I think what they're doing is ridiculous. I do not understand why it was so difficult to update form I-129F BEFORE the IBMRA law went into effect. The law wasn't approved on March 5th, didn't they have enough time to get the forms updated? We are talking about 3 questions here!!! Sigh.

I feel so bad for those of you with recalled petitions. I think it's completely outragous that they're basically "taking back" their approval.

It's like stealing candy from a kid.

And also, just because those of us who are only in the NOA1 stages are already getting the RFEs does not mean we're ahead. Who knows what's gonna happen to us. Maybe our petitions will sit idle for months until they take care of EVERYONE.

Oh well. Life aint fair. :(

Ok guys....

Look at my timeline. Receipt date March 14th, NOA2 completed, the case made it as far as the embassy in Buenos Aires, for packet 3, and then was sent back to NVC.


TODAY I GOT THE IMBRA RFE IN THE MAIL........................Ive just deleted a long post in where I tranbscribed verbatim the entire 1st page.

Maybe it will be better for people to just open it and see it with their own eyes, and be as elated as I am right now to have come home and found this in the mail!!!! :dance:



So, again, VSC IS SENDING OUT IMBRA RFE'S TO PEOPLE EVEN WITH RECIEPT DATES OF MARCH 14TH AND LATER!!!!!!!!!



If anyone would like to know anything that is in this document just ask. Maybe everyone already knows, because it may be exactly like the one from CSC. Point is, They are sending out RFE's already to people whos petitions were already approved, and have receipt dates passed March 6th....

My fiance also got our IMBRA RFE today. So far, I guess we have 3 cases of NOA2ers with RFE's sent out on VJ. Am I right?




Thats a good question. Id like to find out. Luis&Laura was compiling a good NOA1 RFE list. Where do we find out just by looking at timelines? Im curious to know how many NOA2'ers have gotten theres. Its a good sign. I think the NOA2 RFE floodgates will be opening for everyone now.

The logical thing to do would be to keep processing them in order of NOA1, but AS the RFE's come in.
Meaning...everyone on March 7th wouldnt have to wait for EVERY single person from March 6th to submit an RFE back. But if there was a March 6th with an RFE in, they'd go before a March 7th with an RFE in. Make sense? I mean, you have to consider that there may be people not quite as diligent as us, who will take months to respond to the RFE. USCIS is not going to wait for that person. Its entirely impractical.

considering the NOA2's from before imbra are still waiting for their RFE's seems like it will be longer than normal for them, since you are essentially backed up behind thousands of people waiting for the RFE.
That is assuming they go in order....



See, that's what's unclear to me. How are they going to handle the applications with NOA2s, the older applications with NOA1s and the new applications? Are they going to stop working on my application and put it aside for a while until they take care of the thousands of people who are way ahead of me, or are they going to work on all of them at the same time, or what? :unsure:




well if they were fair, they would yeah put you aside and wait for all the other noa's that are ahead of you. But there seems to be no rhyme or reason here with imbra, so I dunno.
I mean I know the last thing you want to do is wait, but think about it if you were in our shoes, had your NOA2 back in april, a wedding planned for august and are waiting for an RFE, meanwhile someone applies months after you and gets to go ahead of you? bleh ;o;


I agree, of course they should take care of those ahead of me first! I would probably go insane if they did that me. I feel like those with NOA2s should be exempt from this. It is not your fault that they didn't think ahead and approved your petition and now are basically taking it back :o Is that legal?
I know it will probably be a while until it's my turn, which is why I have absolutely no expectations :(

Although I can't relate, I can understand how hard it can be and how much it must hurt to get so far in the process to later be told that you have to start over again. But RLT, put it this way, once you get that freaking RFE and you send it back, it's not like you have to start over again and resend packet 3 and packet 4. From what I heard/read, your interview will be scheduled right away and it'll be OVER.
The cases like Luis&Laura on the other hand still have to go through all those steps, so they are by no means ahead of you. And the June petition that got approved, well, who knows how long it will take them to get to the interview stage.
Those of us with newer applications are by no means ahead of the recalled petitions.

Sorry if I sound naive, but I'm just trying to point out the bright side of things.

I spoke with a nice person at USCIS who told me about the current status of the "recalled applications" to the Vermont Service Center.

The "files" were recalled along with the "Petitions" from the foreign embassy. My petition was still on its way back to square one so I could be sent my IMBRA addition (ironic considering we met in USA and IMBRA is applied to all K-1's now).

So now she tells me that once my file and petition are together in the office I will get my RFE and my case along with everyone else affected will be expedited. She said the RFE's sent out due to IMBRA will be mailed in bulk from the Vermont Service Center.
How can that be true if I am hearing that other people using the Vermont Service Center have already got their RFE's?

She said my case was of course recalled like everyone else's due to IMBRA, but I am hearing that other people have already gotten their RFE.

Let me if anyone is along the lines of my timeline and has heard back from the VSC.

I think everyone who's gotten an IMBRA related RFE have been those whose petitions have not been approved yet (easier to catch maybe?). I don't know if anyone with a NOA2 has. I'm not certain though.

I wish they would give examples of what they considered international marriage brokers. According to the RFE ("any blah blah blah blah that charges fees"), it's basically any paid services.

I met my fiance in 1998 at a friend's party, but we eventually lost touch. We ran into each other in 2005 on a FREE dating/friendship website. So since the site is free, and since we technically didn't meet through it, than it doesn't apply to me. I hope I'm right :unsure:
