Thanks a lot for the help

Have they cashed the check? Better yet, did you send the petition with a check or money order?

Hi, william. We sent the petition with a money order. Is there a way for we know if they cashed it?

No te preocupes!

Thanks for all

malego77,

Are you asking how long it takes to get an RFE if one was going to be required?

The answer is - in most cases;
"About as long as it would take to get an approval if no RFE would have been required."

Hi Karin and otto, thanks for reply...
So, you said it is posible to get a RFE instead an approval when 90-120 days (the time for an approval) have been passed and there is not any approval yet?

Yes, it is certainly possible. Keep in mind, a majority of the time, 90-120 days (or whatever the processing times are at the time), the petition is not being looked at - it is waiting to be looked at. So, when it gets its review for approval, it either gets it, or not..

Hope this helps good.gif

You´re right, of course it´s helping me. It´s logical your explanation. Thank you rose.gif

Anyone else stuck after the NOA2? Any luck with calling a live person even though automated guy says "stop calling we don't know who the heck you are"?!!

We´re in the same status. We have received the approval since september 28 and my boyfriend called the last week to the NVC but nothing yet. It´s almost 3 and a half weeks... So, we continue waiting and waiting and worried. Good luck.

Hi, zeroland. You´re right, there isn´t an interview date! Yes, I´m waiting for Paket 3 to arrive... Is it the same thing with the letter wich NVC send to the petitionary?? (packet 3 = letter from NVC)? Thanks.

You`re right, 2 months!!! It was so long for me. NVC has delays due to a lot of people filled before the prices rising for the applications. And the CDJ consulate delays too, maybe due to they´re moving to another place (I read that in this forums), but anyway, here are more people who CDJ received the packet and in this days got the packet 3¡¡¡ So Don`n worry maybe it`ll change...

you can call to CDJ consulate 01 9008494949 to ask for your package. It´ll be possible that your fiance in mexico will receive the package after you (US citizen) due to the efficiency of the postal service in Mexico. K-1 Fiance(e) Visa Process & Proceduresmistake on K1 application
QUOTE (dueber @ Jan 30 2008, 09:34 PM) <{POST_SNAPBACK}>
I filed a K1 petition for my ex-fiance and during the waiting period the relationship ended and I decided to withdraw the application. After a couple of months I received the paperwork stating that the case had been closed. I met another woman shortly after and fell in love with her immediately and decided that we wanted to get married. So, about 5 months later I filed a second petition and received the NOA1 shortly after. 2 months later I received a notice stating that my case was being transferred to the local office in the city I live in because that office now has jurisdiction over it. After receiving this notice I reviewed the application and realized that I had made a huge error. I checked "no" on the box that said "have you ever filed for any other person before". After realizing this mistake, I filed an amendment and provided all the documents from the prior petition. It's been over a year and have yet to hear anything. I have gone to 5 infopass appts, made a phone inq, sent 2 letters to the district director, and had my senators office call on 4 occasions. Has anyone ever made this kind of error or heard of anything similar to this? Has anyone ever been charged or had to deal with a visa fraud investigation? Thanks for the feedback.

When you withdrawn the application it was already approved?? If it was not I think than it won't be a big problem...

K-1 Fiance(e) Visa Process & ProceduresVisa Laser and Inmigration Options
QUOTE (franklie @ Feb 1 2008, 10:55 AM) <{POST_SNAPBACK}>
Good day to all,

I was introduced to this forum by a friend who used it to successfully bring his fiancee to the US. He said that there is a lot of good info here. I have spent the last 2 days scouring the forums trying to find a response to my situation and have been unable to anything similar.

I live and work in San Diego, California. My fiancee lives and works in Tijuana, Mexico. The 2 cities are on either side of the US-Mexican border. My bride-to-be has Visa Laser that enables her to cross the border at will.

We wish to marry and make our home in my house here in San Diego (it's a bit safer here than in TJ and I can satisfy my other commitments).

The questions: Is there a way that she can continue to go to work in TJ if she has a K1 or K3 visa? Will a K1 pr K3 visa supercede her Visa Laser? Is there another option? helpsmilie.gif

I appreciate, antemano, any help given good.gif

If you apply for a K1 visa for her, she has to said than she had a visa laser. When she'll go to the K-1 interview they quit her hers visa. So I don't think she would be able to cross the border daily to go to work more. Because the K1 visa is for one entry and she won't get out USA until she will have her Greed Card (6-18 months). So, in my opinion is better if you get married and apply for her residence directly.

Do you think that I will have any problem having a different signature in my passport? any problem at the USCIS, embassy or POE??

Thank u!

I don't think it'd be a problem. If your recent documents (ID, Driver License...) have the same signature that you put in the I-129F you can prove that is the same person if the proof will be request (thing that I hardly ever think that would happens).

I'm getting ready to send my petition in and I have a couple of questions that have probably been asked a billion times, so I hope no one minds answering them again. blush.gif

Should I send it regular mail or should I send it with someone who has a tracking service?
Both options are good. Whe sent our package with USPS service and it have a tracking service too. Maybe the delivery is faster with UPS or other company

I am listing my employment on the G-325a. I've had two main jobs for a long time, and have sporadically had a third job. I can't remember the exact months that I started or stopped at the third job and their employment verification hotline (through a different company) says there isn't a file on me, so they can't give me the information. I can't get a real person on the phone at the HR hotline of the actual company. Is it ok to put approximate dates? Should I indicate that they are approximate? Should I just leave this off since I can easily show 5 years of employment history without this company?
You should leave this off. In our case that part was empty and we have not had any problem.

Am I way over-thinking this? I've been reading some of the posts on here and they terrify me because there are so many teeny, tiny little reasons that they will send it back. I'll probably have more questions...I just can't think of them right now. smile.gif

Thanks in advance for your help!

K-1 Fiance(e) Visa Process & ProceduresTo Sponsor or Co-Sponsor?
QUOTE (AlHayatZween @ Feb 7 2008, 03:27 PM) <{POST_SNAPBACK}>
Hi all,
Just trying to think of my assets for the Affadavit of Support.
Most of the time I am a freelancer and earn above the poverty limit. Only this past year I've been working and traveling abroad so in 2007 I haven't really made too many $$. Now I have a temporary contract in the US that pays quite well, but ends in the spring and is just shy of 17,500. I'm confident that something else will turn up, and that we'll be fine. But I might not look to wealthy on paper in 2007. I have savings, and such, but for a 3 year commitment (as per the I 134) we might be cutting it close.

Should I start arranging for a co-sponsor even though I will provide evidence of gainful employment for the last few years? It's that this contract is ending in the spring... I'm afraid that will mess me up...?

Thanks for any advice,
hz

In my opinion, is better that you use a co-sponsor. You can send your employment letter with it.

For the imigrant person is imposible (difficult) to get a SSN if you have not got married yet (at least with K1 visa procedures). So, the SSN isn't necessary for get marry. Like tell DanielParul, you can apply for a SSN after get married. Good luck.

Hi Everybody,

Sorry I posted this in a different forum hence posting it again under K1 Forum.

My interview is on 20th Feb and all excited getting closer to being my Fiance soon.
We have started planning our marriage date and have a question regarding the wedding process.

Our Situation

1) Me and my fiance are Hindu.
2) His family doesnt bother much about auspicious dates however they would prefer any Thursday (Saibaba day).
3) My parents want us to tie knot on a auspicious date.
4) And We both want to be together as soon as possible.
5) However my parents have asked me to stay with my sister in Missourri untill we get married. Because our culture does not allow live-in untill married.

Our Wedding Plan

Keeping above in mind, we were planning to get married within 3-5 days as soon as I land in US.
Since my interview is on Feb 20, I am planning to be with my Fiance by first week of March.

Our Issue

After googling around I found couple of auspicious dates. Though I have asked my Dad to find out some more dates from our PunditJi).

Auspicious wedding dates :
March 2008 - 1 Mar, 4 Mar, 11 Mar, 26 Mar.
After that till April 14 there are no auspicious dates (as heard).

Our Question

1) Considering the above dates, when should we get the marriage certificate?
2) Someone said marriage certificate validity is of 30 days which means getting married within 30 days of marriage certificate purchase.
3) Also heard that we may need to purchase marriage certificate 30 days in advance of marriage date.
4) Am confused now and would like to know process of getting marriage certificate and getting married? We got married in Texas. We got married in Dallas, the same day that I entered to US. The same day we got our marriage license and there wasn't any problem. In the marriage license, said that you must wait 72 hours to get marry but they put a paper where the judge can sign for "waiver" that period.
5) How much time should we count?
You can go or call to ask for a marriage license to your nearest office and ask them if you can get a marry license now with a copy of your fiance/ee passport. Maybe you can get married asap in the first Auspicious wedding dates:
March 2008 - 1 Mar

We have to plan my flight accordingly because I do not want to stay at my sister's place away from my Fiance for long. This process has tested our patience too much and when we are almost through we just cant be away from each other for any xyz reason. cray5ol.gif Help!!!

I hope this would help you.
Thanks,
Manya

K-1 Fiance(e) Visa Process & ProceduresWhat paperwok is needed to bring to america?
QUOTE (punkouter @ Feb 8 2008, 12:54 PM) <{POST_SNAPBACK}>
Besides the documents compiled from the process of obtaining the visa.

Are there any other documents that will be needed to process any of the paperwork in America ?

If you're talking about Adjustment of Status (AOS) when the imigrant will be in USA? I think to get the vaccinations complete in your contry, so, on this way you avoid paid for vaccines in USA which ones will be free in your country. It's important to save the records if you get one. School's records are too important...

K-1 Fiance(e) Visa Process & ProceduresLetter of Intent
QUOTE (CL79 @ Feb 11 2008, 12:31 AM) <{POST_SNAPBACK}>
Hi all...

My fiance is re-doing the letter of intent to marry with a signed date closer to the interview and have it notarized. Now, the question is, do I need to change the address of the recipient? Previously, we had the Vermont address at the top, and now should he change the address to my embassy here instead?

Please advice....

Cheers!!!

In our letter of intent we only put: to whom it may concern: We don't put any address. In my embassy's country we didn't need re-new those letters of intent, only I filed the letter of intent wich comes with packet 3.

Thanks all. Here are some suggestions for the people who will have the interview soon in CDJ.

At last we have the reward of so many concerns. We are already together and where they wanted to be.

I would like to share some suggestions that can serve those who go to the interview:
-- To show K1 not mentioning your boyfriend (a) to the consulate only fits the person who is requesting the visa.
-- Bring clothes because it makes you warm windy ice cream.
-- The day of the medical examination can form as at 5 am. You have to go on an empty stomach. I come to the 5.30 and as 15 people had already ahead of me. But soon sali (at 10 am).
-- Bring your sheet appointment and passport. You do not need vaccines (I carry immunization records and I returned).
-- Not to be formed outside the consulate on the day of the interview but arrive early because the people who have the appointment before the pass in front of you. As in the quote sheet said that serve 8 to 10 am one enters the group of people by appointment at 8, of course you have to be a little earlier (as at 7 am). LLeva your sheet citations and your passport at hand.
-- Be sure not to take anything for prohibited items. If you can bring food which is not only in glass bottles, all inside sold outside the lunch room B, but then there is no time to leave because they can call at any time and not heard.
-- Ah, very important: You have to make the payment of the right to demonstrate in Banamex subio rate to 131 or 1470 dlls pesos (must be at a branch of Cd Juarez) if you want to pay the same day of the medical examination to avoid have to leave the consulate at that time the bank opened at 9 and I think perderias your day.
-- Upon entering the consulate you must go to the room C where there is reviewed your documents (forms DS156 and complement the commitment to marry, 2 photos, birth certificate of the beneficiary, affidavit or I-134 support to the income tax of last 3 years, on the boy's medical examination). Do not despair if you call others before you. As that do not carry an order defined shifts, but to all callers.
- After you review your documents and signatures to call you again for taking the fingerprints. From there raisins to room B where it will be an interview with the consul. The interview was in Spanish.
INTERVIEW: I go to the window 28. The consul was very kind. First, you have to swear that everything you will say is true.
-- Said me about your relationship.
-- Has been you in the United States?
-- It has been promised to visit her?
-- When you think marry?
-- Who is (NAME OF CO-SPONSOR)?
-- He gave me a piece of paper and told me that his visa approved. Welcome to the United States.
I came back to lay in wait for me to call the package handed yellow (to be delivered when to enter USA) and my passport with a visa in it. This is the best part tardada throughout the interview process until you get the visa stamped are AT LEAST two hours. Check that everything was correct and exit to give the news to my boyfriend.
That same day we crossed the bridge that indicated in yellow on (at the bottom right which says a bridge must be crossed if you decide to do so by Cd Juarez.

This was my day in the CDJ consulate:

3 JANUARY 2008

4:00 am ---- Training outside the consulate (it was not necessary!)
7:30 am ---- entrance to the consulate. With a group of people by appointment
At 8:00 am Entry to Building C.
8:30 am ---- Window 8. Revision and signing forms.
9:30 am ---- Taking footprints. From here to Building B.
---- 11:00 am Interview. Approved!
2:30 pm ---- Visa and package received.
2:32 pm ---- I gave the news to my boyfriend.
6:30 pm --- Procedure permit and entry to USA Cordova Bridge, the passage Tx.
8:00 am on January 4, 2008 ---- Arriving in Dallas Tx.
2:00 pm on January 4, 2008 --- Marriage License
3:00 pm on January 4, 2008 --- Wedding

Hopefully you serve this suggestions. A lot really lucky and that everything goes well. For the majority of people are approved.

AQUI LES NARRO EN HORARIOS COMO TRANsCURRIO MI DIA EN EL CONSULADO:

3 de ENERO de 2008

7:30 am ---- Entrada al consulado. Con el grupo de personas con cita
