Would I even be able to visit him during the process without proof of a living place? If So, any chance I could go for many months So I'd at least have a place to stay?

Also, what are the current general wait times for Canada to US? I've tried looking and am just confused by the whole thing.

HI ITL. First off, welcome to VJ. Everybody on this sight is very helpful. Secondly, do not go a lawyer route as that is expensive and it would not move your petition any quicker.

Filing a K1 application will take a great amount of patience especially the amount of waiting that you will be doing while your application is being processed. That is one thing to remember.

If I seem to remember correctly, all correspondence from USCIS went to my then fiancee (US citizen and petitioner). Getting a PO box would not hurt though.

If you are going to visit your fiancee just bring ties showing that you intend to return back to Canada like a letter from your employer stating your return date to work, any utility bills etc. I carried this with me every time I went to the US to visit my husband when we were engaged. I was always honest and truthful and always returned on the date that I told customs I was going back. Make sure that you also have a return ticket. USCIS border guys want to see that you have intent on returning and not staying illegally.

When you do file your paperwork and receive your notification (NOA1) take that with you as well to show that you have filed for a k1 visa.

My husband and filed my K1 app the day after he got his divorce papers. His divorce had only been finalized for 3 weeks. We had no problem with our application.

Canadian citizens can do this, yes. Not people from countries that require a visa to Canada.

That is correct. You need a valid AP card and your passport to come back into the US. You have to be paroled back in. You are in a period of authorized stay once your AP card has been issued and you are still waiting for the GC.

If you need a visa to get to Canada, then you cannot travel to Canada with just AP. People have been turned away because they require a visa until the point they get a GC.

If you are from a country that has visa-free travel to Canada, or if you have a Canadian visa, then you can travel to Canada on AP.

If they are adjusting from K1 to AOS and have received their AP card, then they can travel to Canada with the AP card and their valid passport

What your saying is that with AP and some other proof of residence you can safely travel to Canada?

Yes you can go to Canada once you get your AP/EAD combo card (which is what USCIS is now issuing if you apply for EAD with your AOS app). I went the day after I received that card, which was fast. With AP card, I went back and forth about 5 times. When you go into Canada, make sure that you have the AP card as well as the passport. She will need to be paroled back in (fingerprints,picture and stamp in the passport with new I-94). It's funny, I always got a hassle when I was coming over to visit my fiancee with my Nexus card but once I received the AP card, those guys were as nice as pie. Go figure.

Hey Beck26, try not to be nervous about POE as you have already been approved. You should be fine with the 'do not open yellow envelope.' Everything that you need is in that envelope except for your passport that contains the visa. When I moved to the states, I was really, really nervous about driving my Uhaul over the border. I labelled and numbered all of the boxes and had a corresponding typed list to go with the boxes plus the applicable customs forms. When I POE'd with the Uhaul, the agent just opened up the back, looked in and then shut the door. He didn't even want my list. I went into the building and sat for about 45 mins while they processed the yellow envelope and me. I again asked if they wanted the list and the officer said no. It was a piece of cake.

All you can do is contact the consulate and perhaps the USCIS and let them know your relationship has ended before she ever used the visa she was just granted. Then, it is out of your hands and there is nothing else you can do about it.

 

If you are concerned that you are being scammed, then I would definately follow the advice of the above post immediately. Once you have done this, then wash your hands of the whold situation and just be thankful that you may have dodged a potential bullet.

Technically you can apply for an EAD as soon as you arrive in the country, but as you posted, it will expire at the same time as your K1, meaning you will only be able to work for up to 3 months. Why do you say you will be out of work for 6 months? Are you not getting married for 3 months? The EAD/AP card should only take between 2 and 3 months. Mine only took 70 days from the date I applied.


Pats, that is what I thought but someone corrected me and said USCIS is phasing that out and it must be now done with AOS for K1.

If you are coming in on K-1 you cannot apply for EAD until you apply for AOS after marriage. When you file your AOS, you should apply for your EAD/AP (it is now a combo card and is usually issued withing 3 months of USCIS receiving your AOS/AP/EAD application) with the AOS as it is included in the cost of your application.

For the record Harsh, I'm the lady in this couple. smile.png But you're right, I am within processing times. My problem didn't come from her saying there wasn't anything they could do, I fully anticipated that. The issue was with how poorly she handled the situation, and brushed the issue aside. For me to ask why there is such a delay and her to tell me she wasn't going to find out was unacceptable. 

 

 

Spareows, welcome to the waiting game of USCIS and US Gov't. Everytime I would call USCIS and speak to a Tier 2 agent regarding my AOS application it was a different answer from the that I got before. I learned that I had to develop a really thick skin when dealing with these people. Some where rude and some were not. Just luck of the draw of who I spoke to on the phone.

Is it needed for anything once I've been issued my visa? Other than health insurance?

 

Once you have crossed over and activated your K1 visa, all that paperwork goes back to USCIS. The only thing that you will need is a copy of the immunization form (I think it is the I-693 form) that the panel doc filled out. You will want to include this in your AOS application to show that you completed your medical. Even though USCIS should have this on file, it is always good to provide a copy of that. When you picked up your medical stuff, the panel doc's office should have made you an extra copy.

I may consider flying into Canada then crossing the border IF I get my visa. The only issue is I would have to take megabus or grey hound bus to New York. I wouldn't want to hold up the bus for an hour.

My fiance is in Rochester. Great to see others from that area as well.

 

Can you take the bus to Erie and have your fiancé pick you up on the Canadian side of the bridge where the bus stops? Then you can cross over together...processing your K1 shouldn't take that long. They are pretty quick there from what I have heard.

 

It's nice to see that we have a small group here from the Western NY area. I am originally from Toronto but love Rochester....great city and they have a great restaurant there called Trata that is in the old armory.

I wanted to ask if anyone knew anyone that was denied with the K1 Visa at the border crossing or flight departure? My fiancé is going to be coming soon and I am so scared that this might be  scenario. Has anyone faced this? what advice do you have for me?

 

Is your fiancé flying into YYZ? If so, why not drive up to Toronto and pick up your fiance and cross over with them? I crossed over in Lewiston, NY with a huge cube van full of my stuff when moving here and when they asked what the purpose of my trip was, I told them it was to activate my K1 Visa. I was with immigration for 45 mins while they activated/processed all my paperwork. Easy peasy!


 

I actually called the border at Niagara Falls in May to ask them re: this exact issue (sometimes flights from UK to Toronto are WAAAY cheaper than flying here to Rochester so I wanted to keep options open).  They said it isn't a big deal at all.... they may pull you over and check out what you have in your car, etc., but it's the same as coming in through an airport.

at this point, i've only gone to visit my fiance once since we started our application back in january. it was only for a week in march, but i did bring a letter from work indicating my expected return date as well as my flight itinerary for a trip i was taking for a family reunion (here in canada) over the easter weekend. it was a good thing i did too.

i answered all questions honestly: reason for visit (vacation), why (to visit my fiance), is he moving here or are you moving there (i'm moving to the US). at this point i mentioned that we had applied for the K1 visa (hopefully to indicate we were going about things correctly and legally), and that i would only be moving once the visa had been approved. the officer then led me to one of the back offices where i spoke with another customs official.

fingerprinted, picture taken, asked basically the same questions, produced my evidence of returning to Canada. this official mentioned that they get a little more careful with people once visa's are involved (said i completely understood), but they let me proceed. my carry-on luggage was thoroughly searched and i was given the full pat-down at security.

it was definitely unnerving and stressful, but i was honest about my intentions. if i had not had the evidence of returning with me, i don't think they would have let me on the plane.

Andrea, good point about the NOA2. I brought that with me everytime I crossed over at the border and had no problem. I also brought over evidence that I would return to Canada when stated....like a copy of my lease agreement, bank statements, hydro bills, phone and cable bils and a letter from my employer stating my return date to work.

Since I crossed over often (every 2nd weekend) I had only a hassle once but because I had all of this info with me, it made it easier and the CBA asked how I knew to bring all of this supporting evidence with me. My response was "My fiance's cousin is an ICE agent and he was the one who told me to make sure that I have this information wtih me" After that response, the agent typed some stuff into the computer and I never had a problem being admitted into the US again.

Sorry that I can't give more information about my individual enteries each time into the US but because we only lived 2.5 hours away from each other, I visited over 250 times in 4 years...so to post about that would be like writing a manifesto.

i am flying to Wichita again next week tuesday for 2.5 weeks and hope to not have too much hassle. i have a few doctor appointments in june, so i am bringing the appointment letters with me, i plan to take some phone bills along, my flight itinerary with return date/time, and last time i visited him i did come home. i am also bringing along my NOA2 email notice (my fiance has not received our actual letter in the mail yet) to prove that we are going about things legally; my feeling is - and i would hope the customs officer would see things the same way - that we've done things legally thus far, why would we screw things up now when we're so close to the end?

i'm keeping my fingers crossed that this is enough and they let me through, but i have to admit i am apprehensive... i'll let you know how things go once i'm down there *crosses fingers*

CanadaEnhanced driver's license after receiving K! before POE

If I get the K1 visa in my passport but don't want to activate it for the move yet, but would like to keep visiting my fiance in the USA in the meantime, is it possible to use an enhanced driver's license instead of my passport? That way theoretically I could still enter without activating the visa. I have a few concerns with this idea.

First of all, by not using the passport with this visa, would the government consider this a type of fraudulent entry? Could I have any consequences for not using my passport with the visa inside?

Secondly, would they be suspicious because I use an enhanced driver's license when up until now I've always used my passport? Would that show up as some type of a flag because they may need to enter the information into their computer differently or whatever?

Do you think if I cross I should take along my passport in my bag just in case? Or leave it at home?

Will they ask me about why I'm not using my passport and if so what do I say as a reply?

Would the government know I have a valid visa when they enter in the enhanced driver's license in their computer and be upset about that?

Does anyone have any experience doing something like this? It would make it SO so so much easier timing wise but I don't want to have any problems!

When I crossed over at Lewiston a few times in May to visit my then fiance, I told the CBA that the K1 visa was issued but I would not be activating it until mid June. They had no problem with this at all.

I believe trip purpose will be to permanetly immigrate to the United States. I had my interview in MTL and had my DS160 just in case. I went to Black's to have US style passport photos taken but also got them to put this on a disc so I could upload that photo for my application. That photo worked.

Chicken Fricot is a very Acadian dish, which is really more New Brunswick than Nova Scotia area, but still close enough that your husband probably had it quite a bit. It's yuumy and would work for a buffet type dinner. Gravy for poutine is usually a brown beef gravy, unless you are doing a chicken poutine, then you would usually use a chicken gravy.

Ooooh yummy...I miss poutine and Montreal smoked meat sandwich's as well as peal meal bacon.

Isn't it kind of unfair to use it and hold other people up? When you go to secondary, they have to close their booth for a couple minutes, guide you over and fill out papers. I'm with Kathryn. I'm sure you COULD use it, but I just don't think it's fair to the others to.

No it is not unfair. As Krikit pointed out, you pay for this service so that you can bypass the line and go thru numerous security checks and an interview befor it is issued. CBP will put you into secondary when you do use it. I crossed over today at Rainbow and asked if I could use my NEXUS card as I have my AP card. I was told "Yes you can use your Nexus card to avoid a long delay but you will still have to go into the building to be paroled through".

Once you receive your AP card, you should contact NEXUS to let them know. They will need to see your K1 Visa as well and update the information into the system. You will also need to do this when your green card is issued.

We stayed there earlier this week, it was nice. We took the train though so we didn't have to deal with parking. Breakfast is included but it is a help yourself breakfast. I had read they had eggs and got excited, but they were just hard boiled and sitting out with the rest of the food, but still a good breakfast overall. The only issue we had was getting the clock radio to work right, it just didn't want to go into radio mode, sometimes it worked, sometimes it didn't.

The walk to the consulate is quick, it took us a bit to find door for the consulate. We walked up the stairs and all the way around to the southwest side of the building until we found the line. We got there around 7:20 and there was 4 interviews ahead of us (2 couples and 2 single). I don't know what time they opened the doors, since I couldn't bring my phone, but there was a total of 8 interviews in line when they opened. We were C-5 and out of there by 9:30. I think checkout was noon, so you could pull it off in one night. Just make sure the do not disturb sign is out when you are gone or room service will stop by early (~8am for us). We stayed two nights, walked around the city all day.

As far as poutine, Complexe Desjardins just down the road from the consulate, the bottom floor is loaded with restaurants. The Hyatt Hotel is part of the complex. The stores closed at 6 but the restaurants stayed open. The icecream place closed at 6 too, I was disappointed..lol.

Good to know about the parking - we'll be driving in from Toronto. I read on tripadvisor that there is parking somewhere a block away too? I guess that's something they'll tell me when I get there. I love that it's super close to the consulate though - that's the first concern (second is: how far of a walk to good poutine?! LOL)

I think we're planning on only staying one night, so I'll leave most electronics at home, except for my phone - so the safe is a great option. Do you know if they allow for a late check-out, just in case the interview runs long?

KT, just a word of advice but do not bring your cell phone with you to the interview. There are signs posted everywhere at the consulate that say no electronic devices or cell phones. I had to run back to the hotel and leave mine at the front desk.

I think my mind is made up though and we will book this hotel - it seems like it'll be a good fit for us!

I stayed at Le Phillips Square back in April and the room was huge!!! It had 2 bedrooms and I could see the consulate from my window. It sat next to a parking lot that had an alley which led you directly to the side door of the consulate.

I think that this hotel used to be an apartment building at one point.

Things are great, thanks for asking. I arrived on the 8th of June, closed on our house on June 19th, married June 22nd and then started demo on the interior of our house on June 23rd. Since then have been busy with reno mode and being a lazy bum by not working.

The hubby and I were together for 4 years before tying the knot so I was able to make friends thru his friends. Life is good except for the AOS app process and waiting for our interview date. So frustrated with that process and have been calling to see what the case status is. I got my EAD/AP card back in September but still want to get my GC. The waiting is killing me.

Well, it's been a bit of a rough year. I POE'd in September 2011, got married, and then on the day we were originally going to mail off my AOS- in December- my husband got laid off. After applying for hundreds of jobs he finally got hired 6 months later. We moved in with hub's mother and her husband, where MIL's husband treated us like absolute #######. Then as we were about to move out we got hit with a huge bill from the hospital when I had to go the ER. We managed to scrape together enough to move into our own apartment and finally to pay the AOS filing fee. I spent the last three days putting the AOS package together and mailed it off today.

I am SO ready to work after spending an entire year unemployed. It's been difficult but perhaps it was good to go through some rough times together in the first year of marriage. We have been through so much together, spending the first 3 years in a long-distance relationship where we saw each other only every 3 or 4 months, and then spending about half of this year unemployed together.

I cannot wait to get a job, to be active again, and to make some friends. I am so sick of being confined to our tiny apartment. I am going to DANCE when my green card finally arrives in the mail :dance:

Hello! Was thinking I could post this here since we have the biggest opportunity to travel so someone here might have done this. I was wondering if my husband had to get his medical done in canada, or if we were in the US visiting at that time, he could get it done there?

We would have to travel out to toronto to get it done here which is costly, but there is a civil surgeon right down the street by my parents in IL so I was hoping we might be able to get it done while on holiday down there next year.
Also, how much is the guy in toronto? I think I read like 250? Same price in the US? Is there a list of these prices?

Protocol is that the host country's flag precedes or flies above any other flags or holds the position on the 'right'. It should have the place of eminence. There are circumstances where flags can be flown at the same height -generally when two countries are at peace with each other and then the flags can be flown at the same height and should be of the same size, but generally, in the US, the US flag takes precedence and should come first or higher.

My husband and I decided to put his American flag over his computer and my Canadian flag over mine. :) We'll have an interesting "dining room" to say the least. His only stipulation was that the American flag has to be a bit higher than the Canadian one. But he's ex-military so I conceded, considering I'll be getting the better computer ;)

I was wondering what the protocol was for the flags? If one has to be hung higher than the other.

I missed seeing Canadian flags everywhere and was talking to my mother (who lives in the Peg) about this. Well this week, when I opened up the mail box, low and behold there was an envelope in the box with a huge Canadian flag in it. We will now be flying both flags on the front of our house..Oh yeah and the Canadian flag is waaay bigger then the US flag that we bought at our local legion.

hmmm talking about all of this food makes me want to drive across the border and get some tasty Canadian snacks. I feel lucky since I'm only a 48 minute drive to Niagra Falls.
