I called the NVC and spoke to a supervisor who sounded like a robot and basically repeated the same thing "your i-129f has been closed because your i-130 has been approved for further action" to every question I asked her. I explained to her everything from all different angles and she really didn't sound like she cared at all. She told me my only option was to call another Embassy and ask them to take the case.

For the last time, Mauritius DOES issue K visas. I have called the Embassy spoke with the consulate, emailed her, etc. No they do NOT handle IR/CR visas but they do K visas because technically they are non-immigrant visas.

Anyways. I've been talking to some people that have gone to Nairobi and a friend of mine who lives in Kenya...trying to get a feel of how it is. Basically it's just use common sense and at this time they aren't taking people out of cars and killing them lol...

Actually, I called the embassy here in MRU & they do K-3 visas. I called them back in May of '11 when I started organizing my papers...I also spoke to them last week.
He could have gotten a K-3 here in MRU. I've verified that several times. No they don't do immigrant visas, but they do k-3s.

I just meant that I may have been able to save time if I had known he'd have to go to Kenya from the start.

I would call and email people and explain your reasoning and see if they can continue the K3

It may be futile at this point but it is worth a shot

I never heard of anyone trying this so I wish you luck and keep us posted if it works!

Unfortunately there is nothing much you can do. It's been awhile since K-3 is getting administratively closed and the CR-1/IR-1 replacing it. I am not sure if really have to go to Kenya, may be they can transfer it to some other consulate closer to Mauritius. Try to find which closest consulate process spousal visa and ask them to transfer there.

Hi all,

We got out NOA2 for our i-129f & i-130 on March 6 (after 187 days) and last night I got an email from NVC with " acl for neopost ds-1200" as the subject for one, and
PAOSF I-130 FOR NEOPOST DS-1200 as the subject for the other. I've not gotten anything for the i-129f and so I'm guessing my fears are confirmed and they have closed our K-3 case and now we are IR-1? I say this because the instructions I got sent were to send my AOS and pay the $88 fee and I was like, wait what? Posted Image

Before telling me "K-3 is so ancient and takes for ever! why did you do that!" the reason is because I am currently staying in Mauritius with my husband and our son, because we all want to be together for our son...and for the IR-1 he has to go to KENYA Posted Image because they don't do IR-1s in Mauritius. So we picked K-3 because it seemed "safer" (as in NOT going to Kenya) I'm not sure what I should do at this point? Do I call the NVC and explain to them? (I imagine that would make little difference) Do we just suck it up and go to Kenya? I'm confused and a bit angry, because HAD I KNOWN this is what it would have come to I would have just done DCF 8 months ago and be stateside already Posted Image

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864 and I-864a are different tax years...
I've filed for my husband and I used my father as a joint-sponsor. He filed an initial I-864 for 2010 tax year and my step-mother filed an I-864a for 2010 as well.

My stepmother's papers were fine, but I got an RFE (twice! haha) for my dad because he's self-employed and that kind of confused him on lines 23/24. We call the NVC and they said that my husband can bring in the corrected I-864 with the correct income amount to the interview.

During this time my dad/step-mom filed their 2011 taxes. So my dad's I-864 has the 2011 tax info and my step-mom's I-864a has 2010.

Is this a problem?

Between my I-864 an just my dad we meet the 125% guideline. The RFE never mentioned anything for my step-mom. But my concern is that it's 2 different tax years.

Also on the I-864 we have the bring to the interview should i check the box about the above family member having filled out the I-864a or leave it blank ( this question seems obvious however...I'd like to double check)

Should i put a note on the I-864 mentioning that my step-mom has already filed the I-864a and check the box?

Worst case scenario is that I need to have my dad overnight some information to Nairobi and hope that it arrives while my husband is there.

K-1 Fiance(e) Visa Process & ProceduresPetitioner residing abroad

FYI - we had a very similar situation. I was living in England with my fiance for 3 years before we filed. What I did was wrote our UK address on the I-129F and listed everything in that address; however, I attached a supplement form to the I-129F stating that I wished to use my parents address in the US for correspondence, due to the fact that I would be shortly leaving the UK to take up new employment in the US.

As you can see from our timeline, everything worked fine, encountered no problems, no RFEs, no questions, etc.


What about for the G325a? For Last 5 years did you list your UK address? or did you only list that in address abroad?

Sorry...I'm in the same spot I have a permanent US address but live in Mauritius with my husband and son.

These address questions drive me crazy !!
