I think your fiance will be setting himself up for a mind blowing denial if he ever uses the "I wanted to cover all basis just in case my K1 VISA gets denied" line with a Consular Officer in Lagos. I do not also think it is wise move to register your name in a marriage registry while your K-1 interview is coming up. I would advice that you keep an open mind and pray for the best.

Hello All,

I am currently filing out the I-130 form for myself and my Colombian wife. We were married at a notary here in Colombia on September 21, 2007. The marriage documents were filled out and signed by my Colombian wife using her maiden name and supporting documents with her maiden name. Does the fact that we are officially married allow me to put my last name instead of hers on the I-130 where it asks for her last name? Or do I need to change her last name (to my last name) by a court order or some other measure before I am allowed to assign her my last name on the I-130 form?

Hello All,

My Colombian wife and I were married here in Colombia 3 months ago.

I am currently completing the I-129 as part of the K3 process (I-130 already submitted).

Since the I-129 (K1 visa) is for single couples intending to get married I have a question.

In line 6 (marital staus), do I state I'm single as well as for my wife even though we are married to each other? How about the accompanying G-325a. Do we state we are single or married? This is confusing!

How long have you been living in Colombia? If you are a resident there, you may be able to pursue the DCF (Direct Consular Filing) route. You may want to inquire about this as it is supposedly a lot faster. There is a DCF forum on VJ which may be of use to you.

Thanks alot for the advice. I just got off the phone with the Embassy in Bogota and a woman told me that if I can prove that I have lived here in Colombia for over a year (which I have) that I can process my wife's K3 visa in Bogota instead of sending it through the (slow boat to China) slow US process. Since I will need to schedule an appointment to naturalize our son (foreign-born citizen) at the Embassy in Bogota I am hoping that I can also submit the paperwork for the K3 before we go to Bogota. I need to call back tomorrow to get more details. Keeping my fingers crossed that we can do everything here in Colombia. Would save alot of time and hassles.

I have this question on the I-129:

18. Has your fiancé(e) met and seen you within the two-year period immediately receding the filing of this petition?

My answer is YES! We were married in September and are still living together in Colombia this moment as I fill out this form.

Do I need to attach a statement of how we met? Or is it standard to just fill in the box below the question with:

"My wife and I were introduced by a mutual friend here in Popayan, Colombia in June 2006".

Any ideas if I should elaborate more or attach an official statement at the end of the I-129?

to find out the progress of the request for police records that I sent weeks ago....I have tried both numbers and either they hang up on me, or no English speakers ( which I can understand being another country, I try my best Italian but its horrible) All we need is the police records form so we can get our interview. This is such a minor thing and it's holding us up very much. Anyone with any information or experience in dealing with this office/ english help line...ANYTHING would be much appreciated.

Well, the first time I sent a money order, after talking with the Canellierre in Rome I was told to send cash....I have been told 3 different prices thus far and given 2 different address has to where to send it (the paper work). After paying $20 to speak to the American embassy to complain about the confusing instructions and lack of information I was basically told nothing new and offered no help. I am left still trying to resolve this, I plan to call on monday as today is the weekend and everything is closed overseas.

The case might be that as a foreigner, you can only go through the Rome office. I am still unclear.

Police Records
Available. The Certificado Generale del Casellario Giudiziale is a certified record of final court convictions and decisions regarding mental incompetency and bankruptcy or a statement that no such record exists (Nulla).

Persons within Italy can obtain the certificate by applying in person or by mail at any office of the Procura della Repubblica. Such offices are located in all major cities and in many small cities and large towns. Those who apply in person must submit a written request, a photocopy of a photo i.d., and all fees; the certificate is usually provided the day of the request.

Persons outside of Italy can obtain the certificate by writing to:
Ufficio del Casellario Giudiziale della Procura della Repubblica,
Piazzale Clodio,
00100 Rome, Italy
Those requesting the certificate by mail, whether from within or outside Italy, must submit a written request, a photocopy of a photo i.d., and all fees, along with a stamped, self-addressed envelope. First, when an LPR files an I-130 petition, the petition gets adjudicated the same as a citizen's does, so your should have been approved long ago. It would then be sent to NVC to wait for a visa number to become available. Only NVC would need to be notified of your citizenship, so they can move forward with their part of the process.

K3 is obsolete but it's a nice way for a stupid or unscrupulous attorney to earn some extra fees. With an approved I-130, any I-129F filed for a spouse would be rejected but there certainly is no requirement to wait. K3 filers have always been wise to file the I-129F as soon as possible. An LPR cannot file an I-129F for a spouse or for a fiance.

I would get the file from the attorney and insist on a full report of what was done when. Look at the NOA2 and you should also have an NOA2. If not, something is really screwed up.

One place to start if you have your WAC or EAC case number is simply to call NVC and see if they have the case file. If they do, they can tell you how long they've had it and whether it has been upgraded. I would expect an I-130 filed over a year ago has been approved months ago.

We have not received any notice that it has been approved. The only notice we have received is the Receipt Notice for my wife and for my stepson. I called NVC and they had no information about my case. I also got an InfoPass and they knew nothing.

At this moment I would like to ask if it would be better to file a new I-130 as a Citizen and also file either the K-3, K-4, or the CR1/IR1 (which ever is better) along with the I-130. If it is better, I would like to ask if someone can guide me in the right direction as to how to do this.

You can try and give them a call, but it will not help. They will basically tell you what you already know. But it never hurts to try! :)

The I-130 (CR1) visa timeline has become much quicker in the last couple years. If you follow the LingChe shortcut the visa process is almost as fast as the K3: http://www.visajourn...he_NVC_ShortCut

The K3 was popular when the CR1 visa took a year or two to complete.

The CR1 will cost less and your spouse will get the green card shortly after arriving in the US since it is an immigrant visa.

With the K3 your spouse will have to wait until you apply for Adjustment of Status and receives either the EAD or green card to work.

I dont know if i should just file for the I-130 and wait or file for the I-130 + I-129 (for the K-3 visa)?

Is the K-3 visa really worth it?? and how does it work?
Would i have to pay the fee for the I-130 form AND the I-129 form?

I would really apreciate it if someone can help me out with these questions! :help:

My guess is that it is probably nothing to worry about. if your fiance was told that he been approved then i suggest you wait till he goes to pick up his visa on the day he was told to come or wait for the visa to be delivered to him, whichever is the case. i think you were a lil bit too hasty in calling the DOS now when there is no indication that there is something wrong with your visa process., and secondly i think the person u spoke to at the DOS must of made a mistake, sometimes these guys behind the phones do not always know their left from their right. Your fiance should have been given a 221g if you guys had any issue which would've required an extra AP. My advice, chill out a bit and try to relax., you lucky u guys are almost at the end of this journey. Enjoy the feeling :)

Hi there., i really don't understand. I thought you posted some 3 days ago that u guys were approved of your visa and that ur fiance said that everything went ok at the interview. What's up with the AP thing now, and did the guys at DOS gave u any reason why u ended up in AP? :unsure:

Africa: Sub-SaharanCase transferring from Cyprus to Lagos
Does anyone know how long it takes to get an interview in Lagos in a case which has been transferred from another embassy to Lagos? secondly, seeing that we have already had an interview and paid visa fees at the embassy in Cyprus including medicals, do we still need to do all that in Lagos and submit all the initial documents and proofs that we have already done in Cyprus? Is there a way that the embassy in Cyprus could write to the embassy in Lagos informing them that we have done all these requirements before. we are going to write to the both embassies in the morning about these questions but first we will appreciate your thoughts and responses. Thank you.

El motivo que les escribo es para preguntarles si alguno de ustedes saben si existe un foro para tod@s aquell@s que ya se encuentran en Estados Unidos con una visa K1 y K2 y que estan en el proceso de ajuste de status para obtener la residencia o si algun@s de ustedes saben cuales son las formas que hay que llenar, cuanto hay que pagar a Migracion y a donde se tienen que enviar. Hola a tod@s, una detallito mas que deseo compartir con ustedes... el dia de la entrevista en la Embajada Americana traten si es posible de vestirse bien, a que me refiero con esto? simplemente imaginense por un momento que van a una entrevista importante de trabajo... como irian vestidos para dar una buena impresion ante quien los va a entrevistar?... eviten llevar jeans... aunque no lo crean y piensen que nadie los esta mirando, pues si hay camaras de seguridad y puede ser que los esten mirando como llegan vestidos y como se desenvuelven con su pareja... recuerden que los americanos se fijan en todo... hasta en la apariencia... no es necesario ir super elegantes o llamativos... pero si acorde con la ocasion que demuestre la seriedad del caso... espero este tip como decimos aca en Miami, les ayude... cualquie duda o pregunta a sus ordenes... Dios los bendiga...

Espero esten bien cuando lean este pequeno mensaje... especialmente para aquell@as que tienen una cita o entrevita pendiente en la Embajada. Como ustedes saben una de las formas que piden es el Affidavit of Support I-134 (Apoyo Economico) de la persona que l@s esta pidiendo como tambien los tres ultimos anos de declaracion de impuestos (2011, 2010 y 2009) con sus respectivas W-2 forms, pero ademas es recomendable llevar una carta del banco en donde manejan sus cuentas l@s peticionarios y llevar copias de por lo menos un ano de los estados de cuenta que ese mismo banco les envia en donde aparezcan los depositos mensuales, en nuestro caso yo lleve ademas un resumen en base a esos estados de cuenta todos los depositos de un ano con la fecha de los estados de cuentas bancarios, esto ayuda a probar que son solventes pueden mantener a su prometid@ a su llegada a los Estados Unidos. Esto ayuda mucho a sustentar lo que sus declaraciones de impuestos dice y ademas en especial lo que dicen en su forma I-134 Forma de ayuda economica. Si tienen alguna pregunta o duda pueden escribirme y con mucho gusto les dare la repuesta mas adecuada. Suerte y bendiciones en sus proximas entrevistas.

Hola Arturo y Andrea, si fue una lastima no conocerlos... pero mi prometida me conto que los vio en el hotel y hablo con ustedes sobre las experiencias vividas en la Embajada... felicidades por lo de sus visas... y en verdad lo que me llamo la atencion fue la cajita de plastico nosotros estamos sentados detras de ustedes... pero con el nerviosismo que teniamos casi no ponia mucha atencion a mi alrededor...
En el hotel yo me encontraba en la habitacion cuando Iraida subio y me conto que los habia visto... bueno sera en otra ocasion... Dios los bendiga...

Buenos Dias a todos en este foro...
Deseo compartir con ustedes en breves palabras nuestra experiencia en la entrevista para las visas K1 y K2.
Llegue a Bogota el dia Domingo 11 de este mes en aerolinea para la cual trabajo... el viaje estuve muy bien, tranquilo... sali de Miami a las 8:09 am y llegue a Panama dos horas despues ahi tuve un pequeno susto, ya que como empleado de la aerolinea viajo sujeto a espacio o cupo... pero gracias a Dios pude viajar a Bogota en el vuelo programado, llegue alrededor de la 0100 pm al aeropuerto el Dorado, todo muy tranquilo ya para las 0130 estaba en el hotel Casa Paulina, un hotel pequeno pero placentero, mi prometida llego con su nino una hora despues por algunos contratiempos...
El dia de la entrevista 13 de Marzo nos levantamos muy temprano como a las 0500 am, tomamos un taxi hacia la Embajada Americana que queda a unos 15 minutos del hotel, segun el senor de taxi nos tenia que dejar en una calle en frente de la Embajada ya que segun el no permiten acercarse mucho a la Embajada los taxis, caminamos un poco hacia la fila 3 ahi una senorita nos puso un sticker verde con las letras K1 el mio me lo puso en mi bufanda porque hacia algo de frio, pasamos por el punto de seguridad, parecida a una donde yo trabajo los Sabados aca en el aeropuerto de Miami, mi segundo trabajo, ahi deje mi celular y camara y me dieron un numero de casilla para recogerlo a la salida, camine con Iraida y el nino y despues nos entregaron unas indicaciones emplastcadas de como deberian llevar el orden los documentos, y nos enviaron hacia la ventana 31 ahi mientras abrian nos pusimos a poner en el orden requerido los documentos, la ventanilla 31 abrio a las 0702 am y llamaron a un senor con sus hijos que estaban de primero, y despues de casi media hora fuimos los proximos en seguir, una senora muy amable nos atendio, pero todo es a traves de un telefono, ahi una senora revisa todos los documentos, se pegan las fotos, y nos felicito por llevar muy ordenamente nuestros documentos, ah tuve que entregar mis dos divorcios originales porque no habia sacado copias de ellos, porque cuando envie el primer paquete ahi habia enviado copias y traducciones notarizadas, pero bueno eso fue lo de menos, nos indico que fueramos hacia una carpa en frente de la casilla 5 que es donde seria la entrevista, detras de nosotros habia una pareja muy amable, la senora vive en Miami igual que yo y su prometido es de Cali y mientras esperabamos conversabamos con ellos dandonos animos, porque es si... los nervios siempre estan presentes... nos dirijimos hacia la casilla 5 pero habia una parejita haciendo su entrevista, por los mensajes leidos creo que era Arturo y Andrea porque segun su relato tenian una caja plastica con sus documentos, nosotros estabamo sentamos esperando a ser llamados... despues de un buen tiempo llamaron a Iraida por su nombre a la casilla 5 nos acercamos con nuestras pruebas de la relacion adicionales, Iraida tomo el telefono y la consul mientras iba mirando los documentos le hacia preguntas a Iraida... las cuales ella contestaba con firmeza y con mucha educacion... hubo una pregunta que Iraida no supo contestar y no esperabamos que hicieron y se las comento para que la tengan en cuenta, la consul le pregunto cuando yo me habia hecho ciudadano americano que le dijera el ano... Iraida le dijo que no sabia el ano pero que si sabia que yo tenia 28 anos viviendo en Estados Unidos... despues siguieron las preguntas... yo escuchaba a veces la voz de la consul a traves de el telefono aunque era Iraida quien contestaba, cuando le preguntaron que si yo tenia hijos, Iraida dijo que no, lo cual es cierto, pero yo escuche esa pregunta a manera de buen humor le dije que si y que era Alvarito hijo de Iraida mi nuevo hijo... la consul sonrio con amabilidad... de ver como Alvarito y yo no abrazabamos y el nino me daba muchos besos... un consejo que quiero darles es que desde que entren a la Embajada siempre esten juntos demuestren su amor a traves de gestos carinosos, abrazos, besos, comunicacion... yo hasta le abria los jugos al nino y mi prometida para que comieran algo... siempre haciendo todo juntos... de forma natural y tranquila aunque los nervios no nos dejaban, siguiendo con la entrevista, vi que la consul anotaba numeros en los documentos y esa fue para mi la primera senal de aprobacion y tambien escribia datos en el computador... le pregunto a Iraida cuando iba a ser nuestra boda en Miami y quienes asistirian... ojo esto lo hacen para ver como contestan... Iraida le dijo que nuestra boda seria en Mayo y que hariamos una pequena reunion con mis amistades... hubieron muchas preguntas acerca de mi, tambien sobre Iraida, su trabajo, su matrimonio anterior, etc... ojo, preparanse para muchas preguntas... despues de un buen rato ahi, la consul le pregunto a Iraida si hacia frio... la verdad que si hacia frio... imaginense frio y nervios... luego la consul sonrio amablemente y le dijo "su visa ha sido aprobada" Iraida se emociono mucho que hasta le tiro un pico a la consul y esta sonrio... yo abraze al nino y hasta las lagrimas se me salieron le hice una sena con mi mano a los senores de la fila de que todo salio bien... cabe mencionar que siempre estuve mirando a la consul mientras mantenia abrazado al nino... y de vez en cuando besaba a Iraida para darle animos... hubo algo curioso... la consul miro mucho una foto en la cual el nino y yo salimos abrazados al igual como nos estabamos abrazando ahi mismo... y creo que ella noto mucho eso, el carino y apego del nino hacia mi... cabe mencionar que es un nino super carinoso... creo que el nino me dio mas besos que mi misma prometida... asi son los ninos... despues de terminada la entrevista, saludamos a los senores de la fila... Iraida los abrazaba... yo estaba tan emocionado que se me habia olvidado abrazar a Iraida y cuando ya ibamos de salida nos dimos un fuerte abrazo y le dije todo esto GRACIAS A DIOS... porque Iraida jamas penso que todo saldria tan PERFECTO como salio, a las 0910 am estabamos fuera de la Embajada, retire mi celular y camara en el puesto de seguridad, tomamos un taxi al hotel, pero les cuento estuve desde el momento de la aprobacion hasta una hora despues de llegar al hotel que si pronunciaba palabra se me salian las lagrimas de la emocion pero ademas de ver lo lindo que es Dios conmigo... y si es verdad Dios es grande... una cosa que le dijo la consul es que esperara que le llegaran los pasaportes con las visas y que no comprara tiquetes aereos aun... pero como trabajo par Copa Airlines... eso no es problema porque ahora mi prometida y su nino, bueno ahora mi nino... tienen y gozan de los beneficios de voloar con descuento igual que yo.. despues de la entrevista estuvimos un ratito descansando en el hotel, Iraida llamo a su hermana para contarle y luego nos fuimos a almorzar y a caminar... el proceso en la Embajada para nosotros duro 2 horas y 7 minutos... anoche regrese a Miami y por trabajar en el aeropuerto mis amigos de Migracion estaban ahi y cuando me vieron pasar me dijo el primero, hola como te fue?... y segui hacia otra oficial que me conoce porque trabajo ahi todas las noches y no me preguntan nada... el supervsor de Migracion me saludo y le conte... y me dijo te felicito porque ya vas a tener pronto a tu familia aca, cuando llegue nos avisa para recibirla... salude a mis companeros de trabajo porque ese es mi turno... ah en el avion excelente servicio de parte de los companeros... pase por aduanas y el oficial a quien conozco me saludo, lo salude y sali a tomar mi auto en el parqueo... y bueno esta es mi historia, espero les ayude en algo a los que aun estan en espera de su entrevista... solo les digo algo amig@s CONFIEN SIEMPRE EN DIOS... y veran como Dios hace su voluntad... tengo programado traer a Iraida el dia 11 de Abril... y nuestra boda civil para el 4 de Mayo y una pariente de mi Papa nos quiere hacer una reunioncita en su apartamento y de ahi seguir con en ajuste de status... gracias a todos por leer este relato...
