I also collected EI after I received my EAD card, great program, really appreciated it after paying in for years!

If you do end up collecting EI call Canada Revenue agency to see if you're eligible for a tax credit for income tax the following year, even if you filed an exit tax return - in my case it was the only income I earned for the 1st year I was in the US so I filed in Canada as a US permanent resident and was credited about 2/3 of the taxes they deducted!

Kool Brenda! Thanks for that juicy nugget! I will have to check that out. I love the fact that we can claim UI even though we are living in a different country. I have been paying into since 1981 so I figure I might as well make the most of it.

K1s are a little different than a CR1/IR1 though.

They (K1s) apply right away same as the CR1s but because they don’t receive work authorization until after they are married and file for adjustment they cannot collect EI right away.

Exactly Hikergirl. I applied for UEI right after I got to the US just to get the paperwork and a file started. You will not be eligible until you receive your EAD card. Once I received my EAD I then sent a copy of it via post and fax to the Interstate claims office. UEI will then activate your file from the date that your EAD card is valid. You can even call in every 2 weeks for your reporting period once you are eligible and they will deposit the funds directly into your Canadian bank account. It is so much better than mailing in the cards as the money goes in 2 business days after you call in vs. mailing in the reporting cards.

Are you close to a Nexus office? If so, take your Nexus card in with your EAD/AP card and give them the information. Once you get your green card, you will again have to give Nexus that info.

You will still have to be paroled in with your EAD/AP card even though you have Nexus. I know that I could not use the Whirlpool bridge in Niagara which is a Nexus only bridge as they do not have immigration officers there. They only have CBP agents and those guys could not parole me in. I either had to go to Lewiston/Queenston or Niagara. You can still use the Nexus lane for faster entery but you will have to be paroled in. Make sure that you have your passport, EAD/AP card and your Nexus card with you.

PS. If you do go to a Nexus office to update, make sure that you take your passport and any paperwork pertaining to your I485 application as well. You may not need the paperwork but take it just in case.

I just realized I need to update my Nexus information. I haven't received notification of an AOS interview so I think I am in the waiting group...

I'm sort of facing a similar challenge. Hope it's okay if I post in here, as I'm more just asking a question than helping answer the OP.

I hope to visit my fiance at least once every few months, if we can afford it, but I have to fly each time so I know that is a bit trickier than driving through the border. I don't have really any proof of ties to Canada as all I have is a part-time job right now at McDonald's. No rent or anything because I stay for free with my mother while I help her out because she is ill. I know that is not very strong proof. Is the K1 paperwork enough to bring as proof on it's own, provided I am honest and open? Would this NEXUS card be helpful for me, as well?

I could understand if I was refused, but would feel awful as my fiance pays for the tickets and it costs quite a lot each time to go from Toronto to Tucson, AZ.

Hey IntoTheLight, you should try to fly out of Buffalo or Rochester as the price of flights are much cheaper. I went to go visit a girlfriend of mine who moved to PHX and always manage to find flights between $250 - $375. Southwest is pretty cheap and to park at the airport is cheap as well unlike YYZ.

Definately invest in the Nexus card and again if you fly out of NY state, you can use the Whirlpool Bridge which is Nexus access only via car.

Make sure that you always have a return date with you plus return ticket and always leave the US when you say you are going to be leaving.

You might want to take copies of any recent bank or credit card statements as well as any bills you might have like a cell phone bill. I always carried this info as well as my NOA1 and never got any sort of hassle. I also always took a letter from my employer stating the dates that I would be due back at work plus my employers contact info just in case.

Definately invest in the Nexus card...it is the bomb!! It has saved me from 3 hour waits (US Thanksgiving) at the border coming back into Canada. If you are in Ontario and she goes thru Niagara Falls, there is a seperate bridge which is Nexus only.

K-1s book themselves appointments on-line.

The spots are on a first come, first serve basis so if Hannah and Haribo check the booking site frequently they will hopefully get a spot right away.

I haven’t heard of a lot of people wanting spots on VJ recently so perhaps not a lot of competition for spots right now, but in the past K-1 applicants have texted each other when spots open up and post on here so others know.

There were quite a few of us K1's last year waiting to book at Montreal in April. We probably waited about 3 weeks for those appointment slots to open up. We started a thread about this and kept each other in the loop via the thread plus exchanged email addresses and phone numbers so that if some appointments opened up then we could all notify each other immediately.

Rule #1 about USPS... they know nothing about the mail they deliver, nor do they care. 

 

 

Peachy, actually the post guy in my small town does. My GC ended up being delivered to the church down the street because the girl that was covering for him got the numbers mixed up 1353 instead of 1335. It was supposed to have been delivered on a Friday. I had followed delivery on the link and freaked out when I didn't get it...blah blah blah. My regular mailman Dave, was back at work on Monday. When he walked up to my mailbox, he had a priority post envelope in his hand. He told me that the church never gets PP and that he checked and saw that it was for me. It turned out it was my GC. My mailman Dave is awesome!!

CanadaUSC Visiting Canada via Airplane: Where do you go through customs?

Hey Everyone,

 

My fiance just booked his first international flight to come visit me in Canada (he drove last time), but I'm a little unsure of what he should expect. Whenever I visit him, I go through Customs in Toronto's Pearson International, before flying anywhere. But he'll be traveling from Tuscon (TUS), through Chicago (ORD), then landing in Toronto (YYZ). Will he be going through customs in Toronto or Chicago? If Chicago, how long does that normally take? He'll have about 2 1/2 hours layover there.

 

Not sure if this is the right place to post, but I figured it was most likely relevant here. Just a bit nervous that his first international flight goes smoothly and excited to see him again in less than a month! 

 

You guys might want to look at getting Nexus cards if you are going back and forth frequently. It just makes it easier and faster with customs.

This place is nice, huge rooms and if you go thru the parking lot behind the hotel and down the alleyway that joins the parking lot it comes right out at the entrance of the consulate.

Do not bring any electronic devices such as cell phones. Leave those in the hotel. With regards to bringing in your paperwork, get a clear plastic binder and just bring that.

CanadaK1 Visa in Hand!

I am a happy camper. It's been a lot of commuting and blood, sweat, and tears but it's in my hand!


Loomis, not happy with, and I know another poster late last year was frantic about the treatment of their documents as well.

I went in to their office to pick up my packet, she knew it was a passport type thing as she asked if it was. She returned with the plastic packet and then opened it in front of me which I thought was strange as it was addressed to me. She pulled out the white envelope which I knew was the envelope that was the "DO NOT OPEN" envelope. She was trying to figure out where to open it!!! I said very quickly and loudly, "Please don't open that! Trust me! It says do not open!!"

Oh thank they didn't open it. Why can Loomis not follow instructions and why do they always want to open that envelope that says DO NOT OPEN. Boneheads!

Don't forget to bring a copy of your NOA2 with the confirmation DS160 page to the interview. It says this right on the DS 160 confirmation page that the NOA 2 is to accompany the 160...sorry don't want to stress you out but don't want you to be missing something on your interview day that could have been avoided thus making the consulate issue an RFE.

Hi all,

Just assembling my documents for my interview in April at the consulate in Montreal. Was wondering if there was a specific order that the docs should go in? I noticed on the review for the Vancouver consulate that there was an order to how the documents should be organized but nothing on Montreal's review of the consulate.

Anyone have any input? Hoping that this will impress the interviewing CO with how organized my documents are. :devil: hehe...little brownie points never hurt!

Now that I think about it, it's not too much more expensive than when I first started flying out May of 2012. We just stay at the same hotel every time, so we started getting discounts emailed to us, which helps out a lot. Since embracing that it'll be expensive regardless, my new mission is to convince the fiance that we should stay at Le Phillip ;-)

Oooh I stayed at the Le Phiilip's when I went for my interview and I would give this place 2 thumbs up plus it is so close to the consulate. You can cut thru the parking lot in the back and go out thru the alleyway and bam you are right at the doors of the consulate. The staff at the hotel were amazing, super friendly and our room was huge. I think that I found a deal for $161.00 taxes in per night.

As long as you retain your residency in the US, there is no reason you cannot commute across the border to work.  There are a number of Canadians married to Americans, residing in the US, who live near the border and work in Canada.  You would probably want to get a Nexus card to facilitate your border crossing, but as long as you have your green card and are residing in the US, there is no reason why you cannot continue to work in Canada.  You may wish to consult a cross border tax consultant to ensure you are getting the best tax advantages, and yes, you are right, you would still require health care coverage from the US as you are not a Canadian resident so not entitled to provincial health care.

 

It's definitely do-able.

CanadaCan I work/stay in Canada 2-3 days a week if I am a conditional resident

So I stayed in touch with some of my former co-workers in Toronto and we were talking about the office. My former co-worker mentioned that they would love to have me back on a part time basis..work partially from home telecommuting but come into their office Tuesday's - Thursday's. I live 2.5 hrs from Toronto in Western NY and am seriously considering this as the money would be fantastic fantastic benefits (3 weeks paid vacation plus 1 week paid off between Xmas and New Year's plus bonus). No medical benefits though because i would have to get insurance here in the US.

 

What I want to know is, if I find a room to rent for 2 nights a week to stay up there, how will this affect my conditional residency? Can I just tell US customs when I come back that I was away for business? I am applying for permanent residency in November of this year.

NOA2 June 24.  MTL# was given over the phone on Friday from NVC.  I'm waiting in response to my email to the consulate asking if they have received my case.  I have packet three all ready to go.


You should actually call DOS and see if MTL has logged your stuff in the computer. If so, then I would say send out packet 3. This is from a link that I found and I have posted the link below this information.

3. DOS
After you get word that the petition is headed for Montreal, give it a few days (Id say minimum a week) and you can start calling the Department of State (DOS). Their number is: 1-202-663-1225 and to get to a visa specialist, its 1 and then 0. This operator will want your MTL # and sometimes both the names and dates of birth for both petitioner and beneficiary. At this stage, youll go through the follow things with DOS:
-Has your petition arrived in Montreal? If it has not, theres nothing to do yet. Montreal is notorious for delays in its mailroom so even if you think its unrealistic it hasnt physically arrived yet, chances are its sitting somewhere waiting to be logged. Until DOS gives the word the petition is in Montreal, you just have to sit tight.
-Once the case has arrived, you can ask DOS is Packet 3 has been sent out. Even if it hasnt, you can prepare and send Packet 3 yourself, the important thing is to make sure Montreal has your case before you send them anything.

When I moved down, I just put down what the contents were in the moving boxes. IE. clothing, coats, shoes etc. I numbered all my boxes and listed them on a seperate form which I attached to the customs form. Well when I crossed over with my UHaul, CBP just opened the truck, looked inside and then closed it up. I was so mad because it took me so long to pack all of those boxes and list everything and the agent didn't even want the paperwork or to see it.

I stayed at Le Phillips Square. The consulate is right behind it. You can walk behind the hotel thru the parking lot and cut through the alley and are right there at the door of the consulate within 2 minutes. The room was huge and clean and the bed was super comfortable.The staff was fantastic. I think that I paid $130.00 for the night.

NO, I am not covered under a my provincial health care (Manitoba). The criteria for eligibility is that you have to be physically present in Manitoba for a total of the 183 days. Basically, a day at work in Canada doesn't count as it is roughly defined as "where you hang your hat at night".
It is one of the cons of the whole thing as CRA still defines me as a "factual resident of Canada" for tax purposes and my tax home is Canada. Also you may not be eligible to certain extended benefits that are based on being covered under a provincial health plan, such as I can't utilize the prescription, and extended health benifits (physio, chiro, etc) of the Canada's gov't plan.
You will have to weigh the pros and cons. To me I am still much better off (payscale and benefit wise) to work for the CBSA than to try to find anything similar in the area we live in in the US. Also if you are considering having children you will still be eligible for Canada's materity/paternity benefit and can collect your EI and any top off while you live in the US. THat alone is a huge deal for some considering the US's maternity leaves.
If you are defined by the CRA as a "factual resident of Canada" for tax purposed you will also be eligible to collect the Child tax benefit (if you qualify) as well as the Universal Child Care Payment.

Just curious because I posed this in another topic, was looking at working in Canada (once I'm able to come back after AOS is approved) but residing in the US...being told that I cannot use OHIP because I will not be residing in Ontario..but don't your provincial income taxes cover this cost?

Can you please let me know?

Just curious how the consulate processes and sends out some visa's within a couple of days and how some take awhile before they go out even if the interviews were all on the same day.

I'm getting mine delivered to Markham. I think that people who got their's right away were getting the visa's sent to Brampton...could this be because Brampton is closer to YYZ?

Just checked the CSC site and saw that beautiful sentence that passport was ready for pickup!!! Sweet!!!

Try calling DHL, when I called this morning, she said that the Reference ID is good for her to check if where my passport was.. Or check online on the DHL.ca website..

Green Giant said that they interviewed at Montreal last Monday and called DOS on Wednesday. DOS told them that the visa (K1)was issued and would be sent out shortly. Hope this helps

Removing Conditions on Residency General DiscussionCalling USCIS

Ok this is our situation.

Mailed in I-751 in February 2012. Received RFE in October and sent in reply on 11/16/12 with signed confirmation.
I called the uscis yesterday because we haven't heard anything since sending in the RFE reply. At first we talked to a tier 1 ISO and because there weren't anything this person could help us with, he willingly sent us on to a tier 2 ISO.
This one was kind of rude and quite short in her answers. The tier 1 ISO said that because it was past the 60 days of receiving the RFE dated for 10/23/12 then we would qualify for putting in a service request on the I-751. The tier 2 said that we couldn't do a service request until after the date of them receiving the documents for the RFE. My question, is that she wouldn't have known that I had gotten a signed confirmation on the 16 of November except I had told her when talking about our case. I felt like she was brushing me off because she wanted to get off the phone.
I told her that because it has taken this long the extension letter that was sent to my husband was on the cusp of expiring. She suggested to go to the local office and get a stamp.
We will do this if necessary but what else can I do to get a fire lit under them? One way or the other, we need results.

Any suggestions?

You and I must have had the same IO. She was miserable when I spoke to her.

The USPS reported that your new card was delivered on January 12, 2012, directly to the address we had on file. The USPS tracking number assigned was #DCN. You can use this number at <a href="https://tools.usps.c...gTrackNum=#DCN" target="_blank">www.usps.com</a> to view the detailed tracking information recorded by USPS for the mailed card. If you did not receive your card, or have any questions, please call our customer service at 1-800-375-5283.


This step applies to applications that result in an applicant receiving a card (such as a "green card") or other document (such as a naturalization certificate, employment authorization document, travel document, or advance parole). Applications will be in this step from the time the order to produce the card/document is given until the card/document is produced and mailed to the applicant. You can expect to receive your card/document within 30 days of the approval of your application.

I dont know what this means. does this apply to my ROC application??

Maybe it is a typo in the system? You might want to call USCIS, speak to a Tier 2 IO and clarify that the card that has been issued was for an I-751 application and not for an I-485 application.
