Um I can't speak for the K-1 visa, but Packet 3 that Ciudad Juarez sends out for immigrant visas says the following:

that police certificates are not available from various countries including Mexico, so you should not get them. I would guess that if you have committed any sort of crime you would still have to bring the record, though. Missing_my_Amor is doing a K-1 through CJ so I would think her word would be correct. (sending good wishes your way M_m_A!!) I definitely know they are not needed for immigrant visas as the Packet says so. However, keka, I believe you were the user talking about a police record from some other country, so I would think if you were there for a fairly long time that that might be more of a concern. Anyhow, it would probably be helpful for you to do some internet research on police certificates and k-1s.

It seems to be taking about 3-4 months, I guess I'll know for sure when we get our interview date.


What you might want to consider is how you would work out sponsorship with the I-864. If your boyfriend has a good business in Mexico, I guess I would think twice before throwing that away, because you could probably have a fairly pleasant life in Mexico after graduation. Another issue you will likely have is proving some sort of domicile as part of the I-864 requirements since you have been living in Mexico for the past several years. I suggest you study everything required for the immigration process and think about where you both want to live and work long-term so you can plan accordingly, especially considering the current economic situation in the US.

Juarez is very far away from Merida and if my fiance got the visa the day he went to the interview he could just come on from there to the US. Is there any way of planning for this? Will we know ahead of time if he is going to get the visa the same day? If I went to Juarez with him would they allow me to go in with him to the interview?

US citizen is not allowed to attend the interview (based on information in the Embassy Info section here on VJ) - doesn't prevent you from being close by though.

No way to know ahead of time if you'll get the visa at all, much less the same day - that would require a crystal ball.

does the USPS deliver mail to you if you are not home? I think they will....


My mail will be forwarded to my mother's house and she can open it for me. I don't know if they will forward the NOA2 and if they do then I don't know if I need the actual paper for my fiance to go to the interview.

My fiance and I are waiting for the AOS2 and then he hopes to go the interview as soon as possible after that. On our original 129-F we applied for a K-2 visa for his seven year old daughter to follow later. I know that eventually she will have to have a medical exam in Juarez but I am not sure how we will do that. Would my fiance have to apply for advance parole to come back to take her to the interview? Does anyone know of a place on VJ that I can read more about young children that followed later (esp from Mexico)?
I would really like to find a VJ member that has gone through a similar experience so I can ask you a few questions.
I have read this in the guides but I would like to meet a person that did it:

A...Generally, yes. The Consulate sets the requirements. Some do not require the child to attend if they are under 14, and some will require the child to attend even if they are not going to move to the United States with the parent, but will "follow to join" later.

4.4.2)...My child did not move with me to the United States, but now he wants to move here. He was listed on the I-129F petition. Can he still get a K2 visa?
A..I included my Ukrainian fiance's 18 year son on the I-129f form. My fiancee went for her interview alone on Jan 27th, 1998. She immediately came to the US and we were married on Feb 21st. I called the US Embassy in Warsaw in July and explained that my Stepson was ready for his interview. He had 1 year to come the US on the k-2 visa. They set an appointment for him in 30 days. They mailed him the same forms as they did for my wife. He had to get the same documentation as my wife had to for her interview. As soon as he arrived in the US we applied for his change of status and work card.
(FAQ note: the son moved to the US in Sept 98, and even had the visa interview delayed a month due to problems obtaining an international passport. He was not even required to have a new I-134 affidavit, Although his step dad sent one to him.)

I need some opinions. In a few weeks my fiance has his interview in Juarez, Mexico. I am flying to meet him but I got a ticket to El Paso instead of to Juarez (because it costs $500 less to fly to El Paso). My flight arrives at 7:00 in El Paso and so my fiance has arranged for a taxi to take him from Juarez to El Paso to pick me up. We were uncomfortable with me traveling in a taxi alone at night in Juarez so we thought this was the best solution. He has a B1/B2 visa that he uses to come back and forth for visits and so we assume he would be able to cross to get me. Some of his friends recommended that we do not do this because he might get refused entry since he is now likely registered as an intending immigrant. They said that then he would have to put on his forms that he has been refused entry and would have to go through a different process. If this were the case then of course he should just not even try to come pick me up. To be honest I am very anxious about traveling alone at night in Juarez and I was so relieved when we came up with the idea of him coming to get me. I am trying to weigh the benefits against the risks and need some people’s opinions to help with the decision.

DCF is Direct Consular Filing at the embassy. FASTER than K1, K3. It ends up being a CR-1 spouse visa. You file a I-130 at the embassy. You file I-130. Separate ones for you and the baby.
You have to have lived in Mexico for at least 6 months.

Really?..It was my first tought.. but someone told me that the k-1 visa is faster than the k-3?.. I will do whatever is faster.

Because I have a 14 year old daughter (american citizen from my first marriage) and she will start high school in August 2010. And I want to go with her, but I dont want to leave my fiancee and my baby (I have a baby with my fiancee..he es 8 months). I tried to get the Certificate Report of Birth Aboard for the baby but I did not qualify because I am not married with his dad, then I am a "single mom" for that purpose. And I had to stayed in USA for 1 year continuosly.. And I always came to Mexico in Christmas.. so my time un USA wasnt continous.

Anyway.. thats why I think on getting a K-1, k-.2 visas for my fiancee and our baby.

here's my problem....
I think that when I was less then 10 I was unlawfully in the states, but Im not sure.
I know my parents had work permitts but i don't know if they came in with visas (or me for that case)
We moved to canada after living in the states and I know that when we lived there we had a legal stauts (we where not unlawfully in canada) which means that when we left the states we where not deported.
I know that if the case would be that my family and I had been the states illegaly it would not count becuase i was under 18?
ok , so on my k1 visa form it asked me t tell them if i had ever been in the states should i say yes? even though I dont remember the WAY i came in, with or with out visa? It also asks me to tell them the entry date and exsit date, what should i say if i don't know? and it also ask me to tell them if i was ever unlawfully in te states, if the im right about "they don't count an unlawfully stay if done someone did it when under the age of 18" should i say yes or no? is there anywhere i can find out this information about the stauts i had in the states? will this afect my chances to be with my fiance in the states? ps

From what I understand Banamex has all of Juarez's account information ... I think all you have to is go to any Banamex in mexico tell them you have to make the payment for a K-1 Visa in Juarez. I would also take your passport.

How long could they let me stay as a tourist?

The thing is that after those 6 months of being here he kind of lost his job, so we decided to change cities he used to be in Florida and he went back up to start all over in Las Vegas. He´s doing well, he has a job but he is shareing a house with other people since rent is chaper this way. If I head up there he has to look for an apartment since I can´t live in the shared house, so if I head up and they don´t let me stay then he would have left a good living arragement and be stuck with an apartment by himself until I get there.

So does anyone think they will let me stay for around 2 months or so? Until my apointment comes through.
It would also be easyer because I´m afraid of taking my baby to CDJ all by myself, I´ve heard some bad things about that place and my daughter is a bit hard to control. lol

I think I didn´t write clearly and I will explain better. Sorry.

We met over 5 years ago, he came back and forth to visit me then I got pregnant and she was born on feb of 2006.
He came down for her Birth (we have pics)
He came once on Xmas of 2006 (we have pics of them together)
He came on her Bday (also have pics)
Then he came back last August to get her paperwork done: We managed to register here in Mexico, we spent Xmas together (we have pics) and we registered our daughter at the US consulate in Mexico City (she recieved her US passport in March).
I got a tourist visa a month ago and the interviewer that grants them knew I am trying to see her father... Before she granted it she said "you know you can´t stay with this visa right?" I said "Yes, I have to come back for the Ciudad Juares interview anyway" And she said "Okay, your visa is granted"
But now I´m not sure if I should go as a tourist because I´m afraid they are going to tell me I can only stay for 15 days or something like that and we can´t be spending on two flights going back and forth because my baby has to stay with me... So I was thinking maybe I can go up once we know exaclty when I get the CDJ apointment? But maybe they would deny me entry because my name comes up or something... I miss him... She misses her Daddy so much.... They really bonded these six months he was here.

I met my fiance over 5 years ago and we had a daughter born here in Mexico in 2006. We submited all this information with the I-129F. We also registered her at the US embassy and she now has a US passport. I´ve never entered the US illegaly and I have always had a tourist visa, I was even granted a new one a month ago (and I told the truth).

Questions:
Do you think there´s any chance of me not getting aproved?
Does my daughter have to go throgh any further process or can she go straight to the US?

It shouldn't be...just make sure you are consistent with whatever information you fill in on the new forms you have to fill out.
The embassy will have the original package you sent in...you should be fine.

I´ve been reading the timelines and guides to the K1 visa and I´m still a bit confused on a couple of things.
  1. Once somebody looks at our case and lets say gets approved, then they send my fiance in the US the NOA2. Right?
  2. Then he has to fill something out?
  3. Also he has to send me the "further instructions" down here to Mexico?
  4. Then I take these documents to CDJ?
  5. How long between him receiveing the NOA2 and when I get my official appointment? Or how does this work exactly? This part gets confusing to me.
  6. This medical exam I have to get, does it include the vaccines?
  7. Is it mandatory that I have to get vaccines? Which ones are normaly required?
  8. After the medical, I go to the interview?
  9. After getting the visa, can I cross over to El Paso and that´s it? Or do I have to come back home and wait for something else?

Yes we went through that this year. My fiance and I have a 2 year old daughter and she was born here in Mexico, but we were only able to register her until this february at the US Embassy and she recieved her Consular Report of Birth Abroad certificate and her US Passport. So all we are waiting for is the K1 visa and then we can join him in the States and get married. It shouldn´t be a problem.

This post by a former adjuticator explains the RFE process pretty simply. The put the file aside until you send back what they need. Once it's back, they process it. We know by reading here that some cases take longer than others... probably has to do with when the adjuticator that has your case sets time to go over their RFE's. Some seem to do it much quicker than others.

Did you send it back using some sort of trackable system? Return receipt, etc? It is always a good idea to send anything to USCIS or the Consulates using a method that has a tracking number. They are notorious for not acknowledging the receipt of mail and often your tracking receipt is the only way you know they received it.


No he didn't. How could we know if they recieved it then? Should we call? Or wait and be patient?

On July 16 we were sent a request for aditional evidence.
They just needed his divorce papers that he missed sending, he sent it back exactly 1 week later but we don't know if they recieved it. There is no change on our status online and no word from them.
Should we have heard from them?
Should there be a decision by now?
I am getting concerned about this. My concern is that they haven't recieved it and we are just sitting here wasting time.

You're always running a risk but I think yours is minimal. The fact that you were granted a visa after petition filing says a lot and as fwaguy says, turning you away would turn your daughter away. You have a nearly iron clad path to legal residency, so there's very little reason to suspect you intend to circumvent US immigration law. I'd just explain as calmly and assertively at the POE as you did for the visa, and keep a positive expectation.

My fiance and I have a 2 year old daughter who has her US Citizenship throgh him, filled at the Mexico City consulate. I was given a Tourist Visa a few months ago valid for 1 year. The interviewer knew that I filled the I-129F and approved me but asked me first "You know you can't stay permanently there with this visa, right?", I said "Yes, I have to come back for the CDJ intrview anyway" And then she said "Okay, aproved."
I haven't gone to visit yet though. My question is:

Would they most likely deny my entry because of my daughter?

She is with me and I would be flying in with her, so I am concerned that because of her Citizenship the officer would deny our entry thinking I have other motives than just visiting.

We would like to do the following: We would fly up and stay until we get the NOA2, then I would leave our daughter with him and I fly down to CDJ for the interview and then go back. We have 5 months into this already but have been probably delayed a bit because of a simple Request for Additional Evidence. He can't stand that our kid is growing up without him, but we are affraid of waisting slim money we got on a flight and then being sent back.
