In view of the law of the Philippines, any divorce filed by the OP, while continuing to be a Filipino citizen, would have no legal effect whatsoever in the Philippines.

That's correct. A divorce in the US will be recognized in the Philippines only if it is the USC that petitions for the divorce. If her husband files for divorce, it will be recognized in the Philippines and she will not need an annulment.


She will still need an annulment, this time the grounds is that the USC ex-husband divorced her. It needs to be recognized by Philippine Court and issues the decision and decree to be able to change her NSO data. She can't get an annotated MC by just presenting her divorce decrees at NSO.


just a petition to enforce the foreign judgment will do. once the said petition is granted by a Philippine court, the Philippine court's order can now be presented to the NSO for MC annotation.

Yup! good.gif i agree with the above statements. only the USC can validly divorce their Filipino spouses for it to be recognized in the Philippines. This is based under Art. 15 of the Civil Code of the Philippines. Hence, if you are planning to remarry another Filipino, your marriage will be considered null and void, as you have no legal capacity to contract a second marriage...ooops! i seem to be jumping the gun here...sorry! headbonk.gif

sis, did dave try to call the NVC for an update on your ds230? its quite unusual that they have yet to act on this. i remember when it was taking them a long time to review our I864, i had mike call the NVC for the update, only to find out that our set of documents were lost in between their mail room and the adjudicators, so we had to resend. better call and confirm that they have the documents with them so you can ease your mind as well. if in Manila, counselling and stamping would have to be done in two different locations. i believe counselling will be in PRISM near DLSU. for the sticker/stamp you would need to go to the CFO office in Quirino cor. South Superhighway.

i think its only in Cubao (SMEF-COW) where you can have your counselling and stamping done without the need to commute to another location.

i was just on the phone with my travel agent, i had her book my Mar. 3 flight way back in January, but have yet to pay for it (i gave her instructions to just extend my options until a cheaper rate comes along). anyway, she mentioned that NWA has an ongoing promo now for 1st time immigrants. the total cost for my O/W ticket now is approximately $690, inclusive of US taxes and surcharges, for MNL-WAS, compared to the january rate of $785. not bad if you ask me...not bad at all yes.gif good.gif

If she was one of those arrested in bar raids, i really do hope she had good reason why she was found working there (working under duress, threat, etc.), otherwise she would not only have a police arrest on her name but a criminal record as well. my limited knowledge on bar raids consist on how the same is conducted. its usually enforced with a search warrant on probable cause that prostitution is being practiced in the establishment. better research if the US immigration law holds a lifetime ban on the said crime, like they do on drugs. if they don't you'd be fine.

its the custom's declaration form. =)

i got in with my hubby last March 3, 2008 via Detroit. no questions were asked by the CB Officer (i guess because hubby was with me). a fingerprint of my forefinger was taken and was asked to sign a form. save yourself some time and go to counter 37 or the special processing counter. we lined up at counter 41 and after looking at our passports were told to go to counter 37.

if you bought the tickets online, your fiancee needs to go the PTA counter at the airport and pay for the Php1620 travel tax. add the Php750 terminal fee and she's all set to fly to you.
