K-1 Fiance(e) Visa Process & ProceduresI'm having a problem with my mailing address!
Ok folks, I've got a sticky situation here and I'd like your advice:

I've spent the last 1.5 years living/working in New York. I moved September 1st back to Mexico to be with my fiance ... we submitted the K1 paperwork (when I was visiting family in Michigan) on September 22nd. The address that I used for myself on all the paperwork was where I have now forwarded my mail - still in New York. I submitted the paperwork to the Vermont service center, which represents New York. Eventually, my finance and I would like to move back to New York to live and work when he gets his visa.

The problem? Apparently, some of my mail is being sent back to the sender - and I have no idea why. A friend of mine sent something to my NY address, and although the address was CORRECT (I doubled checked), it got sent back to her.

So my delimma ... should I change my address to something more secure, like my mother's address in Michigan? But then, will that affect the service center? Or should I give them my address here in Mexico? Will that affect anything?

I have no idea what to do! I don't want the service center to get the return NOA back and reject my K1 application!

P.S I checked my bank account today, on 10-4, and my check still has not been cashed. Is that normal? Its been almost two weeks!

K-1 Fiance(e) Visa Process & ProceduresHas anyone tried calling the Service Center 800 number?
I sent my 129F paperwork in on September 22nd and I haven't received anything yet. I've tried to call the service center's 800 number, but every time I wait on hold for 30 minutes and then my phone card runs out. Does anyone know how late I can call? What are the best times to call?

Thanks.

Our K1 Visa paperwork was recieved on Dec 28th, the check was cashed on Jan 4th, but I haven't recieved any NOAs yet .... is this normal? How long should I wait until I should call them to get my case number?

Thanks.

K-1 Fiance(e) Visa Process & ProceduresNOAs 1 and 2
According to emails sent to me from the USICS:

On Dec 28th they recieved our K-1 petition.
On Dec 31st they cashed my check.
On Jan 4th they sent our NOA1.
On Jan 12th they sent our Approval Notice (NOA2).

I have not recieved either NOAs.

Part of the reason is becasue I live with my fiancé in Mexico, and the mail system here is horrible. We've been to the post office several times to ask if anything has arrived, and they keep telling us that the letters will be sent to our house. But then they casually mentioned that if the mail carrier can't find our apartment, they will send the letters back to the sender.

I'm afraid if the letters get sent back, our VISA petition will be canceled/paused. Should I call USICS? Should I wait? Please advise, VisaJourney's!

K-1 Fiance(e) Visa Process & ProceduresIm new help!

Hey everyone new here need advice.Met My girlfriend about 4 months ago and we will start the process very soon. She is going to school in Dublin and been living there for almost three years. We met online and then met in person in Dublin.Talk everyday through IM and video chat.not much phone calls.Been to see her in Dublin 2times and just got back from Thailand with her to see her family and hometown.Going back to Dublin at the end of nov and then again at Christmas. Her visa will be up soon for Ireland and we didnt know the wisdom of her staying or going back to Thailand. We didnt know if any of that is relevant to the k1 process.been saving IMs and all pictures and plane tickets hotels etc.Any advice?reading all of this seems like the process is pretty stressful.and tips or advice would be greatly appreciated. Thanks all!

Definetely save as much information as you can gather that proves your relationship such as photos of both of you with dates and locations, photos with relatives, plane tickets with boarding passes, receipts from hotels and restaurants and places you went together, emails, chat room conversations, letters with envelopes that substantiate dates, receipts of phone bills or used calling cards, etc.

Hi Friends,

My Filipino girlfriend is currently working in Hong Kong and has done so for the last 13 years. For a bried period about 20 years ago she worked in Oman and in the UAE. Since it is so difficult to secure Police reports from these places, could she just report the work
in Hong Kong and just request Police reports from Hong Kong and the Phillipines. Do you think the USA embassy could find out of her previous bried stay in Oman and the UAE and if so what are the consequences.

I beleive the one exception to the rule is Cuba, they get processed by the service centers early. I heard it has something to do with the consulate there, but I'm sorry I don't know the specifics of it. But I've seen many Cuba applications processed early for sure.

Not sure about the processing but there is no US Consulate in Cuba.

Actually there is, i left Cuba in 1988 and remember going there for our interview. Don't know if that's changed though.

From what I have seen in some of the timelines and heard from several people...

Does the USCIS prioritize certain countries visas over others? Or are most delays due to the paperwork not being in order?

QUOTE (Liebi @ Dec 12 2007, 09:50 PM) <{POST_SNAPBACK}>
Most US consulates accept police certificates with a date of issue that's up to 6 months old. So if your fiancee gets hers after you receive NOA2 she should be fine (also depends on how fast police certificates are issued in the Ukraine).
But to be sure the consulate in the Ukraine is fine with the 6 months time frame, contact them via email, explain the situation in brief words and ask them for a short feedback on it.

Thank for the help that's a great idea...

K-1 Fiance(e) Visa Process & ProceduresPolice report question?
I filed my K1 late September, received my NOA1 in the mail on Oct 7.

My questions is at what point in time should I have my fiancee get her police report from Ukraine? She lives in Yalta from what I understand they are good for about 2 months.

Can anyone help answer this?

You could call but they probably won't help you until it's after 180 days.
Have you checked your status online? Has your petition been touched at all, not saying that means anything but there were a bunch of us touched on December 17th and many of us have been approved.

I wish you much luck and patience!!!

Thanks for your reply. I was touched on January 30th...but nothing new since. My main concern is that everyone with my timeline and country has received the NOA2 except me sad.gif This has been a little unbearable..

Definitely return the documents requested and explain that you were away on work-related travel and did not receive the request until today when you returned, asking them to please consider them even though they are late.

I'm sending them first thing in the morning FedEx...and will call as soon as they open. The only thing that kinda comforts me is that I have no convictions of any type. But I know immigration can be a pain..I just hope they don't deny me because of this...

I have been working out of town for the last month and a half, and the USCIS sent me a letter on Jan 30,2008 asking me a question in reference to convictions by court or court marshals (I have neither). The response was to be sent before March 3,2008. I got back in town on March 7th..I'm sending the response out ASAP, but I noticed it says no extensions. Am I screwed here or is there hope? Hello,

It's seems me that you talk about the I-94 whose the validity is the 3rd of december.
One thing, you have to marry before this date. It's an obligation.
After, you have to adjust status.
It's the process.
You can't marry legally in january, because if they catch her, she will have to go back to her country.
If you do it, you have to start again all the process about adjusting I-130 (they already gave you this information).

In conclusion, you have no choice.
You are forced to get married before the 3rd of december ( and not '' My fiancee is due to leave on December 3rd'')
And she can't go anywhere (outside Usa) now, before adjusting status (AOS), if she plans to go outside USA before receiving the AP (after sending AOS package), she can't go back in USA , and you will have to satart again all the process.

Good luck

Thanks all...I guess courthouse marriage it is tongue.gif

If you are planning on a K-1 visa she has a one time arrival in the US on that visa. She cannot leave and come back again on that visa. Once she is here she has to get married within 90 days or she cannot adjust status based on the K-1 visa. Has she activated the K-1 visa yet? If so, then if she leaves the US without getting married she will not be allowed back in to get married later. You would have to start the visa process all over again from the beginning. If she gets married but hasn't received an Advance Parole (permission to return to the US) if she leaves the US you will have to start the visa process all over again from the beginning as well.

If she is here now but not on the K-1 visa, then she can leave and return to the US when the K-1 visa is issued to get married. There is no guarantee that she will get the K-1 in time for your January wedding, however, if she isn't returning home until December. On what status is she in the US right now? On what status will she be returning to the US in January? Does she intend to stay in the US after the wedding in January or return home again to finish a spousal visa?

If she is here on a K-1, then basically, going back home in December will negate all of your immigration paperwork to this time. Why is she going back?

She is here on a K-1 Visa she arrived September 4th, the 90 day period expires on December 3rd. Our plans aren't until January, I we didnt want any legal complications so, originally I just wanted to know if she would be penalized for overstaying past the 90 days.

Thanks for all your comments smile.gif

Dont over-worry about this.. since you have a work visa.. just get married and file away i-130 & i-485. You may want to file for work permit too since your work visa will expire soon and you are never sure how long the AOS will take. (it depends on the state/city ) better be prepared. :)

Ukrainian embassy can only extend it to the date I travel to Ukraine, but then I still have to get a new one there, because without it I can't come back to US. So basically at some point I still will have to go to Ukraine for a month or so to get it renewed.

K-1 Fiance(e) Visa Process & ProceduresVISA Interview
Hi All,

I am back & as usual very nervous...i guess would stay nervous till I know where I am standing

I got both packet 3 & 4, guess have all the documents in place but the only document I am having issues is with the Police Clearance Certificate as I might get or might not get the cerficate on time. If I do not have the certificate on time what are my options?

Also my fiance & me did not have a formal engagement ( it was just me & him ) so we dont have pictures of the engagement but have the pictures of me wearing the ring after the we got engaged. however we have out flight tickets & hotel bill where we stayed. Would those proof be enough for the engagement?

Lastly what all are the potential reasons for the rejection of the Visa if so what is my option & how can we get it approved?

I would be very greatful if you could help me, thanks! :help:
