Congrats! I called today to CDJ and they told me I need wait until Dec 6-10, then I need call them for ask if they have sent the packet 3. Waoo!! Maybe I´ll go to the interview until January crying.gif

I called Ciudad Juarez Embassy twice already and they have not received the packet from the NVC. I don't know why it's taking so long, alot of people that are a week behind me have their packets already from the Embassy. Anyways, I have to wait from the Embassy's response.

Yes, the I-864A must be notarized. The I-864 don't need to be notarized. Remember file the I-864 from petitioner too if you're using a co-sponsor (we got an RFE for I-864 from petitioner).

The best choice is that you try to find someone as a co-sponsor, but if you don't have none I think that you can call to USCIS and ask for cancel/standby the AOS. If you will be able to find a co-sponsor your wife can attach an explanation letter where she explains the reason by she didn't work abroad. She can attach documentation extra -ex. school records- which shows that she wasn't able to work.

Maybe my questions were not clear.

1) We are confused with questions 23 on I-864, we are not sure "current annual income" refers to the income reported to IRS in 2007 tax return or the current income for 2008, which we may have to do a guess-timation.
It's the most recent of income tax year, so 2007 if he already file, if he doesn't do it yet, it'll be 2006 year. In the employment letter is where he will show an estimate of his earns for 2008

2) We are also not sure whether we need a co-sponsor. My husband reported income to IRS in 2007 doesn't meet the poverty line, but the income for 2008 is expected to meet the poverty guideline, do we still need a co-sponsor?
Yes, you need a co-sponsor who meet the 125% poverty line in the last income tax year.

If the petitioner doesn't meet the 125% poverty guidelines and he/she is using a co-sponsor (who must meet that 125%) both of them must file a separate I-864. If the petitioner and co-sponsor live in the same address they must sign the contract I-864A and notarize it. The I-864 doesn't need to be notarized.
A suggestion, is that if your spouse didn't work in previous years, he can attach a explanation of unemployment letter, and he'll attach evidence of that like school's records.

I think you're talking about I864 form. I don't think so that it would be a problem if he/she earns enough money to support her/his dependants including the imigrant. If you aren't sure about the outcome if you're his/her dependat too, you can choose another co-sponsor... Also, remember that you (as a petitioner) must file another I864 aside you have a co-sponsor. If you are only petitioning your spouse you already counted her in the part where says about the principal imigrant. So, the next part there is a place for the person that you're sponsoring in the form plus your spouse, but in this case, your spouse and the principal imigrant are the same person. You must put 0 in the space for spouse and 1 for you another 1 for the person that you're sponsoring. The total must be 2. Have you see the guide and theexamples forms

I think that you can attach your most recent income tax (2007) and provide the other two from puerto rico (2006 & 2005). I think it's valid because PR is part of US. Also you can attach an explanation where you say that you were living in PR since X year and provide proofs about it (mail letters, bills, lease bills form PR) and that you moved to USA last year...

I think that now is the time for chose if she wants to adopt a married name. You can file the I130 as she can that her name will appear in her GC or documents in USA. Because in USA I realized that it's very common to adopt the married name automatically, but still is her choice is she wants to keep her maiden name or her married name.

You can write an explanation letter about why tou didn't earn enough for 2007. I don't think that they'll deny your I130 directly, they'll let you know if you need to provide more finacial info. Anyway I think that if it's possible you can look for an co-sponsor. Because they will review more extrictly your last income (2007)I think. It really depends of who'll review the case... Good luck.

Call the service center and ensure that they have your fiance's (he's not your husband, think fiance fiance fiance) address correct in their system. You don't need the NOA1 for anything -- we never received ours -- but it's good to make sure that they're not sending your mail to Outer Mongolia. Plus, then you can check on the status of your case.

Another thing you can do is ensure your name is labelled on the inside of your mailbox, especially if you live in an apartment building.


Hi caladan, My fiance called 3 wk ago and he corroborated the address already. The address was OK. So, it delay may be a CSC system problem. I am reading about these problems in this forum... But of course we continue checking the case on USCIS page.

Are you doing a K-1 or K-3 visa? It says K-1 is what you are filing for. But then you referred to your "husband". Are you married to him? When I read that, I was thinking you need to be filing for a K-3 visa. Not a K-1. The K-1 visa is to bring your fiance(e) to the US to be married.

It can be ha ha ha here but it is not a laughing matter with the immigration authorities. One of their favorite questions to ask the K1 applicant is anything about their husband. If the applicant fails to correct them and say, he is my fiance, not my husband, before answering the actual question, things have been known to go very badly.

If I were you, I would immediately get out of the habit of referring you your fiance as husband or boyfriend.

[size="3"]My boyfriend sent our I-129F application on May 8th 2007. Since then we haven´t any news about an answer from imigration. We have the mail receipt and my husband called them. They said they sent us the NOA1 since May 14 but this notice didn´t arrive to my boyfriend address. Why this happen? When he called, he corroborated the address and it was Ok... We are worried about the content of this letter because I have read that sometimes imigration ask for more evidence. I´m not sure if in case of the RFE be necessary, it comes with the NOA1 or if they may ask for the RFE in another mail?
When we check our case on USCIS page this information do not change since 2-3 wk ago... The same happen when we check about the processing times on CSC...
What is happening? It´s a normal thing?

Buenos dias, somos nuevos en esto y me ha parecido muy interesante este foro, nosotros empezamos el proceso para la visa K-1 el 18 de mayo en el centro de california, estamos a la espera de nuestra aprobacion del NOA2.

Según entiendo, no es necesario que te las pongas ahora, porque no buscas en el website de la Embajada de USA en México? El website de la Embajada en Guatemala me remite al website del US Department of State, que dice que no es necesario, pero es RECOMENDABLE ya que de todas formas las necesitarás para el AOS.

Según entiendo, no es necesario que te las pongas ahora, porque no buscas en el website de la Embajada de USA en México? El website de la Embajada en Guatemala me remite al website del US Department of State, que dice que no es necesario, pero es RECOMENDABLE ya que de todas formas las necesitarás para el AOS.

Esto es lo que dice:

Yo creo que si me hace falta alguna, que no estoy segura si mi mamá guardó todos mis records sad.gif me las pondré de una vez aquí, creo que es mucho más barato y así ya te llevas todos tus papeles completos.

Good Luck at CDJ. For K1 visa - you do not need vaccinations. You will need them for AOS stage once you are in the USA.

Someone knows which vaccines i need to have for my interview? I know that for each country they are different. I´m from Mexico so I have my interview in Cd Juarez. I know that in the medical exam they will put them if they are necessary, but i have read than if I carry with me the evidences that I have the vaccines already, I must not pay for them...
