K-1 Fiance(e) Visa Process & ProceduresMedical Exam

She is not to open the contents of her medical. She will give it to the consulate when she has her interview. When her visa is returned she will be given another envelope to give the officers at her POE. Her medical will be opened by them and forwarded on to USCIS and will be there for when she does her AOS. She must not open anything. Along with my medical there was a vaccination paper for my records, I'm not sure if every country does that or not. This was for me to send in with my AOS. Her medical is good for one year....I hope that clarified your questions.

So this basically leaves us with no other choice but to call Leelavati hospital and ask whether or not they included a vaccination report within Medical Report as well.
Thanks JeannieL.

i thought i was supposed to be sealed.. am i wrong

Lol... Unless you're a document, you shouldn't be sealed... sorry I am a grammar nitpick.
But yes, I am trying to get an answer for the same question as yours...
Ours is still sealed, which is why I am asking the question before proceeding to open, thinking that people who have been through the process know whether or not its meant to be opened.

K-1 Fiance(e) Visa Process & ProceduresMedical Exam
Hello All,
My fiancee had her Medical exam recently in Mumbai's Leelavati Hospital in Reclamation (Bandra).
I am not so clear as to what they have given her.

This is because I'm under the impression that the report is meant to be opened by the US Embassy and not before. Am I wrong?
Can she look at her medical report and all its contents?

The reason I am asking this question is because a few months down the line, we will need to file for her AOS and we plan on using the medical report as proof that she has necessary vaccinations etc that are required for AOS (as opposed to spending money at the civil surgeon).

Please let me know.

Thanks,
Chigs

On the I-134, on Page 2, in the "Oath or Affirmation of Sponsor," there seems to be an extra field.
Hovering over it in Acrobat says "Enter Relationship," which really doesn't make sense (or maybe its 2:30 AM for me and i should get some sleep... lol).

Form revision is 05/25/11 Y
This appears right after the text "... Food Stamp Act, as amended.__________________"

There you go that is why this happened to you. You are a white American female (no Indian background) who fell in love with an Indian, they generally are tough in terms of proof when this happens from reading threads on VJ, especially in Middle Eastern and Pakistani countries as well as India. I guess Some of these consulates have a hard time accepting interracial relationships.

Not sure if she said she is white! She only said American. As in citizen of United States. Or atleast thats what I interpreted it to mean.

Electric86: Are you not of Indian descent? If not, then what Persepolis said is very true. There is a lot of scrutiny on interracial marriages, especially coming from the New Delhi Consulate.

I don't know about the fund transfers because it can be misconstrued as something else as well.
However, I certainly agree that "letter of intent" from both the parents stating what kind of engagement (verbal) you guys have gone through and what their views are on a formal ceremony for the engagement and the wedding in the states would be a plus.

Also, I noticed that you've joined quite a while back.
Please update your timeline so that as much as others try to help you, others can benefit from your experience as well.
For instance, it would be good to know what embassy your fiance had the interview at: Mumbai or Delhi or Chennai?

Thanks and hope things move positively from now on.

regardless of what these guys tell you, it always goes to the NVC and then to the embassy. I believe its a 603 number, i forget but I'm sure you will come across it here on the forums.

My fiancee and I sincerely appreciate all the well wishes. In fact, we were certainly not expecting such a wide response.
I apologize if my topic forced you into reading my post, as I did it under sheer excitement.

This just goes to prove how connected this community is.
I will most definitely stick around and help out anyone who needs guidance with respect to what we've been through so far. It's the least we can do in response to the help we've received from fellow VJers.

Again, we are not through yet. This is just the beginning of our journey together. Still to climb the AOS and ROC mountain. However, it seems like everything from this point on gets easier.

And yes, she is THE ONE.

That being, said. I don't want to draw too much attention to this thread. So if mods would like to lock it, please do so.
Anyone who wishes to get in touch with me can send me a PM or post on my profile and I will respond when time permits.

And of course, I will occasionally lurk onto your thread and post something interesting, si man! (Tbone reference... i'm a fan of this phrase)
Thanks again.

Was she not able to get it the visa from VFS the same day?

Did you set up the SMS/Text alert that VFS provides to let you know when the passport is ready?

Apparently, this is not something I knew about. I just became aware of this feature where VFS can send you an SMS when your passport is ready.
Most of such things, I was going to let my fiancee handle.
But to answer your question, she did not sign up for the SMS service there. However, she did go the VFS office later in the day to see if her passport was ready, but it wasn't ready.

My Fiancee just phoned in from a phone outside the Consulate after her interview at the Mumbai Consulate.
WE ARE APPROVED.

I don't have any details yet but will post an in-depth consulate review/interview feedback/experience once my fiancee and I get to talk about it.

We are sooooo relieved.
These have been trying months. So much of agony, pain and frustration. All behind us.
I'm glad we have made it beyond this phase. Seems we are so much stronger now.

I want to thank all the VJers who have helped and supported us. We are not done yet. However, we feel the biggest hurdle is behind us both.
Thank you lord.

It's going to be tough trying to get some sleep tonight with all this excitement in my head.

PS. We have neglected to update our timeline because we simply wanted to get through our phase without being bombarded with too many things. It really felt like out plate was full and we simply needed to make sure we did well to get through.
Nevertheless, we have a success story at Mumbai. And we will be more than happy to share it as soon as we can.

K-1 Fiance(e) Visa Process & ProceduresI-129F Filing and Evidence of Relationship
Hi Lindsay,

I would send as much as possible. Im guessing that you two are an interracial couple. Please correct me if I'm wrong.
I would send with the I-129F:
1. Pictures of the two of you having met in last two yrs (before filing the I-129F).
2. Chat logs/emails/call records in periods (no need to send EVERYTHING). For example, if you've been communicatiing since the past 2 years, start from the beginning and til the end, accumulate about 30-40 pages of these records in TOTAL which show that you've been in communicating progressively and not in bursts.
3. Engagement Ceremony Invitation card (if one is available).
4. Boarding Passes/Receipts of ATM/Bank card withdrawals overseas, and Passport Stamps (exit/entry) will be primary evidence of having met. If you met in a foreign country, you will need these from both yourself and your fiance.
5. Advise book is not going to help much at this stage. This is something that should be taken to the interview.
6. If you've written letters to each other, you can send them copies as evidence of communication.
... Everything else that you need to send is well specified in the guide. If you follow it to the T, you will be well set in your efforts in obtaining approval from the USCIS and then some.

One thing to note. Be careful of sending pictures which are too extravagant. you don't want to go through trouble proving that your engagement was not a wedding. So be mindful of these things and all should be okay.

K-1 Fiance(e) Visa Process & ProceduresHelp - SSN and ID card in California challenge.
SSN is a national identifier.
As per SSA for K1, your wife, who was once your Fiancee at the point the K1 was granted, can most certainly get an SSN. She needs her passport, which indicates that she arrived on a K1. If she's had a name change as per the wedding, she will need the Marriage certificate to grant her a SSN in her married name, else it will have to be in her Maiden name.

I'm surprised you hadn't requested her to get an SSN soon after her arrival in the States.

Thats as much as i know, if I'm wrong, someone else will most likely correct me.

It's Indian system....:) but the time fram can be different for different cities. I just mentioned about Mumbai and when I had applied for, this time might have reduced.

Yes when I applied I had applied for both police and passport clearance.
Its stupid to have both but thats how it is as passport office contacts your local police station so police station does the same check what they do for police clearance and then they send it back to passport office.

I got my police clearance done much faster, what I did was I got the clearance from the local police station in sealed envelope and submitted that to HQ instead of waiting on their internal courier system.

So HQ just had to write a letter based on the i/p I gave them and second they cannot delay in getting the letter based on the its lost in their internal courier system :)

Do you have any idea how long this "passport clearance" is valid.
I mean, its better to have the ducks in a row, but if they have an expiration date of say 4 months or 6 months, we can time it accordingly.

Thanks,
Chigs

Right... We are not concerned with Flights which force us to Switch from Heathrow to Gatwick. It will simply be Heathrow arrival and Heathrow departure.
What is this term MBE? I'm hearing this for the first time. Please elaborate.

Qatar and Emirates are also good options. However, the reason why I am looking at British Airways is because of a $100+ fare difference. We are well off, but we can certainly use this money towards the AOS process or the Honeymoon.

I'll also look into Continental/UA...

So the take-way is that if its simply a transfer within Heathrow, she should not require a DATV or Transit or Visitor Visa from the UK? Yes?

IndiaK1 Visa in Hand, selecting flights
Hi All,

Though this question pertains to the aftermath of a K1 Visa being acquired, I thought it would be best if I posted in this forum as more will be potentially aware of the issue with my question.
My fiancee (Indian Citizen) just got her visa issued from the Mumbai consulate.

I'm now deciding on flights for her to arrive here in the United States. I'm concerned about potential Transit Visa or an Direct Airside Visa that may be required (or maybe not) incase we travel through the UK (London Heathrow, or any of the other airports on the Atlantic Route).
I came across this thread on (website removed by request)
I don't have an account there and thought I'd strictly ask in this forum since I'm a regular here.
According to the link, it seems any USA bound traveler with a Valid Unexpired US Visa does not need a Transit/Airside Visa.
I'm just looking for a verification of this statement. I was under the impression that if an Indian Citizen travels through London to get to USA, they need a transit visa.

Please advise.

Thanks,
Chigs

IndiaHow is the AirIndia direct flight to New Delhi?
Okay my two cents.
Haven't traveled in AirIndia since the ice ages... lol
I will however recommend Emirates and Qatar. Unbelievable flight experience. Good amount of legroom on their B777-300ER (both Emirates and Qatar use these airplanes).
No idea about the A380 used by Emirates.
Food is good, however I am a vegetarian, so understand my perspective.

I have traveled through Swiss, Lufthansa, Delta, Alitalia... but nothing compares to Emirates and Qatar.
Unfortunately, none of them have a direct flight to India.

There is a Continental/United direct flight to mumbai, however you want to go to Delhi ;)

National Visa Center (Dept of State)Im confused by NVC/DOS and Embassy

Chigs,

I had a hell of a time watching a package on the DHL website. Waiting and waiting for it to complete the "CLEARANCE DELAY". On some very good VJ advice I called DOS and found out that not only was my file at the embassy but they had in fact already sent out P3, albeit to a bad address but thats another story. Since P3 was undeliverable the embassy had decided to send to me here in the US  it took 7 weeks to get here. Fortunately we went ahead and sent the P3 info back to the embassy before I ever got the letter.

My advice is go with what DOS is telling you and send the P3 info. Worst case scenario would be that the mail room gets it and doesn't know why you sent it. If P3 has been sent I would think you are good to go!

Good luck!

Well I've sent one final email to the embassy. If they say "Yes, we have it."

National Visa Center (Dept of State)Im confused by NVC/DOS and Embassy
My case has seen some decent amount of movement lately.
Firstly I was told by NVC that the case arrived at the NVC on the SEP 09 2011 and forwarded to the embassy on SEP 12 2011.
Great.

Then I called Department of State to see if this information matches up.
DoS said my file was received by the Mumbai consulate on SEP 12 2011 and that PACKET III was issued on SEP 14 2011.
WHAT?

NVC is sticking to their story and DoS keeps on saying the same thing.
Now let's add the Mumbai Consulate/Embassy into the mix. My fiancee contacted them via email to ask something about packet 4. Apparently, they also are claiming Packet III was issued on Sep 14, 2011 and that the file was received by Mumbai on SEP 12 2011.
DHL.COM tracking isn't verifying the DoS or Embassy's claims. There wasn't anything received by the Mumbai consulate on SEP 12 2011. Matter or fact, Mumbai hasn't seen many packages in a while, mostly NEW DELHI is receiving them. Unless the tracking means has changed from the "EXP DD MMM YYYYA" shipper reference search, this is it.

Furthermore, NVC's statement sounds more legitimate. They claim it forwarded the Approved petition to the embassy on Sep 12, 2011. On Sep 13, 2011 a package was picked up from BOSTON and is headed to the Mumbai embassy. I don't know if this is our I-129F petition, but I think it is. Its slated to be delivered on Sep 16th 2011 in Mumbai (in line with the NVC's departure timelines).

I have sent an email to the Mumbai Consulate asking them for clarification as to whether or not the case is already there.

We plan on sending the Packet 3 via email or potentially hand delivering it to the VFS office.
I don't want my fiancee to take a trip to the VFS office/embassy only to find out that we were misinformed and that the case isn't already there.

What should I believe? What should I do?

US Embassy and Consulate DiscussionMumbai Embassy Giving my fiancee the runaround...
Okay.

Deep breath.

Now, here's the deal. After reading several posts here and also following some genuine advice, my fiancee and I decided that she would manually hand over the Packet 3 to the embassy. So she woke up in the morning and went to the embassy. They refused to accept any form of documentation at all and wanted the Appointment letter incase something needed to be submitted. WHAT??? She went there to submit the Packet 3, which would result in a Packet 4 (including the interview/appointment letter). Then she attempted to submit Packet 3 at the VFS. They were a bit more courteous in letting her know that neither the embassy or VFS is going to take packet 3 hard copy. Now this really threw me off.

So all in all, she woke up at 5:20 in the morning to go to the US Embassy and VFS to come back without doing what she wanted to do in the first place. Really disappointing.

Firstly, when Packet 3 is issued, it is almost never mailed out or never makes it to the beneficiary. This is something really wrong in the process.

When my fiancee returned home, she went online and emailed the DS156, DS230 Part I and DS2001, Checklist, Applicant Statement to the Embassy. We got an email response saying "Action Taken." Hopefully this is it.

Now we pray to god that they send out the Packet 4 Hardcopy via mail.

Can anyone who has recently dealt with the Mumbai US Embassy care to discuss their process of packet 3/packet 4.
Please share your experiences.

Thank you,
Chigs

Removing Conditions on Residency General DiscussionROC info
Hello Fellow VJers,

Background: I filed a I-129F petition for my wife (fiancee at the time), she arrived on a K1. We married and filed I-485 (plus EAD/AP), got transferred CSC and were approved without interview.
My wife received her GC in Oct 2012, so we have a bit of time to before we prepare our ROC documents.

Just trying to gauge how this process is and its wait times.
Does this application get sent to VSC or CSC based on your address (similar to the I-129F processing)?
I know this process can take up a while but I'm trying to find out the current wait times for applicants.

Can she travel while her Conditional GC expires while undergoing ROC (while technically being out of status), similar to being out of status on a K1 and needing AP to travel abroad?

I'm also thinking ahead to the citizenship process for my wife.
Does she need to complete 3 years from the original GC issue date for her to file for Citizenship (assuming ROC gets approved without issues)? Or Is it simply 1 year after the approval of ROC (its confusing)?

Cheers,
Chigs

Removing Conditions on Residency General DiscussionDid we send enough evidence?

Ami&chigs .... You are paranoid for no reason. You have sent enough financial proof.. You should be focused on others proof as well. The docs you have sent i think should be sufficeint. The question remains "you dont have any pictures with each other in 2 years?" Big redflag..
But dont forget the joint tax returns are a big plus...

We thought of pictures together as secondary proof and hence we didn't think it was as important sending them. We have tons of pictures uploaded on facebook and social media. If they wanted to they could do some extra work and find them in their "background check." But I do agree that had we sent them with our application, it would have made the decision making process a bit easier. I'll get pictures on the list as well if we decide on filing an addendum.

Things so far:

  • My Driver's License and Her Learner's permit showing same residence
  • More bank statements (1 per quarter and showing transactions of usage)
  • Pictorial evidence of us together at various events (past valentine's days, birthdays, festive occasions such as karwa-chauth, temple visits with her parents in India, parties with friends, etc).

Anything else?

What is the proper mode of sending addendums to the application?

regards,

Chigs

Removing Conditions on Residency General DiscussionDid we send enough evidence?

First, what about evidence of cohabitation and joint lease or ownership of property?  I'd be much more concerned about that than bank statements.

However, yes I would send more bank statements.  They will want to see not only that you had a joint bank account but actually used it for transactions.  Many filers send one statement per quarter from the date of marriage to I-751 filing.

Cohabitation: We live with my parents. House is under their name, and don't have a written lease agreement or something of that sort. We basically help out with the house (house is already paid off). I take care of internet, tv, phones, cellphones bills, etc. Both me and wife have state issued IDs (driver's license and learner's permit, respectively) showing the same address information. Why didn't this occur to me during the filing? I'm not sure.

Also, since the parents live with us, they provided us with affidavits saying that we are happily married and that we all live together at that address (all notarized and signed). Another affidavit is from a friend who attended our wedding and who we hangout with all the time attesting that our relationship and marriage is very much in good faith.

On another note, we already filed our application and the NOA is dated 08-15-2014 so should we send the Driver license copies and additional bank statements as an addendum (as a separate mailing) after we receive our biometrics (which will include the case number as well)?

A friend of mine in similar situation (married and also living with parents) didn't have any problems such as RFE, etc. Infact he sent only a single bank statement. BUT huband and wife both sent copies of their Driver's license.

Should we send this stuff as an addendum to our filing (shortly after receiving our case number on the biometrics appointment)?

Thanks for the input.

Chigs

Removing Conditions on Residency General DiscussionDid we send enough evidence?

Hello everyone,

We filed the I-751 on behalf of my wife and now I'm feeling a bit jittery/nervous about the number of Bank Statements we sent.

Here's what we sent altogether:

  • Application Fee ? $590 ? Personal Check ($505: I-751, $85: Biometrics Fee)
  • USCIS Form I-751
  • Copy of USCIS Form I-551 (Permanent Resident Card)
  • Copy of current passport
  • Three (3) sworn Affidavits by family and friends attesting to our relationship and marriage
  • Copy of IRS Tax Transcripts for three (3) years of jointly filed tax returns (2011-2012-2013)
  • Joint Bank Statements spanning 2 years (4 statements)
  • Written Notice from Bank attesting the validity of the account as a Joint Account
  • Copy of health insurance cards showing joint policy
  • Copy of SonyCard credit cards showing joint ownership
  • Copy of GEICO insurance policy page showing joint account ownership
  • Copy of airline e-Tickets & boarding passes for vacation in India (August 2012 ? September 2012)
  • Copy of credit card statement showing ticket purchase (August 2012 ? September 2012)
  • Copy of airline e-Tickets for travel to India (February 2014 ? March 2014)
  • Copy of credit card statement(s) showing ticket purchase (February 2014 ? March 2014)
  • Passports entrance/exit stamps for both travel trips to India (2012 & 2014)
  • Ticket stubs and credit card statement for visit to Empire State Building & Statue Of Liberty (March 2012)

We basically focussed on hard evidence about being together (passport stamps etc, airline tickets, etc) and didn't send any pictorial evidence.

What is bothering me is that we only sent 4 Bank Statements; January & February 2012 (because the account became "Joint" on 12-26-2011 Shortly after the wedding 12-23-2011) and June & July 2014 (most recent statements showing the account is still joint). We obviously should have sent more because the statements in between leaves a lot of room for speculation. Obviously we didn't change anything about the account.

So we also decided to get a letter from the Bank where the account is held. This letter basically states that the account has been join since the aformentioned date. It happens to be on the Bank letterhead and is very much official. Would this also count as proof? Should I stop being so paranoid?

I've attached the letter (with private information blacked out) to get an opinion here as to whether is solidifies proof that the bank account has been joint and has stayed as joint.

Thanks,

cchhat01

Removing Conditions on Residency General DiscussionConditional Green Card expires on Sep 17th

Hi Ash&Dave,

Now would be the time to get a move on with your I-751 filing. As previously mentioned, the 90 day window applies to the period before your Conditional Permanent Resident (CPR) Card Expiration date, nothing to do with the wedding date.

Also, my suggestion is that you read the guide with care and accumulate as much proof as you can with respect to RoC filing.

You should provide solid evidence of "Joint finances" and "Joint Cohabitation", following are some examples:

Tax Transcripts of 1040 filings which should hopefully be joint

Joint checking/savings accounts with account activity, not just money sitting in an account

IRA/401K account with beneficiary info

health/life insurance with beneficiary info

joint credit cards accounts

//cohabitation

both drivers' licenses with matching addresses

utility bills showing residential addresses preferably showing both names

travel plans and itineraries for overseas flights if any (passport exit/entry stamps are good evidence)

pictures of being together at various events over the span of the last 2 years

These are mere examples of what you should send. Some folks send little, some folks send a huge packet with lots and lots of information.

The guide will be your friend.

Best of luck and hope you get this done in time.

Regards,

Chigs

Removing Conditions on Residency General DiscussionCSC or VSC, Was it transferred?

This is the USCIS standard boilerplate stuff (aka. their standard song-and-dance). Our NOA looks just the same. Also you cannot track your case using that case number from what I understand.

There is absolultely no mention of tranfser. Your Biometrics letter came from VSC. That's okay. Lot of folks have lately been getting their biometrics letter from VSC. Its a growing trend from which everyone seems to conclude that VSC is assisting other processing centers in sending Biometrics letters. You should have a couple of case numbers on this letter (one which was on your acceptance NOA and another one, use the 2nd one to track your status online through the USCIS website).

If your case does get transferred (which I highly doubt), it will only be because you'll probably be interviewed. Right now, you have received no shred of evidence stating that your case has been transferred so you should relax. Congratulations on being a CSC filer, you obviously don't have to wait as long as a VSC applicant.

EDIT: I noticed my NOA looks just like yours EXCEPT it does state VERMONT SERV CENTER (and the address) right below it. The Biometrics Letter doesn't have any address within it. However, the envelope was mailed from Vermont. Also, our Biometrics letter doesn't seem to be printed on USCIS grade paper. Its standard letter paper. NOA came with the proper USCIS letterhead and Liberty watermark bond paper.

Chigs

I just re-read the NOA1 and it had no mention of the case being transferred.

Here's the NOA1 summary.

Paragraph 1: Conditional Resident status extended 1 year, I can work and travel.

Paragraph 2: Notice I'll be receiving biometrics appointment letter.

Paragraph 3: if you overseas in the military you won't get an appointment.

Paragraph 4: Provide evidence if you haven't already.

Paragraph 5: You can track the status via CRI89.

Paragraph 6: If I check E or F, you can't change your address online.

Does that mean it's still at the CSC?

There is absolute no mention of ANY service center on the NOA1, the address at the very bottom however states a CA Post Office Box. But that's it.

The biometrics letter is the only letter that states VSC.

And of course I definitely without question filed with the CSC :)
