You have to go by what the your beneficiary consulate wants.
Usually it is the I-134 for K1 visa application and the I-864 is for the AOS process.

Mine wanted a I-134 with supporting evidence

Ask your beneficiary if he or she got a checklist from the consulate.

Hey Steph,
When i initially sent in my 1-129F petition, the letter of intent was done by me (petitioner-US Citizen) and my address was on the top, the Service centre where it will go to would be on the second line.

At the end of the letter, create another Signature line e.g

Signed,

Petitioner's Name: U.S citizen signs here and puts his name


Beneficiary's Name:Fiance signs here and puts her name.



It was approved by the Service Centre.

For the Actual Visa Interview, you do the same thing but The address on the top would be Petitioner's Address
Second line: Consulate's Address for the foreign fiance.

Hope this helps.

Both the Petitioner and Beneficiary also signs at the bottom of the letter.

You can go ahead and send it TO YOUR FIANCE.For the Affidavit of support , as long as it is within a year.prefarably close to the interview date. It is okay,

The NVC has not yet acknowledged the fact that they have the petition, it has not yet been sent to the consulate so that they would set up an interview date

I would hold off on sending anything right now.I would rather concentrate on getting the supporting docs ready until you get an interview date set up.

If the petition is submitted , you can always go ahead and visit your fiance anytime you want . Your fiance on the other hand is not advised to do so that often, cos the govt might think she is coming in to the U.S to stay permanently.

You as the U.S citizen have the right to travel anywhere when this is going on.

Still wondering about the G325 form though. For that same part, do I put N/A or NONE...I am the US citizen. I've read not to put N/A when None is applicable...they are so similar sometimes! hehe

Since you are going back to the U.S to live.
The k1 fiance visa would be appropriate for you and your fiance.You would have to send the 1-129F petition to the service center of the area you last resided in the u.s. If it is florida, find out what service center takes care of fiance petitions.

I was in the same situation. I am USC that lived in Canada.
I last lived in Texas so i sent the petition to Texas Service center, they ended up transfering to California Service center.(still worked)

I was working in Canada by the way so i had no financial history in the US.

Before the Visa process was over, i moved back to the U.S and everything was fine.I started working, got an emp letter, bank statement e.tc.I moved back only when the petition was approved.

If you don't want to move before your fiance's visa is approved, i guess you can always have a CO-SPonsor to help you out by submitting forms 1-134 . You would have to submit a copy too for yourself as well.


Other people might have other input and it does not take long.Mine took a total of 6 months from when i filed the petition

THe use of either 1-864 or 1-134 really depends on the consulate you are going through. Your foreign fiance would have to find out what the consulate wants.

Generally though, the 1-134 is used for K1 visas and I-864 is used when you are Adjusting Status for the foreign fiance.

Your US fiance must be in the US to file the petition, or have your forms sent to US and have someone file it for you from there.


A u.s citizen does not have to be in the US to file for the petition.
I was a U.S Citizen that lived in Canada and i only had to send the petition to the service center serving the area i last lived in the u.s.You just have to have an address in the U.S so that further communications would be received at that address.

If your fiance is visiting you, and he still maintains the address in the u.s, he would use that address.

I was out of the states for about 5 yrs and my last residence was in Texas, so i sent my petition to the Texas service center.

It was only when my petition was approved and sent to the foreign embassy did i move back to the states.So i can get a job and prepare for my fiance to come

No that's incorrect! Th USC doesn't have an A# (he may have had one if he was a permanent resident prior to becoming a citizen - in that case the A# is superceded by the US citizenship and is moot now.) So! You should actuall leave it blank. At the bottom you should put K1 Visa and check the 'other' box. Good Luck



I said the USC would put their SSN(if they have it). Of course the foreign fiance does not have a SSN no yet,they do not have an alien number too if they are not in the u.s
On the G-325A form for the foreign fiance, they put NONE if an A# Is asked( for the foreign fiance)

Easy eh.Everything would be okay.Go to the GUIDES on the top of this page,Hit the K1 Visa link .
It tells you what forms you need to complete this process.
As regards the G-325A form. it is 1 copy duplicated 4 times. You would fill out 4 , date and sign it, your fiance would also fill out 4 copies, date and sign it. The service center would have to see the original signatures

Yes you both get your passport photographs taken.(1 for you and 1 for him)-Full frontal. You don't have to tell them it is for a visa.
Behind the photos, write your full names and SSN if you are the U.S Citizen, he also writes his full name behind the passport photographs . This must be completed with a pencil

On the bottom of the form, you check the box "OTHER" and put for the K1 Visa petition

Good thing you are starting the process now. You do have to fill out the G-325A forms(4 copies) for you and 4 copies for your fiance and sign it. and also more importantly, attach it to your I-129F form.with passport photographs and all the other stuff
The foreign fiance does not have an ALIEN NO right now , so you would put NONE

The U.S citizen petitioner on the other hand would put their SSN no.

I would advice you to get married ASAP as long as you are still within 90 days for the KI Fiance visa starting from the date of entry to the U.S for her.

If you have enough money ,you can also go ahead and do the AOS .The most important thing is that you get married within that 90 day window.

I would also suggest you find out if a letter could be written to USCIS informing them of your situation that actually from getting married within the alloted time.You never know, they might extend the KI validity by few more months.

Other people in this forum might have other suggestions
