Ok i filed my I751 for me and my 9 year old son. Paid biometric fees for the both of us. I got a letter for me stating that the paperwork was received and one for him. Now I got an appointment letter for my biometrics. But not yet for my son. Does he not have to take it again. or can it come in later. I tried calling. Only got some stupid computer telling me my status and that customer service wouldn't be able to tell me more. Where am I suposed to find out then if he needs to go too. I don't feel like flying Honolulu twice. it is not cheap and we don't have really an option of driving to the office. kind of a long swim ;-)

Hi,

I am also in the process of getting my PCC from Bangalore and after numerous trips to the local police station, they have just sent the document to the Commissioner's office for uploading so that the PSK can then issue the PCC to me.

I have two questions -

1. Why are there two types of PCC. Will it suffice if I just get the PCC from the PSK?

2. In the G-325A form we mentioned that we also lived in another part of India for 6 months. Do we need to go to the Commsioner's office there also to get another PCC? The problem is that we do not have any proof of address from this other place...we were just staying with friends and do not have any official papers to show that we were residing there....what to do in this case?

Thank you for the awesome post. I am also in the process of getting my PCC from Bangalore and after numerous trips to the local police station, they have just sent the document to the Commissioner's office for uploading so that the PSK can then issue the PCC to me.

I have two questions -

1. Why are there two types of PCC. Will it suffice if I just get the PCC from the PSK?

A lot of posts suggest that NVC Sign in fail means that the case is complete from the NVC side. Although this is true, please note that the only way you will know when your case is completed by NVC is when you call them....I have already got my interview letter, but I can still successfully sign into the NVC page.

Just wondering what I need. I sent original copies of police clearance and proof of birth with packet 3, can we get those back at the interview?

 

I purchased seven originals of everything I got in Philippines.  We each had an additional original with us at her interview.  As I always say, 'YOU CAN NEVER HAVE TOO MANY ORIGINALS"  I mean in Philippines the documents are reasonably inexpensive but the peace of mind is well worth it.

Not sure about Canberra but in Philippines my wife had to take three passport sized photos, all the same of course and taken recently.  I am pretty sure that is what they are asking for.

 

By the way.  My wife had her passport photo taken and had 8 copies done just before we applied for CR-1 visa.  Everyone on the planet seemed to want a photo so we ended up using I think all but 1 or 2.  So the point is when you take the photo make sure it complies with all the rules for a VISA.  And IMHO you can never have too many photos.

Just a quick question about the photos for the medical in Australia. The Canberra embassy site says to take "3 recent photographs". Does this mean take 3 different photographs non-passport style, or to take 3 copies of the same photograph that is passport style (size, only head in frame etc.)?

K-3 Spousal Visa Case Filing and Progress Reports4 months pregnant out of the U.S and waiting for my K-3 or I-130 to be approved!

The 1-130 is still pending, and then I filed for the K3 visa. (Which as I reading was silly as they appear to be obsolete). My husband is still in the U.S and I am in Australia. I would like to be with him to have the baby, in our house. If possible. So want to get back there asap. It's fun being pregnant at home, but it is our first child and he is missing out on it all.

They are not and it's just an utter BS.

This only means they still have I-130s pending that were filed in Oct 2012.

We've been seeing approvals from Jan, Feb, March, April and even May lately.

 

There is another workload shift going on (just announced, posted above) so let's hope it will help. Also, files transferred to local field offices are expected to be adjudicated by the end of Oct. (as per recent AILA/USICS conference).

 

I would have to agree with this.  My spouse and I filed in November 2012 and she came to the USA in July of this year...so whoever is suggesting that they are just getting to October is full of c*@p.

I dont think processing times are updated so maybe they just read whatever info they could see in their screens and tell us just for the sake of having an answer to our inquiries.. It stated there that i-130 (for spouse of USC) - oct 22, 2012 (it's from VSC though, like i said its not updated since uscis doesnt even have i-130 processing time listed under NBS yet.

Hey, I just spoke to the NBC where they are handling my I130 and they told me that at the moment, they are working on October 2012. I sent my I130 on February 2013. That?s a lot of time, toooo much time. We basically have about 4 or 5 months before they get to my papers. THAT?S CRAZYYY. Should I cry or should I laugh?

I think they are lying to you, fortunately.  We filed November 15, 2012 and our CR1 was complete with visa in hand on July 20, 2013.  The entire process took 8 months.  So I think we just have to assume they are lying to you.  We will be praying for you.

Hello everyone I am curious if anyone knows what has happened in Nebraska? On Friday I checked to see what the USC time period for the I130 was and on both the drop down menu on the USCIS page and my account page listed Nebraska and the wait time being 11 months. Today I checked both my account status page and the USCIS page for the time length and Nebraska is now missing from the drop down menu. Also on the USCIS website it doesn't list the I130 as something they do on Friday it did. Only Vermont, NBC, and California is listed for the I130's. I am so confused any one else see this???

USCIS Service CentersAre VJ K-1 Guidelines Complete?

 

I'm working on getting my I-129F package together and I've been using the Visa Journey Step-by-Step page as my guide.  (http://www.visajourn...content/k1guide).
 
I just want to make sure that guide is complete.  I noticed it didn't say anything about the I-134 form.  Is that not necessary to fill out and submit at this point?  I'm assuming that means it's something my fiance would take with her to her interview.
 
Also, I'm going to have to have a co-sponsor for this but noticed on the US Embassy website (for Pakistan - http://islamabad.use...y.gov/i864.html), it says an I-864 (co-sponsor) is not required when applying for a fiance visa because it's not an immigrant visa.  It said it will only be required when my fiance applies for her adjustment of status.  But if she submits an I-134 at her interview and it shows I don't make enough money to support her - wouldn't they deny her the fiance visa at that point?

Mary her in the Philippines and apply for a K-3 Visa. Don't know if this would work, but it's an idea.

 

I would recommend a CR-1 VISA.  But without the other visa application/s being withdrawn I don't think marriage will help.

I have seen a few articles on AP, and they are pretty informative - thanks. HOWEVER, I have yet to find a situation like mine (although I hear it is quite common??). My Fiance and I have been together for almost 3 years. She had a previous relationship about 4 years ago with a guy who she was engaged with and filed a K1 visa petition. They never went beyond filing it and getting an initial approval (NOA1) and no interview or travel to US. They broke up because of his cheating and treatment towards her before the process was completed. Matter of fact they only met once in person. They haven't had contact since - at all. She cannot even remember his middle name, exact age, or where he is now - no contact whatsoever. I know...weird...but it is what it is and it was a while ago.

 

Meanwhile, we have completed the whole process for the K1 (USCIS, NVC, and this morning failed the Embassy Interview). Every form that we filled out, we put all of the correct info. Every spot that asked about previous rela's we put his name and that they filed before together (again, this relationship was almost 4 years ago...2010ish). They denied her this morning and gave her a 221g form for Admin Processing.

 

We have PLENTY of proof for our rela the past 3 yrs (she brought about 15lbs of paperwork with her this morning to the Embassy), and I have visited her multiple times in the Philippines, most recently Jan 2013. I will also be going there in December (few weeks) to visit. We had our plane tickets to the US already on the 14th of Dec, with plans to get married in Vegas already booked for 21 Dec. Not to mention both our families had plans already to be a part of that celebration...wasted now.

 

I don't see why an approved I-129f is valid for only 4 months, yet an incompleted and outdated K1 petition is still valid and causing issues for almost 4 years now?! From what I understand I need to file a request for waiver or something?? I plan on calling the USCIS tonight, as well as DoS. If I'm not satisfied, I will be calling a lawyer but they charge $300 for a phone consultation - so that's my last ditch effort. I will not sit and wait for this Admin thing to take it's course. I want to know what I can do to make this happen. Any help or advice will be GREATLY appreciated!!!

You're wrong.  Read what she posted again:

 

I was interviewed 21st of October this year. It's almost 8 weeks of waiting and my case is under administrative processing. The status updated date online changed 3 times, first Nov.18, second Dec.5 and lastly is Dec.9, 2013. I don't know why the date is changing but the status is not. During my interview, I have this friend, a woman who happened to be interviewed after me. My interview went well (5-10 minutes only) and the consular officer told me that everything's ok and he has no further questions for me. He also instructed me to wait for my name to be called at the last window, so I was very excited and confident to hear my name. As I said earlier, my friend was interviewed after me. It took her a while and when she came to me, her face was so pale, shocked and crying so I asked her what happened. She told me that the consular officer informed her that her fiance has charge/s so I asked her, she said that she can't remember all the details because she was very shocked.After that, I comforted her. When my name was called at the third to the last window, the woman incharged there asked me, if the consular officer already informed me that my fiance has charges, so I said "NO MA'AM, THE CONSULAR OFFICER DID NOT MENTION THAT ONE TO ME". I believe that there was a big mistake here. My friend confessed to me that she observed some scenarios that will really prove that the charges that the consular officer was talking that time to her is true. That's her fiance, not mine. My fiance is a pastor for 10years and he loves God so much. I know my fiance and he has a Christ-like character. What do you think will happen to our papers? Is this a bad sign that we will wait for so long? I'm praying that the embassy will not finalize something without conducting further investigation about this matter. Please pray for us.

 

It sounds like she had been approved by the CO then told to wait for her name to be called for the next window. A final check is done by a second person and then you are told to go to yet another window.  Based on what she says it sounds to me like the files were somehow exchanged because both were interviewed by the same CO and it is possible that the next person at the next window got them out of order.  Lets hope that is the case. 


They wouldn't say that you're fiance has a criminal charges unless he did.

 

A CO could easily mix up two files/interviews.

What do you mean by charges? A criminal record? Without telling us exactly what the "charge" is we can't give any advice. I'm not really sure what your friends cars has to do with you. Did you ask what the supposed charges were(still not clear what you even mean by charge unless you mean criminal record)? Just because someone is a man of God doesn't mean in their past they didn't have run in with the law. If it involves anything with the Adam Walsh act it changes the whole ball game.

 

 

Most likely the embassy is doing additional background checks on your petitioner.  There's nothing you can do to speed things up.  Just be more patient, okay?

You people really need to read her entire post.  She clearly states that her friend that was interviewed after her was told that HER husband has charges against him, not the ops fiance. 

And charges usually mean that the case has not yet been adjudicated in court.  Pending charges usually means a court case has not yet commenced.  A person could be arrested and "charges" could hang around for years before any court case or they could simply expire by statute.

 

In all fairness to poster it would be nice if everyone would try to read complete posts so they better know how to respond.


Someone else's case has nothing to do with yours. If their case involves crimes of sexual nature against a child their visa won't be approved. Don't worry about them. Many people get AP, including my husband. Just sit tight, and if they request any further documents or evidence, just simply provide it.

 

You don't get this?  She is saying that perhaps the two files were mixed up after the two interviews.

I took the comment as meaning that after a lengthy overstay you will forever face extra scrutiny when applying for a visa.
And unless you can prove absolute concrete ties to your home country then forever may not be too far from the truth, hence the bit about keeping hold of paperwork to prove ties.
I wouldn't say that was trying to scare anyone, merely being realistic with a slight hint of pessimism.

 

I agree with you 100%.  I understood what you meant.  (Another poster that told you to get your facts straight tends to be kind of judgemental, IMHO)  You can see that you were understood by most here based on the number of thumbs-up you have already gotten compared to zero on the other poster.  Keep up the good work!

My baby is a USC but a father is not the same as a mother my baby was born sick not Emergancy ill just ill and wat I tried to do is to For my baby to get medical aattention.she is not having her benefits as a US child and for that Sir I need my wife here to take care of her while I work im a Diesel Mechanic I have two households I have to pay gas and light and water bill I have to send for $$ for my baby medication for her therapies I and thats y I want to expedite my wwifes waiver ..

 

In My Humble Opinion:

 

This is not intended to upset you or offend you in any way.

 

Your baby is a USC.  Baby was born ill "not emergency" condition.  You will not get the expedite for your wife.  You have the option of picking up the baby.  The US is going to say that you can pick up your baby.  (I am sure the treatments there are way cheaper than in the US.)  They are not going to expedite your wife to be a baby sitter for the baby in the US. (That is what the US government will say, not me.)  Sorry but that is what I believe...I hope I am wrong...

It's possible to live with friends or relatives (namely the joint sponsors, but not necessarily) until they get on their feet. I would rather do that than spend another year apart.
 

 

Yeah, that's a great idea.  Uproot a Filipina from her home and everything she knows and have her move in with a fiance that is not earning above the poverty level.  That will be one heck of a honeymoon with mom and dad or other relatives on the other side of the bedroom walls.  Great idea!  Seems like a terrific start to a marriage made in heaven.

Pardon - I thought you wanted to stop the process? Best way to have done that would have been to withdraw the visa application during the interview.

 

as to your questions - you give them exactly what they ask for.

 

You might get some 'slack' from the IV Unit showing his 2013 tax data.  Maybe.

hi! i receive 221g today..... two of the requirement were 2012 tax returns and w2....
here's my question: My fiance didn't earn that much in 2012, so his tax return is below poverty level. Do you think his incoming 2013 tax return which he actually made it above poverty level will help us? or im i still in trouble with 2012 tax returns

 

I just have to ask you one question. 

 

Do you think it a wise decision to move to the US to live with someone who earns below the poverty level? 

 

(It looks like you are coming on a K-1 VISA.  That means you will not be allowed to work until you have gotten married, and received work authorization.  It could take 3-6 months or more after you arrive.)
