Gracias por todos sus comentarios y advertencias. Yo soy Mexicana y apenas estamos pasando por el proceso de K1 pronto en Junio vamos a ir a nuestra entrevista, y me han sido muy utilies muchos de sus comentarios y consejos. Mi novio esta preocupado que me vaya yo alla a deprimir, por uqe dice que la situacion de trabajo esta muy dura, y que no cree que encuentre un buen empleo, escuchar eso la verdad si me apachurra un poco pues es de la persona que me gustaria escuchar actitud positiva por que yo se que de ese momento vamos a salir pues yo llevo una actitud positiva. Yo estoy apunto de titularme pensaba llevarme mi titulo profesional, aun no trabajo de mi area pero si tengo muchas ganas de hacerlo y apesar qeu no sea de mi area quiero trabajar, se que no va a ser facil pues nada en esta vida es facil. Creeo que el tiene miedo pues el tampoco gana mucho, pero lo suficiente para tener un departamento y pagar sus gastos. Me han servido mucho sus comentarios que me llenan de aliento y me dan una orientacion de lo que tengo que hacer para revalidar mis estudios alla.

we recieved a letter which says ....the state department´s national visa center has recently received an approved I129 petiotion filed on behalf of your fiance. this letter is to let you know that within a week the petition will be forwarded to the appropriate visa issuing post where your visa interveiw will take place.
this letter is dated july 31,2008 but arrived in the mail aug, 04.....how long should i give my fiance to recieve her package before writing to the embassy in mexico to see if for some reason it got lost in mail because her approval notice expires 11-20-08

El paquete 3 no es otra cosa más que la carta de invitación , la cual de hecho consta de una sola hoja en la cual te proporciona un link para checar los documentos que debes llevar a la entrevista, las formas que debes llenar, el proceso para hacer la cita en el consulado, etc. A veces tarda de 4-10 semanas para que ya sea el peticionario o el beneficiario la reciban por correo dependiendo de cuando llegó al consulado toda la documentación del caso, procedente del NVC.
En mi caso, la petición fue aprobada a principios de marzo y yo recibí la carta a principios de mayo...(al igual que tú, ya estaba desesperada).

La verdad ya no sabemos a donde llamar porque nadie sabe decirnos exactamente donde y en cuanto tiempo llegara el paquete, me dicen que aunque no lo haya recibido aun puedo realizar la cita, encontre esta informacion http://www.visajourn...xico&cty=Juarez, eso es lo que tu recibiste? Hola a todos!

Perdon que no escriba esto en Inglés pero aun no soy muy buena escribiendo. En fin quería pedirles ayuda. Mi novio y yo aplicamos para la visa K1 a través de un abogado porque creimos que era más rápido y conveniente, cosa que no ha sido así. Este nos dijo que el tramite tardaría entre 4 y 6 meses, empezamos el proceso a finales de Julio obtuvimos la aprobación en Enero pero no hemos recibido el "famoso paquete". Llame al Servicio De Visas en los Estados Unidos (mexico.usvisa-info.com) para saber cuando recibiría el paquete y hasta la fecha nadie sabe decirme de cuanto tiempo va a tardar, se supone que tardan de 4 a 6 semanas en enviartelo pero este tiempo empezo a correr desde febrero 10, ya han pasado casi 2 meses!!!! El día de hoy llame y medijeron que podía descargarlo en esta pagina (uscis.gov) pero no pude encontrarlo. Estoy algo preocupada porque mi petición expira el mes que viene y aun no vemos nada claro, si alguno de ustedes puede decirme donde descargar el paquete se los agradeceria mucho puesto que ya tego todos los demás papeles que necesito para la entrevista. Are you the petitioner right? I don't remember some place in the form where they ask for "criminal records" from petitioner. So I don't think that you must include that. In this case they put their attention on the immigrant. Anyway you'll keep your proof that you complete the request related with your DIU if they would ask for in the future. Good luck

Depende de si tu I94 esta vigente y del tipo de visa a la que te refieras. En mi caso, yo entre con visa K1 pero ya me llego la residencia y la I94 quedo en mi pasaporte como recuerdo porque no la tuve que regresar cuando sali de USA, sin embargo con las visas de turista tengo entendido que es diferente. Debes de entregar la I94 pues es la prueba de que saliste del pais dentro del tiempo permitido. Saludos.

We're going to need a lot more information.

Is she still in the U.S. now?
When was her last entry into the U.S. (the laws changed in 1996 and this would be VERY affected by that).
What type of visa (immigrant/visitor/immediate relative, etc.) are you considering?

The same occured me!! When I checked the forms that the lawyer filed I found a lot of mistakes. I got so angry because we paid them and they didn't do their work well!!! It was one of 1000 reasons for not to get a lawyer with AOS devil.gif
So, I corrected the forms but not the pages where there was a signature and I didn't have problem in my K1 visa interview. Good luck

Hola Jimmy, claro que si son validas las vacunas que te pongas en tu pais. Solamente guarda tu comprobante para cuando lo necesites mostrar al medico de imigracion cuando hagas tu ajuste de estatus. Si puedes tratar de obtener las mas que puedas porque aca son caras y me imagino que hay algun hospital por parte de gobierno en colombia donde te apliquen las vacunas gratis. Yo me puse la de varicela, hepatitis B, sarampion, tetanos y difteria. Puedes ir cuanto antes porque algunas se necesita mas de una dosis y debes de esperar como un mes entre una dosis y otra. Suerte.

If they marry within the 90 days, yes they are.

If they marry outside the 90 days, a K-1 visa holder can also adjust within the country, they just need to file the I-130 along with the I-485.

The problem for travel with the I131 while she'll waiting for the GC, is that when she'll want to re-enter to US she cannot will be allowed to do, because her admission will depend of the critery of the immigration official. At least is that I have read here in VJ. Supposely, the I131 is with that porpouse but I don't know, in my opinion is better don't to take the risk.

Some people decide to get religious wedding abroad (if it isn't considered as legal marriage) and next they apply for the K1 visa. Other way, is waitn until she gets the GC to go to Peru and get the religious wedding.

I suggest you check out http://immigrate2us....forum/index.php. There is another forum that I can't remember right now that also has a lot of waiver people. (There are two separate ones dealing with Mexico that might be helpful for you as well since people on those forums seem pretty knowlegeable about waivers and overstays.) As far as I understand, you have to do the entire IR-1 process (I-130), then you get denied automatically, then you apply for a waiver, they tell you if you are eligible to apply for a waiver and how long the ban is if there is one. It sounds like you could draft a pretty good hardship letter from the situation. Good luck!

1. I'm not sure why you would have to file the I-824. I understood that was for cases that have been lost or forgotten.
2. RFEs are requests for more information, e.g., if you did not send enough information in your original packet you get one. There is no fee for an RFE. :guides:
3. The I-130 costs:
USCIS: 355, NVC/ Interview: 400 DHL at the interview: 70 for one of the forms (I forget which because the fee is not relevant to me) 8 Medical Exam: currently about 175 plus VAT plus the vaccinations, probably approximately 344 if not more. Add to that the cost of flights, hotel in CJ, taxis, and a variety of paperwork. However, those prices can change at any time, so be prepared for that.
4. In Ciudad Juarez, he will have a medical exam on one day, and then the interview later. Most people advise leaving at least one day between the medical and the interview because there can be delays. He will be denied at the interview, and then wait around for DHL to send him information saying if his case is waiverable or not. If he is eligible for a waiver, you can call right away about it. Some people get scheduled while they are still in Juarez. You will want to have your waiver packet prepared before you go there. Your hardship waiver is very important. Here's VJ's link to more info:

I would also recommend www.immigrate2us.net and www.smf.juarez-mexico.com because there are a lot of people on both those forums who have experience with those issues.
I don't have enough knowledge about waivers to know how your case will go, but you should make sure you are aware of what the consequences of leaving the US will be, because some people gets bans much larger than they expected. I recommend checking with some of the other forums.

From what I have read, the really important part besides having a good letter is including proof of what you are saying, such as letters from the people you talk about, and evidence of all the things mention. Laurel Scott's levels of hardship are helpful for deciding what you should and shouldn't include in your letter.

If I were you, I would post my hardship letter on www.smf.juarez-mexico because those people will give you really helpful suggestions from personal experience.

momof1 - I think you misunderstood what I was trying to say: I said the OP should have the waiver packet with them in Ciudad Juarez because Juarez has a pilot program where waiver interviews are sometimes granted that same week. It is one of its kind in the world. Also, that first statement was made before we knew why the OP needed a waiver. It is pretty rude to say "incorrect" when we were unaware why the OP had been told they might need a waiver. I understand you are trying to help, but try to read the posts.

I did not say they should bring the waiver to the interview. I said they would be notified if they are eligible for a waiver by DHL (or at the interview) and then they can file the waiver.

I did say that they should take relevant paperwork with them to the interview, such as the DWI, or proof or rehabilitation in case it is asked of them then.

I also agreed with you that they would probably be referred as I stated above, once the OP cleared up the situation.

Juarez is slightly unpredictable, so it is good to always be prepared.

I would also like to say if the wait is killing you, some people do choose to move to Mexico for the wait. Since they become really familiar with the country it is actually easier for some of them to write their hardship letters.

Also, smf.juarez-mexico.com has a lot of formats for hardship letters and what doesn't get approved and what does and the people there seem to give helpful comments on hardship letters.
