Does this include documents from your savings and other Cds and investments...or is this strictly your working income??

I can get all of this adjusted before the AOS interview which I might as it is way in the future as we haven't even done or K-1 yet...I am lucky enough to be able to pick my own salary...however I just want to be sure.
