My fiance and I have a 2 year old daughter who has her US Citizenship throgh him, filled at the Mexico City consulate. I was given a Tourist Visa a few months ago valid for 1 year. The interviewer knew that I filled the I-129F and approved me but asked me first "You know you can't stay permanently there with this visa, right?", I said "Yes, I have to come back for the CDJ intrview anyway" And then she said "Okay, aproved."
I haven't gone to visit yet though. My question is:

Would they most likely deny my entry because of my daughter?

She is with me and I would be flying in with her, so I am concerned that because of her Citizenship the officer would deny our entry thinking I have other motives than just visiting.

We would like to do the following: We would fly up and stay until we get the NOA2, then I would leave our daughter with him and I fly down to CDJ for the interview and then go back. We have 5 months into this already but have been probably delayed a bit because of a simple Request for Additional Evidence. He can't stand that our kid is growing up without him, but we are affraid of waisting slim money we got on a flight and then being sent back.

My fiance called the NVC this last Tuesday (Sept 30) and they said they haven't recieved our case yet. According to the Flowchart it should be there by now or on it's way to the Embassy.

Should I be worried? sad.gif

What should we do? ohmy.gif

What worries me is that I have until January 8 to go to my interview according to the NOA2 he recieved. And with the Holidays coming they probably will be closed for a few weeks so that shortens my timeline.

We filled for the I-129F on March 2008, I got a tourist visa in April 2008, got NOA2 Sept 2008 and flew up to US this month and was granted 6 months stay as a tourist. We are just waiting for my fiance pack to arrive in Mexico so my mom can send it up to me. I brought all my documents with me.

Major factor for me is that we have a 2 and a half year old daughter that stayed with me and flew up with me and she has her citizenship and US passport. She is the reason why I was allowed entry with no questions asked.

But it is posible to do this, but I would say that under normal circumstances you have a 50-50 chance. If you can afford to try it, then do it.

hello to u.. my name is aishah and im new to vj site,, let me answer this question for ya,, ive ben doing alot of researching,the thing that the govermetn doesnt want is for the alien relative to become a public charge,the goverment definition of public charge is they dont want them to recieve anything of cash value like ssi,, or tanf.they can recieve food stamps,hud housing,medical card(as long as they are not in a place for long periods of time getting help like,drug rehab or nurseing home ecttt,)even they can get w.i.c.if the aliens sponor,say his wife in usa or her husband in usa is on any kind of public aid assistance other than tanf or ssi, its ok and cannot be held against them,
if u want to find out more information go to yahoo search and type in things like,, what is considerd a public charge for someone applying for visa,, or just words in this nature,, its how i found my information,, hope it helps ya.

Oh well... We have to look out for my baby first. We'll figure out the rest later.

Yes, I came as a tourist and the POE officer gave me 6 months to stay. But I can't legally work so my hands are tied to help.

Long story short I spent all the money.
But the house getting sold and me actually seeing any of that money is probably 6 months minimum away from today. Paperwork takes a LOOOONG time to get through.

So we are kinda stuck.

He says we will worry about that later, that for the moment he's not letting his daughter starve or be homeless.
He says that they would not separate me from her, that US law always side with mother. So that if she is a US citizen that it will be very dificul to get denied.

He is not correct. They will not waive this requirement just because your daughter is in the US. You may be able to file a hardship waiver, but it will not just happen. It always seems like its the men on here that think the US will just waive requirements for them wink.gif Don't let him learn the hard way. If I were you, I'd continue on with the K1 and try and delay the interview until your fiance picks up a 2nd job or something to show an increase in income. Also make sure to count all assets such as your house and savings he has etc. Time to get creative with your finances. Definitely make sure to prioritize your daughter's health and well-being as you can always try again once there is a turn around for your family.



What if he only uses this for about a month while he finds another job and pays debts? Could a short term asistance be held against him?

We are planning on moving to another state since where we are things are REALLY bad an where we are going we have a few friends and we hear work and living is better. This is in about a month.

So if he gets help for a month to get back on track and keep our child fed and under shelter. Do you think it will be held against us?

I'm probably not having my interview till late Dec or early Jan. So that should give us some time. Right?

And he was doing fine until this economic situation went down. He is in sales and obviously nobody is buying now. So we can't sit here an let our daughter starve or become homeless.

If I was alowed to work in the US by now, then we wouldn't have this problem.

We had the situation under control until the economy went bad on everyone. We had everything and then 3 weeks of no sales and we are in a bad sittion. Not fair!!! ranting33va.gif

Ok, was told by the CDJ Consulate to NOT let over 6 months pass and that the Invitation Letter IS an OPEN Invitation to the Interview.

Said to go with all documents required and can show up Monday to Friday except every last Friday of the month and US and Mexican holidays.

Said that if you let over 6 months pass then the case might get cancelled or filed and then further delay your case.

So thanks again to all who answered and I hope this helps someone else in the future.

I am in the US with my fiance, but we ran into some financial problems (2 traffic tickets) and some other stuff that took some of our savings, so I can't afford the trip at the momment. Plus we have a 3 year old girl and we also need a babysitter for those days. We just can't do it now.

I am going to try to call the Embassy today or tomorrow and see if I can change my date.

I was thinking that seeing how many people miss their apointment because they didn't recieve their letter on time, that the Embassy shouldn't have a problem with those dates. They should give at least 6 months or specific instructions on what to do in these situations.

Anyway thanks again and I will post to let you guys know what they told me over the phone.

Petition approval expires in four months but Consular officers can and routinely do extend the validity. You attend the interview as scheduled on your invitation letter whether before or after the expiration date you see on the NOA2.

The only thing I know is that Ciudad Juarez Consulate gives open apointments for Fiance Visas. We can go any day of the week without apointment. What I don't know is if I can go after my expiration date or how to postpone it.

I have been reading about this and I also spoke to our lawyer about it ( my case is a little different) anyway she said that they will let us know in the K1 interview but I also read that you can apply for the waiver before the interview, so I guess and I hope she can be in the USA before 2014 ( prayers and blessings to both of you).

 I overstayed in 2008, (for a month) I don't know if this is different but they gave me a "punishment" or banner , not sure how you say that, anyway my "punishment"  was over this past March, I asked our lawyer and she said it's not a problem and that I didn't need a waiver cause the 5 yrs had already passed, she said that if my I had my interview before March ( which it didn't happen, since we applied in January) that then I did had to apply for a waiver, so I guess a waiver will do for your fiancee, GOOD LUCK!!!  We're waiting for our NOA2, I hope everything goes well good luck to all of us! smile.png

I just got to Dallas, TX this Monday, it depends how many people there is: There's a line for residents, one for US citizens and another one for visas ( get in line with the one for the visas) as soon as they see you are a K1 or K2 they will send you somewhere else and it really depends how many people there is. It took me about an hour and fifteen minutes because there was alot of people there from different countries so if you have to take another flight let the people from immigration know that's  what this lady did. Honestly my Fiance and I were looking for the process of getting married first than apply for K3 but seeing a lot of options we see that the easier way to do it is by K1 visa otherwise the other procees takes a lot longer and they have a lot more requirements. Hi we just recieved what I believe to be pack 3 ....we recieved this packet at my home address in the states but Daysi still has not recieved her information in mexico but the letter says we have an open appointment ...can we go now ...also I have read that you need to send in letters the the embassy but no where does it state that in the pac.3 we recieved it just says collect this information and medical chec. and then interview ....is it different here in mexico than other country´s ..also I have read you need to get a police report of no crimes committed but this document just says only if you have committed a crime you need to show this....do we still need to get a police report even if she has no record.....thanx for any help on this

hola soy nueva aca y estoy viendo el time line de algunos participantes y sale despues de recibir el NOA1 touch que eso??? mi novio mando el paquete 129 el 10 de julio, lo recibieron el 13 de julio y el NOA1 le llego a el el 17, en la pagina de uscis sale que recibieron la peticion ese dia ya!!!! esto es hace un mes y todo el mundo despues de esto tiene touch y no se que es!!!!! puede que no sea nada importante pero no se bien que es lo cual me tiene muy nerviosa.... si me pudieran ayudar con esto se los agradeceria en el alma

Lo que significa es que, en la pagina de USCIS donde checas el estatus de tu solicitud aparece una fecha que dice última actualización. Esa es la fecha que puede cambiar, si cambia quiere decir que tuviste un touch¡¡¡ Como si ubieran revisado tu caso o le hicieron algo pero en relidad no se puede saber que? Muchos dicen que no tiene nada que ver si cambia la fecha de actualización y que incluso les ha llegado la aprobación sin haber tenido ningún touch. Nosotros metimos nuestro trámite (I-129F) en Mayo 8 y no hemos tenido ningún touch desde entonces.... Y tú cuando hiciste tu trámite?Espero haberte ayudado con tu duda.

Its pretty easy, just call the USCIS main number, listen to the menu prompts and follow the prompts regarding a request for evidence. I dont remember the exact path and it may have changed. You will be asked to input your case number, and you will hear something like please send in the requested evidence, and then you will have the option to speak to customer service.

If you don't have a case number, those wont work. But it looks like you do, just your NOA1 was suppose to be sent when they were having issues.

It have passed almost 105 days that we filed my I-129F and no hard copy of NOA1. No updates, no NOA2. I´m really worried... I have read about the RFE trick, How can I use it for get info about my case?
Can i call to USCIS and ask if they need more evidence or what?
