It really depends of where are you from... In Mexico we didn't need to sent back to the embassy anything, we followed the packet 3 instructions and went to the interview. But in case that you need to return something ti the embassy you can file the requirements and send them back of anywhere you are, or well, you can file it and send it to your parents and next they send it to the embassy

5.Can i get the police certificates now or shd i wait for packet 3 and 4.Is there a specific format for the certificates,i mean what kind of certificate we need,what shuld it say.
Make sure if your embassy ask for police certificates in your country, in my case I didn't need any.

6.Also,i was in Uk for 2 years on deputaton by my company.I wont be able to get the police certificates from there.what shd i do?

And, if she had previous income tax she can attach them if they would be necesaries

The co-sponsor only must earn enough for the imigrant fiance/ee and he. The US petitioner doesn't need to sponsored.
The co-sponsor can attach the last 3 years of income tax with the I-864, if he/she did enough income, she/he doesn't need to show more assets. Ahh, You don't forget that aside you have a co-sponsor the US petitioner must file another I-864.

I'm really looking for advice from U.S. Citizens and how hard it was to bring their fiance over from England. I know the paperwork is in depth, but I don't know how much of it they actually look at.

Any input would be greatly appreciated,

There wouldn't be any problem if you won't have income for those years. The worse thing it's that you will need a co-sponsor if you won't meet the poverty lines when you will do the visa petition.

Secondly, as my fiancee is a struggling student, she will not be able to be my affidavit. I understand that you can get a co-sponsor if your fiancee does not earn above the poverty line. Originally, we planned for my fiancee's mother to be the co-sponsor, however, my fiancee has recently had a falling out with her mother, as she found out that her mother had been stealing the inheritance left to her by her father. We no longer want to use her as a co-sponsor, however, my Uncle lives quite close to my fiancee, would it be possible to use him as a co-sponsor or would that cause problems as he is my family member?

The co-sponsor can be any person who is permanent resident or citizen of the USA. It doesn't matter if you have a family member as a co-sponsor. Mine was my sister's husband and I was the imigrant. Also, I recommend that your fiance will attach an explanation letter about why she didn't work last years or now, she can attach evidence like schools records. This ssuggestion is only "if they will ask for". Good luck.

I got that information in the consulate the day of my interview. Also, you can see that the visa is valid until 6 months after. It has a date printed on it.

In Mexico the packet 3 in the website of the embassy is the same with the packet that the embassy sends to us. The only difference is the appointment sheet. From what I have read, you only begin to build up illegal presence after the 18th birthday. I think that he would be given a 10-year ban which might or might not be eligible for a waiver. I don't know what the benefits are of doing a K-3 in that circumstance. Most people agree that the IR-1 would be faster and you don't need a K-3 if the IR-1 would take the same amount of time and cost less. The K-3 was only invented as a sort of addition to the IR-1 so that people could have their relatives in the US sooner while the wait for the IR-1 to process, but it no longer functions noticeably quicker. There are some people that are not eligible for visas and those include people that used fraud such as presenting themselves as American citizens when they were not or have some sort of criminal record, etc. However, even the most difficult case seems to possible when there is evidence of great hardship on the part of the American spouse. They need to do a lot of research before they act. Lawyers are a good idea, but in terms of filing the papers, there are various forums for waiver people. Good luck!

I thought that K-3 was a wash but I have noticed in the Mexican timelines that it may be as much as a month or two quicker. Check out the K-3 timelines for Mexico above. It's impossible for us to tell you how long it will take, but the timelines can give you a general idea. Since you already filed K-3, you may as well watch and see how it goes through NVC. I think you can pick later on whether you want K-3 or the CR-1 interview? but don't quote me on that. My guess is your K-3 interview would come slightly faster and it seems like that may be a really important factor for you.

However, if she was ever illegal or has any other US customs difficulties it will probably take a lot longer...

Then read the guides.

You need to know where you are at in your process. Find out if you have gotten your NOA2 yet of if your petition is still as USCIS, or if it has already gotten to the consulate.

If she filed a couple months ago, you are probably already at NVC so I don't know if you can even file for a K-3 that late.

Check the timelines to see if a K-3 is even faster for Sweden or not. A CR-1 could be just as fast if not faster. I just checked the timelines and they are pretty hard to understand. There is almost a complete lack of data for Sweden but it doesn't look like a K-3 would be faster.

The I-130 is the application for an immigrant visa, that visa being the CR-1 if you have been married less than 2 years and the IR-1 if you have been married more than two years. The CR-1 is a two-year conditional green card and the IR-1 is a ten-year green card. You have already applied for it. The K-3 was really not that much of a benefit, and often was a loss, because people would pay more money (adjustment of status $1000+) and have to wait until they adjusted status to work or get other benefits. It was only used as a sort of "expedite" as you say, of the CR-1/IR-1. However, in recent years, the CR-1s/IR-1s had gotten faster so it was practically as fast to do that and much cheaper. There is no other expedite that I know of unless you are in the military. Read the guides where they compare the visas.

To the OP: I wrote to my Senator this morning as Kathryn mentioned, and I suggest you do too. Hopefully it will have some effect.

The Ciudad Juarez embassy is the only immigrant visa post in Mexico. There are many other more desireable cities as I have mentioned before in various other posts. Mexico City would be ideal, as Mexico is a centralized country. Ciudad Juarez ranks among the most dangerous cities in the world and according to the news yesterday, is the largest US embassy in the world. Not only were 3 family members of consulate workers (including 1 consulate worker) killed close to the consulate, but there have been shootings mentioned at the Denny's and other restaurants on the same street in broad daylight. I live in Mexico, and the rest of the country has violence, but nothing compared to that. ANY other city would be preferrible to Juarez.

If you haven't gotten it yet, I would definitely go to the information window because you are outside the 5-day timeline. I can't find any information about it on the consulate website, but they do have the US Citizen hours.

If it's not ready right away, you can ask if they can send it to wherever she is from, which although unlikely that they would do so, has worked so far in 2 waiver cases. Obviously, my advice is not expert advice, but I am just offering the solutions I would think of were I having to pay for a week's worth of hotel rooms.

I like your message, Hopp. I so wish my hubby was going to Cancun for his visa but it's looking like he definitely will be in CJ where you can meet every type of Mexican police - traffic police, city, state, federal, the creepy ones I call Men in Black cuz they drive black Chargers and have black sunglasses and glare at you as they go (judiciales,) the army, and now even DEA agents undercover.

Hey Dbarker, I found the DHL website for you: www.dhl.com.mx. They have a 1-800 number: 1-800-134-5847. (1-800s don't work if you are in Mexico. It's 001-880 + the number) which can be quite expensive, or you can use Skype to dial 1-800s free supposedly. (I'm not good with Skype.) I'm about to see if other people are in a similar situation. From the ones I can remember, everyone who posted that they were waiting for theirs got it very soon after. I think there might be 2 DHL offices in CJ but one is the more used. Did you check both? 2 days appears to be not unheard of for a visa, though, so I bet you will get it tomorrow.

If you are getting worried, I think you (the USC)or possibly she can inquire at some information window? I have heard that you can check if your package is ready at DHL online on DHL's website. We filled the I-129F back in March, got approved in September, I entered the US on a tourist visa last October, been here for 5 months now, we have a 3 year old daughter together that was born in Mexico but has her US Citizenship and is here in the US with us.
Asked around by phone to a couple of immigration lawyers and they said that I could do the following: We can get married now as I am (tourist) and avoid going down to CDJ for my interview and just change the satus and do the AOS. They said that I would not be banned from the country for misguiding and all that. Because I'm not, just things have changed a bit for us.

Can anyone tell me if this would be true?

We don't have money at the momment and going down for my fiance visa would run us around 1000 dollars, then 1100 for the AOS.

If we get married now they said I just do the AOS and a medical that is done here in US. True?

Would I be legal to stay once I file the AOS?

I do apologize if this seems like I am trying to bend the rules and get ahead of people that have been waiting forever. But we are not.

We really didn't plan this, my husband and I have been together for 7 years this November. We have tried to do this following the proper steps. We live in Mexico together for 5 years until he decided it would be better for us to move up here. We filed he moved I stayed with our daughter, separated for 8 months until I got approved. Used all my money to fly here thinking with his job he would be able to pay for everything needed.
But 3 weeks after I got here he lost his position where he worked and things kind of spireld down since then, the economy took us to the bottom.

He finnaly has a good job and we now need to get this done. I eneded up getting money loaned by a family member I haven't seen since I was 8 years old. I need as much help as possible.

We had filed the fiance petition on March of 2008, we got approved but I never went to the interview because of money problems and some other issues. So we ended up getting married 2 days before my tourist visa expired.

I finally got some money loaned to me to start my paperwork and we have an appointment with an immigration lawyer this thursday, but I barely have enough to get my paperwork done. Worried I am going to end up giving money I don't have and getting nothing done.
On the other hand I'm affraid to do this process myself and ending getting deported and my baby staying here. I am scared.

We have a daughter together and she is a US Citizen like him. We did the consular report of Birth Abroad.

What should I do?

I have read the Guide here, I have downloaded all the paperwork, but I am affraid that I get deported because I over stayed my tourist visa or because I miss something or don't file something correctly. I am terrified!

The original plan was for me to come here with our daughter and leave her here with him while I went to my interview to CDJ. But I ended up getting married here on my tourist visa. Now my visa is expired, but I finnally have the money to try to fix this.

Please any advice is greatly appretiated.

Does anyone know of a GOOD affordable immigration lawyer in Las Vegas? Someone to trust.

I've finally decided I'm going to try calling to see if I can find out anything.........which number should I call? Just the customer service # on the USCIS website? My petition is at CSC.....



Well, I called, and the girl I got was actually really friendly and helpful. As usual, she told me it was still pending, but she did check to see if she could find anything else, then told me that they're processing petitions with a date of Feb. 1 right now. Who knows if that's accurate or not, but it's better than what is listed on the website right now for CSC processing times.
