After the RFE we moved the wedding date until September 10th, Jenie Bee will arrive at POE (Portland) Saturday August 13th. This will make for a relaxing non-rushed event. This also will allow Jenie Bee to do more of the wedding planning (seriously would you want Rex planning your wedding?) I have to say that when Jenie Bee called I was fearing the worst, she works from 8:00 PM to 5:30 AM and her request for the night off was denied so after work she had to rush to the Embassy (it's 30 mins to an hour from her work). When she called her voice sounded so tired, yep worst case scenario for sure, then came the giggling probably due to I had just fallen hard into a surprise trap!! :bonk: The interview sounded odd, no smiling, no joking, and the lions share of the questions revolved around my previous marriage, dates, kids, etc.. Oh well, visa approved, flight secured, all is good. :dance: Next week I will get serious about working on AOS...

Thank you. We have been playing "lets pretend we are at the interview" for a while, and I think that has been very helpful, we stumbled across a couple things Jenie was confused about. I have actually been having some trouble sleeping but I know that is probably just normal stuff for this journey. I have taken a couple of vacation days lined up with the 4th of July holiday to go camping with my kids and some close friends. Just going to kick back, do some outdoor cooking, shooting, wilderness exploring etc.. What an odd feeling of helplessness this is... :blink:

I think that it is important to have a contingency plan for the visa application being denied. It would be pure horror but face it, you may have done everything just right, but the CO at the interview just happens to be having a bad day. The next thing you know, WHAM! Your Fiance(e) walks out of the embassy with a yellow sheet of paper, DENIED, case closed! What will you do? Hire a lawyer, call your congressman? Kick the cat (dog in Mari's case)? It can happen, I have a friend this happened to, not something I read online, I know the guy. The good news is that was 3 years ago and they are together and happy now. Sorry to be pessimistic but never forget we are dealing with the government, so have a "plan B" is what I am saying. The K-1 visa is just one battle in the war, approved or denied there will be another battle but in the end we will win the war. So what is your "plan B?"

Knowing USCIS they may cancel your I-130 and you will be waiting another 5 to 6 months for the I-129F, I wouldn't do it..  Just stay with the I-130.  Darnell had a good idea, that may help? I am not a lawyer nor am I an expert. Sounds like your lawyer isn't either...

I'm a Dec. filer at the Calif Service Cnter. I know it's unfair, but I'm so happy for those Feb. filers who already received their NOA2. I was wondering how USCIS process our petition, do they go alphabetically? Also, I'm pretty sure I make the poverty income requirement, however I have F*&7 up credit, I was wondering if this is going to be an issue? Thanks ALL, Godbless!

I don't think that credit is an issue, from my understanding you either earn the 125% of poverty AND can prove that with tax returns, pay stubs and letter from employer, or you don't. If you don't I understand the Manila Embassy does not like co-sponsor, so you would have to have other assets to bring you above the $125 % of poverty.

How is my answer on this guys?? Anyone else? Just have not heard the credit issue before at all..

We submitted our I-129F and got the NOA 1 in Dec, 2010 and we do not have a reply. I am curious why some people are getting their NOA2 from filing in Jan/Feb 2011???? WTH??? And they have beneficiaries in third world countries. Can anyone explain this to me? I was told they process them in the order they are received. We even tried an expedite and was denied so now we get to lose out on $30,000 because they decided not to grant it. I am very disheartened by this whole process.

Just use her address in the Philippines, in 5 months when this is all being adjudicated, she will be in the Philippines so no worries. Unless she is going back to the Middle East?

There are so many factors to consider about falling in love, each case is different for sure. I met my fiancee online in March 2010, then spent a week with her in September in person. That was all that was required in our case, we were each looking and kind of knew what we were looking for and found that in each other. We have NOA # 2 now and hope she can be here in July..

Don't bother trying to schedule online, it usually doesn't work. Save yourself from wasting a bunch of time and just call to schedule the interview. I went through this last week. Good luck!!

I am 51 and she is 31. I realize this is a 20 year spread, but she is no teenager. I would think that it may be more of an issue if she were younger, say 18-25 and I was 38-45. We are almost 60 days into our wait after NOA1.

What do you VJ'es think? Will this be an issue?

Regarding the medical in Manila, anybody have any trouble booking a room and paying for it in advance by using a credit card from the USA so your Fiance can just show her I.D. and they will give her the room ? I know this can cause some troubles. Do you have any experiences in this ? Which hotel ? What procedures ?

Does she have to have a copy of my credit card with her ? Did you use Agoda.com or call directly. Help me ?

I had to go round and round with Marriot Manila to get approval for her to arrive before I do with just her I.D.

I used agoda, just make sure that your Fiancee has the voucher they will email you..

I tried all of this last night and my case number was not valid so I called and I had to hold for 25 minutes (the USA number) but I was able to schedule my Fiancee's interview for July 6th, that was the earliest date as of last night. I wanted the interview in June, no slots available. I had no luck scheduling online. Calling was easy..

HI GUYS,

We've been denied last March 04'2011 due to AWA. Now, me and my fiancee decided to be friends. Were still in contact with each other though. We sent them an appeal last March 21... I don't know if i still hope for NOA2. It's just maybe good that we decided to change our status to move on our life. My life and his has been pending due to the waiting process. I Love him to death, and that denial keeps him so depress. I hate to see him cry day by day...

I just hope that all those AWA filers, will not go through the same process that we have. I hope for your happiness guys...

To My Fellow VJers,

I just need to get this off my head so I'm asking for your thoughts and opinions regarding this matter.

Here's our scenario in a nutshell:

2002 - 2006 - We met in the university, in Manila. We became a couple. Graduated in 2006.
2007 - 2010 - We tried to do business in Manila but return of investment is very slow and we are getting older hence the dream of settling down.
June 2010 - He went back to NY (he is a USC and his family is based there, he just went to Manila to study college) to find a job so we can settle there for good. He
wasnt able to find a job right away until after 7 months.
Feb 2011 - He got employed, a full time job where he earns above the 125% poverty line. He got another job, a part time job in his dad's business.
So basically, he has two jobs that earns above the 125% poverty line for a household of 2.

My concern is this: We don't have ITR papers to show the consulate as he just started working. My interview at the consulate will be approximately around August 2011 so by that time we can only show letter of employment and pay stubs, and some money in the bank. I've read some refusals due to lack of financial documentary requirements. I'm extremely bothered by this. Please shed me some light.

I am pretty sure you are ok. You will be able to document at least two "quarters" of petitioner earning more than the 125% poverty level. Be sure to have a letter from both employers even if one is his dad.. Good luck!!

US Embassy and Consulate Discussion!!**UPDATE**!!

Ok, some of you may know that my fiancée had her interview on April 13 and was told that she was approved. Well, we waited and waited and never got notice from 2GO that her visa was being delivered. Based on other timelines we were expecting that she would have her visa by April 18th (she was staying in Manila) and be able to fly here on the 19th. How wrong we were. On April 18th I called the embassy to see if here visa had been printed. I was told that while all of her documentation was in order and her interview went well and she had in fact passed her interview, the consular officer had not yet signed off on her visa printing and was holding her visa for a reason that they were not allowed to tell me over the phone. They told me to just wait and her visa would be printed soon. Ok, so I am pissed off but I will wait a little longer. I call back on the 20th and check again. Still nothing and no movement and there is no telling when my fiancée's visa will be approved for printing. I think the CO is asleep at the wheel. Since it is the Holy Week and the embassy is closed on Thursday and Friday I decide that the only way for me to proceed is to go the the Philippines and confront them my self. I booked a flight out of Phoenix on Friday night and arrived in Manila on Sunday morning. Monday, April 25th, we went to the Embassy and again inquired about her visa. It still has not been printed and we were again told that everything was in order and there was no reason for the hold up. I asked if there was anything I could do, talk to her superior, talk to the CO, etc. She told me that I could write a letter to the CO requesting an expedite. I am thinking, ask for an expedite! It has already been 2 weeks since her interview approval. What needs to be expedited? So I write my letter basically begging the CO to send her visa for printing since I am leaving the Philippines on April 30 and want my fiancée to be on the flight with me. We leave hopeful and upset. Nothing on Tuesday on the 2GO website so Wednesday we go back to the Embassy to inquire again. They are closed. The IV unit is having training that day so there is no one there. Still nothing on the 2GO website on Wednesday. We go back to the Embassy on Thursday and viola, they tell us that her visa is out for delivery. Now if you were told that your visa was out for delivery you would think that means that the courier has it. Well, not if that is what the Embassy tells you. It means that the Embassy is getting everything together to eventually give to the courier. So we wait some more. Remember that my flight leaves on Saturday and it is Thursday. The courier does not have her visa yet. She does not have her CFO sticker yet. I do not have a plane ticket for her yet. Friday morning at about 8:30 I check the 2GO website and it says that they have her visa in the manifest. We call them and ask about delivery time. They tell us that the requested delivery location is not allowed (Robinson Mall, even though it is selectable when you setup your interview) and we have to have delivery to another location in Manila. Also it won't be delivered until Saturday. All hope is lost at this point. But then my fiancée asks if we can come down to the main office and collect her visa. They tell us that we can pick it up after 5pm. Ok, now we are onto something, but there is still the issue with the CFO stamp. The CFO office will be closed by the time we get the visa. I remember that Tahoma mentioned that there was a CFO office at NAIA so we called there and the gentleman said that he was not sure if we could get the stamp at NAIA until he looked at her documents. After collecting the visa and making sure that all the information on it was correct, we went to NAIA and attempted to find the CFO office. Everyone that we talked to pointed us in a different direction. Upstairs, downstairs, over here and there. After about an hour we finally got to the right person (CFO is inside the secure area so he had to come out to us). He looked at her docs and had her fill out the form. All of a sudden we realize that we don't have a passport photo for the CFO registration form. He tells us that it is not necessary. He takes her passport and goes away then returns with the sticker and stamp inside. Wonderful. Almost there now. We just need a ticket on the same flight was me. I ask the information desk where I can purchase a ticket for my airline and he send me over there. Nope not over there. So we ask someone else and they send us over here. Still not the right place. Another security person tells us to go to the 4th floor and it is there. So to the 4th flooor we go even though that seems a little odd to me. Well it is not there either. That is the airline flight operations. The man there is nice and tells us that you can not buy a ticket at the airport. I am shocked. You can not buy a plane ticket at the airport? How ridiculous!!! He give us the number to call for reservations. When we get back to the hotel. I call and the reservation desk is closed from 6:30pm till 9:00pm. I wait and call back at 9:15 and finally after all that has happened get a reservation on my flights with a seat next to me for my fiancée. Just need to print the confirmation at the hotel and it is done. She tells me to be sure that we are at the the airport 3 hours before the flight departure time. I am thinking, 3 hours. That is pretty early, but it is needed. Any less and we might have missed the flight.

We arrived POE Honolulu on 30 April 2011. It took about 45 minutes to clear immigration and customs. There were no problems at all. Very smooth. Arrived in Phoenix, Arizona at just after midnight on May 1, 2011.

Thanks to all that helped during this portion of our process. Now onto Marriage, AOS, AP, and EAD. The journey continues. Just hope it gets a little smoother from here.

It appears for the past several months a HUGE amount of I-751's are being rejected as "the supporting evidence does not sufficiently establish that you and your spouse entered the marriage in good faith and continue to share a good life together".

 

I (Larry and Ella) submitted the deed (fully paid for) for our house in our names, sent  the 2011 and 2012 12 tax forms, a joint check account for several months, two affidavits (notarized) Joint health insurance cards, joint auto club cards, deed in both names, insurance policy showing beneficiary credit card statements, etc, and a USB of pictures.  My wife has over a thousand pictures with date and GPS coordinates in some cases,

 

USCIS stated: The evidence does not establish, in sufficient detail, JOINT OWNERSHIP of assets, Joint responsibility for liabilities, and/or an active co-mingling of finances "FOR THE DURATION" of the marriage.  Supporting documentation must cover as much of the marital period as possible, and must also indicate joint financial responsibility and joint residency for that same period.

 

Larry: The key words appears to be for the joint and for the duration of the marriage.

 

So leases have to be rewritten?  Cars that are already owned and paid for and you get a discount for being the original owner need to be re-titled, phone service, cable service, electric statements, and if you have any loans, must be in both names?

 

Well, holy #######.

 

I had to send the entire bank statements for every month showing deposits or withdrawals on every account we had.  Gee USCIS, do you really need to know I like turkey sandwiches at the grocery store?

 

What is so bad is that we both are almost joined at the hip we are so close to each other after 3 & 1/2 years of marriage and cannot possibly think of a time when we would wish to change that.  She  has her own car (hybrid paid for).  We even have electric mopeds that we ride around.  Her facebook page gets updates several times a week with new pictures.  She really like pictures of herself or us, hehehe. 

 

Anyway, If Visa Journey would like, I can scan my letter from USCIS.  I did return USCIS asked for several months ago and still no word.

Wow, you guys have more evidence than most, it's troubling for sure. The USCIS officer whom adjudicated your case must have spilled her Starbucks on the way to work that morning and no evidence you can supply will fix that.

Congratulations on your quick approval! I found out today that my biometrics are waived, but told that it can be up to 7 months to be approved. Keeping my fingers crossed that I do not received a RFE this time :)

Hi Lise, looks like Uncle Sam needs to return your biometrics fee, yea probably not.

 

I will encourage Jenie to go through the the naturalization process so she can sponsor a family member to come here, it takes 10 years for that so the sooner she gets started the better..

We didn't do the affidavits, as I understand it is just one of the evidence possibilities and to be honest, it doesn't sound like good evidence to me.

 

Our check was cashed on the 19th, I am hoping to get NOA #1 today or tomorrow.. dancin5hr.gif

Hi guys, I have a real question not about some tv show this time: We are getting ready to file our ROC and I suspect that we are not going to have the new green card by the time the old one expires. My question is will Jenie be able to work in the time between the old card expiration date and the arrival of the new card? Oh and happy valentines day in advance friends!!

Ok, I have to ask, has anyone watched "90 Day Fiancee" on TLC?  If so what are your thoughts?  I enjoy watching the show, we have seen episode 1, 2 and 3. Somethings I don't like is it seems they selected the couples to ensure drama. The other thing is they place a lot of emphasis on the "90 days" like they are making it feel like you meet and have to get married within 90 days. I would guess the average K-1 visa recipients have known each other close to 2 years from the time they meet until the time they are married? The other thing the show has done is really resurrected the term "Mail order Bride."  I use to find this term funny, but twice now someone has suggested that I have a mail order bride and I now find it offensive, believe me, they get an education when I hear that.

 

Despite my gripes, I have to admit that I am enjoying watching it, Jenie likes it as well.

PhilippinesMY UNFORGETTABLE INTERVIEW EXPERIENCES

To all Vj members,

I apologize to all of you my vj friends for the LATE posting/sharing my interview here. I hope you understand me guys :innocent: but i know you all understand :lol:





As I’m done with my interview last Dec 15, 2010, I want to share my unforgettable experiences.

4:00am arrived at USEMBASSY manila

5:30am the guard informed us (all immigrants that scheduled 6:30am) to get inside

the guard took my 1st appointment letter (emailed by NVC) together with my new appointment sched which I did online

Then I waited 15 mins to get inside..we lined up inside the immigrant section. The lady asked me if I have ds230 printed then I said yes then she took it and give me my number. (6016) unforgettable # hehehe

As my number appeared on flashboard I go to window 22…

Pre-screener (she is Filipina) she is so nice. I felt comfortable talking to her. She asked me the following:

  • Who is your petitioner?
  • How old are you?
  • What is the name of your petitioner?
  • How old is He?
  • Is this your first to be married? How about Him?
  • Do you have any kids? How about Him?
  • Do you have any photos together?
  • Do you have a copy of your Certificate of marriage?
She is so nice. She said her good luck for my final interview.



I waited 10 mins for my name to be called to fall in line in finger scanning in window 15. The lady asked me to state my fullname and my date of birth. After that the lady that assisting us (doing the finger scanning) told me to go to waiting area for final interview.



After 15 mins my number flash on to window 44. She is American, I think her age is 26-30 yo. She let me raise my right hand and swore that all i will be stating is true. There are the questions that she asked me:



  • Who is you Petitioner? His name? His age?
  • What is your name? Your age?
  • When did you get married
  • Are you living alone? (in this question she asked me took me for another interview) which took me almost 4 hours (coz there are some questions concerning my nephews.
She told me to wait outside for my name to be called. I was so worried coz I’m expecting the magic coming from her “visa approved” I didn’t heard those words. But I thank her instead.

My name was called at window 33 (If im not mistaken) the guy told me that I need to have another follow-up interview. So i went to the office that the guy instructed me to go. There are lots of offices inside in the corridor I saw the lady approached me asking my name. And she let me go inside her office..she gave me 2 pages of questionnaires (back to back) all my hubby’s infos and mine too. It focuses on my information about me, my parents, my sisters, brothers, nephews etc.

The lady forwarded me to a guy in the next door. He asked some questions about my nephews which I answered and defended. At around 2:30 he forwarded to American Consul (guy) for interview. He let me swore that the statements that I made is true and correct. Then he told okey “tapos na tayo” (We’re done). Then the guy that facilitated me took me to exit door. While we’re on the corridor I asked him if hows my interview and he told me its okey I’m sure you’ll do fine and I think your visa will approve soon just wait for the a call from embassy to informed you. I was not happy enough I left the embassy not sure of the status of my visa. Finally my day is done at 3:30pm. As I went home I told to my husband about what happen in the whole day of my interview day. The following Monday, Dec 20, 2010. My husband called up usembassy manila to know the status of my visa. As I saw him (in webcam) smiling while talking to live operator. Then after he put down the phone, he said its approved! Thanks God!!! The operator told him that my visa is just printed as of today, December 20, 2010 and need to wait for 7 to 10 days to be delivered. Yehey!!!! :dance::dance::dance::dance::dance:We’re finally done with our visa journey. :dance::dance::dance:
