K-3 Spouse Visa Process & ProceduresWhat about going to school?
QUOTE (cad @ Apr 10 2008, 09:38 AM) <{POST_SNAPBACK}>
Hi,
when you say "you" will need a SS#, do you mean, ME (the U.S. Citizen) or my wife?

Also, one other question? So, our "I130" is being processed, but then our lawyer is giving us contradicting information - once it "comes in" he said that we will have to file papers to get her over still, that it takes "about two more weeks" but I asked him if this was for the sponsership and the tax returns, ect, and he said earlier "no, thats for a differen't visa" so I'm confused, when it comes through the CVC can she come over? Or do we need to send more papers? Thanks!

The SSN is needed for the imigrant who wants to study in US. Have she considered to revalidate her career in USA? Maybe she can avoid 1 year more of study and she'll work soon as she get her work authorization.

K-3 Spouse Visa Process & Proceduresurget help for 134 AOS
I think that I134 is only for get the visa in the american embassy abroad, it's the short form of I864. If you're filing AOS and you come with K3 visa, you need the I864 form.

K-3 Spouse Visa Process & ProceduresPlease help,,No past Tax returns!!
My husband was in the same situation. He used a co-sponsor and my visa was approved. He attached an explanation of unemployment letter and he attached school's records as a proof that he was studying. You won't have problems. If you have a job you can attach the employment letter and the paystubs. Good luck.

I don't think that it would be possible! The other choice is that the US citizen will go to Mexico to get marry with the foreign person. And next, you can apply for K3 visa.
Good luck

K-3 Spouse Visa Process & ProceduresNo NOA1 after 45 days...
When we mailed our K1 visa petition they delayed almost 3 months for sending the NOA1. If you have the receipt when you mail your registered packet you can call to imigration and ask for the NOA1.
Generally it will delay 15-20 days to get the NOA1 but we see, there are exceptions.

I think that is better if you use a co-sponsor. If you can find someone whom can be your co-sponsor I think it's the best way.

The I-134 form is to be signed in the presense of a Notary Public, who will certify that the person named, signed the form. This can be done at any bank or most insurance agencies have a Notary on staff. It can be notarized at the Consulate but any notary will do.

Hi Pushbrk,

US Embassy and Consulate DiscussionFalse or true? Packet 3 is only delivered personally
Somebody that already it has happened through this transacts (visa k1), it is certain that we must receive the package personally? And that if we are not at the time of the delivery are problems... I think if this the person then does not give a term to happen to gather it to DHL (they send it by DHL or mail?) It´s difficult for me stay at home 24 hours (because at any time it´s can arrive) and that is practically impossible due to the different daily activities... Somebody knows if is certain, it really worries to me. Thousand thanks

Mil gracias

Hello all,

Our K1 visa was recieved on Sept 27 in CDJ and when I call them they keep saying any day now it could be sent but they have up to 3 months to get the fiancee packet out to her in Mexico.
My question is can I go to the Consulate now and wait in line and ask for an appointment letter??? I have read some have done that and recieved the packet.
I only live 5 hours drive from Ciudad Juarez and even if they dont give it to me it will be a recon trip to spy out the land so to speak. We desperately want to have my fiancee here by Christmas!!!!

Advice please!

Hi, Hodad1. I´m really sorry about the delay. We´re waiting for the packet since November 06 (CDJ received the packet from NVC) and your post make me feel sad, maybe our packet will be delayed too. I´m too pesimist right? But, anyway I hope soon our cases are in our hands. Good luck. At CDJ consulate said me than the fiance would be to the interview if the petitionary or beneficiary had the packet. It isn´t necessary wait for a couple packets. But anyway you need call to CDJ and ask about this delay, when I called they said me if I´ll not received the packet within 1 month (until Dec 06), I have to call them for info. I hope this help you. Good luck one more time. good.gif

US Embassy and Consulate DiscussionI-864 affidavit HELPPPPPPP AOS K1
We're filling my AOS I-864 affidavit, I was entered to the US with VISA K-1.

I have some questions:
If the peticionary (US citizen) don't meet the poverty guideliness and he uses another sponsor, Does the US citizen need fill out too another i-864?
What option in the first part does the sponsor must check if he's the unique? Is like substitute sponsor but in this part said than a substitute sponsor is when the principal sponsor dies.... I'm confusing.
The another option is THE ONLY JOINT SPONSOR but he isn't a joint sponsor, is the only sponsor...

____________________________________

Jeff and Sofia,
I am going to Juarez this Sun. Jan. 27th to meet my fiance. Can you explain wjat you meant by having them fill out the DS-3025. What is that? Do they have that form at the hospital or do we need to bring it? Also, what is the vaccination document? I am freaking out nervous, any help you can give would be awesome!!!
Amber

Hi amber, I think than I could help you. The DS-3025 is the form that the clinic give you when you go to the medical exam. In this form they will put all the vaccination record (vaccines you're already have). For K1 visa applicants the record isn't necessary (only for AOS when you're in USA) and they will give you the DS-3025 empty. Anyway you can carry with you the vaccination records and ask them for fill it out because you will needed after. If you get the DS-3025 fill out there you'll avoid this part when you'll be in USA. Anyway the vaccination records in the DS-3025 must go to a new form the I-693 than an authorized immigration doctor fill out and you send after with the AOS package.

Good luck.

This would apply if you have vaccinations at the time of your medical or if you have vaccination records from your country. Vaccinations aren't required for a K visa so if you wait until you come to the US to get vaccinations you can go to the health department and get them and then have the Civil Sergeon transfer the records to the 693 suppliment. If you get them at the medical then yes have them fill out the form for you to bring to the CS in the US to transfer

My suggestion is than is better if you get all the vaccines in Mexico because the costs in USA are more expensive and all the vaccines are free if you go to Secretaria de Salud in Mexico or IMSS.

Have a nice day

Do you know if there is a time limit on when I have to go, say within 4 months of getting USCIS approval (approved 12/02/07)? I only ask because looks like first week in March is the time we can both go together. But in either case would like to know my due dates...

Thanks everyone for their insight, it is helping more then you know!

You can go to the interview and if the visa is approved you can wait to enter to US until 6 months... Another way? The CDJ consulate told me if my NOA2 expire there is not a problem if the case is with the consulate, so I think you can wait a time like 15 days before the NOA2 date expire...

Another point

when i receive the packet3 i found that there is some forms in English (which is normal) and other forms in French .

what should i do upon that ?

fill out the French forms by answering in French ?
or
answer the French forms using English ?
or
get the English versions and fill them out ?

i am just wondering if they will understand French, it's not a problem for me

I think that you must answer in English. Does the packet have instructions with about how to file?
Maybe they sent you the information in French but you must file the forms in English.

in other way it will have 4 forms : 2 of my fiancée + 2 of my mother in law
2 forms ( my fiancée's and mother in law )should be sent to the USCIS office & 2 forms ( my fiancée's and mother in law ) should be sent to me

is that what you mean
I-134 is sent to foreign citizen just before visa interview for the interview.

No always, may be my USC fiance was the exception. We didn't receive this form with our packages, we downloaded it from the my country's american consulate website...

Hi everybody

i really need some help here, i have my interview in Marsh and i am almost done with the documents, but i am confused about the affidavit of support.

my fiancée is a student and she work at the same time but i think that her work is no enough, fortunately my mother in law, her mom, want to be the co-sponsor.

my questions is :

- Do my fiancée and her mother need both to fill the form of affidavit of support ( because i read that somewhere is the website ), or just my mother in law, and which form they need

- What to do after filling it and having the required documents, did they need to send it to the USCIS office where the petition was sent or send it to me so i can take it with me to the interview

my fiancée asked before if we need that affidavit and some said that the consulate in Casablanca don't ask for, however i think i will be asked cause of our case

Thank you in advance

- Do my fiancée and her mother need both to fill the form of affidavit of support ( because i read that somewhere is the website ), or just my mother in law, and which form they need.
If your mother-in-law will be your sponsor, you only need one form filled for her. It isn't neccesary than your fiancee fills out another. Ahh, the form needs to be notarized, The form is the I-134 and this is the link http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=fe3647a55773d010VgnVCM10000048f3d6a1RCRD&vgnextchannel=db029c7755cb9010VgnVCM10000045f3d6a1RCRD

- What to do after filling it and having the required documents, did they need to send it to the USCIS office where the petition was sent or send it to me so i can take it with me to the interview
You'll need the affidavit for your interview, take it with you to the interview. You don't need sent it to USCIS.

my fiancée asked before if we need that affidavit and some said that the consulate in Casablanca don't ask for, however i think i will be asked cause of our case
In my opinion is better if you have it by if the consul will ask for.

Hi -- I was just wondering if anyone can clarify for me how co-sponsorship works. I have three kids (my fiancé doesn't have any) and am a student, and probably not even at the poverty level, much less 125% of it. Some of my relatives might be willing to co-sponsor my fiancé, but I'm not sure any of them make enough. Would the co-sponsor have to make 125% of the poverty level for his/her own household, mine, and my fiancé all put together (at least six people)? Would my income added to the co-sponsor's only have to total that much? How does it work? Thanks.

The sponsor must include all the member on his household, you see, if you have 3 kids you household is 3+you+your fiance = 5 members you must have an income for 30,152. But if you don't meet that income you can use a co-sponsor who must meet the income requirements for his household (dependants as:wife, sons daugthers) plus your fiance (intending imigrant). You and your kids don't have to go included on the co-sponsor household.
http://www.uscis.gov...form/I-864P.pdf
Not correct, no0pb.gif CO-sponsor only has to make enough income to support them self, their dependents, and the prospective immigrant, and any dependents of the prospective immigrant that may be coming over, they do not have to show supporting the US Citizen petitioner, and any dependents of the petitioner.
Hi, may be I couldn't explain it good. But the co-sponsor's dependants (wife, sons and daugthers) aren't include in his household size (wife, sons, dauthers)??
Maybe I'm confused between household and dependants . Thank you for clear any mistake.

SO if the CO-Sponsor is single, then the count is 2.

Hi all i have a problem related ot my affidavit of support this siguation im ganna explain will sound weird and strange but all true...

I currently live in Russia with my wife now for the past 15 months, i dont have a job and i live off a savings account from my wife.. When i arrived in russia i brought with me 15,000$ that i claimed.. I gave it to my wife to put into her savings account... Since i dont work in russia or have a job filing the affidavit of support alone would be rediculous so i had my brother that we plan to live with in the USA sign a I-864A and he will provide the 125% income needed untill i arrive in the USA and work... Right now reading that they need my W-2's and a tax return. Well i really cant get all that living abroad now can i without waiting months by mail.. If you understood the russian mail system you would understand that it is really terrible... Besides that... I was reading that i could be able to use a written statement?? Is this true? Would i be able to provide a written statement explaining my siguation that i cant provide my W-2's and tax returns?

Also how would i be able to use me and my wifes savings account? What form would i be able to fill out using my wife's account? The account name is in my wifes and not mine for the record.

Thanks all, Sincerly DF

If you have the previous income tax and w2 in USA you can get them by a package service and not for a ordinary russian mail...
I think if you don't have w2 and income tax you can explain it in a letter and you must attach evidence that you were living abroad during the time you're mentionig. Also, you can explain that you plan to get a job in USA in X date.
About the saving account, I think that your wife can change the account name for both it'll be helpful in order to show relationship evidence...
Good luck

QUOTE (asenk @ Feb 20 2008, 12:39 AM) <{POST_SNAPBACK}>
Hi,
I have a few questions about what to fill in the I-134 form.

My situation is I have been working and living in a foreign country(not in the US) for the past 2 years. So it seems they only care about information or money made in the US?

1) Do I require any type of document from my current employer (in the foreign country)?

2) Since I havent been in the US , for question 7, I put down $0 for annual income or approximately what i made in the foriegn country?

3) Do I still require any bank statments from my bank?

4) If by the time of the interview, I am not working, will the amount i put down for annual income be invalid (assuming i dont put down 0$)?

5) If I have my mother fill out I-134 for support, what what she put down for Relationship to Sponsor?

Thanks,
K

Are you in a K1 petition? I think you're the petitioner,
5) Future mother-in-law of fiance/ee's mother.

I think you must include a letter explanation where you say that you're living abroad and the amount of your earnings. You must attach evidence to show that you're living abroad for the period that you'll say in the letter.
A letter employment from your employer abroad can be Ok. It's better that no send any if you don't have a work in US for now.

Hi all, i live abroad and im having my brother be the joint sponser with me... I was wondering if they will accept copies of ducuments such as the I-864 signed and notarized, W-2 and 1040's.... Will they accept these documents if my brother copied them and sent them to me in a email?

It isn't a good idea. Your brother can sign the I-864 and send it to you. The I-864 doesn't need notarization.

Are you sure it doesnt need to be notarized? I live in Russia btw... Thank you for your reply. You are a real helper.

If you check the end of the I-864 form there isn't any place for notarization and the instrucctions don't mention anything related with that.

They can and do test for Varacella (Chicken Pox)

A US Civil surgeon in the USA when transfering foreign record to a vaccination supplement for adjustment of status wont take your say so on the chicken pox, and will do a titer test for it.

The requirements are:
 • Mumps, Measles, Rubella (MMR)
 • Tetanus and diptheria toxoids (TD)
 • Varicella (Chicken Pox)

We are also preparing all immunizations for my husband, BUT when he went to the Doctor in Mexico they would not give him a Varicella shot, they told him he was too old to get it. And that he should have received it as a child. So what do you do when the doctor will not give you one?

Thanks

I had the same problem, in Mexico the doctor asked me if I already had have varicela and I said YES, and he didn't put me the shot due to I have immunity by the "disease" but the mistake was that he didn't put that in my vaccination record. So, when I went to the imigration doctor he didn't believe me and he said that at least that I have scars like evidence of the disease he cannot believe it... And that the test will cost more than the vaccine so that it was better if I got the varicella vaccination. mad.gif

Im going to have my visa interview in Ciudad Juarez, Mexico, but I haven't have my vaccines since a long time ago....I don't even remember, so I want to know how much it costs to get them in Ciudad Juarez before my interview appointment?

Hi, you don't need to have vaccines for K1 visa. Anyway, if you want to ask for them in the clinic the cheaper vaccine is like 200 pesos and the most expensive is like 800 pesos. I reccomend that you go to IMSS or SSA (centro de salud) for get the vaccines free. And save the records because you need the vaccines for AOS when you're in US and this vaccines here in US cost almost 250 dlls for all. You must have Sarampion y rubeola (MMR), varicella, hepatitis B, tetanus y difteria (Td). If you already have some of this "diseases" I reccomend that your doctor put in your record that you already had the infection and you don't need the vaccination, because I already had varicella and sarampion and the imigration doctor told me that he must put me the shot because I don't have any evidence of the disease (like scars). Here, they can test you for immunity but you have to pay for too.
Good luck

Forgot to ask this. What are you guys doing for the AOS to prove his income since he has never filed taxes?

Someone in this forums answer this for me: If he did not file taxes since he didn't make enough income or didn't have any income, just state that in the I-864 and make sure you have a strong co-sponsor with good ties...you'll be ok...

This is that we do. Good luck

You wont get the tax return back I think..You neednt to file it when you petition..just use it in interview..

Why would i not get my tax return back? I know i dont need for petition, i am asking if ill likely receive it before my interview or not.

Please someone that has reliable info, let me hear your opinion about this financial deal and tax return deal.

I'm gonna tell you about our K1 experience. My boyfriend never has filed income tax, We used a co-sponsor for my K1 visa and my boyfriend (now my husband) sent an employment letter ("self-employed") and the co-sponsor sign the I-134 we had not problem with K1 visa approval. So, I think that your income tax isn't necessary at this point because you're using a co-sponsor right? When you'll send the AOS is when you must show your income aside you have and co-sponsor. I don't know anything about tax return but I wanted to share you our experience to help you (I think) make a better choice. Good luck.

But, there is a thing that I cannot understand yet. If you don't/didn't submit anything or you are going to, why are you too worried? Certaintly, all the imigration process cause illnes in us, but you don't be to stressed for now. The things that you need to prove come everyone at its time.

Thanks for the answer. It wont be a problem to provide co-sponsor letter of employment, and im self employed so that doesnt apply to me apparently.

And yes I really am living abroad or I wouldnt even consider putting it on the forms. I know i can prove we met with passport stamps but it doesnt neccessary prove ongoing relationship, so i figured showing them that we live together is the absolute best form of ongoing relationship. We both signed a contract here and can show the forms if neccessary.

Anyway I recomend you that you include your self-employed letter if in the interview they'll ask for, because you must show that you, as petitioner, are going to support the intending imigrant aside you're using a co-sponsor who helps you to meet the income requirements. If I'm wrong someone for correct me... It's only my suggestion and you decide the best choice for make everything right and have a succesful outcome...
Good luck

How can i make a self employed letter? I will surely do so if its possible and can affect the outcome. Do you have an example of what it should look like? I dont have a premade company letter head or anything like that. And i will only need this form for the internet? (interview?) and not the intial i129f mailing right?

Have you already sent the I-129F petition? I make this questions because you don't have your timeline updated for give any idea about in what part of the process you are... http://www.visajourn.../intro.php?cfl=
But if you going to send the I-129F petition you don't need to send the I-134 for now. The I-134 is when you have the date of the interview so do the employment letters!
Hello. I currently live with my fiance in poland.

What would happen if i used my US address on the i129f, but on the g325a i put down Poland as my most recent address (to help prove ongiong relationship when interview comes)?
In our case, we were living together in Mexico. My fiance put her US adress for receive correspondence and on his G325A he put his most recent adress from Mexico. We didn't have any problem and all the letters from USCIS arrived in his US adress. I don't know why you say "to help to prove ongoing relationship" because you can prove that with passport stamps or plan tickets that show that you visited her... Are you really living abroad or not?

Would this they think is an address confict, or would they just read it as me living in poland temporarily and send all mail to the us address.

Secondly, I am self employed via internet with income around $10k per year, which is what my fiance can tell during the interview. My tax return will also show self employed, and i have arranged to have my mother as co-sponsor and she makes 40k$ per year. Do you think they will still question my qualification as her financial sponsor?
Thanks for the reply
For K1 visa you need to send the co-sponsor I-134 notarized and letters of employment of each one (petitioner -US citizen- and from co-sponsor).

So my fiancees interview is on Thursday, and I wanted to ask anyone who had had an interview for advice.. I read some of the questions in the guides but I thought it might be helpful to get some responses from some Vjers.. Thanks for the help.

The interview's question for me were very simple. The consul told me: tell me about your relationship...
Did he come to visit you recently? Who is the co-sponsor?
Don't worry too much, those questions are easy to answer.

Hope this help you.
