Finally I could get a hold of "live" operator at NVC and found out our packet was already forwarded to Tokyo on 4th! kicking.gif
But she didn't know when it was arrived at NVC... hmm.... well, I don't care as long as they proceeded. whistling.gif

It also turned out that my fiance received snail mail from NVC saying they received our petition and would proceed within 1 week. I didn't know this process, so it's a nice surprise to me. What a kind bureau NVC is, not like VSC devil.gif The letter was dated on 4th, the same day they forwarded the packet.

That DHL tracker says the packet was delivered to Tokyo on 7th.... I have to graduate this topic?? unsure.gif

We got a letter in the regular mail to go to the embassy and pick up the packets. But I think each embassy is different.


Hello. Yes, it seems like different.
In Japan, I got a thin regular mail that includes DS230 and some forms for medical exam. Postal system here is reliable, so they use the easiest way, I think.

I'm pretty sure that you can't pull your I-864 once a green card has been issued. She is a conditional *permanent* resident - that means she has a green card and the OP is on the hook for that until she either permanently leaves the country, gets 40 credits of work, or dies. You can't pull the I-864 during conditional permanent residence any more than you can after the conditions are removed.


She was granted a conditional residency based on the fact that they had not been married more than 2 years. She's still under the conditional residency until this fall. He can still pull it.

I am just curious, but how can I stop the AOS for my spouse. I realized a mistake was made and would like to bring this forward and put a cease on her application. We got married in October of 2010, went for our interview in March of 2011. Unfortunately, after that time we became separated and as of till this date are no longer together. I would like to know what are the proper protocols to take. Our application was granted and she received her Visa, since she went back to her home country this past December.

She informed me that there is a temporary green card, and she has already submitted the paperwork to remove the "hold" and to make this permanent.

Any information and direction on how to go about this, will be greatly appreciated.


Why don't you pull your 1-864 - your affidavit of support? That IS what you can do. If she just got approved earlier this year for a spousal visa to come to the US, then she only has CONDITIONAL residency. Send a letter in writing to USCIS, to your local and regional immigration office and to ICE with a copy of your immigration notices and a copy of your initial affidavit of support that you filed, indicating that you are getting divorced and no longer wish to support the person. She can file her paperwork, but without your support affidavit, they won't approve her. Unless, of course, she cries foul and tries to claim abuse or something.

If she already had her 10-year residency, then there would be nothing you could do but divorce, but she is still a conditional resident. You can still request your support be pulled.

If nobody here gets approved it doesn't mean they are not approving it probably depends on the state where you are also applying from. I had a huge pile of evidence and there we go. My son who was 16 yr old travelled with me to US and got the conditional GC along with me.

Now he is 18yr old and time to remove conditions.

Do we submit one I-751 form with him listed as kid who travelled along with me or do we submit two I-751 forms one for me and another for him?

If your son got his Permanent Residency at the same time or within 90 months of yours, then you can include him in your I-751 application and list him in Section 5 of the form. You will also have to pay an additional $85.00 for his biometrics fee. If however, his GC was granted 90 days after yours, then he has to file also form I-751 and pay the whole fee of $590.00.

One I-751, ONE petition fee and TWO biometrics fees. His status is conditioned on hers and derivitive of hers. For example if you had been married two years when he arrived he would not even have to file for ROC and would have had a 10 year green card.

You need to show that you are married and living as a family and that he is her son (birth certificate) When we did this we also showed things such as the boys being on my helath insurance etc., more to show that Alla and I were living as a family. The only relationship you have to "prove" with the son is that he IS her son.

Hi Guys. I am still confused about the subject. If you read my thread, I explained that when I read the USCIS instructions I find them confusing because in the first part it clearly states that if the K-2 entered within 90 days of the principal beneficiary then you can include them in the same I-751. However in the second sentence it states that if the dependent K-2 acquired Permanent Residence within 90 of the principal acquiring theirs, then it can be included in the same I-751. Now is it the entry date of the beneficiary and dependent K-2 or the date that the acquired their Permanent Residency Status. My daughter in law entered 4 months after my wife, however acquired here Permanent Residency within 90 of my wife's. Thanks

If your dependent K-2 visa holder received Permanent Residency Status at the same time or within 90 months of your wife, you can include her/him in the same application by listing him/her in section 5 of the application. You have to pay an additional fee for biometrics if the dependent is older than 14 years.

You cannot apply to remove the conditions from the children's green cards when mom apply to remove her conditions because the children immigrated did not immigrate within 90 days of mom's arrival in the US. The children will need to apply separately to remove the conditions on their green cards.

Who may file Form I-751?

If you were granted conditional resident status through marriage to a U.S. citizen or permanent resident, use this form to petition for the removal of those conditions. If you have dependent children who acquired conditional resident status concurrently with you and entered the United States within 90 days of your arrival, then include the names and A-Numbers of these children in Part 5 of this form in order to have their conditional status removed. If you have dependent children who acquired conditional resident status after 90 days from the date of your adjustment or if the conditional resident parent is deceased, then those dependent children must file Form I-751 separately to have their conditional status removed.

I submitted a similar question in a recent thread. My question is regarding the confusing wording in the USCIS instructions. In the first sentence it states that if "you have dependent childrren who acquired resident status concurrently with you AND entered the US within 90 days of your arrival, then include them in Part 5 of this form. " However, the second sentence reads "if you have dependent children who acquired conditional resident status ater 90 days from the date of your adjustment, then those dependent children must file Form I-751 separately." In my case my daughter in law arrived 4 months after my fiancee, however obtained her conditional residency within 90 from the date of adjustment of her mother. So which applies? Again Gary and Alla I would like to resubmit my question relating to the same subject. The USCIS instructions clearly state that if the dependent child arrived within 90 days of her mother's arrival then she could be included in the same I-751 form. However, the second sentence addresses the date of the conditional residency and not the arrival date stating that if the dependent child obtained her conditional residency within 90 of her mother's then she could be included in the same application. To me the two sentences contradict each other since one is addressing date of arrival and the next sentence is talking about date the conditional residency was granted. Please clarify. Thanks

If the kids got their green cards within 90 days of Mom getting her card, they can file together on one form. You only have to pay the fee for one form, but the biometrics fee 3 times.


Peet I have asked the same question before and I still have to get an answer that satisfy me according to my interpretation of the USCIS guidelines. My daughter in law arrived 4 months after my wife but obtain her conditional residency card within 90 of her Mom getting hers. According to the USCIS instructions on form I-751, it states in the first sentence that if she arrived before 90 days of her mother's arrival she could be included in the I-751 form. The second sentence, however, states that if she obtained her conditional residency status within 90 days of her mother, then she could be included in the same form. There is a difference between arriving in the US within 90 days of her mother and obtaining conditional residency status within 90 days of her mother. Since my wife arrived on a K-1 visa, she had to apply for AOS after arrival and the date on her card is different from her arrival date and so is her daughter who arrived on a K-2 visa. Please clarify. Thanks

My stepdaughter has to apply separately from her mother as she entered the US more than 90 days after her mother. Can anybody suggest a cover letter since she is really not applying for removal of conditions as she will
inherit those from her mother. What will she really be applying for?. Also, since she doesn't have to submit any evidence, besides her application, fees and copy of her GC, what else is needed? Thanks,

Since your child obtained his 2 year GC over 90 days since you, he will have to apply separately as you stated. I do not think that you have to worry that at the time he applies for ROC he is over 21. The important fact is that he entered
the United States before he was 21 years old.

That is pretty much it. You are the one who has to satisfy criteria for removing conditions. As long as you include her in the your I-751 section 5 and include a copy of her GC, front and back that is pretty much it. It will help if she also can prove that she has resided with you since she arrived in the USA, such as bank accounts or school transcripts.

I do not quite follow? If you are asking about ROC, you do not have to prove income requirements. You should have already satisfy that requirement when you file for AOS.
