K-3 Spouse Visa Process & Procedures	hardship clause	hi margot found this on the aussie site that might help ya with that question.. Australian citizens are usually issued with a multiple entry B1/B2 Business/Tourist visa valid for 12 months or 5 years. For fee information Fees for non-immigrant visas. The validity of the visa has no bearing on the length of stay. Each time you enter, the Immigration Officials at the port of entry will determine how long you may stay. If the amount of time given to you is not sufficient you may contact the nearest the United States Citizenship and Immigration Service (USCIS) office, or under its parent agency, the Department of Homeland Security (DHS). You should apply for your extension well in advance. Approval or denial of the extension is at the discretion of the USCIS. this might be the type of visa she obtain... as for the hardship application...im sure someone on here can help you with that...could it be a waiver application that you have to send in... i would do what margot suggested...stay in the states look after your husband while your pettition is pending then go back to oz for your medical police check and interview in sydney and get back asap to your hubby... good luck to you .. sorry i cant be of any other help to you... kath	Kath	Female	Australia	2007-07-27 03:25:00

K-3 Spouse Visa Process & Procedures	Packet 3 for Sydney	hi k3 if you look at the embassey info at the top of this page .. there is heaps of info ..including what is enclosed in packet 3..all the doctors for each state are listed also... for the medical you can get blood tests done by your local doctor to see what you are ammuned to....also when you get this done you can put it on medicare and get the doctor to signed and date the results for you..and take these to your medical.. police checks are also stated in the sydney consulate website for each state...i posted the link recently in the aussie thread ... a couple of aussie's have gone through the k3 process ..if ya need anymore info just put a post in the aussie thread someone will help ya out mate.. good luck kath	Kath	Female	Australia	2007-11-15 02:52:00

Hi there yep ya need your tax returns fromprevious years..you will have plenty of time to receive them if you ring the irs... we couldnt find my husbands 2005 original ..we had it at the interview but stuffed if i know where it is..so we went to the irs site and paid $29.95 for a copy of it ..it then gets emailed to you and u download it and print it out... when you do go for the interview make sure all is given back to you and you put it where you will know where it is for future reference suchas your AOS lol take care kath	Kath	Female	Australia	2006-09-26 13:53:00

US Embassy and Consulate Discussion	read the guides but still have a question	hi there at the interview they are interested in things you put in the orginal packet that were copies such as photo's and birth certificates i had my original copy of the petition and it wasnt asked for...its mainly for your own records...knowing what dates for you put down and your fiance did...things like that...if your worried about it ask your fiance to send you his copy over to you... good luck kath P.S. US Embassy and Consulate Discussion	Colombia	What to send to your fiance(e) once the I-129F is approved (Receive NOA2): 1. A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one). 2. Send all originals of the documentary proof that you submitted for the I-129F to your fiance(e) for their interview at the embassy. 3. Send an original letter affirming your desire to marry your fiance(e) and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F). 4. I-134 Affidavit of Support form. Ensure it is notarized (by a US Notary Public), with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all. 5. You will likely need at a minimum (for the above form) two to three of your most recent pay stubs and a signed letter from your employer listing you job title, start date, your salary, and the status (full-time) of your position. Begin collecting these ASAP after your NOA2 arrives. You will also probably want to include other evidence such as your banking information and other assets as required by the I-134. Specifically you will need at least 2 of the 4 options mentioned in Section II-Supporting Evidence of the I-134. See this FAQ for more tips and ueful information on the Affidavit of Support Form. 6. A copy of the NOA2 that you received in the mail. 7. Proof of your ongoing relationship. This needs to be taken to the interview! Include photos, travel documents, emails, etc from between the time you filed and present (NOA1 date-now). Examples: Copies of phone bills, cell phone bills, emails (you can edit personal info with a marker), letters (edit personal info also), stamps on the letters (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. US Embassy and Consulate Discussion	what you wished you did?	you can go online to the IRS website or ring them up.. we couldnt find last years anywhere last we used it was at the interview in sydney ... so i went onto the website and we got a copy for 29.95 and downloaded it the next couple of days and printed it out...but you can get them free also ..i dont know how long it takes though. its a horrid process but the end result is your with your husband/wife and they become a permanent resident which is the light at the end of the tunnel no matter how long it takes...and patience is a must .... take care and good luck kath Edited by kath&rob, 30 November 2006 - 08:57 PM.
