Maybe it is a typo in the system? You might want to call USCIS, speak to a Tier 2 IO and clarify that the card that has been issued was for an I-751 application and not for an I-485 application.

Just to add - if they are going to schedule you for an interview then it will be sent from NBC to your local office for scheduling and you would receive another update on the transfer. If not, then your case (barring any RFEs) will remain at NBC until you receive your greencard. Most people who file AOS based on a K-1 are approved without an interview.

CSC is so backlogged with cases they are now processing AOS after Aug1 at the NBC until CSC catches up.

Mine never went to CSC. It went straight to NBC and was submitted back in July.

I got through by following the prompts regarding what I was inquiring about and at some point it gave me the option to press something to talk to a representative. Not much help, I know... I just know I was able to by following the prompts. I'm sure someone else will have a shortcut for you.

Are you actually able to talk to someone at NBC? Or is it the USCIS 1-800 phone number? If you have a phone number for NBC can you please post it?

They all seem to be a little behind though, mine says 5 months but is actually sitting somewhere near 6. It seems your local office is taking around 4 months (as you said) so you would wait all of August, September, October, November- December is when I would make my initial query to USCIS. The standard wait to contact your congressman etc is 6 months- so January but calling the USCIS might give you a better indication of when your petition will actually get looked at. Contacting your congressman before 6 months, I believe is futile and they won't be able to help you or they will merely send in a request to get the response back " You have to wait 6 months...".

Try to be patient, it seems you are almost there. :)

Thanks Xanax. I actually called USCIS on Friday and the IO told me that it is being reviewed right now with someone at MSC. He said it would probably take until Feb/Mar after interview that GC will be issued.

Because the processing should be transferred to your local office and go via their processing times.

My AOS application has been at NBC since the end of July without any movement (I know that some people have been waiting waaaay longer) and has not been transferred to the field office in Buffalo yet. I know that Buffalo does not get alot of these type of apps as my next door neighbor is an ICE agent and has friends that work at this office. I have also checked the processing times for Buffalo and it is only 4 months.

When should I start to think about contacting my elected official to see if they can make an inquiry on my behalf?

I just called USCIS today and my case was at NBC (MSC). Talked to Tier 2 IO and she told me that my AOS application is still pending but was transferred to the field office. She also told me that they are working on cases dated June 16th....this may be for cases that are adjusting from K1...should have asked but hope that this little tidbit of info helps anyone whose application is at MSC.

Although there is only so much you can do do prep ahead. We have everything ready for the next step. Just waiting for them to ask for the police certificate and medical. Cant really book the medical until then. Also have everything i can have at this stage prepped for the interview. Dont really want to do police certificate yet, as i want it to be as up to date as possible when they ask for it.I made photocopies of everything too :)
We are being patient though, but anxious too! :)

Rascalcat, once the petition gets approved then things start to really fly. I called NVC every day to see when the consulate received our K1 packet and then sent out packet 3. After I did that, I called NVC every day to see if Montreal logged it into the system and once they did, I then stalked the website to see when the first available appointment was. I didn't even wait for the instructions for packet 3 and 4 to arrive, I just went ahead and followed information on the K1 Canadina forum.

It is the waiting for approval of the petition that really sucks. Once that approval comes, there is a light at the end of the tunnel.

I have to tell you, if the service center you are assigned to is a big problem for you, you are going to have a lot more problems. The VISA is just the beginning. The petition is not even the beginning of the beginning.

Chill out. You have a long way to go and if you think a few weeks difference in the I-129f will make any difference down the road...you are imagining things.

What WILL make a difference is if you pine away over useless stuff like the ever changing timeline and not prepare for your fiancee's new life here.

The petition is done...look ahead.

Aside from legal action, I'm wondering how to contact the director of the USCIS, or someone in the chain in command in charge of the CSC. That person has got to be put under pressure. That repeated non sense of "July 18" is offensive and insulting. Someone has got to be held accountable. It seems that Congress has little power based on many petitioners (including myself) who have contacted Senators and Congressman. DHS (Dept of homeland Security) is part of the executive branch, meaning someone at the White House can do something. From reading these threads on this forum, it's clear to me that law abiding, tax paying Americans are being grossly mistreated and disrespected. Additionally perhaps media attention would get something done. Once the general public becomes aware of the cruel joke also known as the USCIS, maybe the lying bastards there would be compelled to clean up this mess. 60 Minutes anyone??

I like the 60 Minutes idea alot!! Seriously, you should consider contacting the Today show as well. They seem to love human interest stories like this and might be all over it. Does not hurt to try. USCIS needs to start being more accountable to the people who pay their salaries and maybe if the media shed some light on just how slow the process time is for people who have chosen to do things by the book and obey the law, then the pressure might be on to speed up the processing of applications.

Hi All, I received what I guess is my NOA1 with a National Benefits Center application number. Has anyone else received this? Is this normal and how do I check my case? There is no date for biometrics. Will I get a new letter? I went to the USCIS website and it says that my case number is not valid. Sorry for all the questions. I am just freaking out a little.


Call USCIS and ask to speak to a Tier 2 person These are immigration officers and can see info on your file that the customer service agent can't. They will be able to give you information regarding your case and also be able to tell you that it is there and what the status is. You know that USCIS has received it because you got your NOA 1.

When I applied for my AOS, it went to the NBC as well. Whenever I checked the website, it always said case could not be found but it was in the system. It changed right before my conditional green card was issued which was at the 6 month mark.
Oh and I also got a notice in the mail for my biometrics appointment even though status said that case could not be found on the website.

Hello fellow VJ'ers,

 

I am wondering when I can apply for citizenship. I entered the US in June of  2012 on a K1 visa and we got married June 22nd, 2012. I received my 2yr conditional GC on February 6th, 2013 and I will be filing my ROC application on November 6th this year. I know that some of the wait times for the PR GC may take up to a year to receive and that some people have applied for citizenship based on marriage to a US spouse if this process is taking too long. I just want to be done with the immigration process as soon as I am eligible for citizenship. Would I be eligible to apply for citizenship in June of 2015?

 

Any info is greatly appreciated.

How long is the medical valid for? How long did you have to wait between the times that you booked and when the actual appointment occured? Should I wait until I receive more info or just book? I live in Toronto.

What was the total cost? What vaccinations did you have to get?

On another note, have you gotten your criminal records check done? I called the RCMP today and they said it could take 2 weeks to 4 months.

If you can clarify, I would greatly appreciate this.

For packet 3 it is unnecessary. Just include a photocopy of the biographic info page of your passport and two 2"x2" passport style photos. It wouldn't hurt but it doesn't really matter.

Hi All,

Just doing some research before I assemble all my information. Just wondering if it would hurt to put a copy of my Nexus pass in along with my passport? This was issued by the US government (Homeland Security) and I had to be fingerprinted, submit my passport as well as have an iris scan done to obtain this card. I usually cross into the US with this instead of my passport.

Going thru the DS230 and it is asking for all school info - does this include elementary thru post secondary? If so, for elementary thru high school how do I respond to the question " Course of study and degree or diploma? Can packet 3 get filed electronically? If so, how do I do it?

I keep seeing reference to a checklist included in packet 3. I thought that the checklist was issued with Packet 4 As I am ubber paranoid that I am not going to get the packet 3 instruction from the consulate (haven't received yet and keep seeing some post that some people never receive this). Are there example forms on how to assemble packet 3 (like cover letter for packet 3)? The one for the K1 petition in the forums and guidlines was very good and very helpful.

Is there an easier guide for setting up the DHL account? It can be quite confusing. The questions what is trip purpose and what type of visa.

I am hoping that someone can post the most up-to-date documents required for packet 3 and 4 K-1 Visa only. Some of the information that I am finding is outdated or pertains to spousal visa.

I also am wondering if I can start prepping my packet 3 and if I can send that information to the consulate beforehand even though I haven't received the packet 3 or instructions from the consulate yet. The only reason that I know that Montreal received our K1 from NVC is that I called DOS and asked if Montreal received our information from NVC. The operator confirmed that the consulate did receive our K1 application/approval but that they had not sent anything out to me yet.

Any advise my fellow VJ'ers. The lady at the DOS told me not to send anything to Montreal until I received Packet 3.

AP is advanced parole EAD is the employment authorization. This are filed for after marriage when you file for AOS - don't even worry about thos things right now.

Bio page of the passport is the page with your picture and information on it.

Men do not need a marriage certificate, only the divorce one - if it was a woman you need the marriage and divorce certificates to show the name changes.

in 2009 Montreal asked for both mine and his ( birth cert ) at the interview but returned both originals and kept copys. ( Always ask for originals back and leave them with copys )

Montreal lumps K-1 information with spousal information. Unless they changed the requirements within the last few days to require the 864 - they should only be needing the I-134 for the K-1.

So trying to prepare everything well in advance and went onto the Montreal US Consulate website. On the appointment checklist for the fiances visa, it is asking for the following forms - Evidence of Support (I-864,I-864,I-864EZ, I-864W) - no where does it list the I-134. Is this some new form for the evidence of support? And if so, do all of these have to be provided? My fiancee has his own business - what will he have to provide besides bank statements and tax returns?

Does Montreal require both Birth Certificates? Mine (beneficiary) His (petitioner)?

He is divorced and I know that the divorce decree is required but do they need his marriage certificate as well?

What is the biographic page of the passport? What is english translation? Do they need his passport and biographic page as well?

Do I have to go to the social security office to obtain my EAD? Is there a cost involved for that? If so, how much?

What is the AP? Is this for advanced parole? I keep seeing AP, EAD mentioned in the same sentance on alot of post and am asking for clarification

CanadaMRV Fee payment problems with CSC

Hello,

I seem to be having the worst of luck with CSC. Anyone else find this website service completely non-user friendly?

I am trying to make my MRV fee payment for my K-1 Visa. When I called in to book an appointment, they said I need to make the payment of $350US before an appointment can be made.

1) I have tried making the payment over the telephone. I have attempted about 5 times now, using 2 different credit cards, and I am continued to be told my cards are invalid. I have contacted my credit card company, and they said the cards are fine, and no transactions were even attempted.
I emailed CSC for assistance, and they basically told me to try again, and to try making the payment online or through Scotiabank.
I attemped to make the payment over the phone again....same issue, I'm told my credit card is not valid. (I emailed CSC again to see what the problem is)

2) I tried to make the payment online through the website instead. Except, I can't seem to find the option to make the MRV fee payment. I have followed all instructions as outlined.
-Trip purpose selected (K1 Fiance) Permanently immigrate to the US
- Selected Montreal as my choice consulate
- Was sent to Visa information page - clicked on continue

I have a Nexus card and usually cross with that. My other half lives in Western NY and I live in Toronto. I cross every second weekend in Niagra Falls. The customs officer told me to carry my NOA 1 or 2 once it was issued when I cross as well as current documentation that shows ties to Canada (ie. phone bill, current bank statement and hydro bill). I always get a letter from my employer as well stating when I am coming back to work. This usually does the trick and I have never had a issue crossing. As long as you are honest and DO NOT overstay the days that you said that you are going back home. You will also want to keep track of every visit as you will have to submit this information later on in your application process (Package 3).

DHL is the same as courier, it is the name of the courier company.
