K-1 Fiance(e) Visa Process & Proceduresfiance visa K1

Hello,

we are finally making possible plans for our first meeting in a nearby country from Iraq, it's very overwhelming, should fiance go back to Iraq after our meeting or move, work, etc. etc. to a nearby country? he just got a four year degree and would like to continue stdying also.
the way the situation is in Iraq, I do'nt know if it will be possible or even delay the whole process if when I apply here he is in Iraq. The timeslines I've seen mention other countries those Iraqis met in, I haven't found one in my situation yet.

any suggestions on places to meet would be great also.

thanks

Turkey, Istanbul. There are direct flights from Baghad to Istanbul, your fiancee can get a Turkish Visa at the airport as long as his passport is new. I am visiting my fiancee in Turkey next month.

Turkey is also much cheaper than Amman, Jordan or Beirut, Lebanon, which interestingly enough are outrageously expensive.

K-1 Fiance(e) Visa Process & ProceduresUSCIS-CSC background check delayed the case

I have filed, I-129f petition for my fiancee on 2-12-2010. It was received by USCIS-CSC on 2-16-2010. Receiving notice was mailed and I received on 2-20-2010. Since then I have not received anything. Normal Processing time for the case is 5 months and mine has reached the 7 month and we are into 8th month. I have contacted USCIS-CSC through National Customer Service Center and through follow-up email address listed at the USCIS website and every time I get response back is that subject case is pending due to back ground check and you will receive a decision with in 90/120/180 days. Every response has it's different time frame to get the decision with in. I contacted the both California State Senator's offices and they received the same response. Now finally I have contact the CIS Ombudsman's office for help and they have told me they will get back to me with in 45 days, which means more wait and delay. What can I do???? Can I do anything to speed up the case. Is this happening to me because I have divorce from previous marriage and I filed new petition so quick or it is due to my criminal record about 7-8 years ago???. Anyone have any idea what can be done in this situation. PLEASE SHARE the info, if you are experiencing the same problem

I am going on ONE year since my NOA1 due to a "background" check. I have also written my senators and they responded the same saying there is nothing they can do and that background checks can theoretically take as long as necessary and NOBODY can speed it up. I have read that it can take up to TWO years but the law gives them all the time in the world they want. I know it is because of a criminal issue that I disclosed in my application that although did not result in any kind of conviction (nor did I have to answer "yes" to any of the questions -but disclosed it anyways), they are doing the "background" check. It is incredibly, incrediby frustrating. I have scheduled an InfoPass appointment to go in person to a local USCIS office and try to talk to somebody about what is going on and when I could reasonably expect to hear something.

K-1 Fiance(e) Visa Process & ProceduresI-129F delayed one year now
So, today it was one year since I received the NOA1 for my I-129F.

I have of course contacted USCIS and my congressman after the 5 month mark. I have been told my case is pending background/security checks.

I recently scheduled an infopass appointment that was useless as they told me that they cannot access information from another state (I live in Florida, my petition is being handled out of Vermont).

Again I called USCIS and they told me they would place an expediate request.

I recieved in the mail a letter from the USCIS telling me my expedite request is denied and that "all petitions and applications recieved by USCIS are required to have routine security checks that are resulting in a delay in the adjudication of petition and applications. We can give no definite indication of when they will be completed."

Even a poor soul on here who was unfortunate enough to be an AWA filer, got his approved in 1 year and 1 month.

I have also filed an inquiry with the USCIS Ombudsman office.

Does anyone have any suggestions about what else I can do? This is killing me...and yes, I keep myself busy with other things...I would like to know specifics of things that I can do that I have not already done besides continue to wait patiently.

K-1 Fiance(e) Visa Process & ProceduresTouch and change in status
Hello VJ'ers,

I found out my I-129F petition was touched the other day. Exactly one year after I sent in an RFE. Previously the status of my petition was "delayed" due to name/background checks (not on the USCIS website but from multiple inquiries I made via the customer hotline, my senators, the USCIS omsbudsman). Now the status is Request for Evidence Response Review. Does anyone have any insight into what may be going on with me petition at this time? Any thoughts/comments would be greatly appreciated.

Thank you all for your help. Now one last question, does the co-sponsor have to be my family member or can it be a friend. Both my parents are unemployed right now so my best friend's mother agreed to sponsor. Will that work?

Thank you all of your help.

I agree with this 100%. The Beneficiary would have to transfer funds 100% into the Petitioners Account/Not a Joint Account. That kind of money for a Young Couple seems hard to have to me.
As Gary said: Even falling short of a lump sum into your Account would require a Co-Sponsor in which, yes. Assets could be used as well.
You have'nt even Filed the 129-F as yet. Your not working right now. It's not over, take your time. Don't quit school. Life is not that much of a hurry. Think like USCIS would think.
TAKE YOUR TIME

So technically I need to have $60,000 in the bank account to qualify? Hhhmmm ... I think that's doable with my fiance's savings and maybe help from both of our families. I do not plan to quit school, especially since I graduate in the summer anyway :). It's just my hurry is that we have never been apart for so long since we first started dating and that was for seven months of seeing each other every week and eventually living together. So when his visa expired and he had to go home, we were devastated and we have been trying to reunite again and finally get married.

mmmm I think you need to find a sponsor. I'm in your same situation and I was told that in order to get approved we need to find a sponsor someone who makes enough money .It can even be a friend of yours.

Thank you for that suggestion, I think that might also be a good option for us. So if I were to get a sponsor, would I fill out the I-134 with the information of our co-sponsor? Or do I fill it about myself and just add the sponsor's information for the employment section?

Good luck to you too, its always good to know that I'm not alone :)

Again thank you all for your help.

K-1 Fiance(e) Visa Process & ProceduresForm I-134
Hello all,

I am still it the process of gathering the I-129F package but I'm thinking ahead for the next steps and the Form I-134 is getting me worried. I am a full-time student and do not have a job. My fiance in France has a lot of money saved up and can support us when he comes. Is there anyway that I can indicate in the form that I will not be supporting him when he comes and that he can do it on his own? Is that even possible or should I start looking for some sort of a job while I finish school?

I'm so confused, please help

K-1 Fiance(e) Visa Process & ProceduresI-134 and I-864 Joint sponsor?

This does not violate any constitutional right.

It's the law as passed by Congress.

He would need approximately $60,000 deposited in a US bank.

K-1 Fiance(e) Visa Process & ProceduresWill getting PACSed void the K1 visa?

Hi,

To apply for a K-1 visa you must be FREE to marry but if you get PACSed you are not free to marry anymore. For that reason, it would have the same effect as getting married.

Even if I am PACSed to the beneficiary on my petition? I thought the PACS contract was only valid in France and has no validity in US. Is this true?

K-1 Fiance(e) Visa Process & ProceduresWill getting PACSed void the K1 visa?
Hello all,

My fiance and I decided to wait out the K1 process while living together in France. I've been here for about a month now and though I had some luck getting job interviews, they are not willing to give me a work visa and getting a student visa is too costly for me (i would have to actually pay for class). So we were thinking of getting a PACS (Pacte Civile de Solidarité) so that I can get a long stay visa and work authorization. For those of you who are not familiar with it: PACS in France is not really marriage, its more similar to the Civil Union that we have in the US. My question is, would getting PACSed count towards a marriage and void our K1 visa or is it okay to do?

Thanks

It will help you if you have evidence from within those 2 years.

otherwise they just ask for recent stuff... within 3 months.

i'm not sure if this will help, but i also met my wife and i applied within 2 years since we met and committed to each other.

K-1 Fiance(e) Visa Process & ProceduresFiancé Visa process question

I am marrying a US citizen, our petition has been approved by USCIS and the processing centre and the last we hear that it was on its way to the US Embassy in London. We have called the Embassy but the recorded message says they do not discuss visa applications over the phone even to confirm the paperwork has even arrived.

As I say, we are getting married and trying to plan the wedding but there doesn't seem to be any way of getting information about where we are in the process.

Pretty much on my knees begging for information at this point! can ANYONE tell me how long it takes from this point on? how long till the US Embassy sends out the forms I need to fill out to get the medical and then interview. Its been about a week since it cleared the processing centre in NH but I have yet to hear anything from London.

Please, anyone! can you help at all?

have you tried e-mailing the embassy there? I filed for my Fiance in Colombia and they told me via e-mail that most of the time in Colombia the package 3 never makes it to the aplicant, since the mailing system is so poor there. They referred me to the website where all the forms are, we printed them, filled them out and sent them in...maybe you should try to e-mail the embassy...???

Thanks guys, I spoke to Bogota Embassy, they told me to submit the corrections, better to be honest than wait around and then get them asking questions....if anyone has any questions I would suggest you to e-mail them, they are very good about answering questions, usually with 24-48 hours...

You could try to send it again with an explanation but she needs to sign it. I would send them an email (or call if possible) and ask them what they would like you to do. At a minimum I would correct it and send it to her for signature and make sure she has it with her for the interview.

Also I wouldn't call him your father-in-law yet...if he is your father-in-law you applied for the wrong visa.

Good luck!

K-1 Fiance(e) Visa Process & ProceduresK1 denial

I too have thought that they should straighten out the financials right out of the gate. It makes more sense. If someone is unable to support their beneficiary, why go through all the hassle of forwarding the petition to NVC and then the Embassy? Though if they did it this way obviously the petitioner should be able to prove at the time of the interview that they have maintained their financial situation.
I used a cosponsor and I even went to my fiances interview, had we been denied because of sponsorship issues I would have felt probably the same as you :ranting:

I want to go to the interview as well...how did that work??? did both of you go into the interview? or did they make you wait outside???

K-1 Fiance(e) Visa Process & Proceduresaffidavit of support question

Just to clarify, you (the US-Citizen) will NOT receive the packet 3, the packet 3 is for the non-US fiance(e) only, you will need to send them some documents (affidavit of support etc.) but yeah the non-US fiance(e) is responsible for filing the Packet3 document package at the US consulate in their country.

And regarding the I-864, I'm not sure but mine definitely did (I just rechecked that).

That being said, for me anyways (it might differ from country to country) but the I-864 Affidavit was only required as part of the AOS (Green Card) application. For K-1 VISA, the affidavit of support was via form I-134... you might want to double check that. The main difference is for I-134 didn't want to know about IRS tax information (for K-1 VISA) but form I-864 does require submission of IRS tax documents.

So yeah I think you might be confused as to which Affidavit of Support you need to file..

Thanks and best of luck to you!

GrayL

GrayL, thank you so much!! You really saved me some time! I do recall my fiance telling me about the I-134 earlier tonight as we were going through the contents of the package..I was kind of unsure about it though. Reason being, that we have to use a joint sponsor because i don't make enough :( I saw in another post that you and your fiance also had to use a sponsor. I know this is silly, but was form I-134 the only affidavit of support form you used? It just doesn't seem like enough to me

(apart from the money that is) just understand the risks your taking, get as much advice as you can, and be nothing but completely honest throughout the process

Thanks .I will be honest , especially when it comes to a decision that could change my life forever. I' ll do wathever will take me to be with him, i gave up once, it wont happen again . :)

Ok. I paid someone ( supossedly a friend of a friend) who will send him an invitation letter to Mexico from there he would just cruce the border and ask for asylum , since cubans have the Law Of Cuban Adjustment. Never Happened.. He did sent the initials papers to my fiance but after that never followed up and the guy dissapeared :( . Thank god we never went to any consulate or anything .

USCIS won't question the relationship (at least not at K-1 stage, they might later at AOS) because all you have to prove to them is that you met in person within last 2 years, but CO at the embassy will. What do you mean you lost 5k trying to bring him to the USA? How did you try to bring him to the USA?

You would be surprise how people take advantage of Cubans wanting to get out of Cuba. Illegal ways of course... Mexico, Venezuela.

Hello!! Me and my Fiance have been togheter for 8 years now, I've been in the USA for 6. Im gathering all the required documentation to sent out the I 129-f. My only concern is that out of those 8 years, and after losing more than 5k trying to bring him to the USA, we decided that it was imposible to be together again, so we basically gave up. During that period of time ( around a year) he started to go out with someone ( just like I did) and we both had babies. The girls are exactly 3 months apart ( coincidence eh?)Anyways, after the girls were born we started comunicating again and I've been in Cuba twice after that just to be with him. My only concern is that when I send the packet they may think that our relationship is not true or valid because we both had babies in 2010. I have a lot of pictures of us together (since my first trip in 2008, 2010 and 2011) I also have phone calls records, text messages, emails and a bunch of stuff that may be helpful. Based on you experience, what do you guys think?? will the girls be an issue?? Thanks in advance for your reply

I called the NVC and they wouldn't give me the DHL tracking #... is there something else I can do?? has this happen to anyone else? They said the only thing they can give me is the phone # to the embassy in Havana.. Well,,, unfortunately phone calls to Cuba are very expensive and I need to know if I have other options to try to speed up the process.

Hey Chimi -

Congrats on your incoming!!! I think you're ok and should send off your paperwork. The boarding pass should be enough. It's got your name on it and dates. I would just send it in. You'll soon have a newborn at home and the baby will be occupying most of your time.

Quick question for you (or anyone): My finance lives in Cancun. Is there an embassy there where he can have his interview or will he have to travel to DF or Juarez? My god I hope not Juarez. Does anybody know the answer to this or where I can find out?

Thanks,

Thanks for everyone's quick and supportive replies. It is much appreciated. As you know, the paperwork is *such* a pain in the ###. Then the waiting ... we've been together three years now, and it's gonna be so hard to wait six months more! Then the traveling from Cancun to Juarez is gonna be a major hurdle, but its all worth it in the end...

PS Yeah, UCLA_cutie26, no plans to trick the government, this is a legit relationship here...

K-1 Fiance(e) Visa Process & ProceduresTwo questions about the K-1 Visa
My fiance is in Mexico, I am in the USA. Is it better for us to legally get married in Mexico and then try to get a visa to bring him into the US, or better to apply for the K-1 Visa and later get married in the US?

Also, he lives in Cancun, which is about as far away from Juarez as you can get in Mexico. Is there another city where he can go for the interview? Like Mexico City or better yet Merida or Cancun?

Any and all input is appreciated.
