Hi
Hoping that someone can offer some insight. I live in TO, financee lives in a small town outside of Buffalo. I have been going down to see him every weekend for the summer. We intend to be married but cannot file for a petition for my finacees visa yet as he is still legally married (his ex is being extremely uncooperative and will not sign their divorce papers). I have noticed the last couple of weekends that when I was crossing at the border, the process seemed to take a while unlike the usual 5 minutes in the past. Thank god I had the forsight to bring with me a letter from my employer stating my return date to work, current utility bills, a receipt for my current rent, my income tax information and all my banking statement (TFSA and RSP as well as savings account info).

I was informed when I was crossing this time that my status has been changed from visitor to impending immigrant because we are now engaged and I intend to move to the US once all the paperwork is filed and the government grants me the access to do so. My question is, can USCIS just change my status like that even though I have not filed any paperwork yet? Can they deny me from crossing even though I have all of this documentation? I have my NEXUS interview coming up on September 11th and want to know how this is going to affect that interview.

If anyone can offer some insight into this, it would be much appreciated.

Hello Everyone,

Well after being together for 4 years, my fiance and I are ready to start the K1 process. Just doing a bit of research to see what is required and what the process is. I noticed going thru some of the sample forms that there was one labelled Request for Provisional file.

Hoping that someone can clarify this for me. What exactly is this for? When will it have to be submitted? Will USCIS send this and is it called a I -797 when it is sent? Or is this something that I should submit with my K1 application.

Any help would be greatly appreciated.

Hello,

Just need some information. I realize that I am quite a ways away from getting my medical done...(just sent in the petition last week) but am doing some research to see what will be required as part of this whole K-1 process.

Just need to know if the doctor will provide the vaccinations during the medical or if this is something that I can get done before hand. I haven't had any immunizations in years and have no records of these...so just wondering how to go about doing this. Someone sent me a link to what vaccinations are required and I believe that there are 17 of them.

I live in Ontario and am wondering if:
A) I can get these done by my family doctor beforehand?
B) If I am able to get some of these done beforehand, will they be covered by OHIP?
C) How long are these vaccinations valid for?

Again, I realize that I have a ways to go before the medical exam but want to be prepared as possible so that I am not scrambling at the next minute to get things done.

Hoping someone can help out.

Hey all VJ'ers waiting for their NOA 2. Been following the timelines of when we applied and received our NOA 1 compared to other people who applied the same time. Alot of those people who applied around October 17th have received their NOA 2 while we are still waiting and haven't received anything from Vermont. The consulate that all info will be going to is Montreal. Has anyone has who has filed and will be going to Montreal noticed that it seems to be a bit longer than other consulates.

Should I be worried? My fiancee and got engaged while he was still legally married but had been seperated for 2 years before we even met and his divorce was finalized by September. We sent the divorce papers in with all of the application information.

Hoping that someone can shed some light on this as I am getting abit antsy. I know that the timeline usually takes about 6 months for this process but Vermont seems to be shooting the NOA 2's out pretty quickly.

I just called NVC and got my case#. The lady on the phone was so sweet and helpful. She informed me that they received the petition yesterday and sent it out to Montreal today...wooohoo! Thanks for letting me know that you called so shortly after you received your NOA2....wouldn't have done that unless you had said something. I cannot believe how quick the turnaround time was.

Good Morning,

Hoping that someone can shed some light on something that is confusing me. We received our NOA2 yesterday and on the NOA2 it states Notice Type: Approval Notice. It then says underneath Valid from 02/02/2012 to 06/01/2012. Does this mean that all paperwork processing and interview is to take place before this date? What if I can't get an interview at the consulate (Montreal) until after that date (06/01/2012)then what happens? Does it mean that the visa approval is null and void?

I know that I should contact NVC in the next 2 weeks to obtain my case number.

I also need clarification on what to prep before hand and what forms that I can send once my info has been sent to Montreal

I am assuming that once the K1 is issued then I have up to 6 months to activate and once activated then we have to get married within 90 days of POE and then file AOS right after

If someone can answer this question, it would be greatly appreciated.

I called USCIS and tried to obtain information but as I am the beneficary they wouldn't give me any info and my fiancee doesn't have as much patience when it comes to this as I do.

Just going thru my paperwork and on the DS-156 it asks if anyone has ever filed a visa application for me. To make a long story short, my father relocated from Canada to the USA back in the 60's, I was only a baby when we moved and know that GC's were issued for the rest of my siblings. When I was crossing over at customs on day using my nexus card, I had them do a search to see if my old GC number came up. The system showed nothing for me in the system but entry for my older siblings. We moved back to Canada in the 70's and my mom returned our GC's to the US government.

My question is should I put this on my DS-156 (don't have any info of what the numbers where or date of issuance)or just leave it alone? If I do put this info in, then how is this going to affect me getting entrance into the US on a K1...need help as we are putting package 3 together.

The I-134 requires that the petitioner and if needed, the co-sponsor must provide their most current income tax statement. I have been informed by both my petitioner and my I-134 co-sponsor that they will have to file an extension for their 2011 tax return. The 2011 tax return will not be ready to accompany the affidavit of support in time for my interview on April 25th.

Can you please confirm if it will be acceptable to bring the following information listed below in lieu of the 2011 tax return?

The 2010 tax return for both petitioner and co-sponsor
Tax transcripts for 2009/2008 from both petitioner and co-sponsor
Form 4868 – IRS Extension for 2011 that has been signed by the petitioner/co-sponsor

Yes, the items should be acceptable.

If the consular officer determines that further documents is needed on the day of the interview, you will be able to mail the requested documents after the interview.

Don't read into that surety bond #######. Forget you even saw it. (Consider the source; someone here on an F1 student visa and hasn't sponsored anyone to come to the US.)

Yes, that is only if the parent/sibling is a USC and sponsored them. Montreal and Vancouver are very clear that only the person with a scheduled interview and their USC sponsor are allowed in the consulate. If sis wants to be there for moral support, that would be great. She can find a coffee shop near by and hold on to your purse for you.
FYI: do not take any kind of bags or electronics into the embassy, you'll be told to do something with them and lose your spot in line! Take only a folder of your paperwork, your ID and your passport.


Being self employed things happen. The income isn't predictable, and neither is the paperwork. You'll be fine with what you have. Having your sister as a co-sponsor back up is an excellent idea, and she probably won't even be needed. A good rule of thumb everyone has mentioned on VJ, if you think you'll need that paper take it with you. I personally am taking every scrap of paper sent to me by USCIS and everything I've sent to them.

Keep in mind, you are from Canada, the easiest country to get a K-1/ CR-1 visa. It's even been said that the rules are 'bent a tad' for Canadian citizens.

The very worst case scenario: they have a problem with your paperwork, you will be given a slip with everything you will need to send them and how to send it. They will keep your passport and once they have what was missing, you will be issued your Visa. It would take you maybe two weeks more to get your visa. (depending on what paperwork they want)

Your sister can come with you, but she will not be allowed in to the embassy. Only people with interviews and their US citizen spouse/ fiance are allowed in. They even kick out the attorneys.


Really? Because on some of the paperwork it says that a US citizen can accompany you to the consulate. Maybe that applies for family visa's only (when sibs sponsor other sibs- F4?) Thanks Sheeshkabelle for the heads up. I will let her know. This way, she doesn't have to make a trip all the way from LA to Toronto and then to Montreal.

I'm concerned now after going through all of the post on this topic that I might be denied my K1..after reading all of the post by other members and talking about the surrety bond, etc. The consulate has to understand that some people do file an extension on their taxes. His return for 2010 will be significantly higher than 2009/2008 but he had a good year last year versus the previous 2 years due to the recession (he owns an insurance agency). Reason for extension is that he has to pay extra taxes and needs time to get the funds together.

Like I said, I will just go to the interview with the required docs and use my sister's stuff as a back up. Thinking and hoping that should be sufficient.

Keep in mind the OP is from Canada. Those of us going through the Vancouver/Montreal consulates really don't have an issue getting approved, as long as we have our paperwork in order. Different consulates are more stringent on paperwork and proof.

OP also stated she will have a joint sponsor, so laying a ton of proof onto her fiance really isn't all that necessary.

As Jim pointed out those of us that are DBA or independent contractors with no employees really do not need to go through the expensive hassles of D&B. Nor do we file quarterly taxes, there are no employees to file taxes on. We file a 1040 with our 1099misc once a year just like every other Joe in the U.S. Our 1040's or transcripts are all we need to prove income for anything from a mortgage to showing the government proof for benefits.

Most independent contractors are contracted by large corporations to do things faster/cheaper than what they could hire someone. Personally I'm contracted by one of the largest producers of film in the country, and my other contract is for big daddy box store. I'm sure they have D&B ratings... but I don't.

All the OP needs is her fiances transcripts from previous years, tax returns for last year and the IRS form showing her fiance filed an extension for 2011. Self-employed people file for extensions a lot. Either because they have a CPA doing their taxes and it's a busy time of year, or because we have so much paperwork and schedules and deductions it takes a while to get done.

She has a joint sponsor and all the necessary paperwork to go with it. That's all she needs.



That is exactly what I am going to do, take his tax return from 2010, the transcripts from 2008/2009, the IRS extension. I think that we may be okay as I checked the poverty guideline and we come in a bit over the 125% mark...however, I am going to get my sister to be the joint co-sponsor just in case. She will also be coming to the interview with me just in case there are any issues or questions with her information.

After reading all of the responses, getting a little freaked out and think that I am missing information. Just going to take what I have and hope for the best.

You will need the form your husband filled out for the accountant that shows he filed for an extension. IRS Form 4868. Having that form and the 1040 return will be fine.
Take all the pages of the '09 and '08 transcripts. You need the I-134 for the interview. The I-864 will be after you come to the US and apply to adjust your status.


Sorry but I am confused. I won't have the 2011 tax return for my interview and I know that the deadline to file with the IRS is April 15th. My interview is on the 25th of April in Montreal. I have the completed tax return for 2010. The accountant will not have finished 2011 by the time I go for my interview. I am wondering if the interviewer will accept the tax return for 2010 as his taxes for 2011 are not complete hence the extension. The only reason that I am asking is because my interview is so close to the tax deadline. If the 2010 return is not sufficient as current tax information then I will bring the IRS Form 4868 and a copy of his 1040, along with tax transcripts for 09 and 10 instead of tax transcripts for 08 and 09.

Hope I was able to explain myself a bit better. Packet 4 from Montreal has asked for both I134 and I864 for K1 interview.

It gives you all the forms you need to send in for Package 3

As far as i know you need to submit part 1 of 230 as well as submit DS160 online then print off the confirmation receipt

But if someone has already done this and i'm giving incorrect information-pls correct me!!

Make sure that you take your NOA 2 with you to the interview as it has to go with the confirmation of the DS160 form.

A fellow Canuck here. I was lucky to have my old passports to go back into but I listed as many as possible and stated I could not give the rest as there is no record of the crossing in my passport when I drove across or took one of the ferry's. I believe they have a complete log somewhere of all our crossings. I sure hope so ....

Do the best you can and be prepared to explain more if needed.
That's my story and I'm stickin' to it.

They do have a complete log of crossings. I asked one of the customs agents and he told me that I had crossed over 72 times in the last 2 years...that was with my passport....not sure about how many times I have crossed with Nexus though. I asked the same CA if it showed my nexus crossings and he said no.

Hello!

I was hoping someone could help me! I just received my NOA2 and have started to complete the next set of paperwork.

On the DS-230 form it asks to list all previous visits to or residence in the United States (if never, write never), give type of visa if known. give DHS 'A' number if any.

I live in Toronto and my fiancee lives in NYC and we've been long distance for about 6 years therefore I have ALOT of visits to the USA during this time. Is it asking for all my visits to the US or just if i've stayed in the USA under a visa?!?!?

Please help as this question isn't so clear!

I am in the same situation as you. Mine lives just outside of Buffalo. When I submitted my DS-230, I just attached a supplemental letter with my most current 5 visits and explained that my fiance lives close to the border and that I frequently cross to see him. I am also keeping track of how many more times I am crossing until my interview (which is in 2 weeks) and will include that.

LOL...I know about being a stickler. Evidence of domicile is proof of address where your fiancee lives in the US. I took a copy of my fiancees drivers license, a current utility bill and a copy of his lease. Funny because I was not asked for any of this but had it just in case.

I sent my Package 3 into the consulate as soon as I received my NOA2 and then called DOS every day after I sent it to see if it was logged in the system and as soon as it was, I started trying to schedule my appointment.

You will also have to file the DS160 before you send Package 3. This will have to go into the package.

Photos were I think 3 for the medical. I went to Blacks in the Eaton Centre to get my pics done and got them to put the pics on a disc. I was able to print off extra pics at home if I needed them.

Double check the consulates website for Package 3 instructions so you have everything.

Thanks for the info.. I find the Canadian forum very helpful too! :)

I have printed off the list for Packet 3 requirements.
I have started to gather everything needed. (in an accordian file all neat and filed properly - ready and waiting)

So far I have:
- mine and kids updated passports
- mine and kids long form birth certificates - (certified copies)
- previous marriage certificates
- previous divorce certificates
- my custody order already in place showing I have sole custody and the kids father had agreed to the move - with visitation
and child support agreed upon and in the court order.
- continually collecting skype logs, phone bills, photos and boarding passes from when we have been able to visit since filing the petition.

Still need to collect:
- police certificate
- immunizations for the kids and I - got info from Dr. Seiden's website and going to family doctor next week to get started on those to see exactly what is needed.
- passport photos (is it 3 or 5 of each?)
- DS-230
- DS-156
- DS-156K

Once I have an interview date I will get my fiance to send me:
- photocopy of his passport biographic page
- affidavit of support I134
- letter of intent to marry

I'm still not quite sure what they mean by "Evidence of domicile in the United States". And I am a little concerned because when we received our NOA1 it shows that the I-129F petition for alien fiance has been received and it lists my name only, even though my fiance included my children in his petition for K2's. :unsure:

I am working on the immunization records now... but not quite sure which immunizations are needed for myself and my children except the usual?

Kim, I waited to get my medical done 2 weeks before my interview. Dr Seiden's office in TO will usually have the results ready 2 days after available for pick up. The I-134 we did on April 11th (interview was on the 25th). The police certificate I did in the middle of March (you will need this for AOS and it is valid for a year). My immunizations were done in February and in March. You should call the Dr's office where you will be having your medical done as you may not be required to have all immunizations done depending on your age.

Once you receive the NOA2, you can start calling DOS and see where you are in terms of packet 3. I found calling DOS very helpful and it gave me a timeline to work with to give me an idea of what paperwork to start gathering.

Hello, me and my fiancee have started the K-1 process, sent in the packet and she has been contacted by the embassy with the list of everything she needs to do.

So i have 2 questions.
1. I have been unemployed for 3 years while helping raise my niece so i dont have any tax return info. i Just started a job and i did
a contract job during the beginning of this year so i will have no problem supporting the 2 of us. I do have many people in my life that would co sign
for her financial support. So i guess i am wondering what i have to do (send in my form and the form of a sponsor)?

2. in the how to guide for the k-1 visa it says i should make a 2nd copy of my packet which i did but then it got destroyed in a flood so
im wondering if thats a problem or should we just bring everything that the embassy has asked for?

Just a word of advice going forward but make sure that you scan and save every document that you submit and make 2 copies (may seem a bit excessive but then again I am a worrywart). You will need the NOA2 later on for adjustment of status.

I used my sister as financial co-sponsor and had no problem. My interview was last week and petition was approved..just picked up my visa 2 hours ago.

Just an FYI but Blacks photography does American size passport photos. I asked Blacks put mine on a disc and then just printed out when I needed them.

So sorry to hear about this as I think that you are being totally scammed. Listen to the advice of your fellow VJ'ers on this topic. Do not see her and if you can, try to correspond with her thru email, that way you have documentation.

If you do have a change of heart and decide to marry her, remember this..once she gets her GC and leaves you, if she ever files for public assistance, you will be on the hook for that so you have to ask yourself if you really want years of heartache for someone who clearly took advantage of you.

Ah okay, that makes sense :)

I don't recall ever being asked if I was going to take my husband's name. After we got married, I simply put his last name on anything I applied for (SSN, State ID, driver's license, etc) and filed for my AOS in his name as well, including the marriage certificate for proof.

Nobody ever asked me any questions, so you NOT changing your name certainly won't be an issue. Be sure that when AOS rolls around, you simply put your maiden name so that your green card arrives in the name you've chosen.

Ooh coconuts, just reading your signature and noticed USCIS lost your medical...bummer...that sucks! Hopefully, when I cross over next month at Lewiston and ask the POE officer if they can do this, they'll be kind enough...but then again with Lewiston the agents there are not the nicest.

It is not going to be an issue at all. Plenty of people choose not to change their name after marriage. No worries. :)

I see your signature says you are planning on filing for the K1 visa in October, yet your post says you're getting married next month. Not sure if you just haven't updated your signature to include correct information, or what. But if you do get married next month, there is no filing for the K1 visa, as that is intended for people who want to move and get married in the States, which you can't do if you're already married, obviously. :)

The information in my signature is incorrect. I updated the timeline in my profile but it never shows up. ARRRGHHH

I just picked up my K1 visa last week and crossed over at Whirlpool in Niagra(Nexus only. I called CBP and they said that I could enter but to make sure that I informed CBP that I have the visa but was not activating it unti next month.

I was down in the states this weekend and speaking with my fiance. We are both at an age where taking his last name after marriage isn't an issue. I would also like to keep my maiden name....don't want the hassle of having to change my passport and all other documents.

We are getting married at the end of next month. I know that in some case, they will usually ask what last name the bride is going to be using after marriage...can someone please elaborate if this is true?

Will this be a huge issue when we file for AOS and the Biometrics appointment? Will they look at that as it not being a legitimate thing or frown upon that because they want to see evidence of couples sharing their lives together.

I like my maiden name and feel it is part of my heritage and have strong ties to it.

Hi guys, :help:
It seems virtually impossible to get any help whatsoever to apply for a K1 visa.
I am from Australia, and living here, my fiancee is in the states and desperately wants me over there to get married. We have been dating for over 3 years, and meet the requirements to get married. I hvae visited the US over 4 times, and want nothing more but to be with him
i cannot find an attorney down here for help. I have no idea how to start, all I can find is form downloads.
what is the first step to doing this, I'm so lost and confused. Is there any legal help down here, I found one but its a state away and charge $1,500 just for a consultation fee.
I just need some help, just a point in the right direction so I know how to start off.
I appreciate any help, -and thank you for your time:)

Other VJ'ers are right, do not waste your money on getting an attorney as you can do this yourself. This site is really helpful in providing information for your K1 Visa if you follow the guidelines. As my now husband has a tendancy to be a lazy man (no offense to him as he will gladly admit this), I was the one who put together our whole K1 application and package and just put post-it notes on where he had to sign and initial. When filling out all of the forms for the K1 Visa, I used the example forms from this site which were fairly easy.

You will want to start researching US appointed panel doctors as you will have to have shots and a physical done. You should also start collecting evidence of a bona fide relationship (ie. travel tickets, phone bills for long distance calls, emails and a copy of the receipt of your engagement ring. You will also want to post on the Australia forum as other Ausie's VJ'ers will be able to give you specific information.

For now just review the K1 Forum if that is the route that you and your fiancee decide to go. Reviewing other things such as the AOS(Adjustment of Status after marriage from K1 Visa) forum will just make your head spin and will leave you overwhelmed.

Hope this helps you out. I would also review the flow chart that is posted in the K1 forum as it gives you an idea of what the process is.

You can't, the problem here is the I-94 info is what was entered in the SAVE system (I believe) so if there's an error there... The first part is proof of entering, right now they don't have any proof of you entering except scanning your passport. The second part is what they take out if/when you leave (such as with a visitor visa to make sure you left when you were supposed to).

Sorry but you NEED to go get this fixed. ASAP.

Maybe make a copy of the original I-94 in your passport before you get this changed. This way you have a copy of it in case you have any problems or issues with it.

Would I even be able to visit him during the process without proof of a living place? If So, any chance I could go for many months So I'd at least have a place to stay?

Also, what are the current general wait times for Canada to US? I've tried looking and am just confused by the whole thing.

HI ITL. First off, welcome to VJ. Everybody on this sight is very helpful. Secondly, do not go a lawyer route as that is expensive and it would not move your petition any quicker.

Filing a K1 application will take a great amount of patience especially the amount of waiting that you will be doing while your application is being processed. That is one thing to remember.

If I seem to remember correctly, all correspondence from USCIS went to my then fiancee (US citizen and petitioner). Getting a PO box would not hurt though.

If you are going to visit your fiancee just bring ties showing that you intend to return back to Canada like a letter from your employer stating your return date to work, any utility bills etc. I carried this with me every time I went to the US to visit my husband when we were engaged. I was always honest and truthful and always returned on the date that I told customs I was going back. Make sure that you also have a return ticket. USCIS border guys want to see that you have intent on returning and not staying illegally.

When you do file your paperwork and receive your notification (NOA1) take that with you as well to show that you have filed for a k1 visa.

Hope that this information helps you out. Sorry about your situation at home as that really sucks.
