I was born in the states and always lived here, would I be able to keep my US citizenship and obtain belgian?
My husband was born in US too, he got his dual citizenship from Mexico last year (he's 28 yrs old), and we didn't have any problem related with that.

The waiver is only for the people who has been in US ilegally or if the person is inadmisible for some situation... So if his fiance never has been in US she don't have to fill out anything related with a waiver...
And the INFOPASS is a date that you make with an USCIS local office if you have any problem with your case.

You can call to USCIS and ask for a "address change" or correction. They can do it when you call. My boyfriend called one time for correct one letter of the name street!!! But of course that little mistake was with double intention for know about if everything was Ok. And if we have not received nothing from USCIS it wasn't been due to a bad address...

If you have your track package number (from USPS or any other company which one you sent you package) you can check where and when it was delivered. Too, with this number you can call to USCIS and they can check if already have the package...

If you wanna know if your petition is in NVC you must call them. When the NVC send the packet to beneficiary's embassy the NVC send a letter where they said when the case was sent and the letter shows the new case number which starts with 3 letters from the embassy name.

I think that you can put like you say. Or you can put a note where you say that you don't remenber the exact date. Or omit that because it'll affect the I-134 only if the date will be recent due to the person sponsored will count in your dependants (If it will be recent).

I don't think that it'll be a problem. Because there are two different things, if he earns 125% he meets the poverty line that imigration says and it's the important thing for them, I think. If the discount didn't affect the total income (net income) that he shows on his income tax, I think there isn't any problem.

He can do a letter of self-employment where he says what amount he's planing to get in the next year (2008) and for how long he has been working like self employer. But sincerely, I think that it'd not be a problem because he isn't using a co-sponsor and he is showing his present (2007) income tax. Which means that he, like principal sponsor, is being responsible of you at the USCIS eyes -talking about economy proof-. The worse thing that would happen is that they ask you for submit that information after the interview. Any way, if you want to be sure having that letter, your fiance can make one and send you a copy (by e-mail) but the best thing is that the letter will be original, no copy... You decide

I moved while I was waiting for the packet 3, I didn't inform to USCIS about the address change. I thought that it would delay something, now I don't know if it would really happen. Anyway I moved to another town but I told to my families about they inform me if something from my consulate arrives to my old address. I think that you can call to USCIS and you can make the address change on the phone and there isn't "delays". After that USCIS send you a notification about address changed.

No, the only requirement for k1 visa is that you must get married in 90 days of your entry to US, and you do it. You can file AOS when you want. If you want to start to work you need to file AOS for get the employment authorization, at least for me, it is the most important thing for now.

The G28 is the form that a lawyer send to USCIS when the person who was petitioned already is in USA. If you file your best friend's forms you can help him file the forms but you don't sign it and it appears like they do it by themselves, or if you put your personal information as a preparer you can put NONE in g28 number.
When I arrived to USA I asked to my lawyer about G28 and he didn't do anything about this form; I went to my local USCIS office and the lady told me that it form is to be file for lawyers...

Thinking in K3 visa: Are the intending imigrant woman?? Or what is the problem about name change?? or for what you want to change it?? The procedures in Mexico to ge married with a foreign person, it's that the US citizen must show a marriage permit from US then, the couple go to the civil registration and they get married after they go to some talks about the marriage... Then, with the Mexican marriage certificate, the US citizen can petition her/his spouse and there would be any problem in US.

k1 visa: yes, the foreign person must get a permit form USCIS for travel outside USA. This permit only allow stay out USA for 1 year. And this permit is for 1 entry too US. In the future when she/he gets her/he green card she/he can travel outside but she/he cannot stay out for more than 6 months... Please someone correct me if i'm wrong.

If your fiance/ee comes to USA with a K1 visa she/he cannot return to Mexico at least until she/he gets her/his green card. It'll take 6-18 months. For while she/he will apply for a travel permit but some people said that it's not good advice get out from USA because when she/he can return the people in the border would not accept the permit as a valid document to entry USA.
And yes, you need an affidavit of support for the interview and the last 3 income tax years, if you won't meet the poverty guidelines 125% you can use a co-sponsor. Also, when your fiance comes to USA you need another affidavit of support for the adjustment of status.
in my opinion, If you didn't send any fiance's visa petition yet, you can think better about the best choice for her/he comes to USA because you aren't planning to live in USA permanently and the k1 visa is for she/he will come to USA to get married an relocate to live here. Maybe another good choice will be K3 visa for a spouse, so you can get married in Mexico and apply for her visa as spouse. The basic difference between K1 and K3 is that with the K3 visa she/he can get out of the USA when she/he wants while she/he will be waiting for green card. The K1 visa is for 1 entry to USA... Good luck.

Yes, the petitioner must file another I864 aside he/she has a co-sponsor. We got an RFE for that. If you didn't work the past years you can send an explanation of unemployment and attach evidence that support that statement. Good luck.

...what my question is how liable will my parents be for helping out and signing these forms? or will the main burden be on me?

Also what happens say for instance there is an accident and me or my soon to be husband gets hurt or gravly ill what benefits are you entittled to apply for without penalty?

Or you are let go from a job for no reason of your own doing...can he collect unemployment benefits without penalty?

And what would be concidered sufficient support?

i know this is a bit long winded but I know as my parents are wealthy they will take issue with some of the wording in the I-864 form and will not like the fact that they may or could be held liable for 5 yrs?

And are there any other options available for me as a means of sponsoring my fiance without the help of a joint sponsor as I am well above the 125% just not for the allowable time?

Also and lastly i read that you have to have 3 yrs income tax forms... well 3 yrs back would put me with my x husband would they still want those and if so would they be admissable?

If you're in K1 process you don't need the I864, this is only when you/your fiance will be adjusting status in US. The correct affidavit is I134. If the petitioner (US citizen) doesn't meet the poverty guidelines 125% in the last year of the income tax. You can use a co-sponsor who meet the poverty guidelines. If you meet the poverty level in your last year of income tax (2007 or 2006) you can only send it. The other last two are optional but instead of these you can attach a letter where you explain why you don't have the income from other years. Also you can attach evidence to support that statement (like school records). Hope this help you.

I think that you can get the documents with the name that you were using when you were working abroad. Anyway your embassy can check if the documents are for the same person acording previous names used. Good luck.

Should she put "Sonographer" or "Hospital" (since the type of business is more the hospital that the job title itself)? I think that Hospital's Sonographer would be Ok.

If you meet the poverty guidelines in your last income tax year I think that you can get a employment letter from the university where you work. I don't think that the fact that you don't be "employed fulll-time" matter if you meet the poverty guidelines with that job. The employment letter must have the title and address of the business, your job title, how much do you'll earn per year. It must be signed for your employer. And if you want you can notarize it too.
As a suggestion, if you think that there would be a little problem to show your income, it's better if you get a co-sponsor. Anyway, who'll decide about it it's imigration and they would tell you about something extra that you'll need to show for the interview.
