It is not so clear if the OP is a USC...

That said, anybody who intends to be the petitioner must be a USC and not LPR. In your case, it seems as if you're not a USC and that categorically is an automatic denial of the petition without giving out any reason because the instruction is clearly written in the i-129f form.

I will advice you wait until you adjust your status to USC before ever thinking of filing again, otherwise USCIS will see it as an immigration fraud and you could be ban... Just my 2cent.. But then, keep your head up!!


Incorrect. LPR's can also file. The wait is REEEEAAAALLLYYYY long, but it can be done.

Brace yourself because this is going to sound a little harsh... :blush:

Your fiance didn't read the form instructions. Even without the VJ guides, you could have successfully submitted the I-129F petition AND included all of the required supporting forms, documents, and evidence just by exactly following the instructions for the I-129F form.

You don't need "proof of relationship" with the petition. You DO need proof that you've met, face-to-face, sometime in the last two years. You also need original statements from each of you indicating your intention to marry, and you may provide additional evidence to support your intentions. All of this is covered, in painful detail, in the form instructions. The form instructions also tell you to submit a G-325A form for each of you, and THAT form also has instructions. There is also evidence that must be submitted, and other evidence that may be required, depending on your circumstances. Again, it's all covered in detail in the form instructions.

I have seen other cases where people didn't read the instructions, and sent only the I-129F form, and they got a lengthy RFE asking for all of the additional required forms, documents, and evidence. I've also seen cases just like yours, where the petition was flat out denied. A USCIS adjudicator receives guidance in the Adjudicators Field Manual to send an RFE rather than deny when a case would be approvable if further evidence were provided, but this is a discretionary call the adjudicator makes. If they received none of the required evidence then it's understandable that they might not have the patience to play RFE tag with someone who clearly doesn't understand what they were supposed to have done.

It's also possible that your fiance blew some extremely important declaration on the I-129F. For example, did he check the "married" box for either of you? Did he fail to indicate how he acquired his US citizenship? Did he check "no" to question 18 - have you met and seen each other within the past two years? Did he check "yes" in response to the criminal conviction questions in part C? Did he fail to sign the form? Any of these would be sufficient reason to deny the petition outright, though some of these could have been overcome by providing the appropriate evidence.

Is your fiance subject to the IMBRA filing limitations? If so, did he include a request for a waiver? Don't know what I'm talking about? Of course not, because you didn't read the instructions.

Look, I'm not trying to rub your faces in this, but you and your fiance need to understand that the US government is beyond ####### when it comes to getting immigration paperwork right. They will not take you by the hand and walk you through it. They publish detailed instructions, and they expect you to follow them.

A minor point on semantics - don't refer to the I-129F as a "demand". There are many things which Americans have a right to demand of the government, but immigration is not one of them. Every immigrant visa petition is a "request", and a request can be denied.

Read the guides. Read the form instructions. File again. :thumbs:

I have a 2 year old son, whom I thought would be traveling with myself and family to Jamaica in two weeks. However, after 3 months trying to get his passport, I realize the passport cannot be obtained before August 16th... Soooo my son still has not met my fiance face to face. They talk on the phone and Skype video chats, but in an interviewer's eyes at the embassy is this really enough?

Does anyone have personal experiences with this issue? I'm hoping to get a passport for my son within the next 3 more months, and make a trip with him then to see fiance; however, nothing is guarenteed at this point with his passport. So my question is, how important is it for fiance and USC's child to meet face to face before the embassy interview?

My daughter was unable to meet my husband face-to-face until he arrived to the US. However, they got to know each other best they could through skype video chats. The CO asked about this and if my husband knew my daughter and had met her. She is not allowed out of the US due to previous divorce agreement, but make sure your fiance knows the child's name, age, and things about him. Those questions may come up in the interview.

I'm curious how your fiance feels about it. Does he think everything is fine? Or would he be happy to get you out of his life? Does he feel like he made a mistake in bringing you over here? Would he be willing to buy you a ticket back to your country? Does he still want to marry you?

You have 3 unattractive choices.

1. Marry this guy you dont like anymore, assuming he is willing.
However unhappy you are with him now, multiply that by 3 and that is how unhappy
you will be married to him.

2. Go back to your country: Assuming your fiance doesnt want to co operate with this
I think you would contact the USCIS and they would probably make some arrangement
to get you back to your country. You already know what life is like in your own
country. Probably the main advantage to this is you would be eligible to come back
if you managed to connect with another american man.
If you decide to do this
dont wait until day 89. you need to be gone before day 91 and dont necessarily
expect your fiance to handle it for you. he may not be in the mood.

3. If you stay after the 90 days and you havent married this guy you are officially an
illegal alien. You wouldnt be able to get a legitimate job because you wont have
the proper paperwork. You would be subject to deportation if the police became aware
of your status. You would completely blow any chance of staying in the US legaly.
There are thousands of illegal aliens in this country now and some have been here for
years, but there is a major crack down on illegal aliens now.

Can a non-US citizen get another K-1 visa if they already received one before and ended up going back to their country and not getting married? My findings and my understanding of this is that it's one shot...for life. If you get it and you don't get married, then you go home and cannot come back to the US through another K-1 visa petition. Am I understanding that correctly?

I want to thank you for your patience with me. Now if I understood you correctly, the Dubai or Abu Dhabi Post, is recommending that the visa issuing post waive the police certificate requirement and this is well known in the USA Department of State. Now why this information is
not trasmitted to the local Cosuslar Offices when the Department of State knows you cannot get a Police report by mail. It appears to me that one hand does not know what the other one is doing and we have to suffer the consequences.

When appearing to request a police certificate, the applicant should provide recent photographs, a letter from the requesting authority, the date of residence in the emirate, and their passport.

Not available by mail. Post recommends that consular officers waive the general requirement to obtain police certificates unless the applicant lives in the UAE.

By the time my girlfriend files her forms she would have to have gathered Police reports not only from the Phillipines but also from Oman, the UAE and Hong Kong. This process is quite labor intensive as some of you probably know. The matter is compounded by the fact that I believe the UAE requires that you file the Police report in person. Can anyone help me with this?
Can you give a friend a Power of Attorney act of your behalf? Are there any attys in the UAE that will assist? Any thoughts would be appreciated. Include experiences with the other
countries.

I am presently in PI meeting my fiancee and her family. This our first encounter together and I am delighted with her and she is also with me. I understand that when I return to the states I am the one who has to submit a petition on her behalf to the USCIS. I just wanted to know if she could complete her part of the process in HK since
she works there and it would be easier for her complete the application there. She lives in a small province in the PI and traveling to Manila everytime she has to go to the US Embassy can be a tremendous hardship for her. She know her way quite well in HK and she can go to the PI Consulate there as well as the US Embassy.

Just a note of clarification here too - you cannot file K-1, get married and then bring her to the US. You must file, get approved, bring her to the US, THEN GET MARRIED.

If you get married at any point before her entry to the US you will be starting all over with a CR-1.

If you can start sooner than when your fiancee receives her package, God bless you. The only problem I see is that the countries where you would apply for the Police Certificate require an official
letter from the agency requesting the Police Certificate. This letter is the one your fiancee will eventually receive when the case goes from the NVC to the local consulate of residence of your fiancee
requesting the various forms, eg., 230,156, 156K and the Police certificate among other things.

What I am talking about is what you write on top of the page in responce to an RFE, meaning if you have to put the applicant's name and beneficiary's name, A_ number if known and the like so that the process is expedited. Also, do you include a copy of the original RFE.

I am on Social Security Disability soon to become Retirement Benefits since I am already 65 As you know, Social Security benefits are not considered income when I filed my Income Taxes last year. Let say that you are just $1,500 off a year with a family of three (fiancée plus her daughter). If you have at least $7,500 in the bank that money will secure the offset. I think you have to be able to provide sufficient funds to support over three years, although some people say five years. Please clarify,

Your next step is waiting for your first NOA, or NOA1, which usually takes about 10 days to 2 weeks. After receipt of NOA1, a very long wait then from 3 to 5 months for NOA2, which is the approval of your application. After that the case is sent to NVC and from there to your beneficiary's consulate in about 30 to 45 days. Then about 45 days to 60 days for completion of packets 3 and 4, medical exam and vaccinations and interview and visa issued. Check the guides and processing times available here in this site or with USCIS to have a better idea.

I am sure it is because you sent a form in Russian. USCIS specifically states that all documents submitted have to be transalated into English. That includes birth ceriticates, marriage certificates, Cenomar and Divorce certificates. You do not have to sent the original but have it available for the interview.

I doubt you will have the visa by the end of the year. After you receive your NOA2, figure about 2 and a half more months. I do not think you have to worry if it is in review. I am sure that if your fiancé answered everything they
asked in the RFE, you will be approved. Insofar as the Police Certificate, since you have not lived abroad after age 16, the only Police Certificate you have to provide is that of your country. Make sure it is an official certificate however and not a local one.

I always make sure to search the forums for answers to my questions. I have not found a answer to this one: My K1 visa is currently at the level of the USCIS. If my foreign finacee wanted to come to the USA on a J1 visa, is this permissible? I just read a posting that states travel to the USA by the foriegn beneficiary is not permissible once a K1 visa has been applied. Is this true? And at what stage? Once it gets to the NVC or from the beginning when it is at the level of USCIS?

Hello,

we are finally making possible plans for our first meeting in a nearby country from Iraq, it's very overwhelming, should fiance go back to Iraq after our meeting or move, work, etc. etc. to a nearby country? he just got a four year degree and would like to continue stdying also.
the way the situation is in Iraq, I do'nt know if it will be possible or even delay the whole process if when I apply here he is in Iraq. The timeslines I've seen mention other countries those Iraqis met in, I haven't found one in my situation yet.

any suggestions on places to meet would be great also.

Turkey, Istanbul. There are direct flights from Baghad to Istanbul, your fiancee can get a Turkish Visa at the airport as long as his passport is new. I am visiting my fiancee in Turkey next month.

Turkey is also much cheaper than Amman, Jordan or Beirut, Lebanon, which interestingly enough are outrageously expensive.
