CanadaMixed feelings about having civil wedding first
Yes, yes.

My dad would have paid for a full Big White Wedding but he "got out" of it with our quickie wedding.

I wanted the BWW. So did hubby. It's taken YEARS for my family to accept our marriage. "When are you really getting married?" Of course, we never received any presents from anyone. God forbid that we actually get married.

CanadaCanadian wanting to move home with American Husband

and from what I have read you just have to appear at the border and claim that you are entering to immigrate.

Kind of OT but my MIL's fiancé had to do this and we had to drive him to the border. The drive from Edmonton to the ND/Canada border is NOT fun.

Canadadepressed

It *is* surprising that it's extra hard (or at least extra long) to get a marriage visa. I know the process for J-1 (and probably other student visas?) is quite streamlined for Canadians. Plus, we have that NAFTA TN visa available to us, which I've heard there can be drawbacks to that one...but anyway, in some respects Canadians have it pretty easy with US immigration EXCEPT when it comes to family immigration.

I don't mean to be rude but I think you could look at it as Canadians have it pretty easy in regards to family immigration compared to other countries. This isn't Lagos, where your visa will probably be denied outright, or Vietnam or China or MENA or any other high-risk country where you can be put into limbo for months, if not years, AFTER an interview due to being placed on AP/AR.

The separation may seem like forever but it's really not. And it could always be worse. :)

CanadaYet another car import question (well two)
Nope! I get it now. I just don't think we did it completely legally, like you're trying to do. He didn't have a letter of compliance when he crossed the border, nor did we ever receive a letter stating that we needed to get it re-registered in Canada/imported properly.

We actually just assumed that when his registration expired on his Alberta plates, we'd just need to take it in! Our troubles started when he lost his registration, which was expired so Alberta didn't have a copy on record. Got about a dozen different answers as to whether a bill of sale would work (both from USCIS and the local DMV) but in the end, I guess we managed to bumble through it.

Isn't it odd how un-standardized some parts of this process are? (Like being able to get an EAD at JFK still, etc.)

CanadaYet another car import question (well two)
Huh. This thread kind of went over my head & I wanted to clarify a few things:

Are you basically "importing" your stuff when you first drive over the border and activate the visa? (I never really thought about it like that.)

My husband was a PR when he went to get his plates changed from Alberta to Kansas and didn't have any problems. Is that different, somehow?

CanadaHow did you meet?
Met my husband when I was 14 and he was 15; we were both attending aerospace camp in North Dakota. We held hands and were known as "the item" at camp but I didn't get to kiss him because I had to run to catch my flight. :( I did once fall asleep with my head on his shoulder during Blazing Saddles (I was one of two girls at said aerospace camp), and drooled all over him. Love at first sight, obviously.

We had a prolonged long-distance friendship which merged to into a relationship about two years later. When I was 18, I graduated from high school and immediately shacked up with now-hubby in ND where he was going to university.

We've been married for three years, living together for over five...and he's still my adolescent crush. :)

CanadaI wish I would have known...
Meh. We're coming up on seven years of living together/nine years of my husband living in the US. Maybe it's because he lived in Alberta, the Texas of Canada? ;) but he didn't really have too many issues transitioning. He does in many aspects still miss his homeland. I honor Canadian Thanksgiving with a turkey and whenever Canadian bands come to KC, we go to see them. (Not THOSE bands of course. Real music!) But he's actually found a very, very, very good job in the states with his degree. We've just bought our first house which is far and beyond whatever we could have bought in Canada, if I were eligible to immigrate.

I'm not eligible to immigrate to Canada due to extensive past mental health issues.

CanadaWe decided to buy a house

this is a short sale.. all short sales are sold as is. the only addendum you get are lead radon and the standard real estate 5.0 disclosure. you can't even get any copies of ccr's (covenants, conditions, and restrictions) until lender approval of the price. You might be thinking of a foreclosure that has to have a minimum escrow for repairs or a 203h rehabilitation loan.

And yeah we walked through the house already and do plan a 2nd one at closing with a home inspector.

Huh, it all seems a bit different from area to area. We'd done the paperwork on a short-sale and were just waiting for everything to go through. An actual short sale, I know this because we almost bought the house. :) We got the seller's disclosure, along with the notice about all the liens she had (seller had married and divorced four different men in the five years that she had the house, plus another man that we assumed she had killed and buried in the back yard) -- nothing was writ-in-stone "as is" (which all foreclosures here are) but the assumption on a short sale is that everything will be sold as-is.

Like Kritkit mentioned, you can *ask* the seller for things to be fixed but it usually doesn't happen, at least in my area of the country.
HannahPFemaleCanada2011-05-18 15:00:00
CanadaWe decided to buy a house

You've confused a short sale with a foreclosure. With a short sale, you negotiate any repairs with the homeowner, not the bank. With a foreclosure you negotiate with the bank.

No, the assumption is that the home owner is underwater and cannot pay mortgage, thus the owner doesn't have the money to make anything but minimal repairs, if that. The trick is to go to the lender - which I guess may not necessarily be the bank? - and see if they're willing to do repairs, but most will not. You can ask the seller to dock some money off the price but if it's already a low price (and, at least in my area, short sale homes go onto the market at nearly the -20% price cut off to sell fast) you run the risk of the bank not approving the deal.
HannahPFemaleCanada2011-05-14 21:32:00
CanadaWe decided to buy a house
Kimbear - have you gotten the seller's disclosure and taken a reaaalllyyy good walk through the house? The crappy thing about short sales is that 99% of the time the bank won't fix anything. At least if you're going with a traditional mortgage, you won't *have* to have anything fixed to get the mortgage approved. The house I originally fell in love with was a short sale. We were told at the time (by the realtor) that the roof was only eight yeras old & there weren't any major issues with the house. We finally get the seller's disclosure and it needs a new roof for us to get the FHA loan. And the owner had painted over some horizontal cracks in the basement (huge foundation issues) which she didn't mention in the disclosure. :er:

CanadaWe decided to buy a house
Whoa. Makes me really glad that we closed on the last day of March. Interest rates seem to be creeping up -- we locked in at 4.75% for 30 years. $9000 for closing costs actually sounds close to what we were first offered through a random loan brokerage we wandered in to. (Wanted to see how much we'd get pre-approved for.) We shopped around and found a much better offer through our real estate agent -- closing costs ended up being $5500 on a $122,000 home. We went the traditional route and the seller paid all the closing costs, which isn't something you get with a short sale. :(

I don't know where you guys got your Canadian men! My husband AND his group of friends were all intelligent, geeky guys who also happened to be very polite. (My family still remarks on how polite my husband is.) He can grow a pretty awesome beard when he wants to, but he also shaves when I ask.

But I don't really have any experience with American men to compare to. We met as young teenagers and have been pretty much exclusive ever since.

CanadaCooking schools /courses
Stay away from the for-profit cooking schools. Cost is way too much for the relative value of the degree. (You don't need a degree to get into the industry and many who are successful in the industry do not have a degree.) Most junior colleges offer degrees in cooking and/or hospitality industry that are affordable, and you'd also have the option of taking classes in small business/entrepreneurship if that's the route you wanna go.

Many places offer cooking classes to the public as well. I know the big community college out here offers ethnic cooking classes to the public for something like $30/class. There's also a private company that does cooking classes -- they're kinda pricey, but they offer an intensive 12-week "basics" class for $600. It's five nights a week and covers everything from basic butchering to sauce making to baking. There might be some of those options in your area, too.

CanadaThe Way We Were
Bump!

How is everyone doing these days?

Chris and I are coming up on five years of marriage, eight of living together. He's been more or less in the US for about a decade, so yeah.

We have a house. Two new cars. I just started my nursing career about six months ago -- Chris actually got a job with an aerospace engineering company pretty much when we settled back in KS about five years ago, so. Still with the same company.

We're still trying for babby.

Actually, his sister is getting married to some rich dude in some random South American country over the winter. I'm not complaining because it's $1,000 for an all-inclusive resort thingy.

But I definitely need to be pregnant before then. It'll be my in-laws' first grand-kid if I can get knocked up before his sister. She gets the big wedding; I get the first grandbabby.

Thanks guys. :> I'm starting to collect documents -- definitely blown it off for faaar too long. I think I just needed a reminder that it's probably not going to be as "easy" as it was in the past. It was a little frustrating to spend hours and hours putting together the "perfect" packages for the k1/aos petitions and then not really get any feedback. Not that it's their job to say "hey, great scrapbooking skills!" or anything, I suppose. laughing.gif

Thanks again!

Removing Conditions on Residency General DiscussionSo far, we've "slid through..."
The original petition was, more or less, assured. Our AOS was "rubber stamped" through CSC (no interview.) So, I'm wondering, how much evidence will we really have to provide in the next step? We don't have a co-bank account, which seems to be emphasized during this part of the process. However, both of our names are on the lease, and I have car/health insurance on his policy. We don't have a kid. (But we have a dog!) I could easily put his name on the utilities, but I've been pretty lazy lately...our last two petitions seem almost too much in hindsight. I even put together a bunch of evidence for our interview -- which we never had.

Guess I'm curious as to what ya'all would do?

good.gif Sure makes things easier in regards to proving a bona fide marriage. To me it makes for a better relationship also.

Dude, debt brought into marriage is one of the top reasons that newlyweds divorce. However you handle it, it should probably be handled before you tie the knot.

And, yeah, I'm sorry but it's Canada. Not only do they tend to have the same standard of living as Americans, but it's also pretty easy to cross the border and work illegally. (Nobody complains because it's harder to tell 'em apart.) Never mind the OP's actual circumstances. Maybe she's a retarded gold digger?!

QUOTE (Eric-Pris @ Feb 9 2009, 11:07 PM) <{POST_SNAPBACK}>
You don't want to share your finances with him because he's in debt? Didn't you know this when you married? That's partially your debt now since you're married, or did you only marry him for the benefits? Like a shiny new greencard, and then divorce him right after you remove conditions. It's sickening to know that there are others like you who only plan to stay together until they remove conditions, and then "see you later" to the sucker who fell for these golddiggers.

If you had an ounce of honor, you'd go back home. But you've come a long way, you're almost at the finish line, right??? unsure.gif

Um, the only debt that is legally theirs is the debt that was incurred while they were married. Any debt that he carried over is HIS, and rightfully so.

Plenty of people never merge finances -- my husband and I included. It's simply what we were taught by our parents. Not merging finances because of his debt seems like a very good idea, in fact. Why throw both of your credit ratings down the drain because you're married?

I'm not certain how the OP qualifies as a gold digger. It's not like she was immigrating from a poorer country to a richer one. Her quality of living has probably decreased since she moved to the US -- she did stay with a man who lives with his mom and hasn't held a steady job for a year.

Removing Conditions on Residency General DiscussionFiling close to GC expiration date.
My husband's GC expires on 11/20. I know we're filing kind of close to the deadline, but money's been kind of tight lately. Anyway. This statement from the guide has him freaking out:
"If you fail to properly file the Form I-751 (Petition to Remove the Conditions on Residence) within the 90-day period before your second anniversary as a conditional resident, your conditional resident status will automatically be terminated and the USCIS will order removal proceedings against you."

He basically now thinks that if we should get a RFE that we can't meet before his GC expires, he's going to be deported. I'm pretty sure that's NOT how it works but could someone clear this up?

Thanks!

Removing Conditions on Residency General DiscussionNo Joint Bank Account--Is that OK?

Very funny the way some people look at this whole immigration business. Really.

I daresay there are several posters to this thread who wouldn't even be married if it weren't for the US government saying they had to be.

If you've gone that far, why not open a joint checking account?

Forest. Trees.

Marriage actually means very little to some people. Especially those of us with a few years living together already.

But joint checking accounts? :/

Removing Conditions on Residency General DiscussionNo Joint Bank Account--Is that OK?
We're another couple who made it without a joint bank account. We had joint leases, utilities, car and health and life insurance, and tax filings.

Honestly, I think the joint bank account is kind of a cultural/the way you were raised thing. Both my husband and myself were raised with parents who did not have joint bank accounts -- my mother was even adamant that we shouldn't have one. (But she's got two divorces behind her!) It wouldn't have crossed our minds to have one...except with the immigration thing. And even then, we figured that we had enough other evidence to not need one. :)

Removing Conditions on Residency General DiscussionRemoval proceedings vs. Abandoning residency

I just went through the painful experience of reading 4 pages of fairly meaningless posts, until I got tot the last one: JimVaPhoung gave you a $350 response, free of charge.

To this point, I'm not even sure if you are divorced or not, but it doesn't matter much anymore now. Your GC is dead, you are out of the country, you did not submit an I-751 . . . basically, you are now back at square 0, not 1.

Send a letter to USCIS with proof that you left the US before your GC expired. That's all you can do at this point. Next time you'll be entering the US as a tourist. You made so many mistakes along the way that there is no way to revive your LPR status. You can't just do things as important as immigration as carelessly as you did. Sorry.

Um...pot, meet kettle? Most people on here manage to not become out of status for years, too...talk about careless.

Removing Conditions on Residency General DiscussionOctober filers
Anyone have any info on the time between check cashed and NOA1?

Our timeline so far is:
CSC
Sent - 10/29
Received (signed for) - 10/30
check cashed - 11/3

We made Christmas plans for Canada, his GC expires this month, but I'm /assuming/ (I know, I know) we'll get the NOA1 before then...

K-1 Fiance(e) Visa Case Filing and Progress Reportsin the 3rd week of waiting for NVC
Sent to the embassy on April 24th! My NOA2 date was April 2, so that's about three weeks. Hang in there, tij.

Could it be related to what's been happening in the delay at the USCIS with the worker visas? (I'm not sure if they go through the NVC 'tho.)

K-1 Fiance(e) Visa Case Filing and Progress Reportsin the 3rd week of waiting for NVC
I just found this thread and crapped my pants with joy.

Our NOA2 was approved on 4-02. It'll be four weeks on Monday without a record in the automated system. I was planning to call them when they opened on Monday.

My worst fear - as in, keeping me away at night - is that they lost the petition. This actually wouldn't surprise me in the least, given my luck.

K-1 Fiance(e) Visa Case Filing and Progress ReportsReally belated email from the USCIS!
Yeah. It's been processed by the NVC and sent to the Vancouver embassy on the 24th. I'm just waiting for notice from the embassy that they've received it.
